Minutes - 2023 - City Council - 02/28/2023 - Regular EAGLE CITY COUNCIL MEETING MINUTES February 28, 2023 1. CALL TO ORDER: Mayor Pierce called the meeting to order at 5:30 p.m. 2. ROLL CALL: Present - GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Led by Mayor Pierce. 4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests. None B. Mayor or City Council requests. None 5. REPORTS: A. Mayor and Council Reports. None B. Department Reports. Steve Noyes, Trails and Pathway Superintendent, provided a quick update on the TRL CMP-11 project. This project is located along the north channel of the Boise River behind 2755 E State Street, Eagle. The project is 946 feet in total, increased from an earlier plan of 769 feet. A revised estimate for mitigation of this pathway went from $173,000 to $272,243. The City's net cost of the new amount is estimated to be $116,359. Noyes stated the City has requested and received annual extensions for these repairs and has recently been granted a three-year extension from now. Noyes is pursuing additional grant funds to assist with the City's required match. It is the hope that new bids in three years will be more competitive. Further discussion regarding pathway construction standards and materials. C. Eagle Police Department. None D. City Attorney Report. None 6. PUBLIC COMMENT 1: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, land use application, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Laurie Ruddick, 536 E Mango Dr, Eagle, ID. Ms. Ruddick discussed the regional sports complex and the need for more pickleball courts locally. She requested the City consider adding more courts at the sports complex. Baun requested she continue to share any additional ideas or information as they move forward with plans for the sports complex. Burk Mantel, 4690 N Hartley Rd, Eagle, ID. Mr. Mantel expressed his concern for the safety of people operating motor vehicles in the foothills north of his home. He asked if it would be possible to close the roads during the winter for safety as well as for the environmental damage that happens to the area during the winter when people are off-roading. Baun explained that because the property is Bureau of Land Management land, our officers cannot enforce or ticket those who are not following the rules. This issue is being discussed as the City is working through planning for the foothills with the Bureau of Land Management. Findings of Fact and Conclusions of Law for the Approval of RZ-04-18 MOD2 - Madera Development, Inc.: Madera Development, Inc., represented by Jon Breckon and Mary Wall with Breckon Land Design, is requesting a modification to the rezone development agreement associated with the approved Bellemeade Subdivision. The request is to modify the front yard setback identified in the previously approved Condition of Development 3.4. The 10.99-acre site is located on the north side of West Flint drive at the northeast corner of West Flint Drive and North Park Lane at 3850 West Flint Drive and 312 North Park Lane. (MJW) G. Findings of Fact and Conclusions of Law for the Approval of CU-18-22 Waiver of Rear Setback Mark and Carissa Summers: Mark and Carissa Summers are requesting conditional use permit approval for a waiver to reduce the rear setback from 25-feet to 10-feet on Lot 19, Block 9, within Riversend Subdivision No. 2. The .40-acre site is located on the south side of East Riversong Drive approximately 50-feet north of the intersection of East Garden Brook Drive and East Riversong Drive at 1225 East Riversong Drive. Findings of Fact and Conclusions of Law for the Approval of PP-14-22 - Stadium View Center Subdivision - Margie and Jerron Porchia: Margie and Jerron Porchia are requesting preliminary plat approval for Stadium View Center Subdivision, a 10-lot (8-buildable [5-residential, 2-commercial], 2common) mixed use subdivision. The 2.56- acre site is located on the west side of North Horseshoe Bend Road approximately 130- feet south of intersection of West Bonita Hills Boulevard and North Horseshoe Bend Road at 10201 North Horseshoe Bend Road. Findings of Fact and Conclusions of Law for the Approval of A-13-22/RZ-17-22 - Annexation and Rezone from RR to R-E-DA - Colleen Marks: Colleen Marks is requesting an annexation with rezone from RR (Rural Residential - Ada County designation)to R-E-DA(Residential-Estates with a development agreement). The 1.00- acre site is located on the east side of North Hawk Wing Lane approximately 300-feet north of the intersection of West Homer Road and North Hawk Wing Lane at 4940 North Hawk Wing Lane. DR-78-22 - Common Area Landscaping and Amenities within Farmstead Subdivision -WH Eagle 80, LLC: WH Eagle 80, LLC, represented by Dave Yorgason, is requesting design review approval of the common area landscaping and amenities within Farmstead Subdivision. The 80.23-acre site is located on the north side of West Floating Feather Road between North Linder Road and North Park Lane. (BAW) L. DR-80-22 - Common Area Landscaping within Valnova Subdivision No. 1 - GWC Capital, LLC: GWC Capital, LLC represented by Eric Langvardt with Langvardt Design Group, is requesting design review approval for the common area landscaping within Valnova Subdivision No. 1 (fka Lot 17, Block 1, Spring Valley Subdivision No. 1). CU-14-22 - Conditional Use Permit for Eagle Fire Station No. 2 - Eagle Fire Protection District: Eagle Fire Protection District, represented by Tamara Thompson with The Land Group, Inc., is requesting conditional use permit approval for a new emergency services facility, waiver of minimum lot coverage, and a change of nonconforming use based on the size of property. The 4.40-acre site is located on the west side of North Horseshoe Bend Road approximately 500-feet south Beacon Light Road at 12655 North Horseshoe Bend Road. (MJV) Tamara Thompson, The Land Group, 462 E Shore Dr, Eagle, ID. The Land Group represents Eagle Fire Station #2. They presented site plans of the property, it's location and the area zoning. The property will be developed for emergency services for an Eagle Fire Department and Bureau of Land Management joint facility and a future administrative office for the Eagle Police Department. The property is located at 12655 N Horseshoe Bend Road. All setbacks will be met and nothing will exceed the height restrictions. The main access to the property will be from Horseshoe Bend Road but an emergency access to Highway 55 will be proposed. The property will be served with City of Eagle water and a septic system. Eagle Fire Chief, Tyler Lewis, 1119 E State St, Eagle, ID, addressed the council. This project is a relocation of the existing Fire Station #2. He reviewed their current service area and the reasons for relocating Station #2. Chief Lewis addressed the emergency access to Highway 55. It will be a gated access that will only activate with their alerting system. He confirmed that this access will be south of the existing City sign welcoming people to Eagle and if the sign needs to be relocated for any reason, they will work with the City to do so. Mike Williams, Planning and Zoning staff addressed the council. Williams gave a brief overview of the details of the Conditional Use Permit application for the emergency services facility,the waiver of the minimum lot coverage and the change of nonconforming use based on the lot size. Planning and Zoning voted in favor of this application to recommend approval of the site specific conditions with the exception of item 8 regarding the placement of the emergency generator. Staff recommends either relocating the generator or provide sound mitigation. Staff asks that site specific condition item 4 be changed to state that the maximum lot coverage shall not exceed 15%. It was explained there are no sewer lines in the area, the applicant will work with Central District Health for their septic system approval. There was no public testimony. Tamara Thompson from The Land Group addressed the council. The berm where the emergency access will cut through will be maintained with landscaping. It will be presented to Design Review for approval. She also discussed the septic system and the location of the drain field. There was discussion regarding a micro treatment system rather than a septic system. Chief Lewis explained that the BLM crew of 8-12 people would only be onsite for three months of the year and the fire crew would consist of only three people year-round. Further discussion regarding the onsite generator stated the generator was for emergencies only and will be located approximately 300 feet from the nearest home. Mayor Pierce closed the public hearing. Baun moved to approve Action Item 9A, CU-14-22 -Conditional Use Permit for Eagle Fire Station No. 2, with the changes identified by staff to site specific condition #4 relative to striking the words relative to maximum lot coverage shall not exceed 15%. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds (2/3) vote of the governing body. An executive session may be held: (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. This agreement initiated the process that eventually resulted in a 30-year development agreement(Development Standards 4nd Design Guidelines), and the annexation of 6,000+acres of private lands(Spring Valley),and roughly 1,600 acres of BLM lands into the City of Eagle. The final annexation agreement was signed and implemented on November 10,2009 under City Ordinance 634. Since the City of Eagle annexed the private lands and the BLM lands,those BLM lands annexed into the city limits were now required to comply with local laws and ordinances,with enforcement authority by local law enforcement,pursuant to 43 CFR§ 8365.1-7(See below). Discussion : • Per Eagle City Code, emergency service facilities are allowed within the A-R zone with a conditional use permit. • As part of the conditional use permit request the applicant is requesting to change a nonconforming use to another nonconforming use based on the property size. • The applicant is also requesting conditional use permit approval for a waiver of Eagle City Code Section 8-2-4, to increase the maximum lot coverage from 10% to 15%. On November 21, 2022, the Planning and Zoning Commission voted 4 — 0 to recommend approval of the application with the following site specific conditions of approval and the City's standard conditions of approval: 1. I'he"Emergency Services"facility with accessory training center,and a training tower shall be a permitted use. 2. The applicant shall submit a design review application in accordance with Eagle City Code Section 8-2A. The design review application shall be reviewed and approved by the Design Review Board and City Council prior to the issuance of a zoning certificate for construction of the building.(ECC 8-2A-17) 3. The applicant shall submit payment to the City for all engineering and legal fees incurred for reviewing this project prior to the issuance of a certificate of occupancy and/or upon receipt of an invoice by the City,whichever occurs first. 4. If the Council approves the maximum lot coverage waiver request, the maximum lot coverage shall not exceed fifteen percent (15%). 5. Sirens shall not be used while on the property where the"Emergency Services"facility is located unless otherwise required by I.C. Section 49-623. 6.
