.1fI DESIGN REVIEW BOARD MINUTES The Design Review Board met in regular session, November 13, 2008, Vice-Chairman Grubb presiding. 1. CALL TO ORDER: Vice-Chairman Grubb calls the meeting to order at 6:00 p.m. 2. ROLL CALL: The following members were present: GRUBB, BUTLER, KOCI, COUNCIL LIAISON SHOUSHTARIAN. ABSENT: MCCULLOUGH, WHITTAKER, BARNES, NIBLETT. A quorum is present. 3. CONSENT AGENDA . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. DR-64-08 - Third BuildiDl! Wall Sien for Cool Hand Luke's Steakhouse and Saloon - Stonewvcke Partners. LLC: Stonewycke Partners, LLC, represented by Susan Bosworth with Young Electric Sign Company, are requesting design review approval to add a third building wall sign to the north building elevation of the Stonewycke building for Cool Hand Luke's Steakhouse and Saloon. The site is located approximately 135-feet south of East Shore Drive within Eagle River Development (Lot 12, Block 4, Mixed Use Subdivision No.3) at 291 East Shore Drive. The 5.70-acre site is located on the east side of Park Lane Road approximately 1,200-feet south of Beacon Light Road at 2440 North Park Lane. DR-70-08 - Master Sien Plan for The River District - Lonesome Dove LLC/River District: Lonesome Dove LLC/River District, represented by Craig Jamieson with Lytle Signs, is requesting design review approval for the master sign plan for The River District. The site is generally located south ofthe intersection of State Highway 44 and Edgewood Lane (includes both the Gateway South Development and Lonesome Dove Development). Butler moves to approve DR-70-08 - Master Sign Plan for The River District with the site specific and standard conditions of approval with the following modifications: Site specific condition #1: Modify end of first sentence after feet will read measuring the boundary for the text only per Eagle City Code, 8-2A-8C4e. The master sign plan for the River District criteria #2 be modified to add another sentence at the end that says once any particular building is constructed future signs for said building shall be reviewed as a staff level Design Review. 4B. Modify, to keep first sentence but strike color to be stainless steel, text size shall be a minimum of 6 inches but no larger than 12 inches in height, no logos as permitted, I would recommend that those all be stricken. Fi(MN November 13, 2008 To: City of Eagle Design Review Board Re: Lonesome Dove LLC/River District —DR-31-07 MOD Dear Members of the Board, Thank you very much for this opportunity to present our modification to an existing master sign program for the River District. Certainly, this is an exciting project for both Lytle Signs and for the City of Eagle. This modification application has been requested by staff as the architecture of the subject buildings has changed extensively. We have reviewed the staff report and their recommendations for approval and find them to be appropriate. We would like to request clarification on two items. These have been marked on the staff report as `- i ., d Your time and consideration of this matter is appreciated. 1. We did want to clarify that signage allowances will be based on the ordinance section which allows for signage to be up to 10% of the building face. While this does appear as approval language, it conflicts with the table found on page 2 of the staff report which lists this allowance as 20 square foot. 2. We also wanted to clarify placement of copy on awnings. We believe that the staff report is intended to confirm placement on the front section of awnings as is shown in our exhibit. Certainly, if there are any other areas of this application you would wish to discuss, or have any concerns regarding, we would appreciate the opportunity to be a part of this dialog. COMPREHENSIVE PLAN PROVISIONS,WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called"Eagle Architecture". • Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. • Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. • Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties,neighborhoods,or streets. • Eagle City Code Section 8-2A-8(B) WALL SIGN(PERPENDICULAR): A sign attached to or erected against the wall of a building or structure with the face(s)of the sign perpendicular to the plane of said wall, and not extending over thirty six inches (36") from the wall of the building or structure. • Eagle City Code Section 8-2A-8(C)(1) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. • Eagle City Code Section 8-2A-8(C)(4)(b) Any business within a multitenant building that is located on a street corner or which fronts two(2) streets shall be allowed two (2)wall signs. The sides of the building on which the signs are to be placed shall be shown by the owner,but shall be as approved by the design review board. • Eagle City Code Section 8-2A-8(C)(4)(c) The total area of any wall sign attached parallel to, or painted on the face of a building shall not exceed ten percent(10%) of the total area of the building face to which it is attached or painted. Special portable signs shall require a design review application and design review board approval. 2. Special portable signs shall be unique in character with styles designed in accordance with Eagle architecture. Materials shall be weatherproofed and shall be properly maintained. 3. Illumination for special portable signs is prohibited. 4.No more than one special portable sign shall be permitted for any business. 5. Special portable signs shall be a maximum of sixteen(16) square feet along roadways with three(3) or less travel lanes with a speed limit of twenty five miles per hour(25 mph) or less and twenty five(25)square feet along roadways with more than three(3)travel lanes or along roadways with a speed limit of over twenty five miles per hour(25 mph). 6. Special portable signs shall be a maximum of five feet(5') in height along roadways with three(3)or less travel lanes with a speed limit of twenty five miles per hour(25 mph)or less and seven feet(7') in height along roadways with more than three(3)travel lanes or along roadways with a speed limit of over twenty five miles per hour(25 mph). 7. Special portable signs shall only be permitted on, or on the sidewalk adjacent to,the parcel on which the business is located and shall not be permitted on any other parcel except that any multitenant site shall have the sign on the site and not on any other site. 8. Special portable signs on a public sidewalk abutting the business's parcel may be permitted if a minimum of five feet(5') of unobstructed walkway, or ADA required minimum,remains for pedestrians. 9. Any sign in a driveway or street sight vision triangle shall be a maximum of thirty two inches(32")high measured from the driveway or street. 10. Special portable signs shall not be permitted to be on or within any berm or any portion of a landscaped area. 11. Special portable signs shall be moved inside of the building at the end of each business day. • Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. • Eagle City Code Section 8-2A-8(M)(15) One neon window sign no larger than four(4)square feet or ten percent(10%)of the window where it is placed, whichever is larger, shall be permitted per business.Neon window signs shall be reviewed and approved by the zoning administrator,or staff member designated by the zoning administrator, and one design review board member. • Eagle City Code Section 8-2A-8(M)(16) Door signs identifying the business and/or indicating business hours, emergency phone numbers,etc.,shall be permitted up to a maximum of two(2)square feet. C. DISCUSSION: • Staff recommends the following changes to the applicant's document titled "Master Sign Plan for The River District Mixed Use Buildings", with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. Master Sign Plan for the River District Mixed-Use Buildings The River District—Eagle, Idaho General Notes (Typ.): 1. Each tenant shall be required to submit signage plans to the developer or developer's management entity for written approval. A design review sign application, accompanied by the written approval of the managing entity, shall be submitted to the City for any proposed signs for City staff review and approval. All signs shall be in compliance with the criteria stated herein as well as the Eagle City Code. In cases of any conflict between the Eagle City Code and the criteria specified herein,the more restrictive requirements shall apply. 2. The sign locations indicated on the building elevation plans date stamped by the City on May 9, 2007, represent general locations. Some store fronts may become smaller requiring the additional signage not represented on these elevations. Additional signage may be required but shall comply with the conditions noted herein. Building Address Number(Typ. of 4): 1. Cast metal building address numbers shall be located on top of canopy or where canopy does not occur on the face of building as illustrated on the attached building elevation sheets. See Building Elevation sheets and cut sheets. General Signage Provisions and Allowances: 1. Approved signage types for this development include: halo illuminated wall signs, non illuminated wall signs, blade or perpendicular wall signs, and non-illuminated fabric covered awnings. Any business that is located on a street corner or which fronts two (2) streets shall be allowed two wall signs (the sides of the building on which the signs are to be placed shall be shown by the owner) which may be placed on any elevation that is occupied by said tenant. This includes the angled corner of the building if the tenant entrance is at the corner of the building and faces a plaza or pedestrian way(as shown on Exhibit C). 2. The applicant may install a wall sign parallel or perpendicular to the face of the building. The following criteria shall apply for each type of sign: a. Parallel building wall signs and/or awning signs: 0 1) The total area of any wall sign attached parallel to the building shall not exceed 10%of the total area of the building face to which it is attached. 2) If signage is desired to be used on any existing awnings,the total square footage of any building wall sign attached parallel to the building combined with the signage on the awnings shall not exceed 10% of the total area of the building face to which it is attached. 3) Business identification words, phrases, and logos are permitted for each individual tenant. All signage colors shall complement the colors of the building to which it is being attached to. 4) Permitted materials consist of cast metal, fiberglass, plastic, acrylic or similar. 5) Non illuminated or halo illuminated signage is permitted. Neon signage is not permitted. 6) Wall signs shall be a minimum of 1/2" thick for non-illuminated signage and a maximum of 4"thick for halo illuminated signage. 7) No raceways are permitted with the exception of decorative rail type systems. 8) Gooseneck lighting is permitted to illuminated non illuminated building wall signs. 0 9) Any signs on the fabric awnings shall be screen printed on the vertical face of the awning elevations only. Printing is not allowed on awning sides. 10) All building signage located parallel to the face of the building shall be finished in a matte, flat, or satin finish. No high gloss finishes are permitted. b. Pe endicular building wall signs and/or awnings signs: f 1) The total area of any perpendicular building wall sign shall not exceed 10% of the total area of the building face to which it is attached and shall not extend over 36"from the wall of the building or structure. 2) If signage is desired to be used on any existing awnings,the total square footage of any building wall sign attached parallel to the building combined with the signage on the awnings shall not exceed 10% of the total area of the building face to which it is attached. 3) Business identification words, phrases, and logos are permitted for each individual tenant. All signage colors shall complement the colors of the building to which it is being attached to. 4) Permitted materials consist of cast metal,fiberglass,plastic,acrylic or similar. 5) A minimum distance of 7' 6" shall be maintained between the bottom of the sign and the sidewalk. 0_, 6) Any signs on the fabric awnings shall be screen printed on the vertical face of the awning elevations only. Window and door signage shall be submitted with any building wall signage and shall be approved on a case by case basis and reviewed by staff and one member of the Design Review Board. 2) Any other signage such as temporary, grand opening, etc. shall comply with Eagle City Code. 3) Upon termination of their lease, the tenant or managing entity shall neatly seal all penetrations of the building structure in a watertight condition that matches the texture, color, and material used in the construction of the building. 3. Any other signage on doors or windows shall comply with Eagle City Code. Second Floor Tenants(Typ.): 1. Some store fronts may become smaller requiring the additional signage not represented on these elevations. Additional signage may be required but shall comply with the conditions noted herein. Cast metal building address numbers shall be located on top of canopy or where canopy does not occur on the face of building as illustrated on the attached building elevation sheets. Approved signage types for this development include: halo illuminated wall signs, non illuminated wall signs, blade or perpendicular wall signs, and non-illuminated fabric covered awnings. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. C. DISCUSSION: • The applicant is requesting approval of several different types of signs to be located on the north and west building elevations of the Riverwood Cinemas. A combination of halo illuminated, exposed neon, electronic message, and internally illuminated poster cabinet signs are proposed to be utilized on this building. The total amount of signage permitted on the north building elevation is 517-square feet and the amount permitted on the west building elevation is 540-square feet. The total amount of signage proposed on the north building elevation equals 286-square feet and the total amount of signage proposed on the west building elevation equals 376-square feet. Thus, the total amount of signage proposed on this building is well under what would be permitted per Eagle City Code. On October 7, 2008, the Eagle City Council approved a modification to the development agreement for Eagle Gateway South to allow the use of an electronic message board on the movie theater. Per the development agreement, the back ground color of the message board is required to be black and the text on the message board is required to be one color and is not permitted to have animated or scrolling text. The message board is permitted to show the movie names and start times. The applicant is proposing to use internally illuminated cabinet signs to display the posters of the upcoming movies and those that are currently being shown at the theater. Per Eagle City Code, internally illuminated signs are not permitted, as well as cabinet style signs. The applicant should be required to provide a revised elevation plan of the poster cabinet signs showing the signs to be illuminated from above or below with an external light fixture. Provide detailed cut sheets showing the style, wattage, luminaries, etc. of the proposed light fixture. The revised elevation plan and the cut sheets of the light fixture should be reviewed and approved by staff and one member of the Design Review Board prior to the City issuing a sign permit for this site. • Staff defers comment regarding design and color of all proposed signs to the Design Review Board. As an example,they may wish to place a 12' x 22' decorative metal feature on the face of the entry rock display and then overlay that with a 100 square foot sign panel. Would that be acceptable? 2. Comprehensive plan: we are prepared to discuss this if you feel it is necessary. 3. Master Sign Plan for entire River District:We would very much, at this time, like to establish a master sign plan that would be applicable of all commercial buildings within the development with the exception of the Riverwood Cinemas. Certainly, submitting separate applications for each building requires an investment in both time and dollars for both our client and for city staff. And, to what end? Signs types, locations, and square footage all meet city ordinance which is going to be the backbone of any plan submitted. Every tenants requested signage will have to be reviewed and approved by the developer even before being submitted to the city. And, even at a staff level application, staff is always evaluating individual applications, and requesting changes, before approving these applications. Safeguards against the"unusual"are already built into the process. 4. Limitation of tenant copy on monuments in terms of color, size, and logos: With all due respect, signage size allowance has already been established by the 100 square foot allowance for the sign. City entryways include State Highways 44 (State Street and Alternate Route), State Highway 16, and 55 (Eagle Road). The landscaping(or lack thereof), commercial signage and building character of these entrances provide the first, and often the most lasting, impressions of the entire community. The City of Eagle has the opportunity to improve the appearance of the entryways by establishing guidelines for development and redevelopment that occurs along these entryway corridors. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called"Eagle Architecture". • Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. • Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. • Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting,.landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods,or streets. • Eagle City Code Section 8-2A-8(C)(l) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. • Eagle City Code Section 8-2A-8(C)(5)(e) A "shopping center", as defined in section 8-1-2 of this title shall be allowed one monument sign per street that it abuts,to identify the shopping center. If the shopping center has a single address,the address shall be located on the monument sign and shall be a size that is readable from the street. The height of any such sign, including the base to which it is attached, shall not exceed fifteen feet(15'). The surface area of any such sign shall not exceed one hundred (100)square feet per exposed surface, including any reader board sign or surface. Any freestanding single tenant building within a shopping center shall be permitted a monument sign. The height of any such sign, including the base to which it is attached, shall not exceed six feet(6'). The exposed surface of any such sign shall not exceed thirty(30) square feet per exposed surface. A double faced monument sign is permitted. The minimum distance between any monument sign within a shopping center shall be one hundred feet(100').No monument sign shall be any closer than twenty feet(20')from a monument or other freestanding sign on an adjacent property. • Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. C. DISCUSSION: • The applicant is requesting approval of the master sign plan for The River District which incorporates the Lonesome Dove and Eagle Gateway South Developments. The applicant is requesting approval of two entry features, one to be located at the intersection of State Highway 44 and Edgewood Lane and one to be located on the corner of East Riverside Drive and Lone Cove Drive. Two multi-tenant signs are proposed to be located along State Highway 44 giving identification to tenant within the development. The applicant is also requesting approval of signage criteria for all future buildings proposed within this development. • The exact size of the entry feature proposed at the intersection of State Highway 44 and Edgewood Lane has not been shown on the submitted plants. The signage proposed on the entry feature is shown to be twelve feet (12') high by twenty two feet (22') wide which equals 264-square feet. Eagle City Code permits shopping centers to have one fifteen foot (15') high sign per street it U abuts with a maximum surface area of one hundred (100) square feet per exposed surface. Pursuant to past action by the Board and Council, the entry features associated with signage have been permitted to exceed the maximum height that is required within Eagle City Code. However, the square footage of the signage has not been permitted to exceed that which is permitted within Eagle City Code. The square footage of the sign proposed on the entry feature located at the intersection of State Highway 44 and Edgewood Lane, exceeds the one hundred (100) square feet allowed within Eagle City Code. The applicant should be required to provide revised elevation plans showing the face of the sign on the entry feature located at the intersection of State Highway 44 and Edgewood Lane does not exceed one hundred (100) square feet. The revised elevation the DesignReview Board prior to the Cityissuing a and a roved by plans should be reviewed pp sign permit for this site. • Sheet SD-1, date stamped by the City on October 9, 2008, indicates the planting density and plant material proposed around both entry features is typical of the landscaping proposed around the two multi-tenant monument signs. The applicant should be required to provide revised landscape plans detailing the planting density and plant material proposed around the entry features located at the intersection of State Highway 44 and Edgewood Lane and the intersection of East Riverside Drive and Lone Cove Drive. The revised landscape plans should be reviewed and approved by the Design Review Board prior to the issuance of sign permit for this site. • The applicant is proposing to construct two multi-tenant monument signs along the frontage of State Highway 44. Per Eagle City Code a shopping center is allowed a monument sign on each street it fronts. Eagle City Code also permits any freestanding single tenant building within a shopping center a monument sign. It is Eagle's goal to leave everyone with a favorable impression of the community as one drives through this corridor, as this area defines the design standards for the rest of the city. Therefore, site, building, and landscape design is reviewed carefully through this corridor to help enhance Eagle's image. Signage is also one of the development features that is carefully reviewed. Although monument signs are, in part, allowed by code, it is the City's intention to minimize the number of monument signs along State Highway 44 which greatly helps reduce the amount of clutter along the street. With that said the current plan for Eagle Gateway South shows three (3) pad sites located along State Highway 44. Per Eagle City Code, each of these three (3) pads would be permitted a monument sign on their site along State Highway 44. While it is staff's opinion that allowing only two (2) multi- tenant monument signs is less intensive then the four (4) monument signs (one multi-tenant monument and three individual monument signs) that could be installed along State Highway 44, staff recognizes that State Highway 44 is within the Scenic Corridor and defers comment regarding the size and number of monument signs along State Highway 44 to the Design Review Board. • The applicant is requesting approval of master sign plan criteria for all future buildings proposed within The River District. As noted within the justification letter date stamped by the City on October 9, 2008, by obtaining approval of this master sign plan the applicant is requesting that a separate master sign plan for each building not be a requirement. While staff can appreciate the applicant wanting to reduce the number of applications staff has to complete in the future, staff sees a few issues with a"canned"master sign plan for the entire development. While we can hope that we have addressed any and all possibilities for the signage of all future tenants to be located within buildings we have never seen the architectural features or elevations of, it is inevitable that the one possibility that comes up will not be addressed in the criteria. If that is the case and the developer is willing to consider other options, not written in the existing criteria, the entire master sign plan for The River District will need to be modified to accommodate this change. Just because a certain type of sign is permitted in the master sign plan does not guarantee that all those signs would be appropriate on every building. The City has set a policy that when a design review application is submitted for a commercial building, a design review sign application is submitted at the same time. In the past the building was approved months prior to anyone thinking about submitting a design review application for signage. By the time the sign application came through for approval everyone had forgotten the specific materials used in the construction of the building or if there was even areas to consider for signage. Usually by this time the building was being constructed and making modifications to the building to allow for signage areas was expensive or to change out the materials to allow for signs was impracticable. Allowing the Board to review both the building and signage applications at the same time has reduced several of the issues noted above and has provided a more unified product in the end. Staff believes this is because signage placement, style, electrical, lighting, size, etc. have all been considered while the building is still in the design stages of the process. The written criteria that the applicant has provided has some great language and information provided within it; however, with that said, staff does not believe that all the written criteria would be approved as written. It is staff's opinion that the master sign plan criteria for The River District needs to remain more general but tie up a few things such as the type, size, color, font, or if logos would be permitted on the two multi-tenant monument signs. With that said, staff has created the following criteria for The River District. Master Sign Plan for The River District 1. Every owner of any proposed building within The River District shall be required to submit signage plans to the subdivisions managing entity for written approval. A design review sign application, accompanied by the written approval of the managing entity, shall be submitted to the City for any proposed signs for City review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with.
