WHEREAS, Tom Ricks, requested a vacation to the final plat of Bellemeade Subdivision to vacate five feet (5') of the ten foot (10') side yard public utilities, Bellemeade Subdivision Homeowners' Association pressure irrigation, and lot drainaae easements, located sYithin Lots 12 and 24, .lock 1 (Bell emeade Subdivision) (Emhibi! "A");, and WHEREAS, On August 21, 2023, the Commission recommended approval of the vacation (VAC-02-2 ; ), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on August 21, 2023, and September 1, 2023; aiid W1-1FR_FA.S, On September 12, 2023, the City Council held a public hearing on the proposed vacation (VAC 02-23), and voted to approve the vacation; and WHEREAS, The provisions of Section p_ 1 City Council hereby finds that the proposed vacation complies with the 06A of the Idaho Code, "'Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE EAGLE, IDAHO.
