WHEREAS, Travis Kuntz, requested a vacation to the amended final plat of Ringo Ridge Estates Subdivision No.1 to vacate the entirety of the rear yard public utilities, lot drainage, and pressurized irrigation easement, located within Lot 5, Block 4, (Amended Plat of Ringo Ridge Estates Subdivision No.1) (Exhibit"A"); and WHEREAS, James Hoover, requested a vacation to the amended final plat of Ringo Ridge Estates Subdivision No.1 to vacate the entirety of the rear yard public utilities, lot drainage, and pressurized irrigation easement, located within Lot 4, Block 4, (Amended Plat of Ringo Ridge Estates Subdivision No.1) (Exhibit"B"); and WHEREAS, Juan Morales, requested a vacation to the amended final plat of Ringo Ridge Estates Subdivision No,1 to vacate the entirety of the rear yard public utilities, lot drainage, and pressurized irrigation easement, located within Lot 3, Block 4, (Amended Plat of Ringo Ridge Estates Subdivision No.1)(Exhibit "C"); and WHEREAS, On December 5, 2022, the Eagle Planning and Zoning Commission recommended approval of the vacation (VAC-03-22),to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on January 27, 2023, arid February 3, 2023; and WHEREAS, On February 14, 2023, the City Council held a public hearing on the proposed vacation (VAC-03-22), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, -Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the entirety of the rear yard public utilities, lot drainage, and pressurized irrigation easement, located within Lots 3, 4, and 5, Block 4, Amended Plat of RtTIVO Ridge Estates Subdivision No.1, as considered, heard and approved by the Council at its February 14, 2023,public hearing for application number VAC-03-22 and as shown on the attachments hereto.
