Minutes - 2013 - Design Review - 08/22/2013 - Regular DESIGN REVIEW BOARD MINUTES The Design Review Board met in regular session August 22, 2013, Member Brasher presiding. 1. CALL TO ORDER: Member Brasher calls the meeting to order at 6:05 p.m. 2. ROLL CALL: The following members were present: SAYER, HULL, BRASHER, MARTIN. ABSENT: MC CULLOUGH, GRUBB. A quorum is present. 3. CONSENT AGENDA ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of August 8, 2013. Sayer moves to approve the consent agenda. Seconded by Hull. ALL AYE...MOTION CARRIES. 4. UNFINISHED BUSINESS: None. 5. NEW BUSINESS: A. DR-37-13—Remodel Building into an Office Building for Downs Realty—Larry and Debi Downs: Larry and Debi Downs, represented by James Gipson, are requesting design review approval to remodel a 940-square foot building into an office for Downs Realty. This application is also to review the construction of a 555- square foot addition to the existing building. The 0.28-acre site is located on the west side of South Eagle Road approximately 700-feet north of State Highway 44 at 221 South Eagle Road. James Gipson, PO Box 219, Eagle, Idaho, project architect reviews the project. City Planner Cerda reviews the project. Board discussion. Brasher moves to approve DR-37-13—Remodel Building into an Office Building for Downs Realty—Larry and Debi Downs with the site specific and standard conditions of approval with the following changes: Site specific condition #1. Rewrite to say the Board unanimously agrees that the elevations presented, dated 8/1/13 are appropriate for the use and style of the building and the intent of the code does not apply logically to the use of the structure at this time and therefore the 50% requirement would be relaxed. Site specific condition #2. The Board unanimously agrees that a planter strip along the north of the property is not necessary due to the fact that the width of the lot and the requirements for the parking make that impossible to do the arithmetic, however we do 1 want the landscape buffer on the south to contain shrubs to create a screen for the parking lot as per code. Also the grading and drainage plans shall be provided to the city and approved by the city engineer prior to issuance of a permit. Site specific condition #4. Amend to after the first sentence add that the sidewalk as shown on the site plan dated 8/1/13 is unanimously approved by the board and feel that is fitting although not complying with the code due to the property to the north so that there is congruity with the sidewalks to the north. Site specific condition #13. The Design Review Board unanimously agrees that the lot coverage and set back requirements in the code should be relaxed due to the use of this structure and the fact that it is an existing structure and the spirit of the code for this area of town does not reasonably apply to the use of this structure. The historical nature and the benefit of the city for the use of this site outweighs some of this trade off. Site specific condition #14. The Design Review Board unanimously agrees that the elevations date stamped 8/1/13, options A and B are approved by the Board no matter what option is chosen by the applicant. Site specific condition #15. The applicant shall provide a revised landscaping plan showing the northern edge of the paving ending at a concrete curb so as to protect the edge of the pavement. That site plan would be reviewed and approved by two members of the Design Review Board and staff. Site specific condition #5. The revised site plan will be approved by staff and two members of the Design Review Board. Site specific condition #16. The applicant shall provide a revised landscape plan showing additional shrubs or landscaping on the eastern side of the building and southern side of the building as well as alternative plantings for the courtyard area. DR-38-13—Two Building Wall Signs for Downs Realty —Larry and Debi Downs: Larry and Debi Downs, represented by James Gipson, are requesting design review sign approval to construct two non- illuminated building wall signs for Downs Realty. The site is located on the west side of South Eagle Road approximately 700- feet north of State Highway 44 at 221 South Eagle Road. James Gipson, PO Box 219, Eagle, Idaho reviews the project. The 40.37-acre site is locate on the west side of Meridian Road approximately '/4-mile north of Chinden Boulevard at 6825 North Meridian Road. The sole exception concerns DR -39-13 Site Specific Condition of Approval No. 2 which reads... "Provide documentation indicating that the home owner of 3125 West Sugarberry Drive has agreed to any visual mitigation between the proposed subdivision and the home owner's residence prior to the City Clerk signing the final plat." The referenced "home owner's" principal concern was not "visual mitigation;" his stated request to the City Council was for larger lots along Meridian Road. Initially, the Council responded favorably to that request, even though the proposed "2 units per acre" lots are fully compliant with the approved concept plan (attached) as incorporated into the project development agreement. Upon reflection and reconsideration, the Council proposed the "visual mitigation" condition rather than a reduction in the number of lots. We met with the home owner at the site and have proposed subsequent meetings with our landscape consultant and staff to consider landscape enhancements. The home owner's response has been to "hold" until he has the opportunity to meet with the Eagle City Attorney. We are not aware that such a meeting has occurred. Photographs provided with the application, and included in the staff report, clearly show that additional "visual mitigation" is unlikely to satisfy the concern since there is no visual impact on the property. The landscape plan excerpt on the following page depicts the intensity of buffering provided along Meridian Road opposite 3125 West Sugarberry. When combined with the existing, nearly solid landscape buffer on the east side of the street, we are confident that the Council's objective will be fully realized. Therefore, we ask the Design Review Board to delete Condition No. 2 from its approval of DR -39-13 since the matter will ultimately be decided by the City Council when it acts on the Ashbury Subdivision No. 1 final plat.
