MEETING MINUTES
October 10,2023
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. A quorum is
present.
3. PLEDGE OF ALLEGIANCE: Mayor Pierce leads the Pledge of Allegiance.
5. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA:
Russell moves 11B to consent agenda to be item 8R on the consent agenda.

4. PRESENTATION:
A. American Legion Orville Jackson Post 127 Presentation on Jackson House Proposal.
Ralph Perez the Commander of Orville Jackson Post 127. Mr.Perez provides a brief biography of
Mr. Jackson who served honorably as a medic in World War I during some of the most intense
battles of the war. Upon his discharge he and his wife,Floy built their home in Eagle,now known
as the Jackson House, in 1931. The American Legion is proposing a veteran's memorial honoring
the medical corps be placed on the property,now owned by the City. They have begun researching
different options for a military memorial and would like to invest in the Eagle Community.
Commander Perez discusses landscaping and memorial options the Post has envisioned for the
Jackson House. They are proposing to lease a portion of the property as well as pursue the
placement of a memorial so that they can move forward with grant opportunities.
Baun expresses his support of the proposal and offers suggestions for grant opportunities. General
discussion regarding next steps forward for the proposal.
6. REPORTS:
A. Mayor and Council:Mayor Pierce attended a meeting with Downtown Businesses that ACHD
called today. ACHD provided information on projects that will be occurring over the next
couple years.

7. PUBLIC COMMENT 1:
This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek
comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal
testimony on a public hearing matter, land use application,or comment on a pending application or proposal.Out
of courtesy for all who wish to speak,the City Council requests each speaker limit their comments to three (3)
minutes.
Judy Dahl, 735 N. Echohawk Way, Eagle, Idaho. Ms. Dahl is concerned with noise pollution.
Developers are not being held responsible for the installation of sound walls, and thus the
responsibility is falling on Idaho Transportation Department. Current policy and overdevelopment
have caused the problem. Planning code should be changed to required Developers to install the
sound walls and increase setbacks. Who is to pay for it while people suffer.

Tom York, 703 N. Valley Place, Eagle, Idaho. Mr. York's fiancé has granted him her 3 minutes
as well for public comment. Mr.York believes that public safety is and always has been the number
one priority of Mayor Pierce. Sheriff Clifford received an additional $500,000 to cover cost of
living inflation. During the shutdown (COVID), Mayor Pierce did not submit to the hysteria, but
kept businesses, parks, and city services open. He declared Eagle a sanctuary city to protect the
right to bear arms.During his tenure the City relocated the museum to the current campus location
between City Hall and the Library,the City purchased and preserved the Orville and Floy Jackson
House, and is currently developing a regional sports park. Mr. York lists several other
achievements completed and ongoing that have occurred under Pierce's leadership. Mr. York
believes that Mayor Pierce has and will continue to protect and improve the community.

F. Omnia Partners Membership: Omnia Partners is a cooperative purchasing entity that would
provide the City purchasing options that are compliant with Idaho Code 67-2807. Staff is seeking
Council approval of participating in the free membership offered by Omnia Partners. (TEO/EZ)
G. Findings of Fact and Conclusion of Law for the Approval of A-05-23/RZ-07-23 —
Annexation and Rezone from RR (Rural Residential — Ada County Designation) to PS
(Public/Semipublic)—City of Eagle:The City of Eagle,is requesting annexation and rezone from
RR (Rural Residential —Ada County designation) to PS (Public/Semipublic) for three (3) BLM
parcels (Parcel Nos. S0328141800; 120-acres, S0327223200; 160-acres, and S0322315200; 400-
acres). The parcels are generally located at State Highway 16 approximately 2,500-feet northeast
of the intersection of State Highway 16 and West Equest Lane. The land will remain under the
ownership of the federal government and stewardship of the Bureau of Land Management(BLM).

An Independent Contract Instructor Agreement Between the City of Eagle and Emma Beck to
provide instruction on instrument basics such as Ukulele,Guitar,Fiddle and Banjo. Compensation
shall be at a rate of 70%of the total revenue generated by registration. (HAY)
K. Temporary Waiver from Noise Ordinance Request: Old State Saloon is requesting a
Temporary Noise Waiver for their extension of the Eagle Harvest Festival event being held on
October 14,2023,between the hours of 9:00am and 12:00am. (TEO)
L. Development Agreement for RZ-18-22 — Silvercreek Subdivision — Eagle River
Development, LLC: Council authorization for Mayor to execute the development agreement
associated with the rezone from A (Agricultural) to R-2-DA (Residential with a development
agreement).The 65.39-acre site is located on each side of West Mace Road approximately 1,740-
feet west of the intersection of West Windbreaker Lane and West Mace Road at 1522 and 1811

M. Development Agreement for RZ-13-22 — Old Valley Road Retail Flex Park—West Old
Valley,LLC: Council authorization for Mayor to execute the development agreement associated
with the rezone from RUT(Rural-Urban Transition—Ada County designation)to(Mixed Use with
a development agreement).The 7.97-acre site is located at the northeast corner of West Old Valley

Independent Contract Agreement Between the City of Eagle and DJ Rory P LLC to perform DJ
services during the Night of a Thousand Pumpkins event. Compensation shall be paid for actual

P. Findings of Fact and Conclusion of Law for the Approval of FPUD-06-23 & FP-09-23—
Final Development Plan and Final Plat for Benari Estates Subdivision No.2—Eagle 1,LLC,
represented by Laren Bailey: Eagle 1, LLC, represented by Laren Bailey, is requesting final
development plan and final plat approvals for Benari Estates Subdivision No. 2, a 42-lot (38-
buildable, 4-common), residential subdivision. The 16.08-acre site is located on the northeast
corner of West State Street and North Ballantyne Lane at 1770 West State Street. (MJW)
Q. *Agreement for Independent Contract for DJ Services: An Agreement for Independent
Contract between the City of Eagle and Rory Patterson to provide DJ services at the Monster Mash
on October 21,2023. The Contractor shall be compensated$500.(HAY)

Baun seeks clarification to ensure that Idaho based companies are being considered during these
bidding opportunities.
Eric Ziegenfuss, Public Works Director, states that the prioritizes Idaho based companies. This
cooperative purchasing agreement is currently also being used by the State of Idaho and provides
another tool for them to obtain best pricing. Discussion.

preservation of neighborhoods and the impact of construction traffic on existing neighborhoods.
Mayor Pierce clarifies the public hearing process and that the opportunity provided tonight is to
speak to the Findings of Fact and Conclusions of Law.

David Lehner: Susan and David Lehner are requesting conditional use permit approval for a
waiver of Eagle City Code Sections 8-3-5(A)(1) and 8-3-3(B)(2)to facilitate the construction
of an accessory structure and privacy wall within the street side yard area on Lot 11, Block 1,
Canterbury Subdivision No. 2. The 1.99-acre site is located on the southeast corner of the
intersection of West Champagne Drive and North Clarendon Way at 2453 West Champagne

C. A Public Hearing to Consider a Solid Waste Collection Fee Increase Directly Related
to an Increase in Ada County Landfill Charges. (TEO)
Mayor Pierce opens the public hearing.
Tracy Osborn,City Clerk reviews the request for solid waste collection fees changes stemming
from an increase of landfill tipping fees approved by Ada County. Briefly reviews the
franchise agreement section that allows the Service Provider, Hardin Sanitation, to request a
pass-through fee increase for these types of fees, and the timing of the public hearing.
Mark Fulwiler, Hardin Sanitation representative provides clarification on the definition of
tipping fees. The trucks are weighed before the dump the waste and then afterwards, and then
are charged for the weight difference. Ada County previously charged $29 per ton and has
increased to $32 per ton, so approximately 10.3% increase. Mr. Fulwiler discusses how
Hardin's service rates are calculated, rates are comprised of both service and disposal costs.
The hauler pays for the disposal cost, so the increase to the service if broken down is about
2.3%, rather than the 10.3% total. On average the rates remain 23% lower than last year.

Judy Dahl, 735 N.Echohawk Way,Eagle, Idaho. Dahl states that there are federal regulations for
noise mitigation and sound walls.Ms.Dahl discusses the timing of the construction of her property
and the sound wall requirements. She encourages the Council to work with ITD to seek federal
funding for the installation of the sound walls.
13. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the
public are excluded may be held, but only for the purposes and only in the manner set forth
in this section. The motion to go into executive session shall identify the specific subsections
of this section that authorize the executive session.There shall be a roll call vote on the motion
and the vote shall be recorded in the minutes. An executive session shall be authorized by a
two-thirds (2/3) vote of the governing body. An executive session may be held:
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications
of and legal options for pending litigation, or controversies not yet being litigated but
imminently likely to be litigated. The mere presence of legal counsel at an executive session
does not satisfy this requirement;

It is with great honor and humility that I write to you on behalf of all the veterans of Orville Jackson Post 127 and
their supporters.
Our post has long been dedicated to the preservation of both the Jackson House and the legacy of our namesake,
Orville Jackson. Orville Jackson is a true, unsung hero of World War I.Serving as a combat medic on the European
front, including the largest, most deadly battle in U.S. history,the Meuse—Argonne offensive. He went on to serve
an additional year, post war, in Germany, after most forces came home.After his return home, Mr.Jackson and his
wife Floy made their home in Eagle, ID,serving the community for over 50 years with their pharmacy and general
store. It is this legacy of service and dedication to our country,state and the community of Eagle that earns them
special recognition for posterity. What better way to honor them, but to preserve and improve their family home
and historically recognized property.
The American Legion is one of the, if not the largest veteran services organizations in the United States and the
world.The Legion was created and founded by WWI veterans over 100 years ago and Orville Jackson was one its
founding and lifelong members. Given this history,we believe it is more than fitting that a veteran's memorial be
established on the Jackson property in honor of Mr.Jackson. Unlike most veteran memorials,we propose this
memorial be dedicated to and focused on the compassionate side of war, primarily our Medical Corp.Aside from a
museum located in Texas,we can find no other veteran memorial in the U.S. with this focus.We believe this offers
a wonderful opportunity to create something truly unique that will garner national support and recognition.
Making the Orville Jackson Veteran's Memorial a state, regional and national destination for visitors from across
our nation.
Our post proposes locating our facilities in the Jackson House and managing, alongside the city,the planning,
design,fundraising, and construction of the memorial. I look forward to offering a formal proposal at the city
council meeting on October 10, 2023.

Formal Memorial & Lease Proposal
In order to meet legal requirements for securing all manner of funding for the development of a Veteran's
Memorial on the Jackson House property,our post must have a legal interest in the property and specific
authorization by the city to do so:
We therefore propose the following.
• City to enter into a lease agreement with the post that includes both parcels of land known as
the Jackson House property.
• Initial lease period of 5 years,with extensions.
• Annual payments of one dollar.
• Post would maintain liability insurance,including post sponsored events, and include the City of
Eagle as an additional insured.The city's insurance program would apply for all city authorized
events.
• The city would continue to have responsibility for maintenance and utilities.
• Post will work closely with the parks department to facilitate community access to the property
for scheduling events.
• All improvements on the property must be approved in advance by the city.
• The city would authorize the post to engage in the development of a veteran's memorial on the
Jackson House property.Subject, of course,to city oversight, design&review and ultimate
approval of any and all plans proposed.
• Post will provide annual progress reports for development of memorial.
• The lease would be revokable. If satisfactory progress is not maintained on the development of
the memorial, including public input, design,fundraising efforts,construction, etc.
• The post will create a separate 501c3 non-profit entity to manage all financing activities related
to the memorial.So that post activity general funding is not comingled with the memorial efforts.
• The post would form a board of directors for the 501c3,and the city would have one
appointment to the board.The Post Commander will be the Corporate President and Chairman
of the Board.The Post Adjutant will be the Corporate Secretary.The city attorney would have the
right to review and approve corporate documents before adoption.
• The post would form an open committee for the development of the memorial.This committee
would be made up of post members,general public&professionals and whomever the city
would like to appoint.The Chairman would be the Post Commander, Post Adjutant will be Co-
Chair.The Commander and or the City may appoint such person(s)they wishes to appoint as co-
chair(s)and or committee members.The committee would have the authority to create sub-
committees for specific areas of focus.
• The Post would seek and apply for public and private sector grants at the local,state and national
levels.
• The Post would seek private sector corporate/business sponsorships,donations,professional
services and partnerships in its fundraising and construction efforts.

• The Post would develop and deploy community level public fundraising programs i.e.direct
donations,brick engraving, plaque engraving,events,etc.
• The city would reasonably assist in supporting all funding efforts of the post, as they relate
directly to the memorial.
• The city would direct the city attorney's office to draft the initial lease and to review and approve
corporate documents went submitted by the post.
These represent our initial thoughts and ideas.We remain fully open to the needs and ideas of the City of Eagle
and look forward to creating something truly amazing for the community. Once a tentative
agreement/understanding is achieved, I will need to take it before the post general membership for their final

The Jackson House was built in 1931 during the *
height of the depression. The Jackson's insisted that
the contractor rotate the men working on the home,
so that more men in the valley could get work. The
Jackson House was the only home underlir
construction in the valley at that time. The Tudor ik ,
style home was designed by Tourtellotte & Hummel,
the best known architectural firm in southwest
Idaho at the time. The firm specialized in works of * You can W z y i. get it of
a more sedate nature, but was persuaded by Orville °RVI Lt.E J ,,4 N
Jackson and his wife Floy, to take on the challenge
of this more picturesque English house with a }!r 1 i'
sunken garden. Orville managed the Eagle Drug £°"�
Store, his wife by his side, and was often observed ` L' ,,c
walking to and from work for over forty of the more ' O �R
than fifty years of his tenure as Eagle's leading
druggist and retailer.
Today the house is virtually unaltered both on the
exterior and in the interior where it still features
beamed ceilings and distinguished woodwork. It is
currently occupied by the Jacksons' daughter and
has been lived in and maintained by the Jackson

He continued his medical service when he purchased the Eagle Drug Store on
his 29th birthday,August 16, 1922. The Orville Jackson Drug Store was run by
Orville and his loving wife Floy for the next 52 years until they retired in 1974-
Orville Jackson passed away in Boise,ID on June 11, 1984.

Project Summary
