Minutes - 2011 - Design Review - 09/08/2011 - Regular 3A DESIGN REVIEW BOARD MINUTES September 8, 2011 The Design Review Board met in regular session September 8, 2011, Member Butler presiding. 1. CALL TO ORDER: Member Butler calls the meeting to order at 6:00 p.m. 2. ROLL CALL: The following members were present: BUTLER, PASCUA, SAYER, HULL. ABSENT: MC CULLOUGH, GRUBB, COMSTOCK. A quorum is present. 3. CONSENT AGENDA ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of August 25, 2011. B. Findings of Fact and Conclusions of Law for DR-26-11 —Change of Use from Retail to Restaurant—Smoky Mountain Eagle, LLC: Smoky Mountain Eagle, LLC, represented by Trent Koci with BRS Architects, is requesting design review approval to convert a 4,500-square foot retail building into a restaurant for Smoky Mountain Pizzeria Grill. The 0.48-acre site is located on the southeast corner of East State Street and 1st Street at 127 East State Street. C. Findings of Fact and Conclusions of Law for DR-27-11 —Two Building Wall Signs and One Monument Sign for Smoky Mountain Pizzeria Grill—Dan Todd: Dan Todd, represented by Eric Williams with YESCO, is requesting design review approval to construct two (2)building wall signs and one monument sign for Smoky Mountain Pizzeria Grill. The 0.48-acre site is located on the southeast corner of East State Street and 1st Street at 127 East State Street. D. Findings of Fact and Conclusions of Law for DR-28-11 —Multi-tenant Restaurant/Retail Building with Drive-Thru—Gardner Company: Gardner Company, represented by Jeff Likes with ALC Architecture, is requesting design review approval to construct a 3,100-square foot multi-tenant restaurant/retail building with a drive thru. The 0.75-acre site is located on the north side of West State Street within Arts West Subdivision at 94 North Fisher Park Way. E. Findings of Fact and Conclusions of Law for DR-29-11 —Master Sign Plan for a Multi-tenant Restaurant/Retail Building, Including Signage for Moxie Java— Eagle Island Crossing, LLC: Eagle Island Crossing, LLC, represented by Scott Schneider, is requesting design review approval of a master sign plan for a multi- tenant restaurant/retail building, including signage for Moxie Java. DR-52-99 MOD4—Modification to the Master Sign Plan for Eagle Marketplace —Eagle Marketplace, LLC: Eagle Marketplace, LLC, represented by Greg Llewellyn with Golden West Signs, is requesting design review approval to modify the master sign plan for the Eagle Marketplace. The site is located on the northeast corner of Chinden Boulevard and Eagle Road at 3210 East Chinden Boulevard. This item was continued from the August 25, 2011 meeting. Greg Llewellyn, Golden West Advertising, 114 E. 37th Street, Boise addresses the Board. Discussion. Sayer moves to accept the color because of the circumstances of the traffic and the landscape. Seconded by Hull. ALL AYE...MOTION CARRIES. 5. NEW BUSINESS: A. DR-31-11 —Public Service Facility for Chevron Pipeline Block Valve—Chevron Pipeline Company: Chevron Pipeline Company, represented by Tom Denison, is requesting design review approval to construct a public service facility for a remotely operated block valve. This block valve will replace the existing underground manual block valve currently located on the east side of Ballantyne Lane approximately 850- feet to the northwest of this site. The new 0.03-acre site is located just north of the City of Eagle western entry sign and partially within the right-of-way of West State Street. Tom Denision, 2875 S. Decker Lake Drive, Salt Lake City, Utah addresses the Board. Terry Sayer indicates that she has had discussion with the applicant previously about this project. She states that she has no financial interest in the project and is able to make a fair decision. City Planner Cerda reviews the application. Board discussion. Butler moves to approve DR-31-11 —Public Service Facility for Chevron Pipeline Block Valve with the site specific and standard conditions of approval with the following modifications: Site specific condition #10: The light fixture shall be reviewed and approved by staff and one Board member prior to issuance of a zoning certificate. Site specific condition #11: The A/C unit shall be designed so it's mounted lower, such design shall then be reviewed by staff and one Board member prior to issuance of the zoning certificate. Site specific condition #13: Provide documentation showing how access will be provided from State Street a public road, to the site via access easement approved by ACHD or whoever else has jurisdiction to where the easement is going to cross. Site specific condition #14: Provide ACHD written approval of the driveway off of State Street to the access easement which ultimately goes to this site prior to issuance of a zoning certificate. HiQ 5 V ` °i iron Re: Monument Sign Eagle Marketplace Shopping Center Eagle, Idaho Dear Ms. Cerda, 1 am the property owner of The Eagle Marketplace Shopping Center, located on the northeast corner of Chinden Blvd. and Eagle Rd., which I purchased in 2006, It is my understanding that Golden West Signs did not get prior City consent or a Permit to change the colors of our two (2) Tenant Directory Signs (one on Eagle Rd. and one on Chinden) and that the City is now questioning whether it will consent to the new red background. While I understand the need for the City to have certain zoning criteria and design standards I must appeal to you to give us a variance so we can, hopefully, keep this shopping center viable. As you may be aware, we currently have 10 of our 25 shop spaces vacant. What you may not know is that over '/ of the remaining tenants are struggling to remain open much Tess consider renewing their leases. The biggest problems we have in retaining existing tenants and in attracting new businesses are visibility and ingress/egress. I understand the City is opposed to the proposed new median project on Eagle Road which I appreciate as we are very much against this plan. Regardless of the outcome of this project, however, the City can, and should, help us improve our visibility. It is one thing to have unlighted signs and lush landscaping for commercial properties on interior streets with lower speed limits and quite another when it comes to a property like ours on a State Highway with 55 mph speed limits. Since I have owned Eagle Marketplace we have on several occasions asked sign companies to request variances for lighted tenant storefront signs and/or an electronic readerboard addition to our highway signs. 1 trust that if you drive by our Center you will confirm that it is virtually "buried" behind Walgreens, Key Bank and a number of trees. While the place looks great once one gets into the parking lot the challenge is to get more people (customers!) to do so. I am enclosing herewith a copy of a recent letter from my property manager which mirrors my sentiments on the new red background for our Tenant Directory Signs. Again, 1 implore you to give us some consideration in this matter so we can, hopefully, hang on to our present tenant base and try to rebuild it in the Light of so much new competition and the general economic times. The landscaping and Walgreens both block the view corridors for the tenants. With the speed limits along Eagle Road, and Chinden Boulevard , the white background and dark Letters were just not eye catching enough for passersby. We need a reasonable form of exposure, as the City will not allow lighted signs on the building, or an electronic reader board on the highway. The bright red sign provides some much needed visibility. We need tenants and traffic to keep the property viable and losing the bright red sign would be a major setback to our efforts to maintain our current tenants and hopefully, attract some much needed new business. We are struggling at this property and with the proposed road works blocking the access to turn left onto Chinden Boulevard and Left onto Eagle Road, the center will have an even greater need for exposure and visibility. We ask that the Board approve the sign color as it now stands, in light of the above stated challenges the property is facing. Thanks in advance for your consideration in this most important matter.
