The Design Review Board met in regular session on July 11, 2002, Chairman Murray presiding.
1.
CALL TO ORDER: Chairman Murray called the meeting to order at 6:10 p.m.
2.
ROLL CALL: The following members were present: MURRAY, MC CULLOUGH,
BARNES, PAULSON, STANGER, COUNCIL LIAISON MERRILL. Absent:
CHRISTENSEN. A quorum is present.
3.
CONSENT AGENDA.
. Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.

B. Findin2s of Fact and Conclusions of Law for DR-15-02 - Master Si2n Plan for
Ea2le River Development - Ea2le River LLC: Eagle River LLC, represented by
Debbie Anderson with Idaho Electric Signs, is requesting design review approval of a
master sign plan for the commercial area within Eagle River Development. The site is
located on the southeast corner of Eagle Road and State Highway 44.
The applicant is present and agrees with the findings of fact and conclusions of law set
forth in the staff report. No one from the public chooses to speak. This item will remain
on the consent agenda.
C. Findin2s of Fact and Conclusions of Law for DR-29-02 - Monument Sim. Fuel
Island Canopy Sh!n. and Fuel Pump Sims for Tesoro Petroleum at Justo's
Grocerv - Tesoro Petroleum: Tesoro Petroleum, represented by John Scheffey with
Core States Engineering, is requesting design review approval to construct a new
monument sign, fuel island canopy sign with decals, and fuel pump signs at Justo's
Grocery. The site is located on the northwest corner of State Street and Stierman Way
at 518 East State Street.

Subdivision. The site is located Y2-mile north of Floating Feather Road on the west
side of Meridian Road.

construct a 5,088-square foot office building. The site is located on the south side of

the south side of Riverside Drive approximately 1A-mile east of Eagle Road within
Eagle River Development (proposed Lot 6, Block 2, Mixed Use Subdivision No.3).

Aires Development LLC, represented by Phil Hull with The Land Group, is
requesting design review approval of the common area landscaping within
Brookwood Subdivision No.6. The site is located north of Floating Feather Road
adjacent to Brookwood Subdivision No.4 and Feather Nest Estates.
The applicant has requested that the Board review site specific condition #4.
McCullough moves to remove site specific condition #4 from the site specific
conditions under the findings and facts of conclusions of law. Seconded by Barnes.

F. Findin2s of Fact and Conclusions of Law for DR-33-02 - Wri2ht Brothers Office
Buildin2 - Kittvhawk Investments: Kittyhawk Investments, represented by BRS
Architects, is requesting design review approval to construct phase one of a three
phased office/retail project. This application is for the review and approval to
construct a 5,088-square foot office building. The site is located on the south side of
State Street within Periwinkle Subdivision at 779 East State Street (Lot 4, Block 1,
Periwinkle Subdivision).
Murray would like to correct site specific condition #2, line 3 to read "wood" fence
instead of "food" fence. Paulson moves to accept the modification of site specific

G. Findin2s of Fact and Conclusions of Law for DR-34-02 - RetaiVOffice Buildin2
within Ea21e River Development - Grossman Company Properties: Grossman
Company Properties, represented by BRS Architects, is requesting design review
approval to construct a 9,504-square foot retail/office building. The site is located on
the south side of Riverside Drive approximately lA-mile east of Eagle Road within
Eagle River Development (proposed Lot 6, Block 2, Mixed Use Subdivision No.3).
The applicant has requested that site specific condition #11 be modified to change to a
chain drop system. Also change site specific condition #13, change the language by
removing words "extremely pricey" and rewrite sentence. The applicant is present and
agrees with site specific conditions as amended.
Barnes moves to amend findings of facts and conclusions of law for DR-34-02 -
RetaiVOffice Building within Eagle River Development under site specific condition
#11 to read as follows: The roof drainage shall be of a chain drop system as
indicated by the applicant.
Site specific condition #13 shall be rewritten as follows: The applicant would like to
submit a different light fixture that is similar in design to what was proposed. The
applicant will provide a revised parking lot fixture detail to be reviewed by staff
prior to issuance of a building permit. Seconded by McCullough. ALL

PUBLIC HEARING:
A. DR-80-01 - Two Multi-Tenant Buildin2s - Mike Nihill: Mike Nihill, represented
by Mark Butler with Land Consultants Inc., is requesting design review approval to
construct two multi-tenant commercial buildings. The 2.6-acre site is located on the
east side of 2nd Street approximately 1,500-feet south of State Street. This item was
continued from the June 13, 2002 meeting.
Staff has requested that this item be continued to the August 2002 meeting.
Barnes moves to continue item DR- 80-02 - Two Multi-Tenant Buildings as per
staffs request to the August meeting. Seconded by Paulson. Barnes moves to amend
the motion to DR-80-01. Second concurs. ALL A YE...MOTION CARRIES.
B. DR-30-02 - Ea2le Familv Worship Church Facilitv - Ea21e Familv Worship:
Eagle Family Worship, represented by Shawn Nickel with Land Consultants Inc., is
requesting design review approval to construct two phases of a three phased church
facility. This application is for the review and approval of a 23,200-square foot
building and to convert a 1,300-square foot residential home into an office. This 4.9-
acre site is located on the northeast comer of Floating Feather Road and Park Lane at
3838 Floating Feather Road. This item was continued from the May 16,2002
meeting.
Mark Butler, 52 N. Second Street reviews the application.

McCullough moves to approve DR-30-02 - Eagle Family Worship Church Facility-
Eagle Family Worship with the site specific and standard conditions of approval,
modifying the existing site specific conditions as follows:
Site specific condition #3 shall have the following added: The landscape buffers
shall be increased and redesigned to within 9 ft of the edge of pavement along Park
Lane and Floating Feather to extend along Floating Feather in phase two and
continue within phase 3.
Site specific condition #5 shall read as follows: In addition to what is existing upon
the application for construction of phase 3 the parking shall be reevaluated with
regards to non-competing use of the existing phases.
Strike site specific condition #7.
Add site specific condition #12 as follows: The applicant will be required to provide
drawings and details and material samples of the storage and maintenance buildings
proposed with phase 1.
Site specific condition #13 shall read as follows: In addition to the above

requirements for the new landscape plan, the new landscape plan for phase 3 shall
address the open play area to be irrigated with an underground sprinkler system to
be graded and seeded with lawn. This requirement shall be in lieu of the landscape
buffer along Floating Feather from the end of phase 2 to the eastern end of the
property.
Site specific condition #14 shall read as follows: The new landscape plan provided
shall also address the interior courtyard plan for phase 2 and a time line for
installation of the redesign.
Seconded by Paulson. Discussion.
McCullough amends the motion, at the end of the first sentence site specific
condition #1, ending with frontage should continue with Park Lane and Floating
Feather.
Amend site specific condition #13 as follows: The irrigated graded and seeded lawn
areas shall be addressed for all areas other than phase 1 and shall be installed with
phase 1. An asphalt pathway connecting with the Floating Feather side of phase 2
shall continue to the eastern property line and shall also be installed with phase 1.
Add site specific condition #15 to read as follows: The Design Review Board has
reviewed the new building design from an 8 1/2 x 11 sheet. A new plan providing
additional detailing, including more of a contrast in color between the siding and the
stucco shall be provided to the Design Review Board and presented as an unfinished
business item at a future meeting.

C. DR-35-02 - Master Si2n Plan for the Ranch Buildin2 within Rockv Mountain
Business Park - Heartland Construction: Heartland Construction, represented by
George Transtrum, is requesting design review approval of a master sign plan for the
Ranch Building. The site is located on the south side of State Street approximately
200-feet east of Plaza Drive within the Rocky Mountain Business Park at 1121 East
State Street. This item was continued from the June 13, 2002 meeting.
George Transtrum, 550 W State Street apologizes for missing the June meeting and
discusses the application.

McCullough moves to approve DR-35-02 - Master Sign Plan for the Ranch Building
within Rocky Mountain Business Park - Heartland Construction with the following
modifications to the site specific conditions and standard conditions of approval:
Site specific condition #7 shall be modified to read as follows: In addition to what is
existing, the back ground color placed on the rusticated steel shall be consistent

throughout all the placards on the sign as well as the placards placed on the
building and will be of a color complimentary to the lighter colors on the building.
Site specific condition #11 shall read as follows: No banner signs what so ever shall
be allowed in the lawn area.
Site specific condition #12 shall read as follows: The sonotube pillars on the sign
proposed will be stucco similar in color to the sonotube pillars at the building
entrance.
Site specific condition #13 shall read as follows: The applicant will provide a license
agreement for any landscaping on the public right of way or adjust the sign location
to the south so that new proposed landscaping would be entirely upon this property.
Site specific condition #14 shall read as follows: A new landscaping plan will be
provided with redesign on each side of the new sign to include taller plants stepping
down to smaller plants in order to anchor the pillars of the sign to the ground. The
new landscaping plan will address the appropriate landscaping to screen the light
fixtures year round. This landscaping plan shall be provided to staff and one
member of the Design Review Board.
Seconded by Barnes. Discussion.
McCullough moves to amend the motion as follows: Strike site specific condition #3,
#5 and #6. Also would like to amend site specific condition #14 as follows: This new
landscaping plan shall include an area no less than 80 square feet for landscaping.
The Design Review Board recognizes the limitations of the space in maintaining 100
square ft., 80 sq. feet would be acceptable. Second concurs. Discussion. ALL

D. DR-36-02 - Bledsoe Flex Space Buildin2 within Rockv Mountain Business Park-
Steve Bledsoe: Steve Bledsoe, represented by George Transtrum with Heartland
Construction, is requesting design review approval to construct a 18,370-square foot
flex space building within the Rocky Mountain Business Park. The site is located on
the north side of Iron Eagle Drive, approximately 300-feet west of Edgewood Lane at
1468 East Iron Eagle Drive (Lot 2, Block 1, Merrill Subdivision No.2).

Barnes moves to approve DR-36-02 - Bledsoe Flex Space Building within Rocky
Mountain Business Park with the site specific conditions of approval and standard
conditions of approval set forth in the staff report with the following revisions to the

site specific conditions of approval:
Site specific #3 shall read as follows: Provide a reyised landscaping plan showing
minimum of 10% interior landscaping within the parking lot. If this can be
accomplished without changing the size and elevations of the building, the revised
landscape plan can be viewed by staff and one member of the Board, if that is not
able to be accomplished, this item needs to be brought back at the next Board
meeting, regularly scheduled.
Site specific condition #4 shall have the following added: Provide a cut sheet of a
light fixture showing less projection from the building.
Site specific condition #5 shall have the following sentence added: If a question
arises between the windows and doors as opposed to the walkways we should
default to the floor plan as shown.
Site specific condition #9 shall read as follows: It is the opinion of the Design
Review Board that the metal roofing as indicated on the plans should be the roofing
of choice.
Site specific condition #10 shall read as follows: It is the request of the Design
Review Board that the following items be submitted as an unfinished business,
further definition of color for the building, parking lot lighting showing one light
fixture in the north west corner adjacent to the trash enclosure and any design
revisions, if needed, as stated in site specific condition #3.
Seconded by Stanger. Discussion. Barnes moves to amend the motion. Site specific
condition #9 shall read as follows: The applicant had indicated a desire for an
alternate roofing be permitted, the Design Review Board does not wish to permit an
alternate roof material, other than the metal as shown.
Site specific condition #10 shall be revised as follows: The Board wishes to define
the colors to be used on this building so as to show a little more disparity in color
and to get away from the more bland look of the building as the color board has
indicated.
Site specific condition #11 shall read as follows: The new landscape plan shall
include larger plant material on the front profile of the building in order to break
up the large frontal plane. Large plant material shall be placed around trash
enclosure per City Code.
Site specific condition #5, change to site plan rather than floor plan. Second

E. DR-38-02 - Six Professional Office Buildin2s and Common Area
Landscapin2 within Cottonwood Creek Subdivision - Cottonwood Creek LLC:
Cottonwood Creek LLC, represented by David Waldron, is requesting design review
approval to construct six (6) 5,300-square foot professional office buildings and
common area landscaping within Cottonwood Creek Subdivision. The site is located
on the west side of Eagle Road approximately 150-feet north of Co1chester Drive at
2421 North Eagle Road.

Murray moves to approve DR-38-02 - Six Professional Office Buildings and
Common Area Landscaping within Cottonwood Creek Subdivision with the site
specific and standard conditions of approval set forth in the staff report with the
following amendments to the site specific conditions of approval:
Site specific condition #4 shall have the following sentence added: At the July 2002
Design Review Board meeting the applicant provided supplemental information
indicating compliance with this particular site specific condition, that information
shall be reviewed by staff and approved by staff prior to issuance of a building
permit.
Site specific condition #7 shall have the following added: The applicant shall be
required to provide protection on the two existing trees within the cul-de-sac as
required under site specific condition #3. Should the construction of this cul-de-sac
warrant their removal, a revised landscape plan for the cul-de-sac shall be
presented to staff and one member of the Design Review Board.
Site specific condition #13 shall read as follows: The Design Review Board has
reviewed the report provided by Jerry Stahlsmith evaluating the existing trees and
makes the following recommendations: Tree #5 shall removed without penalty, tree
#6 shall be relocated and saved, tree #7 shall be relocated and saved, tree #8 shall be
relocated and saved, tree #9 shall be removed without penalty, tree #10 shall be
saved, tree #11 shall be removed without penalty, trees in area 12, 13, and 14
retained as identified. Trees in area 15 shall be thinned to accommodate the
construction of the parking lot. Trees in area 16 shall be saved. Trees in area 17
shall be removed without penalty. Trees in areas 18 & 19 shall be saved. Trees in
area 20 shall be removed without penalty. Trees in area 21 & 22 shall be saved and
the Design Review Board supports the removal of all Russian Olives with the
exception of area 22.
Site specific condition #14 shall read as follows: The applicant shall be required to
provide an undulating berm along the frontage of Eagle Road to provide vertical
movement of the grade to a maximum height of 3 ft. and a minimum height of 1 ft.
along the street perimeter. The design shall be reviewed by staff and one member of
the Design Review Board prior to issuance of a building permit. The berm shall
vary in that distance from the center line of Eagle Road and not from the location of

the current property.
Site specific condition #15 shaD read as follows: The applicant shall be required to
tie into the existing pedestrian pathway in Banbury Meadows on the south side of
the property.
Site specific condition #16 shall read as follows: The applicant shall be required to
show a lighting photometric plan of the commercial site that indicates compliance
with Eagle City Code for lighting of parking lots. The applicant has identified that
a series of lighting types, i.e., bollards, landscape lighting and building lighting shall
be used to accommodate that lighting need. Should additional light fixtures be
required, said fixtures shall be reviewed by staff and one member of the Design
Review Board prior to issuance of a building permit.
Site specific condition #17 shall read as follows: The applicant shall be required to
provide a revised landscaping plan showing the three buildings on the south side of
this development to provide a connection between the individual landscape
perimeters.
Site specific condition #18 shall read as follows: The applicant is requested to
provide landscaping differences in the front entrances to the buildings to provide a
subtle change in appearance. The differences can be considered in landscape
material, species, type and color.
Site specific condition #19 shall read as follows: The applicant is encouraged to
provide subtle changes to the building architecture with respect to material
selections and color. It is not the intent of the Design Review Board to provide
individual identities for all buildings, but promote harmony among the building
design rather than identical color and material pallets in each building.
Site specific condition #20 shall read as follows: The historic light fixtures that are
shown as street lighting within this development shall have a solid finial and be dark
sky tolerant. The revised lighting fixture shall be reviewed by staff prior to issuance
of a building permit.
Site specific condition #21 shall read as follows: The applicant shall be required to
identify the exterior walkway or pathway transition to be either a stepping stone or
hardscape at time of building permit. Those stepping stones or pathway shall be
incorporated in the landscape design.
Going back to site specific condition #5: The landscape lighting, monument sign
lighting and bollard lighting within the commercial section of this development, the
Design Review Board supports the use of metal halide fixtures since the applicant
has identified compliance with Eagle City Code 8-4-4-2 (A) (7) (a), (b), and (c).
Site specific condition #22 shall read as follows: The Design Review Board supports
the location of the phasing line as identified on landscape plan DR-2, dated 5-28-02.
Site specific condition #23 shall read as follows: The applicant has identified that all
roof top drainage for these commercial buildings will be handled through perimeter
gutter and down spout collections.

The Design Review Board supports the unique design and layout of this
development and considers it a great example of blending the commercial and built
environment with the natural environment that surrounds.
Seconded by Paulson. Discussion. Murray amends the motion with regard to roof
drainage that it be a series of perimeter gutters and chain drops rather than down

F. DR-39-02 - Common Area Landscapin2 within Timberland Estates Subdivision
- Capital Development LLC: Capital Development LLC, represented by David
Koga with The Land Group, is requesting design review approval of the common area
landscaping within Timberland Estates Subdivision. The site is located on the north
side of State Highway 44 approximately lA-mile west of Ballantyne Road at 2800
West State Street.
Jeremy Ainsworth with The Land Group, 128 S Eagle Rd. reviews the application.

Mark Butler, 1640 Washam Road, states that the landscaping in Countryside is beautiful
and he believes that the Yorgason's do a great job with their developments.
Dave Yorgason, 6200 N Meeker PI, Boise, Idaho, Capital Development, speaks on behalf
of this development and answers questions regarding existing trees on this site.

Murray moves to approve DR-39-02 - Common Area Landscaping within
Timberland Estates Subdivision with the site specific and standard conditions of
approval set forth in the staff report with the following amendments to site specific
conditions:
Site specific condition #7 shall be amended to include all engineering and arborist
fees incurred with this project.
Site specific conditions #10 shall read as follows: The Design Review Board, after
review of the arborist report, identifies the following trees can be removed from this
subdivision without penalty, trees #10,11,12,13, and 26.
Site specific condition #11 shall read as follows: The applicant shall review the
condition of tree #4, identified in the arborist report as a 38 inch Elm, but a 40 inch
caliper tree on the landscape plan, for evaluation and retention. Should it be
determined that the arborist report is followed in that the tree is to be removed, the
applicant shall be required to provide a revised landscape plan submitted to staff
and reviewed by one member of the Design Review Board prior to issuance of a
building permit. If the tree is to be removed, additional landscaping making up the
berm will suffice as compensation for this removal.
Site specific condition #12 shall read as follows: The applicant is required to
provide thinning of the existing trees within lot 2, block 1 and lot 4, block 3.

Thinning shall be done by an arborist or licensed tree surgeon and shall be done
prior to issuance of a certificate of occupancy for that particular lot. The existing
trees that remain along the perimeter of the property can be retained as identified in
the landscaping plan without additional tree thinning activity.

G. DR-40-02 - Monument Si2n for Timberland Estates Subdivision - Capital
Development LLC: Capital Development LLC, represented by David Koga with The
Land Group, is requesting design review approval of a monument sign for Timberland
Estates Subdivision. The site is located on the north side of State Highway 44
approximately lA-mile west of Ballantyne Road at 2800 West State Street.
Barnes moves to approve DR-40-02 - Monument Sign for Timberland Estates
Subdivision with the site specific and standard conditions of approval as set forth in
the staff report. Seconded by Paulson.
Barnes amends the motion to add site specific condition #4 as follows: A site
landscape plan be submitted showing the boulders as noted in the drawing to be
included with the sign. This can be reviewed by staff. Second concurs. ALL

H. DR-41-02 - Monument Si2ns and Directional Sim for Old Town Square - Old
Town I. LLC: Old Town I, LLC, represented by Mark Butler, is requesting design
review approval to construct two monument signs and one directional sign for Old
Town Square. The site is located on the northeast corner of State Street and 2nd Street
at 222 - 360 East State Street.
Mark Butler, 52 N Second St. is the applicant and reviews the project.

Murray moves to approve DR-41-02 - Monument Signs and Directional Sign for
Old Town Square with the site specific and standard conditions of approval set
forth in the staff report with the following amendments to the site specific
conditions:
Site specific condition #1 shall read as follows: The existing dirt area at the base of
the perimeter wall shall be landscaped to provide as much compliance with Eagle
City Code as allowed. The Design Review Board supports the quantity of
landscaping below the wall as meeting Eagle City Code.
Site specific condition #2 shall be stricken and rewritten as follows: The Design
Review Board supports the construction and placement of the second monument
sign as proposed by the applicant which meets Eagle City Code 8-2A-2(a)(3) by
improving the design guidelines downtown development and allowing flexibility for
the applicant for this unique property configuration.
Site specific condition #5 shall read as follows: The Design Review Board supports

the temporary relocation of the existing City Hall monument sign to the east side of
the driveway.
Seconded by McCullough. Discussion. Murray amends the motion to add site
specific condition #6 as follows: The Design Review Board supports the installation
of a pole mounted sign on the existing light poles as presented with this application.

NEW BUSINESS:

A. Merrill would like to add for discussion the berm at Castlebury Subdivision.
Dave Yorgason explains the problem of the berm slope to the Board.
The Design Review Board recommends an action to support the currently existing
2:1 slope at Castlebury Subdivison on the back side of the berm due to DEQ
requirements. The Design Review Board also supports the idea of installing a non-
mowed fescue blend on the back side of the berm in order to avoid future
maintenance problems. The back side of the berm with the fescue blend shall also
be maintained with underground irrigation as originally proposed. Roll call of all
members of the Design Review Board. All aye, recommended by all Board
members, grass shall be installed by the homeowner.
B. Homeowner that would like trees removed from OK Park.
Murray recommends that trees should not be removed and should be left in the City
park. Seconded by Paulson. ALL A YE...MOTION CARRIES.
C. Tree in Heritage Park, safety of tree and if tree should be trimmed.
The Board would recommend that Terrys Tree Service be contacted to take a look
at this tree and trim when necessary.
