A resolution of the City of Eagle,Idaho identifying the amount of the Conservation Education
Program Assessment and providing an effective date.
WHEREAS,the development of existing agricultural lands,riparian areas, and natural open space
has an adverse effect direct, indirect,and cumulative on food supplies, aquifer recharge, soil erosion,
pollinators,wildlife habitat,and viewshed, among others;AND.
WHEREAS, in order to address these impacts,the City believes that developments should be
responsible to mitigate these impacts through a conservation-based program,or participation in the City
initiated Conservation and Education Program through the contribution of funds; AND
WHEREAS, as allowed in Eagle City Code 8-6-7(B)(4), Planned Unit Developments may choose
to make contributions to the City's Conservation and Education Program (CEP)as an acceptable method
of compliance for the required mitigation plan; AND
WHEREAS,the fees submitted shall be used for the City's Conservation and Education Program
and used to mitigate impacts associated with regional development;
NOW THEREFORE NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF EAGLE,IDAHO as follows:
Section 1•
Participating homeowner associations shall collect a Conservation Education Program Assessment("CEP
Assessment)of$5.00 per lot per month. Payments shall be submitted to the City of Eagle on an annual
basis.
Monies will be deposited into a fund to be used solely for the City's Conservation and Education
Program.
Section 2•
This fee shall be evaluated at a minimum every ten(10)years to ensure adequacy. Upon evaluation,the
Committee may recommend changes in the cost per lot collected to the City Council for consideration.
Section 3:
All fees submitted for the Conservation and Education Program shall be used only for CEP program
purposes.
1. Acquisition or conservation easements on agricultural lands to preserve food production, protect soils,
and provide for pollinator and wildlife habitat.
2. Acquisition of private lands or conservation easements(upland or riparian)to mitigate impacts to
wildlife and habitat loss.
3. Acquisition of private lands or conservation easements for public trails and access,associated with
conservation. Funds are not to be used to build and maintain trails unless there is an ecological
function of the trail.
4. Restoration,rehabilitation,or enhancement projects—natural resources(e.g. upland, riparian,aquatic
habitat). This includes plant materials, equipment, site prep,planning, and other support actions or
functions needed to complete the proposed project.
5. Management of invasive and noxious weed species, including fuels projects, associated with
protection of habitat(monitoring, control, and maintenance).
6. Educational materials,classes, equipment, and infrastructure associated with conservation-based
education and outreach.
7. Other activities as identified by the City Council relating to conservation and education endeavors.
8. CEP funds may be used to supplement or replace existing maintenance requirements of the city or its
partners, if associated with existing mitigation or conservation efforts.
Section 4: If at any time the City wishes to discontinue the collection and administration of the CEP
program, all funds collected shall be turned over to a non-profit organization specializing in conservation
programming for use within Eagle City limits as identified by the City Council.
Section 5 That this resolution shall be in full force and effect immediately upon its adoption and
approval.
