The above -entitled design review application came before the Eagle Design Review Board for their action
on November 8, 2018. The Eagle Design Review Board having heard and taken oral and written testimony,
and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Cafe Rio, represented by Terry Loock with Cafe Rio, is requesting design review approval to
construct two building wall signs and a monument sign tenant panel for Cafe Rio within the Eagle
Pavilion Shopping Center. The 0.92 -acre site is located at the northeast corner of State Highway 44
and South Eagle Road at 396 South Eagle Road, on Lot 01, Block 01, Eagle Pavilion Subdivision.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on September 27, 2018.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On October 13, 1998, the Eagle City Council approved a rezone and preliminary plat for the Eagle
Pavilion Subdivision (RZ-05-98/PP-04-98).
On October 28, 1998, the Eagle City Council approved a development agreement for the Eagle Pavilion
Subdivision (RZ-05-98).
On November 24, 1998, the Eagle City Council approved a final plat for the Eagle Pavilion Subdivision
(FP -11-98).
On January 12, 1999, the Eagle City Council approved a design review application for the master sign
plan for Eagle Pavilion Shopping Center (DR -43-98).
On August 3, 1999, the Eagle City Council approved a design review application for a multi -tenant
retail building and the common area landscape within the Eagle Pavilion Subdivision (DR -24-98).
On January 11, 2000, the Eagle City Council approved a design review application for a modification
to the Master Sign Plan to construct a monument sign on State Highway 44 within the Eagle Pavilion
Subdivision (DR-43-98MOD).
On February 8, 2000, the Eagle City Council approved a design review application for a Monument
Sign located on State Highway 44 for Pizza Hut within the Eagle Pavilion Subdivision (DR-25-
99MOD).
On May 9, 2000, the Eagle City Council approved a design review application for a 2,900 -square foot
retail building within Eagle Pavilion Subdivision (DR -12-00).
On July 13, 2004, the Eagle City Council approved a design review application for the modification to

the existing Pizza Hut monument sign to include a second tenant sign. (DR -49-04)
On July 21, 2011, the Eagle City Council approved a design review application to convert a 2,900 -
square foot retail building into a restaurant building within Eagle Pavilion Subdivision (DR -12-00
MOD).
On August 11, 2011, the Eagle City Council approved a design review application for two building
wall signs and monument sign tenant panel for Aspen Leaf Yogurt within Eagle Pavilion Subdivision
(DR -24-11).

STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
• Protect and enhance the small-town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
• Eagle City Code Section 8 -2A -2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment for
residents and visitors alike. The architectural designs, materials, and graphics set forth in this article
are compiled to create a theme unique to the area called "Eagle Architecture".
• Eagle City Code Section 8-2A-6(A)(4)(e)
The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to ensure that any such proposals do
not detract from the function of, or design of, buildings, structures, surrounding properties,
neighborhoods, or streets.
• Eagle City Code Section 8 -2A -8(B) Definitions:
ILLUMINATION, PUNCH THROUGH LETTER: A sign with letters, logos or other sign graphics
that are opaque (no light is permitted to shine through them), that are attached to a sign cabinet or
structure that allows light to shine through it. The distance between the letters, logos, or other sign
graphics and the background (surface of the cabinet or structure) is a maximum of one-half inch
(1/,"). The light source is concealed within the cabinet or structure and is not visible except that
illumination from the light source shines through transparent (nonopaque) background material for
no more than one-fourth inch (I/4") around the letters, logo, and other graphics, creating a halo
effect.
• Eagle City Code Section 8-2A-8(C)(1)(a)(c)(e) Sign Provisions and Requirements:
1. Wall Signs (Flat and Perpendicular):
a. A single -tenant building shall be allowed a maximum of three (3) wall signs, provided that
each sign is placed on a different side of the building.

c. For a single -tenant building the total sign area of any wall sign shall not exceed ten percent
(10%) of the area of the building face to which it is attached, except that any wall sign that is
visible from a state highway shall be permitted a maximum of twenty percent (20%) of the
area of the building face to which it is attached.
e. The sign area, per side, of any perpendicular wall sign shall not exceed ten percent (10%) of
the area of the building face to which it is attached.
• Eagle City Code Section 8-2A-8(C)(13)(g) Sign Illumination:
g. All types of internal illumination is prohibited, except for automated signs and drive-
through/drive-up service menu board signs as regulated in this article.
C. DISCUSSION:
• The applicant is requesting design review approval to construct two building wall signs and a new
monument sign tenant panel for Cafe Rio. The building wall signs are proposed to be located on
the south and west building elevations. The building wall sign elevations show that the "Cafe Rio"
letters are to be internally illuminated and halo illuminated. Pursuant to Eagle City Code Section
8-2A-8(C)(13)(g), all types of internal illumination is prohibited, except for automated signs and
drive-through/drive-up service menu board signs. The applicant should be required to provide
revised elevations of the building wall signs showing that the "Cafe Rio" lettering is not internally
illuminated. The revised elevations should be reviewed and approved by staff and two members of
the Design Review Board prior to the issuance of a sign permit.
The "Mexican Grill" lettering and graphics are proposed to be illuminated by punch through letters.
The elevation plans do not show an opaque finish on the front of the letters or graphics. Eagle City
Code Section 8 -2A -8(B) Illumination, Punch Through Letter states, a sign with letters, logos or
other sign graphics that are opaque (no light is permitted to shine through them), that are attached
to a sign cabinet or structure that allows light to shine through it. The distance between the letters,
logos, or other sign graphics and the background (surface of the cabinet or structure) is a maximum
of one-half inch (I/?"). The light source is concealed within the cabinet or structure and is not visible

through letters constructed in compliance with Eagle City Code 8 -2A -8(B) Illumination, Punch
Through Letter. The revised elevation plans should be reviewed and approved by staff and two
members of the Design Review Board prior to the issuance of a sign permit.
• On August 11, 2011, the Eagle City Council approved a design review application for two building
wall signs and a monument sign tenant panel for Aspen Leaf Yogurt within Eagle Pavilion
Shopping Center (DR -24-11). The monument sign tenant panel for Aspen Leaf Yogurt was
approved with a black background color to match the existing Pizza Hut monument sign tenant
panel. The applicant for the Cafe Rio signage is proposing the background color of the monument
sign tenant panel for Cafe Rio to be red and the lettering to be white. Pursuant to past action by the
Design Review Board and the City Council, the background color of monument sign tenant panels
has been required to match. The applicant should be required to provide a revised elevation showing
the background color of the monument sign tenant panel to be black to match the black background
of the Pizza Hut monument sign tenant panel. The revised elevation should be reviewed and
approved by staff prior to the issuance of a sign permit.

• Staff defers comment regarding design and color of all proposed signs to the Design Review Board.
STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date staff recommends approval of the requested design
review application with the site specific conditions of approval and the standard conditions of approval
provided within the staff report.
PUBLIC MEETING OF THE BOARD:
A. A meeting to consider the application was held before the Design Review Board on November 8, 2018,
at which time the Board made their decision.
B. Oral testimony in opposition to the application was presented to the Design Review Board by no one.
C. Oral testimony in favor of the application was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DELIBERATION: (Granicus time 1:14:09)
Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that:
• The Board is in favor of the applicant's revised sign elevation, date stamped by the City on November
6, 2018, which addressed site specific conditions for punch through letters constructed pursuant to
Eagle City Code and wall signs that are not internally illuminated.
• The Board determined the red background proposed for the monument sign tenant panel was
appropriate, however, the Board would like the applicant to consider muting the red background color
to complement the color of the proposed stucco on the building.
BOARD DECISION:
The Board voted 6 to 0 (Grubb absent) to recommend approval of DR -53-18 for a design review
application to construct two building wall signs and a monument sign tenant panel for Cafe Rio for Terry
Loock with Cafd Rio, with the following staff recommended site specific conditions of approval and
standard conditions of approval with text shown with underline to be added by the Board and text shown
with strikethrough to be deleted by the Board.

4. A sign permit is required prior to the installation of any signs on this site.
5. Upon completion of the building wall and monument sign tenant panel, the applicant shall be required
to request a site inspection to be completed by the Planning and Zoning Department. Upon verification
that the building wall signs and monument sign tenant panel have been completed in compliance with
the approved plans, a certificate of completion will be issued.
6. The red background color of the monument sign tenant panel. provided on the revised elevation plans
date stamped bv the City on November 6. 2018. is approved. Should the applicant wish to mute the red
background color to better complement the red shown on the building elevations. the color shall be
reviewed and approved bv staff and one member of the Design Review Board prior to the issuance of
a sign permit.
NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of
Approval contained herein the Site Specific Condition of Approval shall control.
STANDARD CONDITIONS OF APPROVAL:
1. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the
Commission and/or Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and/or the City Council for review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those required
by the above conditions, will require submittal of an application for modification and approval of that
application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use
is sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR -53-18) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,

concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of
Eagle City Code 8-2A-13(B)(2)(i), and has concluded that the proposed design review:
i. The building wall signs and monument sign tenant panel will he harmonious with the architectural
design of the building and will not cover nor detract from desirable architectural features.
