7. PUBLIC COMMENT 1: This time is reserved for the public to address their elected officials regarding

time. This is not the time slot to give formal testimony on a public hearing matter,land use application, or

F. Independent Contract Agreement Between the Ci , of Eagle and Committed Caseworks and
Events,LLC: An Independent Contract Agreement between the City of Eagle and Committed
Caseworks and Events, LLC to perform audio services at Eagle Country Christmas. Compensation shall
be at a rate of$900.00 for specified event. (JDH)
G. Independent Contract Instructor Agreement Between the Ci1y of Eagle and Jenn Banta: An
Independent Contract Instructor Agreement Between the City of Eagle and Jenn Banta to provide
instruction on do-it-yourself paint projects for adults and youth. Compensation shall be at a rate of 70%
of the total revenue generated by registration fees. (HAY)
H. Live Performance Agreement Between the City of Eagle and Elizabeth Findley A Live
Performance Agreement between the City of Eagle and Elizabeth Findley to perform at Eagle Country

K. FPUD-03-23 & FP-03-23 -Final Development Plan and Final Plat for Beaconwood Subdivision
No. 1 -Trilogy Development: Trilogy Development,represented by Matt Price from J-U-B Engineers,
is requesting final development plan and final plat approvals for Beaconwood Subdivision No. 1, a 77-
lot(72-buildable, 5-common),residential subdivision. The 37.34-acre site is located on the southeast

M. Prosecution Services Agreement-Gem County: An agreement between the City of Eagle and the
Gem County Prosecuting Attorney for prosecution services in those portions of the City of Eagle located
in Gem County. The agreement will not exceed$250.00 per month and will be in effect through

Gem County Prosecuting Attorney for prosecution services in those portions of the City of Eagle located
within Boise County. The agreement will not exceed$750.00 per month and will be in effect through

O. Findings of Fact and Conclusions of Law for the Approval of PP-11-22 -Preliminary Plat for
Valnova Lots 32-35 Subdivision-GWC Capital,LLC: GWC Capital,LLC,represented by Landon
Northey, is requesting preliminary plat approval for Valnova Lots 32-35 Subdivision(Lots 32, 33, 34,
and 35 of Spring Valley Subdivision No. 1), a 78-lot(72-residential, 6-common, [1-public
infrastructure]) subdivision. The 56.51-acre site is generally located 3.0-miles northeast of the

is requesting a modification to the rezone development agreement associated with Amberly Ranch
Subdivision. The request is to reduce the required width of the sidewalk located along West Beacon
Light Road from 10-feet to 5-feet. The 11.8-acre site is located on the southwest corner of West Beacon

T. Appointment to the Historical Preservation Commission: In accordance with Resolution 23-17,
Mayor Pierce is requesting Council Confirmation of the appointment of Nichole Starman to the
Historical Preservation Commission. Ms. Starman will be serving a three(3)year term that will expire it

U. Approval of the Temporary Construction Easement and Permanent Easements with the Ada
County Highway District: Approval of the Temporary Construction Easement and Permanent
Easements with the Ada County Highway District for the Downtown Mobility Improvements (AKA:
Eagle Road and State Street Intersection) for City of Eagle property located on East Plaza Drive, East
State Street, West Aikens, South Eagle Road. (NBS)

Compensation Summary between Ada County Highway District and the City of Eagle for an
improvement project planned for Eagle Road and State Street Intersection Design in an amount of$0.00.

W. Direct Placement Agreement Between the Ci1y of Eagle and Personnel Plus,Inc.: An agreement
between the City of Eagle and Personnel Plus for services related to the recruitment of candidates for
vacant city positions for direct hire, fees shall not exceed$5,000 per placement for hire. (TEO)
X. *Agreement for Merchant Card Processing Services for the Recreation Department Programs
and Park Reservations: A Merchant Processing Application and Agreement and the Merchant Services
Program Terms and Conditions to coordinate with DrivePayments and CardConnect for the processing
of credit and debit card payments for activities and reservations processed through the City Recreation

B. VAC-02-23—Vacation to the Final Plat of Bellemeade Subdivision—Tom Ricks: Tom Ricks,
represented by Claire Smarda,P.E.,with Breckon Land Design, is requesting to vacate 5-feet of the 10-
foot side yard public utilities, irrigation, and lot drainage easement located within Lots 12 and 24, Block

13. EXECUTIVE SESSION: 74-206(1)An executive session at which members of the public are excluded may
be held,but only for the purposes and only in the manner set forth in this section. The motion to go into
executive session shall identify the specific subsections of this section that authorize the executive session.
There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive
session shall be authorized by a two-thirds(2/3)vote of the governing body. An executive session may be
held:
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal
options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated.
The mere presence of legal counsel at an executive session does not satisfy this requirement;
