Ordinance - 2023 - 914 - Amending Ecc Title 1, Chapter 5, Sections 4 & 5 - 12/12/2023 ORDINANCE NO. 914
AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO AMENDING EAGLE
CITY CODE TITLE 1, CHAPTER 5, SECTIONS 4 AND 5; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under
the laws of the State of Idaho; and
WHEREAS, the Mayor and Council have determined that good cause exists amend Title 1
"Administration", Chapter 5 "Mayor and City Council", Section 4 "Mayor"; and
WHEREAS, the Mayor and Council have determined that good cause exists amend Title 1
"Administration", Chapter 5 "Mayor and City Council", Section 5 "Duties of Council Members";
and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGLE, Ada County, Idaho;
Section 1: That Title 1-5-4: MAYOR be and is hereby added, in part, with the underlined text
added and the strikethrough text deleted to read as follows:
2. Chief Administrator: The Mayor shall be the chief administrative official of the City, preside
over the meetings of the City Council, work collaboratively with the City Council President, or
Pro Tern to set the City Council meeting agenda and determine the order of business subject to
such rules as the council may prescribe,have a vote only when the council is equally divided,have
the superintending control of all of the officers and affairs of the city,preserve order,and take care
that the ordinances of the city, and the provisions of the Idaho state law governing municipal
corporations are complied with.
Section 2: That Title 1-5-5 DUTIES OF COUNCIL MEMBERS be and is hereby added, in part,
with the underlined text added and the strikethrough text deleted to read as follows:
1. The City Council President. or Pro Tern in their absence, shall review and approve all
City Council meeting agendas in collaboration with the Mayor.
2. The members of the city council, the legislative and policy making branch of the
government of the city, shall devote so much of their time to the duties of their office as
an efficient and faithful discharge thereof may require.They shall attend all meetings of
the council unless lawfully excused therefrom, and perform all duties by the nature of
their office they should reasonably perform such as the passing of ordinances,
resolutions and the overseeing of improvements and work done for the city according
to the character of committees upon which they may severally be appointed.
Section 3: All prior ordinances or parts thereof, to the extent inconsistent herewith, are hereby
repealed and shall, to the extent of such inconsistency, have no further force or effect.
Section 4: This Ordinance shall be published once in the official newspaper of the City, and shall
take effect immediately upon its passage, approval, and publication.
Adopted by the Eagle City Council, Eagle, Idaho, on this 1I• day of December, 2023.
