WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the.lases of the State of Idaho and is authorized to annex to and incorporate within the boundaries of the City contiguous real property in the manner provided by Section 50-222, Idaho Code; and WHEREAS, Aviinor Development, LLC, Spring Valley Livestock Company, Inc., First American Title Company, and R. Pfannmuller Iti Son, LLC, the owners of the real properties situated in the unincorporated areas of Ada. County, (particularly described in Exhibit "A"), Boise County, (particularly described in Exhibit "B"), and Gem County, (particularly described in Exhibit "C"), of this ordinance have requested, in writing, annexation of said real properties to the City of Eagle; and. WI-IEREAS, the owners of the real properties situated Nvithin the City of Eagle and particularly described in Exhibits `A-C" of this ordinance have: requested, in writing, a rezone from RP (Rural Preseivation --- Ada County designation), 10, (Rural Residential --- Ada County designation), Multiple Use (Boise County designation), and .-Al (Prime Agriculture - Gem County designation)to APD-DA(Avimor Planned Development); and WHEREAS, the properties described in. Exhibits "A-C" is identified by the Ada County Assessor's Office, Boise County Assessor's Office, and Gem County Assessor's Office as the tax parcel numbers referenced on Exhibit"D", and Instrument# 346496 EMMETT,GEM,IDAHO 7-27-2023 08:21:04 AM No.of Pages:30 Recorded for:CITY OF EAGLE SHELLY TILTON Fee:97. � Ex-Officio Recorder Deputy Index to:ORDINANCE Purge I of 4 %�-1CF'U:JC�OrdirarlceslORD 2-AvimorAPD-DA.doc I^FSTRu. n!o. q,� PAA WHEREAS, the Planning and Zoning Commission of the City, pursuant to public notice as required by law, held a public hearing on January 30, 2023, as required by Section 67-6525, Idaho Code, and made a recommendation to the Mayor and Council; and WHEREAS, the Eagle City Council, pursuant to public notice as required by law, held a public hearing on March 30, 2023, on the proposed annexation and zoning for the real properties described in Exhibits "A-C" as required by Section 67-6525, Idaho Code, made findings and determined that the requested annexation should be granted and that a zoning classification of APD-DA (Avimor Planned Development with a development agreement) for the properties described in Exhibits "A-C" is appropriate to meet the requirements of Idaho Code, Eagle City Code and the Eagle Comprehensive Plan and should be granted. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: The Eagle City Council hereby finds and declares that the real properties particularly described in Exhibits "A-C", attached here to, and incorporated herein by reference, is contiguous to the City, that said properties can be reasonably assumed to be used for the orderly development of the City, and that the owner of said properties has requested, in writing, annexation thereof to the City. Section 2: The real properties, all situated in Ada County, Idaho, adjacent and contiguous to the City, particularly described in Exhibit"A" and as generally shown on Exhibit"E", attached here to, and included herein by reference, is hereby annexed to the incorporated territorial limits of the City of Eagle, Idaho. Section 3: The real properties, all situated in Boise County, Idaho, adjacent and contiguous to the City, particularly described in Exhibit `B" and as generally shown on Exhibit "F", attached here to, and included herein by reference, is hereby annexed to the incorporated territorial limits of the City of Eagle, Idaho. Section 4: The real properties, all situated in Gem County, Idaho, adjacent and contiguous to the City, particularly described in Exhibit"C" and as generally shown on Exhibit"G", attached here to, and included herein by reference, is hereby annexed to the incorporated territorial limits of the City of Eagle, Idaho. The City Council further finds and determines that said zone change is in accordance with the Eagle Comprehensive Plan and relevant City Codes and that the Zoning Map of the City is hereby amended to include the real properties described in Exhibit "A" in the APD-DA zoning district. Section 7: The City Council hereby finds and determines that the real properties particularly described in Exhibit `B" and generally as shown on Exhibit "F", attached here to, and incorporated by reference, is hereby removed from the Multiple Use zoning classification and is hereby included in the APD-DA (Avimor Planned Development with a development agreement) zoning classification all pursuant to the Eagle City Code Title 11B Avimor Zoning Ordinance of the City of Eagle. The City Council further finds and determines that said zone change is in accordance with the Eagle Comprehensive Plan and relevant City Codes and that the Zoning Map of the City is hereby amended to include the real properties described in Exhibit `B" in the APD-DA zoning district. Section 8: The City Council hereby finds and determines that the real properties particularly described in Exhibit "C" and generally as shown on Exhibit "G", attached here to, and incorporated by reference, is hereby removed from the Al (Prime Agriculture — Gem County designation) zoning classification and is hereby included in the APD-DA (Avimor Planned Development with a development agreement) zoning classification all pursuant to the Eagle City Code Title 11B Avimor Zoning Ordinance of the City of Eagle. The City Council further finds and determines that said zone change is in accordance with the Eagle Comprehensive Plan and relevant City Codes and that the Zoning Map of the City is hereby amended to include the real properties described in Exhibit"C"in the APD-DA zoning district. Section 9: From and after the effective date of this Ordinance, all property and persons within the boundaries and territory described above shall be subject to all ordinances, resolutions, police regulations, taxation, and other powers of the City of Eagle. Section 10: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance.
