MINUTES
The Design Review Board met in regular session, February 27, 2014, Chairman Grubb presiding.
1. CALL TO ORDER: Chairman Grubb calls the meeting to order at 6:02 p.m.
2. ROLL CALL: The following members were present: GRUBB, SAYER, HULL,
BRASHER, HASH. ABSENT: MC CULLOUGH,MARTIN. A quorum is present.
3. CONSENT AGENDA
♦ Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of February 13, 2014.
B. Findings of Fact and Conclusions of Law for DR-01-14—Entry Feature and
Signage for Castlerock Subdivision—Hammett Homes: Hammett Homes,
represented by Dave Yorgason with Tall Timber Consulting, is requesting design
review sign approval to construct an entry feature and signage for Castlerock
Subdivision. The 10.01-acre site is located on the east side of North Meridian Road
approximately 950-feet north of West Floating Feather at 1628 North Meridian Road.
C. Findings of Fact and Conclusions of Law for DR-02-14—Common Area
Landscaping within Castlerock Subdivision—Hammett Homes: Hammett
Homes, represented by Dave Yorgason with Tall Timber Consulting, is requesting
design review approval of the common area landscaping within Castlerock
Subdivision. The 10.01-acre site is located on the east side of North Meridian Road
approximately 950-feet north of West Floating Feather at 1628 North Meridian Road.
D. Findings of Fact and Conclusions of Law for DR-75-13—Professional Office
Building—Doug Lasher Construction: Doug Lasher Construction is requesting
design review approval to construct a 7,950-square foot professional office building.
The 0.42.-acre site is located south of West Bavaria Street at 3443 West Bavaria Street
within Castlebury West Business Park.

4. UNFINISHED BUSINESS:
A. DR-67-13—Six Apartment Buildings and Clubhouse for Eagle River Apartments
—Tom Hill: Tom Hill, represented by Laren Bailey with LEI, is requesting design
review approval to construct six (6) apartment buildings consisting of 80-total units.
This application also includes converting the 4,642-square foot residential dwelling
unit to a clubhouse. The 5.38-acre site is located on the south side of East Riverside
Drive approximately 300-feet east of East Shore Drive at 827 East Riverside Drive.
This item was continued from the February 13, 2014 meeting.
Laren Bailey,3023 E. Copper Point Drive, Meridian, addresses the Board. Elizabeth
Cooper, 499 Main Street, Boise, architect on the project and reviews the parking.
City Planner Cerda has nothing further to add. Board discussion.
Grubb moves to approve DR-67-13—Six Apartment Buildings and Clubhouse for
Eagle River Apartments—Tom Hill with the site specific and standard conditions of
approval with the following modifications:
Site specific condition #18: Provide a revised landscape plan showing enhanced
detail to overall landscape design with relation to infilling vacant areas and
centering of plants as needed, to be approved by staff and one member of the Design
Review Board.
Site specific condition #19: Provide revised detail showing the parking structures to
have the same roofing material as the main buildings and a matching color scheme,
to be approved by staff. Seconded by Brasher. ALL AYE...MOTION CARRIES.
B. DR-04-14—Building Wall and Site Signage for Ye Olde Sweet Shoppe—Ye Olde
Sweet Shoppe: Ye Olde Sweet Shoppe, represented by Robert Bruce, is requesting
design review sign approval for building and site signage for Ye Olde Sweet Shoppe.
The site is located at the southwest corner of East State Street and 1st Street at 99 East
State Street. This item was continued from the February 13, 2014 meeting.
The applicant has requested this item be continued.
Grubb moves to continue DR-04-14—Building Wall and Site Signage for Ye Olde
Sweet Shoppe to the next regularly scheduled meeting. Seconded by Brasher. ALL

5. NEW BUSINESS:
A. DR-05-14—Taco Bell Restaurant with Drive-thru—ZOKE LLC: ZOKE LLC,
represented by Paul Hilbig, is requesting design review approval to construct a 2,489-
square foot Taco Bell restaurant with drive-thru. The 0.92-acre site is located on the
east side of North Linder Road approximately 385-feet north of Chinden Boulevard at
6560 North Linder Road within the Eagle Island Marketplace.
Member Hull recuses himself from items 5A and 5B.

Grubb moves to approve DR-05-14—Taco Bell Restaurant with Drive-thru—ZOKE
LLC with the site specific and standard conditions of approval with the following
modifications:
Site specific condition #2: The revised elevations as provided on 2/27 indicated as
improved design for the north, south, east and west elevations is approved by Design
Review.
Seconded by Brasher. Discussion. ALL AYE...MOTION CARRIES.
B. DR-06-14—Building Wall Signage, Monument Signage, and Menu Board
Signage for Taco Bell—ZOKE LLC: ZOKE LLC, represented by Paul Hilbig, is
requesting design review sign approval to construct three (3) building wall signs, a
monument sign, and menu board signage for Taco Bell. The site is located on the east
side of North Linder Road approximately 385-feet north of Chinden Boulevard at
6560 North Linder Road within the Eagle Island Marketplace.

Grubb moves to approve DR-06-14—Building Wall Signage, Monument Signage,
and Menu Board Signage for Taco Bell—ZOKE LLC with the site specific and
standard conditions of approval with the following modifications:
Site specific condition #2: Strike.
Site specific condition #4: The Design Review Board is in favor of the increased
square footage of the monument sign to 44 square feet based on the fact that only
one menu board sign is being utilized at this location and approves the use of the
menu board as submitted,with the removal of the wave on the top.
Site specific condition #5: Provide cut sheets of the speaker canopy showing the
color and options on the canopy, to be approved by staff and one member of the
Design Review Board. Seconded by Brasher. ALL AYE...MOTION CARRIES.
C. DR-07-14—Common Area Landscaping within Snoqualmie Falls Subdivision
No. 5—Justin Martin: Justin Martin, represented by Jon Breckon with Breckon
Land Design, is requesting design review approval of the common area landscaping
within Snoqualmie Falls Subdivision No. 5. The 21.18-acre site is generally located
on the south side of West Floating Feather Road approximately 1,700-feet east of
North Palmer Lane.
Marty Goldsmith, 17523 Hoadley Road, Caldwell Idaho reviews the application. City
Planner Cerda reviews the application. City Planner Cerda has nothing to add. Board
discussion.
Grubb moves to approve DR-07-14—Common Area Landscaping within
Snoqualmie Falls Subdivision No. 5—Justin Martin with the site specific and
standard conditions of approval as written with the following modifications:
Site specific condition #2: Strike.

Site specific condition #5: The landscaping for the lots needs to be in place prior to
the occupancy of the residents to insure full landscaping has been done to the
common area.
Site specific condition #6: The revised City of Eagle date stamped 2/27 drawings
with the drawing date of 2/12/14 are accepted by the Design Review Board as the
current elevations and site layout.
Site specific condition #7: Provide revised section #1 of the 5 foot berm, sheet L1.5
to be approved by staff and one member of the Design Review Board.
Site specific condition #8: Provide revised drawing L1.3 showing all call outs for
plant material, to be reviewed by staff.
Site specific condition #9: Provide revised sheet L1.0,with modified elevation of
pond depth for safety bench.
Note: The Design Review Board is in favor of planting reduction on the berm due
to the overall width of the berm which far exceeds the requirements by code.

The developer, Horseshoe Flats. LLC, requests approval to not meet City requirements
which require certain numbers of trees. The developer will commit to construct and
install items listed below, and hopes that the City can find value in this non required
work as a possible offset, and in keeping with the current/future theme at the Legacy
Subdivision.
Five Sandstone retaining walls and twelve stone columns with 6'
flower pots.
❖ Large mature trees will be planted These large trees are in stock
at our yard. shipped direct from Portland and are primarily in
excess of 18'. Strong emphasis will be given to the hardiest trees.
Six foot trees are currently allowed by code.
❖ Five gallon plants will be planted. Five gallon plants have been
used in all of the previous phases of Legacy and will be
incorporated in this phase, up to (75%). Availability did cause
some use of local grasses and this has been the only scenario
where we used smaller pot sizes. 1 gallon pot sizes are currently
allowed per code.
•:• There will be a 2.33 acre lake dug. Waterfront phases at Legacy
do add to the City of Eagle's reputation as a premier community.
•:• Extensive grading will be done along the Middleton Mill Irrigation
Canal, pursuant to the approved License Agreement. This grading
work will open up a view corridor along this long collector roadway.
and provide a regional walking path with water views from Linder
road to Highway 16. This License Agreement restricts the numbers
of trees that can be planted_

The Development Agreement (DA) has wording that put the previous developer and the
City of Eagle on the same page regarding location of pathways, creating view corridors
and planting flexibility to provide for a theme. The 24 acre.. 3-hole golf course and 11
acre park provide for expansive views, don't meet code planting requirements and set
the current theme for this east west collector roadway that goes from Linder road out to
Highway 16.
DEVELOPMENT AGREEMENT (DA) AND THE FLEXIBILITY IT PROVIDES
Article III CONDITIONS ON DEVELOPMENT
SECTION 3.1 all development of the of the Property shall be consistent with the
Landscape, Site Design, and Architectural Design Guidelines attached hereto and
incorporated herein, as Exhibit E, and be generally consistent with the Concept Plan
attached as Exhibit A; provided, however, it is the intent z . : r

long as the general intent of the Concept Plan and the requirements set forth in this
Agreement are met.
Design Guidelines, attached as Exhibit E to the DA, are 21 pages and they state
the following:
General Applicability
Flexibility -these guidelines are intended to depict the general nature of the
architectural character while allowing sufficient flexibility for development to
accommodate the evolving market, remain economically viable, support the
purposes and goals of the City of Eagle, and respond to site and other
conditions as necessary while keeping within the desired character of the
project to the extent possible. Note: there were site constraints involved.
1.10 General
The term Site Development refers to siting of structures and the placement of related
improvements within the Legacy project. The objective of the site development is
twofold. to support and amplify the City Codes and to recognize the unique nature and
location of the property within the City of Eagle.
1.20 Site Development Theme
The design of the development is to be a clearly identifiable community within the City
of Eagle providing a community that provides its residents with a unique living
experience.
2.1.3 Design Objectives
• the site design guidelines reflect several important goals: to strengthen the
area's identity an create a unique and aestetically pleasing environment within
the context of the City of Eagle.
• To create streetscapes which are visually distinctive and memorable to users
and residents of the project and thus strengthen the identity of the site within the
context of the City of Eagle.
• To create streetscapes which aid in the visual understandability of the area by
visitors, residents and other users.
2.1.4 Landscape Standards For Collectors - A variety of Class 1, 2 and 3 trees will be
clustered along the Collectors, adjacent to the curbside planting strip, to provide an
open, natural setting to visually expand and enhance the presence of the
landscape environment.
In conclusion: The existing Legacy project is using mature plantings, views of
green grasses, thought out grading plans and extensive hardscapes to carry a
theme forward into future phases. In the last three phases of landscape
construction at the site, the project has been afforded flexibility by the City. This
flexibility has produced complimentary results when comparing Legacy to Lions
Gate, Henry's Fork, and Lakemoor, even though the Legacy project has a
separate feel and look. Know that the Legacy project has taken daily builder
input on future landscaping, that the project and builders are working in tandem
to create the best possible subdivision and that the team won't abuse any
additional flexibility that the City can muster. Being able to have flexibility was
instrumental in creating the project identity and is greatly responsible for the
existing team's momentum.
