Minutes
The Design Review Board met in regular session May 11, 2023. Lindgren presiding.
1. CALL TO ORDER: Lindgren calls the meeting to order at 6:00 p.m.
2. ROLL CALL: LINDGREN, MERRILL, MIHAN, GREER. Absent: GRUBB, SAYER,
DUPERAULT. A quorum is present.
3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED
ACTION ITEMS Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless a Design Review
Board member or City Staff requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order. Any item on the Consent Agenda that
contains written recommendations from the City of Eagle shall be adopted as part of the
Design Review's Consent Agenda approval motion unless specifically stated otherwise.
A. Findings of Fact and Conclusions of Law for the Approval of DR-16-23 —
Decorative Concrete Wall Adjacent to Chinden Boulevard — Gary Brookshier:
Gary Brookshier is requesting design review approval to construct a decorative
concrete fence/wall adjacent to West Chinden Boulevard. The 1.18-acre site is located
on the northeast corner of the intersection of West Chinden Boulevard and South
Locust Grove Road at 1557 West Hempstead Drive (Lot 14, Block 8, Banbury
Subdivision No.6). (MJR)
B. Findings of Fact and Conclusions of Law for the Approval of DR-17-23 —
Decorative Concrete Wall Adjacent to Chinden Boulevard — Leonard and
Cara Butler: Leonard and Cara Butler are requesting design review approval to
construct a decorative concrete fence/wall adjacent to West Chinden Boulevard.
The 1-acre site is located on the north side of West Chinden Boulevard
approximately 530-feet east of the intersection of West Chinden Boulevard and
South Locust Grove Road at 1401 West Hempstead Drive (Lot 11, Block 8,
Banbury Subdivision No. 6). (MJR)
C. Findings of Fact and Conclusions of Law for the Approval of DR-14-23 —
Common Area Landscaping within Cadenza Court Subdivision — MJV
Properties, LLC: MJV Properties, LLC, represented by Jay Gibbons with South,
Beck and Baird Landscape Architecture, is requesting design review approval for the
common area landscaping within Cadenza Court Subdivision. The 1.37-acre site is
located on the east side of South Parkinson Street approximately 35-feet south of the
intersection of South Parkinson Street and East Syringa Street at 540 South Parkinson
Street. (BAW)
Merrill moves to approve the consent agenda as presented. Seconded by Greer.

4. UNFINISHED BUSINESS: None.
5. NEW BUSINESS:
A. ACTIONITEM: DR-19-23 — Common Area Landscaping within Valnova
Subdivision Lot 22 — GWC Capital, LLC: GWC Capital, LLC, represented by Eric
Langvardt with Langvardt Design Group, is requesting design review approval for the
common area landscaping within Valnova Subdivision — Lot 22 (Spring Valley PUMP
No. 1). The 8.09-acre site is generally located approximately 3/4-mile northeast of the
intersection of State Highway 16 and Equest Lane (approximately 1-mile north of
Beacon Light Road and Linter Road intersection) (Ada County Assessor parcel
numbers S0323336000 and 50323110015). (BAW)
Lindgren recuses himself from application DR-19-23.
Brenda Wadsworth, representing Langvardt Design Group, 336 Broadway, Salt Lake
City, Utah, provides an overview of the application and responds to questions from the
Board.
City Planner, Barb Williams, provides an overview of the application and responds to
questions from the Board.
Merrill moves to approve application DR-19-23 with the site specific and
standard conditions as written and with the following modifications.
Site specific condition #3: Work with staff to put the correct light in-between the
two existing trees on the southeast, terminal island so we have some safety lights
in there and everything else will be the same.
Seconded by Mihan. ALL AYES ... MOTION CARRIES.
Greer recuses herself from applications DR-22-23 and DR-23-23.
B. ACTIONITEM: DR-22-23 — Common Area Landscaping within Rocking A Ranch
Subdivision — Alscott Real Estate, LLC: Alscott Real Estate, LLC, represented by
Rodney Evans with Rodney Evans + Partners, LLC, is requesting design review
approval for the common area landscaping within Rocking A Ranch Subdivision. The
171.9-acre site is located on the east side of North Eagle Road, approximately 1,300-
feet north of East Beacon Light Road at 3980 & 3250 North Eagle Road, 372 East
Beacon Light Road, and Lots 1, 2, 3, & 4, Block 1, Equestrian Estates Subdivision No.
1. (ERG)
Rodney Evans, Rodney Evans and Partners, 1450 W. Bannock Street, Boise, 83702,
provides an overview of the application and responds to questions from the Board.
City Planner, Emily Gero, provides an overview of the application and responds to
questions from the Board.
Lindgren moves to approve application DR-22-23 with the site specific and
standard conditions as written and with the following modifications.
Lindgren begins a motion.
Lindgren moves to withdraw the motion as stated. Seconded by Mihan. ALL
AYES ... MOTION CARRIES.
Lindgren moves to approve application DR-22-23 with the site specific and
standard conditions as written and with the following modifications.
Site specific condition #2: One of two options in reference to the pathways within
the pollinator garden. One option is Design Review would recommend approval
of any additional pathways that were not originally provided in the pre -plat to be
allowed to be 6' in width as proposed in this application. The second option at the
applicant's choice is Design Review would recommend that all pathways within
the pollinator garden to be 6' width that will be reviewed as a pre -plat
modification to be reviewed by City Council.
Site specific condition #3: Provide a revised landscape plan showing all overhead
utilities and poles located on the site to be buried and poles removed. The revised
landscape plan shall be reviewed and approved by staff prior to submittal of the
final plat application.
Site specific condition #4: Provide a revised landscape plan showing all existing barbed
wire fencing to be removed. The Board recommends this condition assuming the fencing
is on the owner's property and that the applicant will endeavor to negotiate with adjacent
properties to remove barbwire that they do not have control over.
Site specific condition #5: Strike the word "if". The condition will read "The City
approves the removal of the trees and approves the proposed mitigation; no additional
trees are required". Strike the second, third and fourth options within that condition.
Site specific condition #6: Provide a revised landscape plan showing all street trees a
maximum of 80-feet apart. The revised landscape plan shall be reviewed and approved by
staff prior to submittal of the final plat application.
Site specific condition #7: The Board recommends eliminating the requirement
for street trees on either side of the pathway along Eagle Road citing the fact that
the applicant has provided additional 50 feet of right away with an eight foot
berm and a natural landscape growth along that whole stretch of Eagle Road.
We agree with the applicant that would deter from the growth along the berm
that is being provided.
Site specific condition #8: Provide community center elevations stamped by a
licensed architect. Building elevations shall be reviewed by staff and two
members of the Design Review Board prior to issuance of zoning certificate.
Applicant to provide materials, colors and any additional information that might
be helpful to communicate the design attempt of the community building.
Site specific condition #9: The Board recommends this condition remain as
written.
Site specific condition #10-#16: Shall remain as presented by staff.
Site specific condition #17: The alternative methods of compliance for the tree
sizes for the habitat areas is acceptable as presented by the applicant.
Site specific condition #18: The applicant's proposal to eliminate the trees as
presented along the west property line adjacent to the existing equestrian area
and with the fence with the four -foot 3-3 pole rail fence line to remain with a
future connection with that property to this open area the Board does
recommend this as a condition of approval.
Site specific condition #19: An alternative method of compliance for tree species
that are otherwise not recommended or on the city's tree species list and given
the context and the condition of this development that is an appropriate
alternative method of compliance.
Site specific condition #20: The common area landscaping and the Board does
recommend approval of the general landscaping as proposed.
Comments by member Merrill: In regard to site specific condition #2, only
sidewalks in the pollinator garden are to be 6 foot. In regards to the lighting,
make note for that staff include kids getting dropped off at 5:00 then walking
home in the dark in the evenings when fall and winter comes.
Seconded by Merrill. ALL AYES ... MOTION CARRIES.
C. ACTION ITEM: DR-23-23 — Two Subdivision Entry Features with Gates and Four
Subdivision Entry Monument Signs for Rocking A Ranch Subdivision — Alscott
Real Estate, LLC: Alscott Real Estate, LLC, represented by Rodney Evans with
Rodney Evans + Partners, LLC, is requesting design review approval for two
subdivision entry features with gates and four subdivision entry monument signs for
Rocking A Ranch Subdivision. The 171.9-acre site is located on the east side of North
Eagle Road, approximately 1,300-feet north of East Beacon Light Road at 3980 &

Site specific condition #1: Strike. The scale and the character, authenticity of the
approach to the signage is appropriate and I do agree with the applicant that we
at times have had applications in front of the Board where the City code does a
great job, but does not cover all conditions and so there times when there are
exceptions where it is apparent to the eye and I think this is one of those cases. As
a backdrop we feel this is an appropriate exception to the norm.
Site specific condition #3: Strike.
Seconded by Mihan. ALL AYES ... MOTION CARRIES.

• This medium to large pyramidal tree has drooping branchlets with dark gray -green
