Cost Share - 2006 - State / Local A009 (757) Merrill Park Boise Rd Bridge - 3/13/2006STATE/LOCAL AGREEMENT (PROJECT DEVELOPMENT) A009(757) MERRILL PARK BOISE RIVER BRIDGE, EAGLE ADA COUNTY KEY NO. 09757 PARTIES THIS AGREEMENT is made and entered into this �3 day of intki/L_,/ , 0t)h , by and between the IDAHO TRANSPORTATION DEPARTMENT, hereafter called the STATE, and the CITY OF EAGLE, acting by and through its Mayor and Council, hereafter called the SPONSOR. PURPOSE The SPONSOR has requested the STATE to program for development and construction Federal -Aid Project A009(757), described as Merrill Park Boise River Bridge, the project development for which is to be performed by SPONSOR'S staff/Consultant Engineers. The purpose of this Agreement is to set out the terms and conditions to accomplish the project development phase of this project. A copy of the Transportation Enhancement Program Application is attached hereto as Exhibit A. NOTE: Securing the services of a consultant for project development services must follow the process outlined in the Idaho Transportation Department Guidelines for Local Public Agency Projects. Since certain functions under this Agreement are to be performed by the STATE, requiring the expenditure of funds, and since the STATE can only pay for work associated with the State Highway System, the SPONSOR is fully responsible for all costs incurred by the STATE related to the project. Authority for this Agreement is established by Section 40-317 of the Idaho Code. The Parties agree as follows: SECTION I. GENERAL 1. It is necessary to develop construction plans and specifications in order that federal participation may be obtained in the construction costs of the project. Federal -aid for project development and right of way is available on this project. 1 RD Register Nn State/Local Agreement (PD) Merrill Park Boise River Bridge Key No. 09757 2. Federal participation in the project is at the rate of 87.11%; local participation is 12.89%. The maximum Federal -aid available for this project is $500,000. 3. Scheduled funding for this project is listed on the Idaho Transportation Department approved Highway Development Program, and subsequent revisions. Current estimated funding is as follows: a. Project Development (State, Consultant, Local) - $100,000 b. Right -of -Way - $15,000 c. Construction Engineering - $55,000 d. Construction - $404,000 e. Total Estimated Project Costs - $574,000 4. The SPONSOR'S match for this project will be provided as follows: a. Cash in the amount of 12.89 percent of the entire project (currently $74,000); 5. The construction year for this project is listed on the approved Highway Development Program, and subsequent revisions. Currently the project is scheduled for construction in FY08, which commences October 1, 2007. The SPONSOR will meet the project milestones shown below or on a subsequently approved CPM Schedule. Failure to meet these milestones may jeopardize availability of Federal participation. Concept Approval — April 1, 2007 Environmental Approval - July 1, 2007 PS&E — October 1, 2007 6. This project shall be designed and constructed to an approved adopted standard. In the event that the SPONSOR does not have an adopted standard for specific areas or items, then the State Standards as defined in the Idaho Transportation Department's Design Manual in effect on the date of this Agreement, or as subsequently revised (for current version, see http://itd.idaho.gov/manuals/ManualsOnline.htm), AASHTO, or other agency standards shall be identified and incorporated into the design and construction of the project. 7. All information, regulatory and warning signs, pavement or other markings, and traffic signals required and warranted will be developed as a part of the plans, regardless of whether the work is done as a portion of the contract or by the SPONSOR'S forces. 8. If the project is terminated prior to completion, and the SPONSOR has been reimbursed with federal funds for preliminary engineering and/or right-of-way acquisition, the SPONSOR shall repay to the STATE all federal funds received. 2 State/Local Agreement (PD) Merrill Park Boise River Bridge Key No. 09757 SECTION II. That the STATE shall: 1. Not guarantee that the federal funds herein sought are available or will be made available. In the event federal funds are unavailable, this Agreement shall be void, except that SPONSOR shall be liable to the STATE for any un -reimbursed incidental expenses as provided for in Section II, Paragraph 2 of this Agreement. 2. Provide the following services incidental to the project development: a. Assist SPONSOR in the selection of a Consulting Engineer and negotiations as needed, and furnish the Agreement for Engineering Services and any supplements thereto, to be used between the SPONSOR and Consultant Engineers on this project. b. Furnish to the Engineers copies of materials test reports and other data applying to the project and available to the STATE. c. Review Preliminary Environmental Evaluation and recommend other appropriate environmental documentation. d. Advertise for required formal public hearings and provide a hearing officer to conduct the hearings. e. Review rights-of-way appraisals and assign personnel to determine relocation entitlements and assistance which might be required by the project. f. File with the Federal Highway Administration applications for exceptions to AASHTO Standards when appropriate and for government land withdrawals for rights-of-way and airport clearance. g. Assist in negotiations with public carriers and utilities for agreements on behalf of the SPONSOR. If requested by a utility company, hold utility hearings before the Idaho Transportation Board or issue IT Board Orders to the utilities on behalf of the SPONSOR. During development, the latest edition of the STATE's Guide for Utility Management will be followed in all matters relating to utilities. h. Review the designing engineers' plans, estimates, reports and environmental studies, and issue notice of approval to the SPONSOR and the Engineer following the Concept, Preliminary and Final Design Reviews and the Design Study Report. i. Supply roadway summary sheets and such standard drawings as may be required to supplement the plans. 3 State/Local Agreement (PD) Merrill Park Boise River Bridge Key No. 09757 j. Print and assemble plans, special provisions, specifications and contract. k. Advertise for bids and let the construction contract. Prior to construction, the parties will enter into a separate agreement covering responsibilities of the parties relating to construction. 3. Upon receipt of appropriate documentation from the SPONSOR showing expenditure of funds for project development, reimburse the SPONSOR at the approved Federal -aid rate for eligible expenses. Checks shall be made payable to the City of Eagle and mailed to PO Box 1520, Eagle, ID 83616. 4. Bill the SPONSOR for costs incurred by the STATE under this agreement for project development, if those costs exceed the amount set out in Section III, Paragraph 1. 5. Bill the SPONSOR for any federal funds to be repaid by the SPONSOR if the project is terminated prior to completion, and the SPONSOR has been reimbursed with federal funds for preliminary engineering and/or right-of-way acquisition. SECTION III. That the SPONSOR shall: 1. Provide a funding match of 12.89% of the Total Estimated Project Costs of $574,000, and assume responsibility for all costs of the project over and above the $500,000 Federal -aid limit. 2. Pay to the STATE, before the STATE begins the incidental services referred to in Section II, Paragraph 2, the sum of TEN THOUSAND DOLLARS ($10,000), estimated to be the total expense to the STATE. In addition, pay to the STATE the cost of all incidental services provided by the STATE upon receipt of the billing provided for in Section II, Paragraph 4. Checks shall be made payable to the "Idaho Transportation Department", and mailed to the District Three Office at PO Box 8028, Boise, ID 83707-2028. 3. SPONSOR warrants that it will repay any federal reimbursements on this project if the project is terminated prior to completion. 4. With the assistance of the STATE, hire a consultant for development of the project. 5. Make timely payment of all consultant invoices throughout the design of the project. Periodically the SPONSOR may submit allowable Consultant invoices and receipts to the STATE showing payment of same for reimbursement. The STATE will reimburse the SPONSOR for eligible expenses less the SPONSOR'S match. 4 State/Local Agreement (PD) Merrill Park Boise River Bridge Key No. 09757 6. Acquire with the STATE'S assistance as noted in Section II, all rights-of-way and easements needed to provide for construction and maintenance of the project. 7. Furnish all appraisals required for the project to the STATE for review. 8. Review the appraisal reviewer's statement of the estimated fair market value and approve an amount to be just compensation for each parcel to be acquired. 9. Complete a monthly right-of-way status report, ITD-2161, and forward it to the Local Project Coordinator. 10. Before initiating negotiations for any real property required for right-of-way, establish an amount considered to be just compensation, under Idaho law, and make a prompt offer to acquire the property for the full amount established. 11. Make a good faith effort to acquire the real property by negotiation. 12. Inform the property owner, in those cases where he indicates a willingness to donate a portion of his real property for rights-of-way, of all the facts including his right to full compensation in money for land and damages, if any, in accordance with Idaho Code. 13. Provide relocation assistance and payments for any displaced person, business, farm operation, or nonprofit organization in accordance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970; 49 CFR 24; 23 CFR 710; the Idaho Real Property Acquisition Act of 1971; Title 40, Chapter 20; and Title 58, Chapter 11; Idaho Code, as amended, and regulations promulgated thereunder. No individual or family shall be displaced until decent, safe and sanitary replacement housing is available to the relocatees for immediate occupancy. In addition, advise the STATE of any relocations required by the project and authorize the STATE to negotiate in its behalf for all relocation assistance and payments, the cost of which will be assumed by the SPONSOR at the time of negotiation. 14. To the greatest extent practicable, no person lawfully occupying the real property shall be required to move from his home, farm or business without at least ninety (90) days' written notice prior to advertisement of the project. 15. Before advertisement for bids, provide a certification that all rights-of-way, easements, permits, materials sources and agreements necessary for the construction of the project have been acquired in accordance with the provisions of this Section. Provide a value of any right-of-way donations obtained, which may be credited as a matching share. 5 State/Local Agreement (PD) Merrill Park Boise River Bridge Key No. 09757 16. Evaluate the impact the project might have on the quality of the human environment and prepare and furnish to the STATE an environmental evaluation, which includes cultural resources, and any other documents required by the National Environmental Policy Act. 17. At all required public hearings, furnish all necessary exhibits and provide for a representative of the SPONSOR to describe the project; present information about the location and design, including alternates; discuss the tentative schedules for rights-of-way acquisitions and construction; discuss the SPONSOR'S relocation assistance program; discuss the economic, sociological, and environmental effects of the project; and answer all questions concerning the project. 18. Comply with Appendix A, Title 49 CFR, Part 21, attached hereto and made a part hereof. 19. Maintain all project records, including source documentation for all expenditures and in-kind contributions, for a period of three (3) years from the date of final acceptance. If any litigation, claim, negotiation, or audit has been started before expiration of the three-year period, the records shall be retained until completion of the action and resolution of all issues that arise from it. 20. Compliance with Regulations: The SPONSOR during the performance of work covered by this Agreement shall comply with all regulations of the United States Department of Transportation relative to Civil Rights with specific reference to Title 49 CFR Part 21, Title 41 CFR Part 60, Civil Rights Act of 1964 as amended and Executive Order 11246. 2. Non -Discrimination: The SPONSOR, with regard to the work performed during the term of this Agreement, shall not in any way discriminate: against any employee or applicant for employment; subcontractor or solicitations for subcontract including procurement of materials and equipment; or any other individual or firm providing or proposing services based on race, color, religion, sex, national origin, age or non -job-related handicap. 3. Solicitations for Subcontracts, Including Procurements of Materials and Equipment: In all solicitations, either by bidding or negotiation, made by the SPONSOR for work or services performed under subcontract, including procurement of materials and equipment, each potential subcontractor or supplier shall be made aware, by the SPONSOR, of the obligations of this Agreement and to the Civil Rights Requirements based on race, color, religion, sex, national origin, age or non -job-related handicap. 4. Information and Reports: The SPONSOR shall provide all information and reports required by Regulations and/or Directives and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the Idaho Transportation Department or the Federal Highway Administration. The SPONSOR will be required to retain all records for a period of three years. 5. Sanctions for Non -Compliance: In the event the SPONSOR is in non-compliance with the Civil Rights Provisions of this Agreement, the Idaho Transportation Department shall impose such sanctions as it or the Federal Highway Administration may determine to be appropriate, including, but not limited to: (a) Withholding of payments to the SPONSOR until it has achieved compliance and/or (b) Cancellation, termination or suspension of the contract, in whole or in part. 6. Incorporation of the Provisions: The SPONSOR shall physically include this Appendix in every subcontract of $10,000 or more to include procurement of materials and leases of equipment unless exempt by Regulations, Orders, or Directives pursuant thereto. The SPONSOR shall take such action with respect to subcontractor or procurement as the Idaho Transportation Department or the Federal Highway Administration may direct as a means of enforcing the provisions, including sanctions for noncompliance, provided in event the SPONSOR becomes involved in, or is threatened with litigation with the subcontractors or suppliers as a result of such direction, the SPONSOR may request the STATE to enter into such litigation to protect the interest of the STATE, and in addition the SPONSOR may request the United States to enter into such litigation to protect the interest of the United States. Purpose and Need: PURPOSE: The primary purpose of this project is to Zink pathways on each side of the North Channel of the Boise River by the installation of a pedestrian bridge that will span the North Channel of the Boise River. This project is unique for a number of reasons, specifically in that this bridge will be the only pedestrian/bicyclist crossing that will span the Boise River and Zink the pathway systems on each side. Second, the bridge is an integral part of the "Ridge -to - Rivers Plan" to Zink the Boise/Garden City Greenbelt to City of Eagle path system, Eagle Island State Park, and ultimately to the Canyon County line. Third, the bridge will extend mobility, improve accessibility, and increase safety for the disabled and mobile challenged to enjoy the natural resources and beauty along the Boise River. This project addresses both the Regional and City Comprehensive Plans for a safe pedestrian/bicyclist crossing from one side of the North Channel of the Boise River to the other; linking local paths with the regional path. Pathways and bridges address the community values of open space and provide opportunities for residents and visitors to enjoy the scenic beauty along the Boise River. This bridge will Zink recreational facilities at Merrill Park with a pathway system on the south side that borders Island Woods and Rivers End subdivisions and ultimately the Garden City and Boise Greenbelts. "I would like to express support, on behalf of Ada County Highway District...These projects provide linkage in the regional pathway system and provide additional connections for existing pathways." William J. Schweitzer, Director Ada County Highway District Opportunities Lost: If not implemented the two path systems will remain separate. The only connection to the City of Eagle business district and Merrill Park will be along Eagle Road and over the North Channel Bridge. Eagle Road has a high volume of traffic at speeds near 50+ MPH. The shoulder over the bridge would be considered marginal for pedestrian/ bicycle traffic according to AASHTO standards. Adversely without the bridge, the regional bicyclist or jogger would consider the path segments local and without destination. To the disabled, the south side of the river would be inaccessible. This project provides for a safe pedestrian/bicyclist crossing from one side of the North Channel of the Boise River to the other. NEED: This project is needed based on the absence of a pedestrian/bicyclist crossing across the North Channel of the Boise River. There currently is no other links to connect the north side path system with the south side path system. Pathway users are currently limited to using the pathway system on either the north or south side of the river. Project Description: The City of Eagle is submitting this Enhancement Program funding application for the project titled "Merrill Park Boise River Bridge." This project includes the procurement and installation of a 210 foot single span 10 foot wide bridge that will be located approximately .25 miles south of Highway 44 near mile post 18, 150 feet southeast of Merrill Park's south entrance. The project includes paving approximately 1000 feet of existing unpaved pedestrian pathway on the north side of the river, landscaping, and signage. This project will conform to ADA requirements. Refer to Project Vicinity Map at the end of this narrative section. Eagle is located 10 miles west of downtown Boise in Ada County. Eagle is bordered by Boise on the east, Garden City on the southeast, and Meridian on the south, and is located 30 miles east of the Idaho - Oregon state line. The influx of new residents has resulted in a growing number of retail and commercial offerings and location of offices from a variety of industries. This low -maintenance bridge that blends with natural foliage and vegetation of the Boise River corridor will provide solitude, scenic wonder, and educational opportunities to the young and old. This project will enhance the quality of the traveling experience and quality of life for not only Eagle residents but also many visitors or tourists. This pathway enhancement will provide a link that will allow users of the pathway to explore both pathways bordering each side of the Boise River, while expanding alternate routes and allowing easier access to Merrill Park from the south pathway. Eagle is a community that is continually in motion; changing, planning, and always looking for ways to improve their community. During the 2003-04 budget year, the City of Eagle installed four bridges and 2.6 miles of pathway along the north side of the Boise River North Fork. The 2003-04 bridges and path was completed through local donations and City funds. This proposed project is a perfect example of their fortitude in planning a project to address a vital link in their pathway system. C. Project Development Considerations: North side of North Fork Boise River, 2.6 miles of pathway, completed 2004. An easement will be required from the Department of Lands. This Bridge project will span from Eagle City path easement to City path easement. Since this project involves spanning the North Channel of the Boise River, permits will need to be obtained from Idaho Water Resources and the Army Corps of Engineers. The Bridge will be located such that minimum foliage will be disturbed. The cast in place abutments will be constructed at locations upland of the ordinary high water marks. This steel bridge will be pre -built requiring only cranes to set the bridge into place. Over the past years the City of Eagle has constructed four other similar bridges for the pathway. City of Eagle ITD Enhancement Application Merrill Park Boise River Bridge Project 3 A preliminary Engineering Report and Environmental Study will be required on this project. Bridge construction and location is such that environmental impact is minimized. This project will not impact or go through historical features or structures and will not impact any low- income or minority populations or structures. D. The City of Eagle assumes full responsibility for pathway maintenance. Currently the City contracts the landscape care and path maintenance with a local company. Path repairs are contracted out to local contractors based on public works construction. Path maintenance and construction is a line item on the City's budget. Selection Criteria: Quality of Experience The Merrill Park Boise River Bridge Project will link two existing pathways, provide pedestrians an alternate route to travel, and provide a safe, alternate way to cross the North Channel of the Boise River. This project will increase pathway use because it is connecting two existing pathways. This project will enhance community pride and overall quality of life, will preserve the existing beauty of the appearance of the surrounding area with a linked pathway system, and will enhance the appearance that is viewed from areas within view of the pathway system. Benches on both sides of the existing pathway are scattered along the pathway's edge. Pathway users are frequently seen sitting and enjoying the scenic beauty of the area. This system will provide a complete, useable, link and alternate mode of travel for pedestrians, including those with special transportation needs such as wheelchair access. Eagle was selected for the award after an evaluation of 15 cities in Idaho with a population between 10,000 and 50,000 and which were recommended for consideration by a survey of business, municipal, state, and other government officials. This award clearly demonstrates the City's dedication to planning and its success as a "rurban" (a community that is maintaining its rural charm in the otherwise increasingly urban setting) community. Eagle has recognized the critical need for this project as part of their Park & Pathway Development Committee's priority list. We have been very involved in the construcrion of the greenbelt pathway through the cutting of the pathway through the area along the nver, tutting trees, deadfall, brush, removing old fencing, and then installing new fencing. We have organized fun runs/fitness events on tate pathway, and would be very happy to sec it connerte.t to both t e other side of the river and the 1.5 milt section from Channel Center to Ballantyne Ln. The greenbelt and pathways are highly used and important to the Eagle area, and being able to cross the river and go under the bridges are important not only for the citizens of Eagle and those that use the pathway, but to m as the Firs department The ability to cross the river in many places is hugely important during times of high water end also during water rescue scenarios. We believe that a path undo the North Channel bridge would be very beneficial to us for water and dive rescue emergencies and it allows us to access both sides of the bridge on foot without having to cross the extremely busy Eagle Rd.
