DESIGN REVIEW BOARD
MINUTES
The Design Review Board met in regular session on September 13,2001, Chairman Murray
presiding.

CALL TO ORDER:

ROLL CALL: The following members were present: MURRAY, MC CULLOUGH,
CHRISTENSEN, BARNES, Absent: KENISON, COUNCIL LIAISON MERRILL. A
quorum is present. Merrill arrives at 6:05.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.

B. DR-52-01 - Monument Sie:n for J Bar K Custom Homes - .Jim and Marsha Band:
Jim and Marsh Band are requesting design review approval to construct a monument
sign for J Bar K Custom Homes. The site is located on the west side of Eagle Road
approximately 600-feet south of State Street at 209 South Eagle Road.
Barnes moves to remove from consent agenda and place with item 5c. Seconded by
McCullough.
C. DR-S9-01 - Two Buildine: Wall Sie:ns for COpy Express - David Brady: David
Brady is requesting design review approval to construct two building wall signs for
Copy Express. The site is located on the north side of State Street approximately 500-
feet east of Stierman Way at 650 East State Street within the Realty World multi-
tenant building.
Murray introduces the item. Applicant is present and agrees with staff report. No one
from audience chooses to speak. This item will remain on the consent agenda.
D. DR-60-01 - Two Entry Sie:ns to Countryside Estates Subdivision - Countryside
Estates: Countryside Estates LLC, represented by David Koga with The Land Group,
is requesting design review approval to construct two monument signs for the entry to
Countryside Estates Subdivision. The site is located on the northwest comer of State
Highway 44 and Ballantyne Lane.

Eagle River LLC, represented by Phil Hull with The Land Group, is requesting design
review approval of the street lighting within Eagle River Subdivision. The site is
located on the southeast comer of Eagle Road and State Highway 44.

northwest comer of Eagle Road and Ranch Drive at 653 North Eagle Road.

Subdivision (formally Wedge wood Subdivision). The site is located on the west side
of Locust Grove Road approximately ~ mile north of Chinden Boulevard.

4. UNFINISHED BUSINESS:
A. DR-68-00 - Common Area Landscauine: for Banbury Meadows Subdivision No.
S - Banbury Meadows LLC: Banbury Meadows LLC, represented by Dick Phillips,
is requesting design review approval of the landscaping within the common area of
Banbury Meadows Subdivision No.5. The site is located on the east and west sides
of Locust Grove Road extended approximately Y2 mile north of Chinden Boulevard.
This item was continued from the August 16,2001 meeting.
Barnes moves to deny DR-68-00 - Common Area Landscaping for Banbury
Meadows Subdivision No. S - Banbury Meadows LLC and that the applicant at
such time they get the items worked out with the adjoining neighbors and ACHD
would be required to reapply and be heard before the Board. Seconded by
McCullough. Barnes amends motion to include the reason for Design Review Board
denial is the continuation of the application since the January 2001 meeting. Second

B. DR-70-00 - Street Lie:ht Plan for Eaele River Subdivision - Eae:le River LLC:

Murray moves to approve DR-63-01 - Two Building Wall Signs for Holland Realty
with the site specific and standard conditions of approval set forth in the staff report
with the following modifications to the site specific conditions of approval:
Site specific condition #3 shall read as follows: Compliance with the conditions of
the master sign plan of Eagle Forum multi-tenant building (DR-63-00) will require
the removal of the phone number for Holland Realty as represented in this
application. The Design Review Board recognizes the term sculptured cabinet
construction to be something other than a four-sided straight cornered cabinet sign.
The Design Review Board requests the applicant to provide the red plexi

background with the gold edge trim as represented in tonight's application and
directly mount that construction to the building facia. Should the applicant not seek
approval with the building owner the applicant shall call upon staff and one
member of the Design Review Board to review any modifications to this approval
prior to issuance of a sign permit. Seconded by McCullough. ALL A YE...MOTION

A. DR-42-00 MOD - Buildine:. Site. and Landscape Modifications to Eae:le Floral
Shop - Steve Conklin: Steve Conklin is requesting design review approval to modify
the building, site, and landscape improvements for the Eagle Floral Shop as originally
proposed. The site is located on the east side of Palmetto A venue approximately 250-
feet north of State Street at 52 North Palmetto Avenue (Lot 1, Block 1 of Fuerte de la
Aguila Subdivision). This item was continued from the August 16,2001 meeting.

McCullough moves to approve DR-42-00 MOD - Building, Site, and Landscape
Modifications to Eagle Floral Shop with the site specific conditions and standard
conditions of approval with the following modifications to the site specifics:
Eliminate site specific condition #1.
Site specific condition #2 shall be amended as follows: The Design Review Board
emphasizes the importance of this specific condition and additionally, cups shall be
built within the drip line of each tree in order to retain water. The fencing shall be
constructed, not "do not cross" tape and no activity whatsoever within the drip line
of the trees shall occur.
Eliminate site specific condition #8.
Add site specific condition #10 as follows: The landscape plan shall be redesigned
and presented to staff and one member of the Board to reflect the following
changes: The Red Twig Dogwoods at the entry shall be replaced with a dwarf
variety in order to maintain the sight vision triangle. The Honey Locust indicated to
be 2 1/2 inches shall be replaced with a 3 inch Honey Locust. The center Norway
Spruce most adjacent to the building shall be eliminated. Seconded by Barnes.
McCullough amends the motion. Site specific condition #2 shall be as follows:
Wherever 10 ft. from the trunk or drip line is referenced please add drip line or 10
ft. from the trunk whichever is closest. Second concurs. ALL A YE...MOTION

B. DR-29-99 MOD - Existine: Landscapine: at the Eae:le Church of the Nazarene -
Eae:le Church of the Nazarene: Eagle Church of the Nazarene, represented by Mark

Butler with Land Consultants Inc., is requesting design review approval of the
existing landscaping at the Eagle Church of the Nazarene which has been modified
from the approved landscape plan for this site. The site is located on the south side of
State Street approximately %-mile west of Eagle Road at 1001 West State Street.
Kris Turner, 52 N 2nd St., Land Consultants, represents the applicant. Turner answers
questions from the Board.

McCullough moves to continue DR-29-99 MOD - Existing Landscaping at the Eagle
Church of the Nazarene until the next regularly scheduled Design Review Board
meeting. Seconded by Christensen. Discussion. McCullough amends motion to add
the reasoning behind the Design Review Board's continuance is the lack of clarity
and description for reasoning of not following the original plan. When this
application comes back before us we would either like to see a closer representation
to the approved landscaping plan or legitimate reasons why the original plan was
not followed. Second concurs. ALL A YE...MOTION CARRIES.
C. DR-SI-0l- Remodel Residence into an Office - .Jim and Marsha Band: Jim and
Marsha Band are requesting design review approval to remodel an existing residence
into an office. The 0.42-acre site is located on the west side of Eagle Road
approximately 600-feet south of State Street at 209 South Eagle Road.
Murray introduces the item. Jim Band, 3829 Brookside Lane, Boise presents the
application. Item DR-52-01 - Monument Sign for J Bar K Custom Homes will also be
discussed at this time. Discussion amongst the applicant and the Board regarding
signage.

Murray moves to approve DR-SI-0l- Remodel Residence into an Office with the
site specific and standard conditions of approval set forth in the staff report with the
following modifications:
Delete site specific condition #1.
Site specific condition #3 shall read as follows: Provide a revised site and landscape
plan showing picnic tables, benches and other pedestrian amenities and natural
vegetation near the Eagle Drain at the time of submittal for phase two of this
development.

Site specific condition #6 shall read as follows: The applicant shall review the extent
of removal of the existing concrete sidewalk along the frontage area of this property.
Should more than SO % of the existing concrete be required to be replaced as part of
the ACHD access improvements then the applicant shall be required to provide
additional press stamped concrete or brick pavers with association for standards set
forth in Eagle City Code for pedestrian pathways. The revised site plan shall be
reviewed and approved by staff prior to the issuance of a building permit.
Site specific condition #7 shall read as follows: The Design Review Board supports
the removal of tree #6, the 28 inch caliper Tulip tree with this application. The
applicant shall be required to provide an additional 28 inch tree caliper and 6 inch
tree caliper in a revised landscaping plan as part of phase two development. The
additional tree caliper inches shall be in excess of what is typically required of Eagle
City Code and should not be considered a replacement of Eagle City Code
requirements.
Site specific condition #8 shall read as follows: The applicant shall be required to
provide full construction fencing around the drip line of all existing trees. The
fencing shall remain in place until finished grading operations commence. No
construction operation of any kind is permitted within the construction fencing.
The applicant shall also be required to provide a 1 ft. high water dam around the
trees to be maintained until final grading.
Site specific condition #9 shall read as follows: The existing fencing to be used as
the south wall of the trash enclosure shall be considered acceptable to the Design
Review Board without buffering. It is the intent of this application to move the
trash enclosure to phase two of this development at which time the code compliant
screening shall be installed.
Site specific condition #13 shall read as follows: The applicant is required to
indicate the location of all ground mounted air-conditioning units and provide a
revised landscape plan to show screening in compliance with Eagle City Code. Said
landscape plan shall be reviewed by staff and one member of the Design Review
Board prior to issuance of the building permit. Seconded by Barnes. ALL

B. DR-52-01 - Monument Sie:n for .J Bar K Custom Homes - Jim and Marsha Band:
Jim and Marsh Band are requesting design review approval to construct a monument
sign for J Bar K Custom Homes. The site is located on the west side of Eagle Road
approximately 600-feet south of State Street at 209 South Eagle Road.
Murray moves to approve DR-S2-01 - Monument Sign for J Bar K Custom Homes
with the site specific and standard conditions of approval set forth in the staff report
with the following modifications to the site specific conditions of approval:
Site specific condition #3 shall read as follows: The applicant is encouraged to
consider modifications to this monument sign with respect to future development of
phase two. Should the size of the sign be affected with this modification the
applicant shall be required to return to the Design Review Board as a matter of
unfinished business. If the size of the sign remains the same the approval can

remain with staff.
Site specific condition #4 shall read as follows: The applicant is required to provide
permanent screening, with plant material, of the exposed steel post at the base of the
sign. The landscaping is encouraged to also have permanent plant material as well
as a mixture of perennials and annuals which can be reviewed by staff and one
member of the Design Review Board prior to issuance of a sign permit. Seconded
by McCullough. ALL A YE...MOTION CARRIES.

D. DR-S7-01 - Landscapine: and Amenities within Reid Merrill Sr. Community
Park - City of Eae:le: The City of Eagle, represented by Don Belts with Jensen-Belts
Associates, is requesting design review approval of the landscaping and park
amenities, which include restroom and picnic facilities, pathways, playground
equipment, basketball and volleyball courts within the Reid Merrill Sr. Community
Park. The 8.7-acre site is located south and east of a portion of the Eagle River
development and north of the north channel of the Boise River.
Murray introduces the item. Don Belts, 495 Main St., Boise represents the applicant.
Kathy Sewell, 565 W Myrtle, Boise discusses the architecture of the park.
Staff has nothing to add.

McCullough moves to approve DR-S7-01- Landscaping and Amenities within Reid
Merrill Sr. Community Park with the site specific and standard conditions of
approval with the following modifications to the site specific conditions:
Site specific condition #2 shall be stricken.
Adding site specific condition #6 to read as follows: The landscape and site plan will
be provided at a later date for Design Review under unfinished business. It will
reflect the following: All shade class trees shall be 3 inch in caliper, there will be
minimal security lighting provided on the buildings, details of the bridge materials,
type and construction will be provided and details of the playground and water
park will also be provided. Seconded by Christensen.
McCullough amends motion with regards to the lighting on the building the
architect will have the option and is encouraged to up-light verses sconce lighting.
Second concurs. ALL A YE...MOTION CARRIES.
E. DR-S8-01 - Two Buildine: Wall Sie:ns and Three Directional Sie:ns for the Kev
Bank Facilitv - Kev Bank: Key Bank, represented by Jeff Carico with Image
National Signs, is requesting design review approval to construct two building wall
signs and three directional signs for the Key Bank facility. The site is located on the
north side of Chinden Boulevard approximately 50-feet east of Eagle Road within
Eagle Marketplace at 3410 East Chinden Boulevard.

Barnes moves to approve DR-S8-01- Two Building Wall Signs and Three
Directional Signs for the Key Bank Facility with the site specific and standard
conditions of approval as written with the following addition to the site specific
conditions of approval:
The surround sign for the A TM be constructed in such a manner that the key logo
at the top be smaller, or at the discretion of the client the word Key Bank or the key
or a combination of both be put on the sign either above the A TM or below, but not
including both areas and that the Design Review Board recognizes the uniqueness of
this site and therefore we recommend to Council that an exception to the one wall
sign be permitted for this location and that the directional signs would each have a
red key on them to denote the Key Bank. Second by McCullough. Discussion.
Barnes moves to amend the motion as follows: In regard to the surround sign for
the A TM that the upper portion of the surround sign would be reduced to 1 ft. in
height and that either the key or the words Key Bank could be used, not both and
that the Design Review Board recognizes the uniqueness of the site therefore the
reason that we are proposing two wall mounted signs is because of the lack of space
on the current monument sign and that we would support modification of the
monument sign to increase signage. Second concurs. Discussion. Barnes amends
motion on the A TM surround the bottom placard would be eliminated. Second

This letter is in regard to the application #DR -29-99 MOD submitted by Eagle Church
of the Nazarene. We, Wayne & Kathy Swanson, had previously agreed to the
elimination of the fence along our adjoining property line with the church. The
primary reason for our agreement to the elimination of this expense for the church
was the anticipated landscaping to include trees and sod along the property line, not
bark as has been installed. The cost of installing sod is not much different than the
cost of installing bark, and we are disappointed with the church's choice of materials.
We signed an agreement waiving installation of the fence and are people of our
word. However, we would hope that both sides of the agreement would be kept.

Re: Eagle Nazarene Church DR -29-99 MOD
Dear Design Review Board Members and Staff,
The site plan shows that the total number of inches short is 12.25 to the total number of extra inches is
28.25. We asked that the extra inches be considered. The congregation was very helpful in planting all
of the trees. When Mark asked them to replace the trees in front of the building with 3 inch caliper
deciduous trees, they put the trees they took out in the back by the building. .
We would like to propose a condition that says: the site plan dated July 12, 2001 is approved with the
following stipulation. On the East Side of the parking lot, remove the trees and plant at the side and in
the back of the building and provide low level shrubs and one 3 inch caliper tree in the Large Planter,
on the east side of the parking lot, and submit to staff and one board member for review.
