Commissioner Deckers makes a motion to move Josh Herker into 5A as there will be no Public Works
Report. Seconded by Vice Chairman Ivie. ALL AYES...MOTION CARRIES.
3. APPROVAL OF MINUTES:

Commissioner Deckers moved to approve the minutes of February 16, 2023, as written. Seconded by

4. PUBLIC COMMENT:
Finley Scott, 912 N. Pimlico Dr. Eagle - High School Mountain Bike Club. Finley is representing the team
and wanted to provide an update on the memorial for Rylan Hoob.
Lee Scott, 912 N. Pimlico Dr. Eagle — Head Coach for the Eagle High School Mountain Bike Team.
Provided an update on the memorial proposal.
5. REPORTS:
A. Josh Herker, Events Coordinator — Provided an update on upcoming events.
B. Steve Noyes — Presented on Trails and Pathways.
C. Council Member Baun — Requested to present next month on the Sports Complex.

racing club being established again.

Commissioner Elwer makes a motion that the commission make a recommendotlon for approval of the
agreement for the Eagle Hills Racing Association. Seconded by Commissioner Lofas. ALL

ITD Meeting for HWY55 and Beacon Light Intersection
The tragic death of Rylan Hoob has focused the planning community on 55/Beacon Light and other routes to the Bike Park
In a meeting requested by Vince Trimboli of ITD, the conversation has been started and the concerns of the City have been made
clear. In attendance were:
Mayor Pierce, Nichoel Spenser, and myself, from the City of Eagle
Scott Koberg from Ada County Parks and Waterways
Multiple ACHD and ITD staff
Chris Miller involved with NICA
Changes made or expected at this time:
• Signs have been added to warn motorists that they may encounter bicycles in the area
• Southbound right turn radius into Becon Light will be increased and striped to better define it
• Brookside Lane will be rerouted
• 55 will be widened to 5-lanes in 2029 from Beacon Light to Dry Creek
Various positions stated regarding a crossing at Beacon Light:
• ITD "would prefer to do nothing more until it connects to other facilities"
• Simply adding a crossing could increase risk by encouraging crossing at the intersection on a bend
• Crossings there are mainly to access a "goat trail" that leads to Old Horseshoe Bend Road and the Bike Park. This access
could be blocked to discourage crossings
• While a bike lane along 55 heading south is not likely, the consensus is that encouraging the use of Floating Feather as a
crossing is the best short term solution
Short term solutions considered:
• Outreach and education for NICA teams who ride to the Bike Park to practice
Meeting with teams at the Bike Park and discuss routes
Create awareness tools for coaches to use in orientation
• Outreach to other bike organizations through social media and signage at the Bike Park
Long term solutions:
• Bike/ped facilities must be planned and built to make any intersection safer
• Municipalities must make their needs and goals clear to ITD and ACHD when safe routes are not otherwise possible — next meeting
• Development will drive actual construction of facilities

On 1/30/23, The Planning and Zoning Commission recommended denial of the application to annex into the City of Eagle.
On 3/28/23, Eagle City Council approved annexation of Avimor
• Avimor will have to comply with City Pathway code with alternative construction specifications for the the area.
• Required to provide 1-mile of public pathways per 200 homes

Cascade Springs Subdivision
The proposed project is a 470-lot (400-buildable, 70-common) residential subdivision. The 138.99-acre site is located on the west side of North
Palmer Lane approximately 80-feet south of the intersection of West Nordic Drive and North Palmer Lane.

This recommendation provides the following benefits for the residents of Cascade Springs and the citizens of Eagle:
• A proposed 3.9-miles of public pathways
• Many canal pathways with planned accesses for ditch riders
• Public parking accessed from Palmer Lane — Minimum 8 spaces
NOTE: on 2/8/23. The Middleton Mill Ditch Company Board reviewed the proposed project as it relates to trails,
pathways, and their easements. It is our understanding that the MMDC Board supports the concept described in this
recommendation and will consider final approval when Cascade Springs is in the design phase.

USER AGREEMENT BETWEEN THE CITY OF EAGLE
AND EAGLE HILLS RACING ASSOCIATION
THIS AGREEMENT is made and entered into the day of
20234- , by and between the City of Eagle, Idaho, an Idaho municipal corporation, hereinafter
called "City," and the Eagle Hills Racing Association, an Idaho non profit corporation, hereinafter
called "EHRA."
RECITALS
WHEREAS, City is an Idaho municipal corporation of the State of Idaho; and
WHEREAS, EHRA is an Idaho non profit corporation organized and operating exclusively
for the charitable purposes of conducting, supporting, and promoting radio -controlled vehicles as
a wholesome activity enhancing and enriching the quality of family life and the spirit of
competition for the common good; and
WHEREAS, EHRA and City desire to cooperate to improve recreation opportunities as
allowed by Idaho Code §50-303, by creating a facility which can be used by participants at all
levels, abilities, and age groups; and
WHEREAS, City owns that certain real property located at the Eagle Sports Complex and
more particularly described as a PAR #0146 @ W SIDE LOT 1 BLK 1 HIDDEN HOLLOW SUB
POR R/S 9645 IN EAGLE CITY #0125C #0171 S Ada County, Idaho, upon which EHRA will
operate a radio -controlled vehicle track and related facilities (the "Facility"); and
WHEREAS, the Parties desire to enter into a user agreement that would allow EHRA to
continue to use the Facility for a period of time upon the terms and conditions as set forth in this
Agreement; and
WHEREAS, the City niu�t now Trx*e addendum, the following doc'umcit will include
subsequent addendum and replace the original agreement made on February 28, 2017; and
NOW, THEREFORE, in consideration of the mutual agreements and covenants contained
herein, the parties agree as follows:
1. DEFINITIONS. The following terms as used in this Agreement shall have the
meanings as hereinafter set forth.
a. City means the City of Eagle, an Idaho municipal corporation, whose
address is P.O. Box 1520, Eagle, Idaho 83616.
b. EHRA, means Eagle Hills Racing Association, Inc., an Idaho non profit
corporation, whose address is 5601 E Deerflat Rd., Kuna, ID 83634

c. Premises. The specified parcel of land, consisting of approximately 1.2
acres located at the Ada/Eagle Sports Complex as set forth in Exhibit A attached hereto and
incorporated by reference. Additional space(s) for larger EHRA events may be granted by the City
and must be requested by EHRA in writing to the City. Operation of RC Cars shall be limited to
the cultivated racing surface and the flat areas immediately adiacent to the cultivated racing
surface. RC Car operation shall not be permitted on adiacent berms or established trails.
d. Project. Operation and maintenance of a Radio Controlled Vehicle track.
2. USE OF THE PREMISES. For and in consideration of the promises contained
herein, and other good and valuable consideration, the City hereby grants to EHRA a revocable
license to use the Premises for the purpose of the Project, as provided herein, and for no other
purposes. Except as otherwise provided in this Agreement, EHRA and its agents and employees
will only use the Premises for a purpose consistent with the permitted use described in this
Agreement. EHRA further agrees that it shall not permit or knowingly condone any illegal
activities to occur on said leased Premises. EHRA further covenants and agrees that it will keep
said Premises in a neat, sanitary and safe condition and that it will comply with all applicable laws,
ordinances, and rules and regulations imposed by the City on the Premises, including applicable
laws and regulations imposed by the State of Idaho, the United States of America, or any other
governmental authority (collectively, "governmental authorities"), applicable to the occupancy or
use of the Premises, and further including all rules, regulations and laws respecting fire and health
and safety measures. EHRA further agrees to secure all licenses and permits required by said
governmental authorities to operate a business on said Premises. Any use differing from that stated
in this Agreement shall not be made without the prior written consent of the City.
3. TERM OF LEASE. The term of this Agreement shall be five (5) years from the
initial contract date of April 1, 2023. (March 31, 2028)
4. CONSIDERATION. As rent for the use of the Premises, the City will receive
EHRA's voluntary services in coordinating, organizing and providing a safe recreational program
for the benefit of the City of Eagle, and the general public in accordance with the terms and
conditions set forth herein, including any liability insurance requirement from the City for such
events.
5. PROJECT SITE. EHRA acknowledges that it has inspected the Premises, knows
its condition, and understands that the same is licensed to EHRA without any representation or
warranties whatsoever and without obligation on the part of the City to make any alterations,
repairs, or additions thereto, unless specifically set forth in this Agreement. The City makes no
warranty or promise as to the condition, safety, usefulness, or habitability of the Premises and
EHRA accepts the Premises as is.
6. LIABILITY OF CITY. The City shall not be liable for any damage, loss or injury
to the person, property or effects of EHRA or of any agent, servant, employee or patron thereof,
suffered on, in or about the Premises, and EHRA agrees to indemnify, protect and save harmless
the City against any and all such damages, costs, attorneys' fees or expenses arising therefrom.

7. INSURANCE. EHRA covenants and agrees to carry public liability insurance in
the amounts of at least $500,000.00 or as otherwise required by law covering the Premises, which
insurance shall name the City as an additional insured and certificate holder. EHRA hereby agrees
to demonstrate, upon demand, to the City that such policies have been secured and such policies
are maintained in full force and effect for the City's protection for any volunteers working on the
Premises and for any events held on the Premises. The policy of insurance must include coverage
for all activities performed by EHRA and shall specifically insure the hold harmless provisions of
this Agreement. The City shall be named additional insured and the coverage afforded will be
primary with respect to activities provided. Showing the City as a certificate holder is not the same
as naming the City as an additional insured and is not an acceptable substitute. If equivalent
coverages are provided and the form is approved by the City, EHRA may provide a general liability
policy in a form different from that described above.
8. MAINTENANCE OF THE PREMISES; DUTY TO INSPECT.
a. Maintenance of the Premises. EHRA shall have the right to improve the
Premises and to operate a Radio Controlled Vehicle track, including operation and maintenance of
structures incidental to operating such a track, selling refreshments and equipment, and providing
for seating and parking for patrons and spectators, at its own expense. EHRA agrees and covenants
to obtain all necessary permits and licenses for the construction and operation of such track and
related activities, and to maintain the same in compliance with all applicable federal, state, county
and local laws and ordinances. The City further agrees to cooperate with EHRA in obtaining all
necessary permits and licenses for the construction of the improvements.
b. Duty to Inspect. EHRA shall be under a duty throughout the duration of
the Agreement to reasonably inspect the Project for dangerous conditions and/or hazards, hidden
or otherwise, and to make reasonable efforts to repair any discovered dangerous condition or
hazard or immediately make such condition or hazards obvious to persons who might encounter
the same. EHRA shall clean up all litter associated with its use of the Premises, including all
facilities, and structures. Any damage to the Premises by EHRA or its invitees shall be the
responsibility of EHRA.
c. EHRA Responsibilities: Treasure Valley Radio Control Racers, shall have the
following maintenance obligations at the premises during the Agreement term:
i. Remove all trash from the identified trash and recycle cans after every
event. Treasure Valley Radio Control Racers, may utilize the dumpster onsite;
ii. Notify the City immediately of any vandalism or maintenance issues.
9. CONSTRUCTION. Prior to any construction, alteration, replacement, removal,
or major repair of any improvements, EHRA shall submit to the City plans and specifications

which describe the proposed activity and comply with Eagle City Code and other applicable laws.
Construction shall not proceed until the City has approved those plans and specifications in writing
as required by Eagle City Code and other applicable laws including procurement of legally
required performance and payment bonds. The City's consent and approval shall not be required
for any routine maintenance or repair of improvements made by EHRA pursuant to its obligation
to maintain the Property in good order and that does not result in construction, alteration,
replacement, or major repair of any improvements on the Premises. EHRA shall be responsible for
paying for and obtaining all necessary permits and fees for User Group initiated improvements.
a. New Improvement Projects. Improvement projects shall be reviewed and
approved by the City prior to commencement of work. Project requests shall
be submitted in writing. The City shall approve, deny, or approve with
conditions within 30 working days of receipt of request;
b. Permanent Signage. All signage and must be approved by the City. It must
be consistent with park best practices in style, shape, materials, mounting methods and
locations. Project requests shall be submitted in writing. The City shall approve, deny, or
approve with conditions within 30 working days of receipt of request.
c. Temporary Signage and Postings. All temporary event and informational
postings, signs and flyers must be approved by the City, and must be consistent with park
best practices in style, shape, materials, posting methods and locations. Approval may be
obtained through email to the Trails Superintendent. Display of such signage will be
limited to the dav(s) of each event unless otherwise approved in writing by the City.
10. SURRENDER UPON EXPIRATION OR TERMINATION. Upon expiration
or termination of this Agreement, TVRCR EHRA shall surrender possession of the Project to the
City in the condition of the Premises at such expiration date, including any permanent
improvements, including the track, which EHRA placed or constructed on the Project. Such
permanent improvements shall not be removed prior to such expiration or termination, and shall
revert to ownership and control of the City upon such expiration or termination.
11. ASSIGNMENT, SUBLEASE OR TRANSFER. This Agreement may not be
assigned, transferred, or sublet in whole or in part by either of the parties hereto without the prior
express written consent of the other party, and nothing contained herein shall create any
relationship, contractual or otherwise, with, or any rights in favor of, any third party.
12. NOTICE. Whenever in the provisions of this Agreement, notice is required to be
given by either party herein, it shall not be construed to mean personal notice, but it must be given
in writing by registered or certified mail, postage prepaid, return receipt requested, or overnight
UPS, Fed Ex, or other like service to the party being notified at the address below, or such other
address as either party may designate in writing:

13. APPLICABLE LAWS AND REGULATIONS. EHRA shall comply with all
applicable federal, State and local laws and regulations, including but not limited to, those
regarding construction, operation, maintenance, health, safety, food service, water supply,
sanitation, use of pesticides, and licenses or permits to do business. EHRA shall certify that all
water and sanitary system modifications made on the Project comply with all federal, State, and
local laws and regulations.
14. ATTORNEY FEES. In the event that either party is required to resort to or seek
legal assistance or proceedings or to incur expenses of any kind or nature in the enforcement of its
rights hereunder, then and in that event, attorneys' fees shall be awarded to the prevailing party.
15. POSSESSION. EHRA is entitled to continued possession of the Premises during
the term of this Agreement, provided that EHRA shall not unlawfully exclude any person from
participation or use of the Premises, and provided further that TVCRCEHRA's possession of the
Premises is subject to the termination provision set forth in paragraph 22 of this Agreement.
16. ENCUMBRANCES. EHRA shall not encumber, mortgage or allow liens to attach
to said Premises.
17. MODIFICATION. This Agreement may be modified or amended only by a
writing duly executed by both parties.
18. CHOICE OF LAW. This Agreement and its performance shall be construed in
accordance with and governed by the laws of the State of Idaho.
19. HEIRS AND ASSIGNS. This Agreement and the terms and conditions hereof
shall apply to and are binding upon the heirs, executors, administrators and assigns of the parties
hereto.
20. MERGER AND INTEGRATION. This writing embodies the whole agreement
of the parties. There are no promises, terms, conditions or obligations other than those contained
in this Agreement. All previous and contemporaneous communications, representations or
agreements, either verbal or written, between the parties are superseded by this Agreement.
21. PERFORMANCE. The failure of a party hereto to insist upon strict performance
or observation of the Agreement shall not be a waiver of any breach or of any terms or conditions
of the Agreement by the other party.
22. TERMINATION. This Agreement may be terminated by either party or upon a
material breach of this Agreement and failure to cure such material breach after sixty (60) days
written notice. The City maintains the right to terminate this Agreement without cause on sixty

(60) days' notice. In any such event, EHRA shall be required to remove all personal property and
otherwise vacate the Premises on or before the expiration of the sixty (60) day period. The City
may immediately re-enter and take possession of the Premises with or without process of law. In
the event of re-entry by the City, its agents or employees, EHRA shall be liable for any damages,
costs, or fees incurred by the City in recovering the Premises.
23. CONSTRUCTION AND SEVERABILITY. If any part of this Agreement is held
to be invalid or unenforceable, such holding will not affect the validity or enforceability of any
other part of this Agreement so long as the remainder of the Agreement is reasonably capable of
completion.
24. MISCELLANEOUS PROVISIONS.
a. No later than April 1 annually EHRA shall provide a schedule of all races
and practice times when the Project facilities will be used to the City's Parks and Recreation
Department and the City Clerk's office.
b. Any or all concession stands must be permitted by the City consistent with
Eagle City code and approved in advance and in writing by the City.
d. EHRA understands and agrees the Premises are public property, open to the
public and may not be closed to the public except during scheduled events and/or construction or
maintenance periods without written permission of the City.
e. Event Noise Levels.
Noise levels generated by EHRA events shall not exceed 85 decibels or higher for a
sustained period of 15 seconds or longer as measured by the City of Eagle Police
Department from the general area of the following coordinates:
• 43°42'41.71"N / 116°18'55.52"W
• 43°42'37.58"N / 116°18'54.60"W
• 43°42'33.24"N / 116°18'51.72"W
f. Hours of Operation. All EHRA events shall occur between dusk and dawn
unless approved by the City of Eagle.

2. Construction of ADA Access Elements to Drivers Tower. EHRA shall
finance and construct improvements to the drivers tower as outlined in black in
EXHIBIT B attached hereto and incorporated by reference. These
improvements shall be completed by April 1, 2024. Any modifications to these
plans shall be approved by the City Building Department.

STAFF UPDATE: A lower cost alternative to the following design is being explored. It would
employ a lower deck with a shorter ramp. It would also allow ADA users to access it more
quickly because it will be closer to the pits.
I have consulted with the Building Authority and the City Attorney, and they will advise as to the
viability of this alternative.

Based upon our site review and the documents provided by the City, the following probable construction costs
have been projected for the elements necessary to provide ADA access to the existing facility through the
construction of a ramp from the existing velodrome fill. Due to the length from the existing platform to the fill
location, the installation will require columns along the ramp to reduce the span lengths. The first span adjacent
to the existing platform is sized to accommodate a possible storage area below. A ramp width of 5-feet is
proposed between the storage area and the fill. The concept also includes a platform extension on the north
side to allow additional accessible area.
Model drawings are attached to reflect the proposed concept as described above. The probable construction
costs are summarized below with a more detailed breakdown included with this memo. Costs associated with
permit fees or electrical improvements necessary for the storage enclosure option are not included.

• ADA Landing (North Side extension) $ 4,150
• Storage Room Enclosure $ 4 228
TOTAL PROBABLE COST $24,240
The costs are separated so a direct comparison can be made between the electrical lift option and the access
ramp option. The extension on the north side will be required for either option. The storage room enclosure is
an option that the City may elect to complete, but not necessary to provide an access ramp.
