AGREEMENT
This Second Amendment is entered into 25 day - 2023 by and
between the City of Eagle (hereinafter referred to as "Eagle'% and Treasure Valley Tropical
Sno Dealership LLC. Dba: The Creamery Idaho, owner August Henning, (hereinafter referred to
as "Lessee"), for the purpose of amending and extending the Municipal P a r k
Vendor Lease Agreement dated April 28,2021 (the "Lease Agreement").
WHEREAS, on April 28,2021, the City of Eagle entered into the Park Vendor Lease
Agreement with Tropical Sno Dealership LLC to sell sno-cones and other food concessions at
Merrill Park; and
WHEREAS, the City of Eagle and the operator of Treasure Valley Tropical Sno
Dealership LLC, desire to extend the term of Service Agreement for an additional one (1)
year term; and
WHEREAS Paragraph 1 of the Vendor Lease Agreement provides that the term of the
Lease Agreement will be in the form of an addendum to the Agreement.
NOW, THEREFORE, in consideration of the foregoing, t h e C i t y o f E a g l e a n d
Treasure Valley Tropical Sno Dealership LLC amend the Vendor Lease
Agreement dated April 28, 2021 , as follows:
1. Paragraph 1 of the Vendor Lease Agreement is herby amended to read as follows:
The term of this Lease Agreement shall be for May 1,2023,to October 2,2023 ("Summer
Months"). Should the Lessee wish to be considered as a Park Vendor at Merrill Park in 2024,
Lessee shall be required to go through the City of Eagle's Park Vendor Bidding process.
2. Paragraph 2 of the Vendor Lease Agreement shall be stricken.

Except as modified by this Second Amendment, the original Park Vendor Lease Agreement
between the City of Eagle and Treasure Valley Tropical Sno Dealership LLC.Dba:The Creamery
Idaho, owner Jacob Velasquez, dated April 28, 2021, shall remain in full force and effect.
