PUMP No. 3 consists of 603.04-acres and is proposed to designate the land as Regional Open Space (ROS), pursuant to Eagle City Code Title 11A and in accordance with the amended and restated development agreement associated with the Spring Valley/ Valnova Development. A portion of the land (+/- 85-acres) is proposed for the future development of a City of Eagle shooting sports park. The 603.04-acre site is comprised of (2) parcels and is generally located on the east side of Willow Creek Road, approximately three and a half miles north of the intersection of Beacon Light Road and Willow Creek Road. All PUMP No. 2 Master plans, as approved or conditioned for approval, shall be used to evaluate and establish conditions of approval for any and all preliminary plat submittals within the Boundary of PUMP No. 2. 2. Comply with all requirements of the Idaho Transportation Department. All Planning Unit Master Plan maps shall be updated consistent with ITD approvals. 3. No grading shall occur on the site, until the applicant has received approval from the City in accordance with the Spring Valley Grading and Hillside Development Standards. 4. The City shall submit a Conditional Letter of Map Revision (CLOMR) application to be reviewed and approved by FEMA prior to any commencement of development within the Special Flood Hazard Area, as identified by the Flood Insurance Rate Map Panel No. 16001C0130J, effective June 19, 2020. 5. The applicant shall design the joint trench with fiber optic conduit at the time of preliminary plat submittal as is needed to ensure that all development within Spring Valley can be serviced with fiberoptic internet service as the service becomes available to the area. 18 17 A 01 6/22/2023 SITE SPECIFIC CONDITIONS OF APPROVAL: 6. The applicant shall submit the proposed regional sports park to the PPRC for their recommendation prior to the submittal of a design review application. 7. The applicant (the City of Eagle), or its assigns, shall receive Design Review approval of all facilities, signage, landscape, and common areas to ensure the proposed park will be designed and constructed to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity prior to the beginning of construction. 8. No development or permits shall be issued outside of the established boundary of PUMP No. 2 unless it is for an essential public facility (i.e. sewer, water, electrical, roads, or BLM access easements). These services shall remain subject to City approvals (i.e. grading, design review, and/or building permits). 9. The applicant (The City of Eagle) shall submit a subdivision application and obtain final plat approval prior to a Certificate of Completion being issued. 10. The applicant (The City of Eagle) shall connect to the City of Eagle Water system for domestic water and to the Eagle Sewer District system for sanitary sewer when central services are available to the site. When public land in the Eagle foothills was annexed in 2009 it became illegal to discharge firearms there because it was now inside the city limits. The law wasn't enforced until 2019 when so many people complained about unsafe shooting that Mayor Ridgeway started enforcing the law (one of the mayor's duties is to make sure the laws and ordinances of the city are enforced). Shooting was greatly reduced. When the present administration took office the Mayor and City Council violated their Oath of Office and didn't enforce the law ( Eagle City Oath: I solemnly swear that I will support..... the Laws and Ordinances of the City of Eagle.......". Duty of the Mayor: The Mayor shall "have the superintending control of all of the officers and affairs of the city, preserve order, and take care that the ordinances of the city, and the provisions of the Idaho state law governing municipal corporations are complied with. " ). Shooting started again. Much of it was without safe backgrounds and put people in danger. In the Eagle Foothills Recreation Survey in 2021, 86% of the people who took the survey (over 1000) said shooting should be restricted on the public land in the Eagle Foothills. In October 2021 the present administration ignored the survey takers and changed the firearms ordinance to make it legal to discharge firearms inside the City limits and on the public land in the Eagle Foothills. They did this without allowing public comments. The news media reported the change and target shooters began coming to Eagle from all over the Treasure Valley. Unsafe shooting on the Eagle public lands increased and became a bigger problem than ever. Hikers, equestrians, joggers, bike riders, dog walkers, families, etc. heard bullets flying over their heads and stopped using our public lands. Some people were narrowly missed by bullets. Nearby homes have been hit by bullets fired from the public lands. By violating their oaths and duties and then changing the city ordinance (without allowing public comments) the Mayor and City Council have created a dangerous and life threatening situation and their solution to the problem they caused is to spend a half a million dollars to build a shooting range on North Willow Creek Rd.. Create a problem and then spend $500,000 to fix it! Avimor is building a shooting range inside the city limits in a safe area and there will be no cost to the Eagle taxpayers.
