MEETING MINUTES
November 14,2023
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. A quorum is
present.
3. PLEDGE OF ALLEGIANCE:
4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA:
Baun states that Mr. Fruhlinger is unable to attend due to an emergency, and asks that his
presentation be placed on the next agenda.
5. PRESENTATION:
A. Jake Fruhlinger,from the Idaho National Guard,will be Presenting on the Guard's
Integrated Readiness Training(IRT) program.
6. REPORTS:
A. Mayor and Council: Gindlesperger provides an update on the Arts Advisory Committee
meeting on November 6t. Several great ideas were presented, one being a youth call to
artist for Arbor Day was approved. Other items discussed were a postcards, exploring
adding more classes at the senior center as well as bringing back the quilt show at Country
Christmas.A Valentine's card project was also discussed. Gindlesperger briefly provides
an overview of the reorganization of the arts commission into the current format and how
it is thriving under the new organization. Pike attended the Urban Renewal Agency and
Eagle Sewer District. The Urban Renewal Agency discussed strategic planning and
projects, as well as the economic benefits of the same. The Sewer District had a cyber
security analysis their system and while mostly satisfactory,there were a few deficiencies
that they will be addressing. Baun met with the Ada County Soil and Conservation District
and reviewed the natural features analysis and mitigation requirements that are outlined in
Eagle Code as well as the newly established Conservation Committee. They discussed
grant opportunities to preserve farmland. Mayor reviews the election outcome for the two
City Council seats and notes that there will be a Runoff Election held on December 5,2023
for the Mayoral position.
B. Department Supervisor:
1. City Treasurer,Financial Reports for Month Ending September 30,2023,and Quarter
Ending September 30,2023.
C. Eagle Police Department: Chief Wilke notes that it is "no shave November" and for a
donation members of the Ada County Sheriff's Office may participate as a fundraising
activity for the victim witness program, through the end of the year. He also notes that
they have been authorized to wear a cowboy hat as they see fit.
D. City Attorney:No report
7. PUBLIC COMMENT 1:
This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek
comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal
testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out
of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3)
minutes.

Manuela Walter, 1327 N.Laconia Ave,Eagle,Idaho. Ms. Walter believes that there is a great
deal of misinformation flowing on social media platforms. She feels that there should be a
debate between the candidates to assist voters in making an informed decision. It is her hope
that both candidates would commit to a debate prior to the December 5th election.
Kali Doylon, 1190 N.Red Leaf Way,Eagle,Idaho. Ms.Doylon would also like a debate to be
held between Mayor Pierce and Councilmember Pike. She believes that communication is
important to the community and a debate would encourage voter participation. It is her hope
that each would commit to a debate.
Bob Van Arnem,3049 S.Whitepost Way,Eagle,Idaho.He finds it regretful that local politics
has taken such a partisan turn. Local politicians should serve the local constituents and not be
sole focused on political party bias and issues. He would like to keep the focus on civility.
Andrea Estes, 5734 N. Montage Ct.,Eagle, Idaho. Ms. Estes feels like a debate between both
candidates is needed. Social media is full of negativity, and it would be an excellent
opportunity to have both candidates discuss these hard topics in a civil manner.
8. ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT
AGENDA
• Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate
discussion on these items unless the Mayor,a Councilmember,member of City Staff,or a citizen requests an
item to be removed from the Consent Agenda for discussion.Items removed from the Consent Agenda will be
placed on the Regular Agenda in a sequence determined by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City
Staff,Planning&Zoning Commission,or Design Review Board shall be adopted as part of the City Council's
Consent Agenda approval motion unless specifically stated otherwise.

a rate of$350 for specified event. (JDH)
E. Independent Contract Agreement Between the City of Eagle and Owyhee Express
Carriage Co.: An Independent Contract Agreement Between the City of Eagle and
Owyhee Express Carriage Co.to provide carriage services during Eagle Country Christmas
at Heritage Park.Compensation shall be at a rate of$850.00 for specified event. (JDH)
F. Amended Emergency Management Joint Powers Agreement Between the City of
Eagle and Ada County: Amended Emergency Management Joint Powers Agreement
Between the City of Eagle and Ada County to provide disaster preparedness and
coordination response for the City of Eagle and surrounding municipalities. The
membership contributions shall not exceed$13,500 annually. (ELZ)
G. Service Agreement Between the City of Eagle and Crime Stoppers: A Service
Agreement between the City of Eagle and Crime Stoppers to provide community services
and continued assistance to the City of Eagle Police Department in an amount not to exceed
$3,520. (TEO)
H. Master License Agreement for Regulation and Control of Green Stormwater
Infrastructure Facilities in the Greater Downtown Eagle Area: Master License
Agreement for Regulation and Control of Green Stormwater Infrastructure Facilities in the
Greater Downtown Eagle Area. (NBS)
I. Service Order Between the City of Eagle and Idaho Regional Optical Network: A
Service Order between the City of Eagle and Idaho Regional Optical Network to provide

commodity L3 ethernet service for City Hall for a contract period of thirty six(36)months
in an amount not to exceed$124,550.00. (DNG)
J. Pathway Agreement Between Drainage District No.2 and the City of Eagle and for a
Pathway within Beaconwood Subdivision No. 1: Drainage District No. 2 is requesting
approval of a pathway agreement associated with the Master Pathway Agreement for a
public pathway located within Beaconwood Subdivision No. 1. The 37.34-acre site is
located on the southeast corner of West Beacon Light Road and North Lanewood Road.

K. Permanent Pathway Easement Agreement Between the City of Eagle and AG EHC
II(LEN) Multi State 2,LLC, for a Public Pathway within Skyview Subdivision: AG
EHC II(LEN)Multi State 2,LLC,is requesting approval of a permanent pathway easement
agreement for the public pathway easement agreement for the public pathway located
within Skyview Subdivision.The 15.36-acre site is located at the northwest corner of State
Highway 44 and North Park Lane at 101 North Park Lane. (MJW)
L. Termination of Covenants, Conditions., and Restrictions for the Eagle Regional
Sports Park: Termination of the Declarations of Covenants, Conditions and
Restrictions for Gulch Ranch Estates.(NBS)
M. FPUD-04-23 & FP-07-23 — Final Development Plan and Final Plat for Soaring
Feather Ranch Subdivision — Dillon Ludlow: Dillon Ludlow, represented by Katie
Miller with Bailey Engineers,is requesting final development plan and final plat approvals
for Soaring Feather Ranch Subdivision, a 32-lot (29-buildable, 3-common), residential
subdivision. The 17-acre site is located approximately 2,000 feet south of Beacon Light
Road between Linder Road and Park Lane at 4807 Little Feather Lane. (MJW)

11. NEW BUSINESS:
A. ACTION ITEM: Canvass Votes for the 2023 General Election: Acceptance of the
November 7, 2023, election results as canvassed by the Ada County
Commissioners. [I.C. §50-412] (TEO)
Mayor Pierce introduces the item.
City Clerk, Tracy Osborn states that the acceptance of the election result is part of the
process required by State Statute. The top two vote recipients for Council were Mary May
and Craig Kvamme. No mayoral candidate received the majority of the votes, and
therefore Ada County Elections will conduct a runoff election on December 5th. A motion
to accept the election results as canvassed by Ada County Commissioners is the action to
be considered.
Baun moves under action item 11A to accept the canvass votes for the November 7,
2023 election. Seconded by Gindlesperger. ALL AYE...MOTION CARRIES.

B. *ACTION ITEM: Discussion and Council Direction Regarding the Selective
Traffic Enforcement Program (STEP) Grant Through Office of Highway Safety.
(HR)
Mayor Pierce introduces the item.
Council Member Russell discusses the importance of finding sustainable funding for
current and future law enforcement needs. The City of Eagle has the lowest tax levy rate
in the valley, a resident in Star would see a 33% increase in taxes, a resident of Kuna
would see 186%. Russell researched and found that both the Police Chief in both City of
Star and Kuna had applied for and received STEP grant funding. Russell scheduled
training on the grant application process last week on November 9`1'. The application
period opens on December 1 s`, thus the reason for requesting this item be added to the
agenda. This grant can be applied for up to three years, at which time the funding would
need to come 100% from the City. She expresses her gratitude to both Chief Wilke and
Deputy Elliot for working with her on such short notice regarding the grant opportunity.
Discussion.
Deputy Elliot reviews the duties of STEP(Selective Traffic Enforcement Patrol)including
collision investigation as well as community outreach and education. They would like to
work with the City for a manhour reimbursement grant. This would be funds for fiscal
year 2024-2025. The maximum hours requested would be 2080 per year, and a total of
two positions. The grant would require a 20% match from the municipality. The grant
must be applied for every year and is not guaranteed. If awarded the grant cannot be
awarded for more than 3 years. As with most grants it will require administration in the
form of tracking and paperwork. Discussion. See Powerpoint.
Nichoel Baird Spencer, Director of Long-Range Planning and Projects. Spencer reviews
the police development impact fee capital plan and the designated eligible expenses
within. States that it would be an appropriate time for the City to update the Police Capital
Improvement Plan due to the age of the document.
Russell notes that the City of Star posts monthly law enforcement statistics on their
website and would like to see that on Eagle's as well. It has been quite some time since a
report was presented at a Council meeting.
Baun moves regarding 11B giving staff direction to move forward with the STEP
grant application process. Seconded by Gindlesperger. Discussion. ALL
AYE...MOTION CARRIES.
12. PUBLIC COMMENT 2:
This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding any matter, up to and including any subject on the agenda with the
exception of Public Hearing and land use items.Comments regarding Public Hearing and land use items need to be
made during the open public hearing for said item(s) in accordance with Idaho Code. At times,the City Council
may seek comments/opinions regarding specific City matters(excluding Public Hearing and land use items)during
this allotted time. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their
comments to three(3)minutes.

Mary May, 1839 Longridge, Eagle, Idaho. States that there was a runoff in 2007 between Sandra
McDavid and Phil Bandy. There was a debate that was moderated by an impartial third party that

was well attended. She encourages both mayoral candidates to engage in a debate prior to the
election, it is an opportunity to get good information out there and encourage voter turnout.
Bob Van Arnem, 3049 N. Whitepost Way, Eagle, Idaho. Van Arnem thanks Council Member
Russell for her work on investigating the STEP grant and supports it whole-heartedly.
13. EXECUTIVE SESSION:74-206(1)An executive session at which members of the public
are excluded may be held, but only for the purposes and only in the manner set forth in
this section. The motion to go into executive session shall identify the specific subsections
of this section that authorize the executive session. There shall be a roll call vote on the
motion and the vote shall be recorded in the minutes. An executive session shall be
authorized by a two-thirds (2/3)vote of the governing body. An executive session may be
held:
(f) To communicate with legal counsel for the public agency to discuss the legal
ramifications of and legal options for pending litigation, or controversies not yet being
litigated but imminently likely to be litigated. The mere presence of legal counsel at
an executive session does not satisfy this requirement;
Baun move pursuant to I.C.74-206(1)that the City of Eagle convene an Executive Session for
the purpose of(f) To communicate with legal counsel for the public agency to discuss the
legal ramifications of and legal options for pending litigation, or controversies not yet
being litigated but imminently likely to be litigated. Seconded by Gindlesperger.

FY 2025 grant request:
• Eagle Police Department would like work with the City of Eagle to
submit a grant application for man hour reimbursement through the
Idaho Office of Highway Safety for fiscal year 2025 (October 1, 2024
until September 30, 2025) for the Selected Traffic Enforcement Program
(STEP).
• 2,080 hours
• The STEP position would work later in the afternoon during peak hours.

Grant application process:
1: Complete a form called Traffic Enforcement Grant Project Agreement(TEGPA). Once completed and
uploaded to the Idaho Transportation Department website,the grant application can begin.
2: Apply for the grant before the deadline of the end of January 2024. The grant would be specific in requesting
items related to traffic safety and enforcement identifying issues to include impaired driving,distracted
driving,aggressive driving and other traffic laws. The goal is to reduce collisions.
3: The City of Eagle would need to commit at least a 25%agency match of the 2,080 hours of funding. This
could be in the form of equipment to include a vehicle or traffic enforcement related equipment.
4: If ITD reviews the application and provides an award letter the City of Eagle will then purchase the equipment
for use anytime in FY 2025.
5: The Eagle Police Department will work the 2,080 hours in traffic safety and enforcement. This can be
completed using existing staff as well as the new position(s).
6: Logs would be maintained to include timesheets,activity logs,traffic stops,citations,etc.with updates at
least quarterly to ITD. This would be the responsibility of the City of Eagle Police and Data Analytics.
7: The City of Eagle would be refunded the man hours.

Examples of grant positions within the
Ada County Sheriff's Office:
• The City of Kuna was awarded a grant position in FY 2022 for a STEP
position. 25% match by the city included a Harley Davidson motorcycle
and traffic related equipment for the deputy.
• The City of Star was awarded a grant position in FY 2024 for a
STEP/POP position. 25% match by the city included a police equipped
vehicle and traffic related equipment for the deputy.

• The STEP grant position has to be applied for every year and may not be
awarded.
