ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, and SMITH. Absent: JOHNSON. A quorum is present. ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of November 19, 2018. B. Findings of Fact & Conclusions of Law for A-06-18/RZ-11-18/PP/FP-01-18 — Endless Views Subdivision — Thomas Turgeon and Dawn Kelly: Thomas Turgeon and Dawn Kelly are requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R -E -DA (Residential Estates with a development agreement), and combined preliminary and final plat approvals for Endless Views Subdivision, a 2 -lot residential subdivision. The 5 -acre site is located on the east side of North Meridian Road approximately 760 -feet south of the intersection of North Meridian Road and West Beacon Light Road at 2700 North Meridian Road. Smith moves to accept the consent agenda as delivered. Seconded by McLaughlin. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE PUBLIC HEARINGS: Guerber moves to reorganize the agenda: under Public Hearings, removing item 5A from the agenda, moving item 5C to become 5A, and item 5B to remain 5B. ACTION ITEM: ZOA-02-18 — Zoning Ordinance Amendment — City of Eagle: An ordinance of the City of Eagle, Ada County Idaho, amending Title 8, Chapter 3, Section 5, Paragraph J "Oil and Gas Extraction", Item 8 "Waiver" and amending Paragraph K "Oil and Gas Post -extraction", Item 7 "Waiver"; providing a severability clause; and providing an effective date. The City of Eagle is conducting public hearings to consider amending the waiver sections relating to oil and gas extraction and post -extraction activities within City limits. City Attorney, Cherese McLain, provides an overview of the application and introduces City Engineer, Phil Bandy. McLain responds to questions from the Commission. City Engineer, Phil Bandy, HECO Engineers, 1079 Ancona Avenue. Bandy provides an overview of the application. McLain responds to questions from the Commission Chairman Wright opens the Public Hearing. Lee Turner, 1399 West Newfield Drive. Turner expresses disappointment that the agenda was changed to allow this item became the first Public Hearing and states that she knows others who were planning to attend later in the meeting. Turner expresses concern with wording used by the City Engineer. Turner responds to comments from the Commission. City Planner, Mike Williams, responds to questions from the Commission. Shelly Brock, 8770 West Chaparral Road. Brock provides the Commission with a letter from Brett Smith and provides a packet of information regarding various violations relating to oil and/or gas extraction that have occurred nationally. Brock provides an overview of information included in the packet, and states her appreciation for, and support of, the ordinance amendment. Brock responds to comments and questions from the Commission. City Engineer, Phil Bandy, provides clarification regarding his earlier comments. City Attorney, Cherese McLain, responds to questions from the Commission. Chairman Wright closes the Public hearing. General discussion amongst the Commission. Smith moves to recommend for approval item 5A ZOA-02-18 — Zoning Ordinance Amendment — City of Eagle. Seconded by Wright. ALL AYES... MOTION CARRIES. B. ACTION ITEM: A-05-18/RZ-08-18 & PP -07-18 — Hollyhock Estates Subdivision — Jerron Langston: Jerron Langston, represented by Marty Camberlango, is requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R -2 -DA (Residential with a development agreement), and preliminary plat approvals for Hollyhock Estates Subdivision, an 8 -lot (7 -buildable, 1 -common) residential subdivision. The 6.72 -acre site is located on the east side of North Lanewood Road approximately 770 -feet north of the intersection of West Floating Feather Road and North Lanewood Road at 2220 North Lanewood Road. Victor Villegas, 141 East Carlton Avenue, Meridian, Idaho. The applicant's representative informs staff and the Commission that the applicant information provided in the staff report is incorrect, and states that the applicant is Lane Ranstrom. City Planner, Mike Williams, informs the Commission that Jerron Langston was listed as the applicant on the application, which is why the packet provided to the Commission lists Langston as the applicant. Williams provides a detailed overview of the application. Williams responds to questions from the Commission. Chairman Wright opens the Public Hearing. Elaine Welk, 2144 North Foudy Avenue. Welk inquires about gas lines running through the property, density calculations, zoning, and maximum building heights. City Planner, Mike Williams, provides information regarding input from andeavor, the owner the gas pipeline in the area. Villegas, the applicant's representative, provides rebuttal and addresses concerns raised during the Public Hearing. Villegas responds to questions from the Commission. City Planner, Mike Williams, provides an alternative condition regarding temporary access to the site. Chairman Wright closes the Public Hearing. General discussion amongst the Commission. Smith moves to recommend for approval item A-05-18/RZ-08-18 & PP -07-18 with the following change that has been recommended by Mr. Williams regarding the status of Venetian Drive and all surrounding conversation. Seconded by Guerber. General discussion amongst the Commission. Smith: With a modification of site specific conditions #17. Williams: Site Specific Condition #17: "North Venetian Drive, located within Lanewood Church Subdivision shall be completed and accepted by ACHD prior to"... you will strike the remaining sentence, and from that point forward it will state: "prior to the City Clerk signing the final plat."
