DESIGN REVIEW BOARD
MINUTES
The Design Review Board met in regular session April 10, 2008, Chairman McCullough presiding.
1. CALL TO ORDER: Chairman McCullough calls the meeting to order at 6:00 p.m.
2. ROLL CALL: The following members were present: MCCULLOUGH, BARNES, BUTLER,
NIBLETT, KOCI, COUNCIL LIAISON SHOUSTARIAN (arrived at 7:00 p.m.)
The following members were absent: GRUBB and WHITTAKER
3. CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless a Design Review Board member, City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion.
Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion
unless specifically stated otherwise.
A. Minutes of March 27, 2008.
Barnes moves to approve the consent agenda as it is shown. Seconded by Niblett.
Discussion: Butler will abstain from this motion since he was not present at the March 7, 2008
meeting. Koci also abstains for the same reason. ALL AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: None.
5. NEW BUSINESS:
A. DR-IS-OS - Site Modifications to The Landin!!: Communitv Center - Mark Priddv: Mark
Priddy, represented by Russ Phillips with Insight Architects, is requesting design review
approval of a dance studio and to modity the parking lot and associated landscaping for The
Landing Community Center. The 0.3 I-acre site is located on the south side of West State
Street approximately 400-feet west of Eagle Road at 149 West State Street.
Russ Phillips, 2238 Broadway Ave., Boise, reviews the application discussing the excessive curb
cut outs, the use of the building being the old Eagle Fire Station, and then stands for questions.
Staff member Cerda addresses several code sections that were deferred to the Board. She
discusses street trees and the transitional development area. She then stands for questions.
General discussion regarding ownership of neighboring parcels, Site Specific Condition No.5, the
parking agreement, street lights, a seat wall, landscaping, trash enclosures, mechanical units, and
the mail box.
Russ Phillips gives his rebuttal.
McCullough moves to continue this application with the following direction for the
applicant: provide a new site and landscape plan showing the two northern most planters to
be uniform in depth on both sides of the drive aisle, as well as modify the landscape to
reflect uniformity on both sides of the drive aisle. Provide a new site and landscape plan
showing two plaza areas north of the building. The plaza areas are to include benches and
planters. Cut sheets will be provided for those benches. The applicant will provide a verbal
plan to be submitted showing how the rear fascia and soffit will be repaired. The applicant
will also provide a verbal plan on how they will address the disrepair of the parking lot. The

applicant will replace the mail box with something more acceptable. The applicant will
paint the eastern C.M.U. wall to match the building. The applicant will provide a new site
plan showing a sidewalk running north and south on the west property line to allow
connection from the building to State Street. And also add another comment that all of the
other Site Specific Conditions will still apply. Seconded by Barnes. Discussion: providing
street light, landscape, and benches.
Chairman McCullough amends the motion, changing the comment in regard to the benches
in the plaza areas to reflect benches or other method for seating. Also, in regard to the Site
Specifics Conditions, they are to still apply. Also, a new site and landscape plan to be
submitted next week to reflect Site Specific Conditions to be required. Clarification on Site
Specific Condition No.5, in the case of the five foot landscape strip with the addition of the
sidewalk, the western landscape strip will be required. Second concurs. ALL
A YE...MOTION CARRIES.
B. DR-77-05 MOD - Modification to the Common Area Landscaoine: within Corrente Bello
Planned Unit Subdivision - Gemstar Develooment. LLC: Gemstar Development, LLC,
represented by Matthew Adams with The Land Group, is requesting design review approval to
modity the common area landscaping within Corrente Bello Planned Unit Development. The
94.89-acre site is located on the north side of Floating Feather Road approximately Yz-mile
west of Eagle Road on the west and north sides of Eagle Middle School.
Chairman McCullough introduces the item.
Matthew Adams, 462 E. Shore Drive, reviews the application.
Discussion regarding application only applying to Phase I.
Member Butler chooses to abstain from this application due to a possible conflict of interest.
Matthew Adams stands for questions.
Staff member Cerda reviews the application. She states the City of Eagle looks at this project as a
whole. She reviews areas of the project that could not be compromised. Those being the entry
way, the frontage landscaping, and the large Cottonwood tree.
Discussion regarding overhead power lines, the development being split, and application not
meeting the original intent. The project was originally based on an Italian style and the Hornbeam
trees fit that theme.
Discussion regarding trees along Floating Feather road and reference to a letter from Idaho Power
requesting the trees to be changed. The City Forrester requests 25 feet on either side of the power
line. The Board is willing to compromise with a minimum of 20 feet.
Scott Noriyuki, 738 Bridgeway Place, reviews the application.
Discussion in regard to the modifications to the landscaping. They were never given approval.
McCullough moves to continue this with the Site Specific Conditions along with the
following: strike through Site Specific Condition No.2 completely, replace it by stating that
the 21 Flowering Crab Trees that were installed by the applicant will be excepted in-lieu of
payment for the removal of the Cottonwood. Also, Site Specific Condition No.4 be added to
state that the Raywood Ash trees be replaced with Hornbeam trees. Condition No.5 is that
a new site plan be provided that also shows the location of the power lines along with the
landscaping, and the landscape plan will be drawn showing no trees larger than class one
trees within 20 feet of the power lines. Seconded by Barnes. Discussion: Scott Noriyuki asks
for a financial compromise, by having the Hornbeam trees go just up to the Gatehouse, rather than
continuing onto the property past it. Chairman McCullough feels this meets the entry effect.
Chairman McCullough amends the. motion to recommend approval with the site specific
conditions as stated before, along with the addition of Site Specific Condition No.6 - that

staff and one member of the Design Review Board review and approve the new plans to be
provided. Site Specific Condition No.7 stating a new landscape plan needs to be provided
showing the Raywood Ash trees replaced by Hornbeam trees from the South property to the
Gatehouse on both the East and West sides of the Boulevard. Second concurs.
Discussion: The option of the City not issuing any Certificates for Occupancy or possibly
assigning a time line for completion. Discussion regarding letter of credit and time restraint. ALL
AYE...MOTION CARRIES.
6. REPORTS:
A. Design Review Board: Chairman McCullough welcomes member Trent Koci to the
Board.
B. Council Liaison: None.
C. Staff: Staff member Cerda discusses progress with Handmade Retail along with banners
throughout the city.
7. ADJOURNMENT:
Barnes moves to adjourn. Seconded by Koci. ALL AYE...MOTION CARRIES.

Subject: Corrente Bello Development Phase 1: DR-77-05 MOD
Staff Report Response Letter
Dear Board Members:
Please accept this letter in response to the Design Review Staff Report for DR-77-05 MOD
dated April 10, 2008. Please note that The Land Group, Inc. represents solely Gemstar
Properties, LLC in this application and further more the application submitted and accepted on
February 8, 2008 represents solely Corrente Bello Development Phase 1, Owned by Gemstar
Properties, LLC and clearly depicted on the submitted and accepted Vicinity Map and landscape
plan sheet L3.00.
It is our understanding from the staff report that there are 3 focus areas for this application that
relate to Corrente Bello Phase 1; 1)Trees planted on the landscape berm adjacent to Floating
Feather Road, 2) Raywood Ash Trees planted on the west side of the main entrance to the
development, and 3) Removal of a mature Cottonwood tree located on Lot 24, block 2. Please
find below our formal response to the Staff Report.
• Focus area 1: There is an overhead power line located at the back of sidewalk adjacent
to Floating Feather. At the street frontage (1364 LF)there are approximately(7) London
Plane Trees and approximately(10)Tulip trees indicated on the approved DR plans. The
trees are located a minimum of 10' back of walk. This power line is also not a typical line
and is extremely high. Considering that the trees are on the approved plan the applicant
is requesting that removal of these (17)trees be at the discretion of the property owner.
It should be noted that after DR approval on October 18, 2005 the Planning &Zoning
Staff requested that 21 flowering crab apple trees be added, above and beyond the
approved DR plan requirements, in the Floating Feather Road landscape strip. Gemstar
Development, LLC complied with this request. The staff report indicates that the(17)
class II and III trees shall be removed and replaced with class I trees. If the Design
Review Board does insists that the trees be removed we request that due to the addition
of the (21)crab apple trees there be no requirement to replace the (17) removed trees.
• Focus area 2: We agree with the letter from Julie Lafferty, dated March 11, 2008,which
states that, "Ash trees grow well in the Treasure Valley, but they are prone to chronic
pest attacks by aphids and lilac ash borers." Like any living thing trees do require special
care in order to avoid pest and disease issues. The issue of aphids and borers is not

limited to the Ash tree and any property owner would be pressed to find a tree species
that is insect and disease free while maintaining the species mix required by the city.
The Corrente Bello HOA has established and executed a comprehensive landscape
maintenance program to prevent insect and disease issues in the landscape. This
program includes the following services;
o All trees and shrubs shall be pruned to eliminate dead, diseased, damaged,
rubbing or crowded limbs also any limbs which would encroach a walking path.
o All trees are to be deep root fertilized to promote healthy growth.
o Dormant oil shall be applied to trees and shrubs for control of insects.
In summary, while the substitution of Raywood Ash for the Hornbeam along the entrance
drive is not per the original submittal, it is still within the overall design theme for the
subdivision. This modification represents a 4% change to the tree planting on this
project. The Owner appreciates the comments provided by the City of Eagle but requests
that the replacement of these trees be at their discretion.
• Focus Area 3: The removal of the mature cottonwood tree was completed after
assessment of the tree by the Owner indicated that this tree could pose a risk and
burden to the future lot owner. The tree appeared to be dead and/or dying in the crown
and center. Cottonwoods are fairly short lived trees that are fast growing and week
wooded. This combination can result in loss of large limbs or the tree itself falling.
Per Eagle City Code Section 8-2A-7(C)(1)this tree could be replaced at a ratio of 1 x the
caliper of the tree removed. The tree in question has been more than mitigated for in the
development which contains approximately(1200)trees made up of 25 different species.
In summary,the Owner requests that the plant material installed be accepted as
mitigation for removal of the Cottonwood tree.
The applicant is requesting that the Design Review Board approve the common area landscape
in the Corrente Bello Subdivision—Phase 1 as presented with this application. Please contact
