MINUTES
The Design Review Board met in regular session July 12, 2012, Chairman McCullough
presiding.
1. CALL TO ORDER: Chairman McCullough calls the meeting to order at 6:00 p.m.
2. ROLL CALL: The following members were present: MC CULLOUGH, GRUBB,
SAYER, HULL, BRASHER. ABSENT: PASCUA, COMSTOCK. A quorum is
present.
3. CONSENT AGENDA
♦ Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of June 28, 2012.
B. Findings of Fact and Conclusions of Law for DR-38-12—Maintenance Shed at
Rock Pointe Apartments— Riverstone Residential Group: Riverstone Residential
Group, represented by Scott Marshall, is requesting design review approval to
construct a 240-square foot maintenance shed at the Rock Point Apartment complex.
The 4.83-acre site is located on the south side of East State Street approximately 230-
feet west of North Palmetto Avenue at 727 East State Street.
Grubb moves to approve the consent agenda as written, items 3A and 3B. Seconded
by Sayer. ALL AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: None.
5. NEW BUSINESS:
A. TR-01-12—Vigne D'Aquila Tree Removal—Ted Bierma: Ted Bierma is
requesting approval to remove three (3)trees located around the existing house
located on Lot 5, Block 1, of Vigne D'Aquila Subdivision. The 4.67-acre site is
located on the northeast corner of West Beacon Light Road and North Ballantyne
Lane at 1964 West Beacon Light Road.
The applicant is not present. City Planner Cerda reviews the application and states that
the applicant indicated to her that he was fine with the conditions as written. Board
discussion.

McCullough moves to approve TR-01-12—Vigne D'Aquila Tree Removal—Ted
Bierma with the site specific and standard conditions of approval with the following
modifications to the site specific conditions:
Site specific condition #2: Strike and replace with if the applicant deviates from the
original approved vineyard plans, no building permits for any of the lots within the
subdivision shall be permitted until the applicant provides a landscape plan to the
Design Review Board and staff for approval.
Site specific condition #3: Strike and replace with the Design Review Board
unanimously supports the applicant removing these proposed trees with no penalty
due to the fact that this is already a platted residential single family lot and the
variety of trees to be removed are considered undesirable and the developer is doing
the City a favor by removing them.
Seconded by Grubb. Discussion. ALL AYE...MOTION CARRIES.
6. REPORTS:
A. Design Review Board: None.
B. Staff: LED lights for ICCU were approved by the City Council. Staff will begin
working on a new lighting ordinance.
7. ADJOURNMENT:
Grubb moves to adjourn 6:20 p.m. Seconded by Sayer. ALL AYE...MOTION
CARRIES.
