DESIGN REVIEW BOARD
MINUTES
The Design Review Board met in regular session July 10, 2008, Chairman McCullough
presiding.
1. CALL TO ORDER: Chairman McCullough calls the meeting to order at 6:00 p.m.
2. ROLL CALL: The following members were present: MC CULLOUGH, GRUBB,
WHITTAKER, BUTLER, KOCI, COUNCIL LIAISON SHOUSHTARIAN. A quorum is
present. ABSENT: BARNES, NIBLETT.
3. CONSENT AGENDA.
. Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.

Grubb moves to approve the consent agenda as written. Seconded by Whittaker.

4. UNFINISHED BUSINESS:
A. DR-25-08 - CommerciallRetail Buildin2; for Spoons Kitchen Store - Jason and
Victoria Ritchie: Jason and Victoria Ritchie are requesting design review approval
to construct a two story, 2,864-square foot commercial/retail building for Spoons
Kitchen Store. The 0.28-acre site is located on the west side of Eagle Road
approximately 800- feet south of State Street at 221 South Eagle Road. This item was
continuedfrom the 6/12/08 meeting.
Victoria Ritchie, 221 Eagle Rd, the applicant, addresses the Board and states that they
wish to be moved forward to City Council for consideration.
Butler moves to approve DR-25-08 with the site specific and standard conditions
with the following additions to the site specific conditions and I will say what each
one is related to before I say it, the first one is related to zoning.
Site specific condition #14: The property has not been rezoned to CBD and this
proposed use is prohibited in an R-4 zone, therefore, prior to issuance of a zoning
certificate for the site the applicant shall execute and record the development
agreement for the site.
Site specific condition #15 is related to the driveway. Based upon the facts that (A)
ACHD has approved the narrow driveway as a TEMPORARY (in the findings this

should be bold and capitalized) driveway, (B) the speed limit on this section of Eagle
Road is 25 MPH, (C) the Ada County Sheriff's Office accident report for this
section of Eagle Road where this site is located (near Eagle Road and Plaza Drive)
shows only one accident per year for the last three years, (D) the requirement for the
building to be located in a pedestrian friendly manner close to the sidewalk, the
Design Review Board recommends approval of the temporary driveway as
submitted with the following condition which is to PROVIDE AN ASSURANCE
THAT THE DRIVEWAY WILL BE REMOVED IN THE FUTURE: Comply with
section 3.1 of the development agreement requiring cross access agreements with the
properties north and south and requiring that the cross access agreements be
reviewed and approved by the City Attorney and be executed and recorded prior to
the adoption of the ordinance to rezone this property.
Site specific condition #16 relates to the lot coverage not being in compliance with
20%. The Board recognizes the applicants care in designing the building footprint
to save the Catalpa tree (which is in very good condition, regardless of what the
arborist report indicates, as she went out there in the winter), just west of the
planned building and therefore in an effort to maintain the tree, the Eagle City
Code required minimum 20% lot coverage may be relaxed to allow the 17%
coverage provided. If the site plan is modified in a manner that the Catalpa tree is
to be removed, the applicant shall submit a variance application request to the City
in accordance with Eagle City Code, section 8-7-4-2 to allow a 17% lot coverage
where a 20% lot coverage is required, or enlarge the building to 20% lot coverage.
Site specific condition #17 relates to the wall that is kind of stark in nature and I
really appreciate the fact and I'm sure the Board does that you met with the Art
Commission, this just kind of clarifies where I think the Board should go with this
recommendation. Due to the stark nature of the south facing wall and its location in
relationship to the main entry into the City of Eagle, and to provide for compliance
therefore with Eagle City Code section 8-2A-6(A) and other Design Review
regulations requiring quality building design aesthetics, provide an agreement
signed by the owners of this property and the City allowing for use of the south
facing wall for public art as may be proposed by the City. Said agreement shall be
reviewed and approved by the city attorney prior to issuance of a zoning certificate
for the site.
Site specific condition #18 relates to the dumpster enclosure which I don't see on the
plans. In accordance with Eagle City Code section 8-3-2(D), provide revised plans
for review by the Design Review Board, this would be after going to Council if they
choose to keep this condition, showing the location of the required trash enclosure,
elevation of the enclosure, materials for the enclosure and colors of the enclosure.
Site specific condition #19 relates to the building design which has been tough for
the Board and tough for the applicants, design is always tough, because it's
somewhat subjective. Although the building design includes some of the elements of
the Prairie School architecture, the Eagle Architecture and Site Design book
adopted by ordinance of the City specifies that the Prairie School design is of the
1910-1925 era. The submitted design is MODERN in the Board's opinion and not
consistent with the period architecture. Therefore, in the Design Review Boards

opinion, the design should not be approved as submitted. Changes were requested
of the applicant and none were made. Therefore, the Board recommends that the
Council require the applicant to submit modified elevation plans to the Design
Review Board showing design elements conforming to the EASD book in the 1910-
1925 era.
Seconded by Grubb. ALL AYE...MOTION CARRIES.
B. DR-26-08 - Two Buildin2 Walls Si2n for Spoons Kitchen Store - Jason and
Victoria Ritchie: Jason and Victoria Ritchie are requesting design review approval
for two (2) building wall signs for Spoons Kitchen Store. The 0.28-acre site is
located on the west side of Eagle Road approximately 800- feet south of State Street at
221 South Eagle Road. This item was continuedfrom the 6/12/08 meeting.
Butler moves to approve DR-26-08 - Two Building Walls Sign for Spoons Kitchen
Store with the site specific and standard conditions, with the following condition
added, if the City Council requires that the building elevations be modified as
recommended, that the Design Review Board take a second look at the sign age.
Seconded by Whitaker. ALL AYE...MOTION CARRIES.
5. NEW BUSINESS:
A. DR-39-08 - One Monument Si2n for Busters Bar and Grill- LGJ. Inc dba
Busters: LGJ, Inc. dba Busters, represented by Evelyn Grime with Place! Inc., is
requesting design review approval to construct a monument sign for Busters Bar and
Grill. The site is located on the northwest corner of East State Street and Edgewood
Lane at 1396 East State Street.
Evelyn Grime, 100 Main Street, Ste. 201, Boise, Idaho reviews the application. Staff
member Cerda addresses the Board. Board discussion. Further discussion with the
applicant.
Grubb moves to approve DR-39-08 - One Monument Sign for Busters Bar and Grill
with the site specific and standard conditions of approval with the following
modifications:
Site specific condition #1. Strike.
Site specific condition #2. Replace in the first sentence 150 with 148.
Site specific condition #7. Provide revised drawing that show relief of lettering on
the sign to be approved by staff and one member of the Design Review Board.
Site specific condition #8. Provide a muted white background for the letter display
box as well as unified lettering and color of letters to be used in the sign box.
Site specific condition #9. Provide revised elevation showing posts to be a black
color, to be approved by staff and one member of the Design Review Board.
Site specific condition #10. The sign shall be no taller than 8 ft. above the center line
of road. Seconded by Butler. ALL AYE...MOTION CARRIES.

B. DR-95-04 MOD - Modification to the Master Sie:n Plan for a Multi-tenant
Office/RetaillRestaurant Buildine: Includine: Two Buildine: Wall Sie:ns for Cool
Hand Luke's Steakhouse and Saloon - Stonewvcke Partners, LLC: Stonewycke
Partners, LLC, represented by Angelina Bunnell with Young Electric Sign Company,
are requesting design review approval to modify a master sign plan for a multi-tenant
office/retail/restaurant building including two building wall signs for Cool Hand
Luke's Steakhouse and Saloon. The site is located approximately 135-feet south of
East Shore Drive within Eagle River Development (Lot 12, Block 4, Mixed Use
Subdivision No.3) at 291 East Shore Drive.
Angelina Bunnell and Leslie Brown 416 4151 Street, Boise, review the application with
the Board. Staff member Vanegas addresses the Board. Board discussion.
Grubb moves to approve DR-95-04 MOD - Modification to the Master Sign Plan for
a Multi-tenant Office/RetaillRestaurant Building Including Two Building Wall
Signs for Cool Hand Luke's Steakhouse and Saloon with the site specific and
standard conditions of approval with the following modification:
Site specific condition #5. The Design Review Board recommends that the sign on
the parking lot elevation be mimicked on the pond elevation with consideration of
Eagle Rivers approval. Seconded by Whittaker. ALL AYE...MOTION CARRIES.

'' Dear Design Review Board:
This letter is to confirm that the Eagle Arts Commission and Spoons Kitchen
F ` Store intend to work together on a public art project for the south side of the
e Spoons building to be located at 221 Eagle Road in Eagle, Idaho.
This project would be started and concluded during our next fiscal year of
', 2008-2009. If Spoons is not completed in time to complete this project
during the upcoming fiscal year, we would defer the project until the 2009-
2010 fiscal year. The project would be through the Eagle Arts Commission
and volunteer committee including Victoria Ritchie and will include a call to
artists with input from the citizens of Eagle and guidance from the City of
` - Eagle Design Review Board.
The terms of this letter of intent are informational until they become
