MEETING MINUTES
June 13, 2023
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:32 p.m.
2. ROLL CALL: Present: PIKE, BAUN, RUSSELL. Absent: GINDLESPERGER, A
quorum is present.

A. Mayor and Council: Pike reports on the Eagle Sewer District meeting, reviewing statistics
and current flows for the District.
B. Department Supervisor: Planner III, Williams reports on flows in the Boise River, they
anticipate those dropping in the next few weeks. Director of Long -Range Planning and Projects,
Nichoel Baird Spencer, states that ACHD has indicated that they plan on going out for bid on the
State and Eagle Road intersection project in January of 2024. Mayor Pierce states that the City will
begin providing services at the senior center including Meals on Wheels beginning Thursday.

This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek
comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal
testimony on a public hearing matter, land use application, or comment on a pending application or proposal. Out
of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3)
minutes.

T. Development Agreement Associated with RZ-05-22 - Willowbrush Subdivision - Jon
Hastinas:Staff is requesting approval of the development agreement associated with the
annexation and rezone from RUT (Rural Urban Transition - Ada County Designation) to R-2-DA-
P (Residential with a development agreement - PUD) The 5.97-acre site is located at the southwest
corner of North Park Lane and West Beacon Light Road at 2795 North Park Lane. The City Council
approved the annexation and rezone on October 11, 2022. (MJW)
U. FP-11-22 - Final Plat for Kingfisher Cove Townhomes Subdivision - Don Newell: Don
Newell, represented by Macy Lui with The Land Group, Inc., is requesting final plat approval for
Kingfisher Cove Townhomes Subdivision, a 71-lot (63-buildable and 8-common) residential

V. Findings of Fact and Conclusions of Law for the Aanroval of A-12-22/RZ-14-22/PP-21-
22 - Annexation. Rezone. and Preliminary Plat for Cascade Springs Subdivision - Challeng_er
Development, Inc: Challenger Development, Inc., represented by Becky McKay with Engineering
Solutions, LLP, is requesting annexation, rezone from RUT (Rural -Urban Transition — Ada County
designation) to MU-DA (Mixed Use with a development agreement [in lieu of a PUD]) and R-6-
DA (Residential with a development agreement [in lieu of a PUD]), and preliminary plat approvals
for Cascade Springs Subdivision, a 470-lot (400-buildable, 70-common) residential subdivision.
The 138.99-acre site is located on the west side of North Palmer Lane approximately 80-feet south
of the intersection of West Nordic Drive and North Palmer Lane at 755 and 833 North Palmer Lane.

design review approval for two subdivision entry features with gates and four subdivision entry
monument signs for Rocking A Ranch Subdivision. The 171.9-acre site is located on the east side

building inspector services. The fee payable to the contractor shall not exceed $18.00 per inspection
and forty (40%) of any re -inspection fees collected. (SIN)
Y. Agreement for Senior Nutrition Meals between Metro Community Service dba: Metro
Meals on Wheels and the City of Eagle: An agreement between Metro Meals on Wheels (MOW)
and the City of Eagle to facilitate the use of the kitchen and dining room located at 312 E. State St
(city owned property) by MOW to provide senior meal services for the senior citizens of the Eagle

Russell states that a couple corrections to the agreement need to be made. The first is Item II.6
should read "...MOW will provide noon meals at the CITY on Monday, Tuesday and Thursday..."
adding Monday. Also in Item II. 7 changed to reflect three days a week (Monday, Tuesday and
Thursday). With those corrections she is in favor of the agreement.

B. CU-02-23 - Building Height Exception and Waivers of Front Setback and Accessory
Dwelling Unit Maximum Square Footage - Greg Andersen: Greg Anderson, represented
by Jay Gibbons, is requesting conditional use permit approval for an accessory building height
exception to 32-feet, 1.5-inches, waiver of the accessory dwelling unit (ADU) maximum
square footage, and a front setback waiver. The .7 -acre site is located on the northwest corner
of South Parkinson Street and East Dunyon Street at 2344 East Dunyon Street. (MJW)

3.6 Except for the limitations and allowances expressly set forth above and the other terms and conditions
of this Agreement, the Property can be developed and used consistent with the Mixed Use Land uses
allowed by Eagle City Code Section 8-2-3 "Official Schedule of District Regulations", existing at the
time a design review application or conditional use permit application (whatever the case may be) is
made for individual building use
The following uses are shown and "C" conditional uses under the MU zoning designation within the
Eagle City Code Section 8-2-3, shall be permitted uses on the Property:
• Restaurant (with drive-through)(Block 1, Lots 5 and 8 only)
3.6.1 Any building with a proposed drive-thru shall be designed in such a way as to compliment the entirety
of the development and shall include a minimum forty -eight -inch (48") berm (measured from the
centerline of the adjacent roadway) adjacent to the drive-thru lanes or a minimum forty -eight -inch
(48") grade separation (measured from the centerline of the adjacent roadway) to reduce the impact of
the vehicles utilizing the drive-thru lanes (i.e. vehicle headlights and vehicle cueing).

9. Provide a revised preliminary plat with a new plat note which states, "Lots shall not be reduced in size without prior
approval from the health authority." The revised preliminary plat shall be provided prior to submittal of a final plat
application.
10. Provide a revised preliminary plat with a new plat note which states, "Irrigation water has been provided by Ballentyne
Ditch Company In compliance with Idaho Code Section 31-3805(1)(b). Lots within the subdivision will be entitled to irrigation
water rights and/or shares and individual lots will remain subject to assessments from the applicable irrigation entities, to be
paid through fees assessed by the homeowner's association. The pressurized irrigation system shall be owned and
maintained by the Bronco Acres Subdivision Owner's Association, or its assigns." The revised preliminary plat shall be
provided prior to submittal of a final plat application.
11. Provide a revised preliminary plat with a new plat note which states, "This subdivision is subject to the terms of ACHD
License Agreement Instrument No. ." The applicant shall record the license agreement and reference
the Ada County instrument number on the plat note. The revised preliminary plat shall be provided prior to submittal of a
final plat application.
12. Provide a revised preliminary plat with a new plat note which states, "All lots shall have a blanket public utility, drainage,

Cross Access and Shared Parking
13 .Provide a separate recorded cross access agreement associated with vehicular
access for the convenience with fuel service site and Bronco Acres Subdivision.
The cross access agreement should be recorded and referenced in a plat note on
the final plat prior to the City Clerk signing the final plat. Provide a revised
preliminary plat with a new plat note referencing a cross access agreement
associated with the convenience store with fuel service site and Bronco Acres
Subdivision. The revised preliminary plat shall be provided prior to submittal of a
final plat application.
20. Provide a revised preliminary plat with a new plat note which allows for shared
parking between all the lots within the subdivision. The revised preliminary plat
shall be provided prior to submittal of a final plat application.

Planning Commission Recommendation
On April 17, 2023, the Eagle Planning and Zoning Commission
voted 5 to 0 to recommend approval of this application with
the conditions of development, site specific conditions of
approval, and standard conditions of approval provided on
page 18 of the Planning and Zoning Commission Findings of
Fact and Conclusions of Law.

Planning and Zoning Commission Recommendation
If the Council chooses to approve the application, the Planning and
Zoning Commission recommends the following staff recommended
conditions be modified as follows:

3.8 The commercial/retail/office buildings shall be constructed utilizing "Tha!r" ityle architecture
as identified within the Eagle Architecture and Site Design Book. As individual buildings go through
the design review process, Owner shall demonstrate the complimentary relationship, in terms of
building -height and style, to adjacent existing or proposed buildings within the development in
order to produce a compatible and desirable development.
4. Provide a revised preliminary plat containing a revised conceptual site plan showing Building "F
5" reconfigured to match the footprint of Building "A." The revised preliminary plat containing the
