A RESOLUTION OF THE CITY OF EAGLE, IDAHO, ADOPTING A FEE INCREASE FOR
SOLID WASTE COLLECTION SERVICES DIRECTLY RELATED TO A FEE INCREASE
IMPOSED BY ADA COUNTY LANDFILL; AND PROVIDING FOR EFFECTIVE DATE.
WHEREAS,the City of Eagle, Idaho ("City")is a municipal corporation operating under the laws
of the State of Idaho and is authorized to set or increase rates and charges and take such other
actions incidental to the collection and disposal of garbage; and
WHEREAS, the Ada County Commissioners have voted to raise the general tipping fee rates for
the Ada County Landfill with an effective October 1, 2023; and
WHEREAS, the exclusive franchise agreement, specifically Section 9(B), between the City of
Eagle and Hardin Sanitation allows the Provider to request a rate increase to pass through for
documented increases to disposal fees such as these; and
WHEREAS, notice of the proposed increase in fees was published in The Idaho Statesman, a
newspaper of general circulation within the City on September 26, 2023, and October 3, 2023, as
required by law; and
WHEREAS,pursuant to a public hearing on the proposed increase of fees held on October 10,
2023, as required by Idaho Code §63-1311A,the City Council of the City of Eagle (the
"Council") desires to adopt fees as set forth below.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1: That the following increase in garbage collection service fees are hereby adopted:
See Exhibit A attached hereto and incorporated herein as if stated in full
Section 2: That this Resolution shall be in full force and effect Nun Pro Tunc on October 1, 2023.

RESOLUTION TO MODIFY RATES AT THE ADA COUNTY LANDFILL
At a meeting of the Board of Ada County Commissioners(the"Board"),State of Idaho,on
the 5th day of September,2023,the following Resolution was adopted,to-wit:
WHEREAS, the last resolution setting tipping fees was adopted on February 3, 2020
(Resolution No.2488);and
WHEREAS, based on an analysis of the costs associated with operating the Ada County
Landfill and recommendations from the Ada County Solid Waste Department, it has been
determined that an increase of the landfill tipping fee rates is necessary to fund the operation and
maintenance of waste disposal system for the public at the Ada County Landfill;and
WHEREAS,the Board held a public hearing on September 5,2023,to hear public input
and consider modification of the tipping fee rates at the Ada County landfill;and
WHEREAS,based on recommendations from Ada County Solid Waste Department staff
and information and testimony presented through the public hearing process,the Board believes it
to be in the best interest of Ada County and its citizens to modify the landfill tipping fee rates to
increase the general tipping fee to$32.00 per ton,increase the tipping fee for refrigeration units to
$25.00 per unit,and increase the tipping fee for tires to$5.00 per tire.
BE IT THEREFORE RESOLVED that the tipping fees set forth in the fee schedule
attached to this Resolution as Exhibit "A" shall be effective at the Ada County landfill as of
October 1,2023.
BE IT FURTHER RESOLVED that Resolution No.2488 is repealed in its entirety as of
October 1,2023.
