Minutes - 2023 - Design Review - 04/27/2023 - RegularDESIGN REVIEW BOARD MINUTES The Design Review Board met in regular session on April 27, 2023. Grubb presiding. 1. CALL TO ORDER: Grubb calls the meeting to order at 6:02. 2. ROLL CALL: GRUBB, SAYER, DUPERAULT, LINDGREN, MERRILL, MIHAN, GREER. A quorum is present. 3. ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. CONSENT AGENDA: Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member or City Staff requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. Findings of Fact and Conclusions of Law for the Approval of DR-08-23 - Common Area Landscaping within Shingle Creek Subdivision - Cook Brothers Construction, Inc.: Cook Brothers Construction, Inc., represented by Ben Semple with Rodney Evans + Partners, LLC, is requesting design review approval for the common area landscaping within Shingle Creek Subdivision. The 4.41-acre site is located on the north side of State Highway 44 approximately 400-feet west of the intersection of West State Street and State Highway 44 at 2500 West State Street. (ERG) C. Findings of Fact and Conclusion of Law for the Approval of DR-10-23 - Common Area Landscaping within Soaring Feather Ranch Subdivision - Little Feather, LLC: Little Feather, LLC, represented by Jay Gibbons with South, Beck and Baird Landscape Architecture, is requesting design review approval of the common area landscaping within Soaring Feather Ranch Subdivision. The 17-acre site is located approximately 2,000-feet south of Beacon Light Road between North Linder Road and North Park Lane at 4807 West Little Feather Lane. (BAW) D. Findings of Fact and Conclusions of Law for the Approval of DR-11-23 - Common Area Landscaping within Kingswood Subdivision - LGPD Utah, LLC: LGPD Utah, LLC represented by Jay Gibbons with South, Beck, and Baird Landscape Architecture, is requesting design review approval for the common area landscaping within Kingswood Subdivision. The 38.81-acre site is located on the west side of North Linder Road approximately 1,430-feet north of the intersection of North Linder Road and West Floating Feather Road. NEW BUSINESS: Chairman Grubb moves to hear DR-16-23 and DR-17-23 at the same time. A. ACTION ITEM: DR-16-23 - Decorative Concrete Wall Adiancent to Chinden Boulevard — Gary Brookshier: Gary Brookshier is requesting design review approval to construct a decorative concrete fence/wall adjacent to West Chinden Boulevard. The 1.18-acre site is located on the northeast corner of the intersection of West Chinden Boulevard and South Locust Grove Road at 1557 West Hempstead Drive (Lot 14, Block 8, Banbury Subdivision No.6). (MJR) Gary Brookshier, 1557 West Hempstead Drive, Eagle, provides an overview of the application and responds to questions from the Boad. Leonard Butler, 1401 West Hempstead Drive, Eagle, provides an overview of the application and responds to questions from the Board. City Planner Matt Rumsey, provides an overview of the application and responds to questions from the Board. Grubb moves to approve DR-16-23 with the site specific conditions of approval. Site Specific Condition #1: A fence permit is required prior to construction. Site Specific Condition 92: The applicant shall provide an approval letter from the Banbury Homeowner's Association approving the fence design should it differ from the design previously approved by the Banbury HOA on May 13, 2022. Site Specific Condition #3: The applicant shall provide a revised landscape plan showing the inclusion of landscaping at the ends of the fencing to be approved by staff and two members of the Design Review Board prior to the issuance of a fence permit. Site Specific Condition 94: The applicant shall provide a tree inventory of all trees around the footprint of the proposed fence upon the submittal of a fence permit. Should the construction of the concrete fence/wall result in the death of any tree listed within the inventory, the applicant shall mitigate the loss of the trees in accordance with Eagle City Code. Site Specific Condition #5: The applicant shall provide a color sample of the wall to be approved by staff and two members of the Design Review Board prior to issuance of a fence permit. ACTION ITEM: DR-17-23 - Decorative Concrete Wall Adiacent to Chinden Boulevard — Leonard and Cara Butler: Leonard and Cara Butler are requesting design review approval to construct decorative concrete fence/wall adjacent to West Chinden Boulevard. The 1-acre site is located on the north side of West Chinden Boulevard approximately 530-feet east of the intersection of West Chinden Boulevard and South Locust Grove Road at 1401 West Hempstead Drive (Lot 11, Block 8, Banbury Subdivision No.6). ACTION ITEM: DR-14-23 - Common Area Landscaping within Cadenza Court Subdivision - MJV Properties, LLC: MJV Properties, LLC, represented by Jay Gibbons with South, Beck and Baird Landscape Architecture, is requesting design review approval for the common area landscaping within Cadenza Court Subdivision. The 1.37-acre site is located on the east side of South Parkinson Street approximately 35-feet south of the intersection of South Parkinson Street and East Syringa Street at 540 South Parkinson Street. (BAW) Grubb moves to approve DR-14-23 with the site specific conditions of approval with the following modifications. Site Specific Condition #10: The applicant shall provide revised drawings showing asphalt connectivity between end of the newly constructed sidewalks on Parkinson back to the asphalt roadway to be approved by staff. Site Specific Condition #11: The applicant shall provide a revised landscape plan showing some various options or alternatives to the current play amenities to reduce conflict with cars to be approved by staff and two members of Design Review Board. Note: In the drainage swell, we don't want to see sand. Seconded by Duperault. Discussion. Grubb amends the motion to amend Site Specific Condition #2: Remove "if' in the first sentence, the "ors" below it. the city approves removal of the trees and does not require any mitigation.
