Independent Contract Instructor Agreement Between the City of Eagle and Levi Hewett: Independent Contract Instructor Agreement between the City of Eagle and Levi Hewett to teach Youth Developmental Sports Programs. Compensation shall be at a rate of 70%of the total revenue generated by registration.(LKB) D. Agreement for Independent Contract Instructor Between the City of Eaele and Valerie Schwers: Agreement for Independent Contract Instructor between the City of Eagle and Valerie Schwers to instruct pickleball classes. Leann Gilberg representing the Idaho Humane Society reviews the current state of the economy and the challenges with inflation they are currently facing. Baun arrives at 3:03 p.m. B. Ada County Prosecutor's Office,Jan Bennetts, Scott Bandy and Michael Guy. Mayor Pierce introduces the item. Jan Bennetts representing Ada County Prosecutor's Office reviews the history of the prosecution services provided by Ada County. A three-year analysis to determine the average of cases handled to arrive at the funding sought for this year. The requested amount for next fiscal year 2023-2024 is$444,531. General discussion. C. Ada County Sheriffs Office Budget Request FY 2023-2024. Mayor Pierce introduces the item. Chief Ryan Wilke and Sheriff Matt Clifford representing Ada County Sheriff's Office review services provided,the cost to provide services,including increases,in staff pay,overtime,personnel equipment and vehicle costs. The budgetary request for fiscal year 2023-2024 is presented,which will see a$506,000 increase from the current fiscal year. Powerpoint attached. Mayor moves to hear new business prior to item 6D. D. Discussion Regarding the Fiscal Year 2024-2028 Capital Plan. (NBS) Mayor Pierce introduces the item. 7. NEW BUSINESS: A. ACTIONITEM: Request for Reconsideration of the City Council Findings of Fact and Conclusions of Law,Conditions of Approval,and Order dated April 25,2023,for: A- 06-22/RZ-06-22 & ZOA-01-22—Annexation and Rezone with a Development Agreement and Zoning Ordinance Amendment to Establish Development Standards and Processes for the Avimor Planned Development Zoning District—Avimor Development,Spring Valley Livestock,and First American Title as dual beneficiary trust: The applicant is requesting an annexation and rezone from RP(Rural Preservation— Ada County Designation),RR(Rural Residential—Ada County designation), Multiple Use Zone(Boise County designation),and Al (Prime Agriculture—Gem County designation)to A-P-D-DA(Avimor Planned Development with a Development Agreement)and a zoning ordinance amendment to establish development standards and processes for the Avimor Planned Development Zoning District. The 17,522 acre site is anticipated to include up to 8,761 dwelling units and approximately 860,000 square feet of commercial and retail uses. This application includes a development agreement,economic impact report,master wastewater study,a municipal water and pressurized irrigation system master plan, a master drainage report,grading and hillside development standards,and a habitat management plan. The 17,522 acre site is located on both the east and west side of Highway 55,approximately 3 miles north of Dry Creek Road in Ada,Gem, and Boise Counties.—AND— Page 2 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-05-18-23min.docx A-14-22/RZ-19-22—Annexation and Rezone for Avimor Village One—Avimor Development: Avimor Development is requesting an annexation, rezone from PC (Planned Community—Ada County designation)to A-P-D(Avimor Planned Development)for Avimor Village One(portions of Avimor Subdivision No. 1, Avimor Subdivision Nos.4-11, and Avimor Townhomes North Subdivision). The approximately 657-acre site is already developed with a mix of uses and is located on the east side of Highway 55, approximately 3 miles north of Dry Creek Road in Ada County. (WEV) Mayor Pierce introduces the item. City Attorney, Victor Villegas provides an overview of the request before them today, and provides a recommendation that the Council continue this item to a Special City Council meeting on June 8, 2023. Villegas provides reasoning for this recommended action. The City Council approved the findings of fact and conclusions of law for these applications on April 25, 2023. Under Idaho law there is a 14-day period in which to seek reconsideration , and after that Idaho Code provides that there is a 60 day window wherein the Council can act on the request and should the Council not act the request would be deemed denied. In response to a public record request by the applicant the findings were provided on May 3, 2023, however it came to light that a previous version of the findings had been provided, rather than the version that was provided to the Council for consideration and posted on City's website. Once the matter came to light staff provided the applicant (Pickens) the findings of fact and conclusions of law that were actually approved on May 8, 2023. In all fairness to the applicant and their attorney, Villegas recommends they be allowed an additional 14 days to provide any comment or analysis prior to the Council taking action on the reconsideration request, and is therefore suggesting the item be continued to the special Council meeting on June 8, 2023. Terry Pickens, attorney for the applicant, states that she will be unavailable on June 8, 2023. Villegas states that the June 8 meeting is not a public hearing, and not one at which the applicant has the opportunity to be heard. It will be based upon anything written that has been presented, and at which the Council will consider the information and determine if the reconsideration will be granted or denied. Gindlesperger moves to continue this item to June 8, 2023 special meeting. Seconded by Russell. Director of Long-Range Planning and Projects reviews the most recent draft of the 2024-2028 Capital Plan and ranking of the projects. Discussion.
