July 19, 2001
The Design Review Board met in regular session on July 19,2001 Chairman Murray presiding.

CALL TO ORDER

ROLL CALL: The following members were present: MURRA Y, MC CULLOUGH,
KENISON, BARNES, CHRISTENSEN, Absent: COUNCIL LIAISON MERRILL. A
quorum is present. Merrill arrives at 6:08.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless a Design Review Board
member, City Staff, or a citizen requests an item to be removed from the Consent
Agenda for discussion. Items removed from the Consent Agenda will be placed on the
Regular Agenda in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Design Review's Consent Agenda
approval motion unless specifically stated otherwise.

B. DR-29-00 - Extension of Time for Two Office Buildine:s and Two Accessorv
Buildine:s - Dave Rovlance: Dave Roylance, represented by Mark Butler with Land
Consultants Inc., is requesting a one year time extension for the two office buildings
and two accessory buildings proposed at 2178 E State Street.

C. DR-46-01 - Master Sie:n Plan for Rivershore North and Rivershore South Multi-
Tenant Buildine:s Located within Channel Center Subdivision- Dennis Baker:
Dennis Baker and Associates, is requesting design review approval of a master sign
plan for the Rivershore North and Rivershore South multi-tenant buildings. The site
is located on the west side of Rivershore Lane approximately 300-feet west of Eagle
Road at 599 S. Rivershore Lane.

Company: US Timber Company, represented by Patrick McKeegan, is requesting
design review approval of the existing monument sign for the US Timber office
building. The site is located approximately 300-feet west of Eagle Glen Lane at 222
West State Street.

report.

A. DR-68-00 - Common Area Landscapine: for Banburv Meadows Subdivision No.
S - Banburv Meadows LLC: Banbury Meadows LLC, represented by Dick Phillips,
is requesting design review approval of the landscaping within the common area of
Banbury Meadows Subdivision No.5. The site is located on the east and west sides
of Locust Grove Road extended approximately Y2 mile north of Chinden Boulevard.
This item was continued from the June 28,2001 meeting.
Murray notes that the applicant has requested to be continued to the August meeting.

Barnes moves to approve DR-47-01-Building Wall Sign with Reader Board for
Seven Oaks Elementary with the following site specific conditions of approval:
Site specific condition #3. It is recommended by the Design Review Board that the
size of the sign be increased to include an area below the letters "Elementary
School" and above the actual reader board area, the area would match the soldier
course now on the building of brown iron spot to create an aesthetically pleasing
look to the building. Seconded by Kenison. Barnes amends the motion to approve
the signage of the reader board with conditions stated above and also to include the
standard conditions of approval. Second concurs with amendment. ALL
A YE...MOTION CARRIES.
C. DR-29-01 - Common Area Landscapine: within Yorkshire Acres Subdivision -
Robert DeShazolBerkshire West: Robert DeShazolBerkshire West, represented by
Douglas Landwer, is requesting design review approval of the common area
landscaping within Yorkshire Acres Subdivision. The site is located on the south side
of Floating Feather Road approximately 800-feet east of State Highway 55 at 2471
East Floating Feather Road.
Murray inquires if the Board wishes to hear DR-29-0l tonight.
Kenison moves to hear DR-29-01-Common Area Landscaping within Yorkshire
Acres Subdivision. Seconded by McCullough.
Murray introduces the item. Douglas Landwer is present. Mr. Landwer discusses the
application and makes himself available for questions.

Murray moves to approve DR-29-01 Common Area Landscaping within Yorkshire
Acres Subdivision with the site specific and standard conditions of approval with
amendments to the site specific conditions of approval as follows:
. Site specific condition #2 shall be revised as follows: The developer has
presented in a landscape plan prepared by Tealy Land Surveying dated April,

2001, 3 inch caliber trees located sporadically along the right of way of South
Hampton Place. The Design Review Board recognizes these trees in their
designed position as meeting the intent of the site specific guideline set forth in
the preliminary plat. The trees shall be located in the landscape strip between
the sidewalk and the curb as presented on the plan. Prior to the City Clerk
signing the final plat for each phase, the applicant shall either install the
designed trees, landscaping and irrigation or provide the City with a letter of
credit for ISO % of the cost of the installation of all landscape and irrigation
improvements within the five foot landscape strip. Trees shall be installed prior
to obtaining any occupancy permits for the homes. A temporary occupancy
permit may be issued if weather does not permit landscaping installation.
. Site specific condition #3 shall be revised as follows: The landscape plan as
prepared by Tealy Land Surveying dated April, 2001, represents installation of
two street lights located with the western edge of Lot 6, Block 2 and the northern
edge of Lot 2, Block 1. These streetlights appear to be in acceptable locations
with regard to the impact on this property and the Board takes no exception to
their placement.
. Site specific condition #6 shall be revised as follows: Due to the nature of the
property frontage along East Floating Feather Road the Design Review Board
accepts the design of the berms represented on the landscape buffer exhibit for
Yorkshire Acres Subdivision dated February, 2001 as represented with this
application. The Design Review Board requests that the City Council accept this
design in lieu of an alternate method of compliance. The original alternate
method of compliance submitted with the preliminary plat provided insufficient
information with regards to a ruling by the Design Review Board, however the
applicants testimony and design reached agreement with the Design Review
Board.
. Site specific condition #7 shall be deleted.
. Site specific condition #8 shall have the following sentence added. Additional
information provided by the applicant at the June Design Review Board meeting
indicated a cross section between the height of 3 to S feet not meeting the intent
of the original design. The Design Review Board requests the City Council to
review this cross section as part of their application and rule on this condition.
. Site specific condition #9 shall have the following sentence added. The Design
Review Board accepts the sketches submitted at the June Design Review Board
meeting as complying with this condition.
. Site specific condition #10 shall be deleted.
. Site specific condition #11 shall be edited as follows: The applicant has provided
sketches of the proposed design for the shelter located on the western edge of the
common area landscaping. The Design Review Board accepts this design as
presented in meeting compliance with this request.
. Site specific condition #12 shall have the following sentence added. The

applicant had provided at the June Design Review meeting a design for this
drainage area of Lot 1, Block 1, which meets with acceptance of the Design
Review Board.
. Site specific condition #14 shall be replaced as follows: The landscape plan shall
be further redesigned by an individual knowledgeable in the field of landscape
design with respect to shrub and plant placement within the common area of
landscaping. The request for redesign is in regards to more distance between
tree plantings, additional evergreen tree placement, shrub grouping and
identification of ground covers within the berm. This revised landscape plan
shall be reviewed by staff and one member of the Design Review Board prior to
issuance of any building permits.
Seconded by Kenison. Discussion.
Murray amends his motion for the submittal requirement for site-specific condition
#14. The revised landscape plan shall be reviewed and approved by staff and one
member of the Design Review Board prior to the City Clerk signing the final plat.

PUBLIC HEARINGS:
A. DR-31-01- Professional Dental/Medical Office Buildine: - Joel Courtial DDS: Joel
Courtial DDS, represented by mark Butler with Land Consultants Inc., is requesting
design review approval to construct a 4,450-square foot professional dental/medical
office building. The site is located on the west side of Stierman Way approximately
150-feet north of State Street at 151 Stierman Way. This item was continued from the
June 28, 2001 meeting.
Murray introduces the item.
Mark Butler with Land Consultants Inc., reviews the application. Mr. Butler requests
additional time to review new conditions. Board chooses to hear item 5D.
D. DR-42-01 - Two Monument Sie:ns for the Flex Space Buildine: within Rockv
Mountain Business Park - Eae:le Land LLC: Eagle Land LLC, represented by
John McBride, is requesting design review approval to construct two monument signs
for the Eagle Land flex space office building. The site is located approximately 200-
feet east of Plaza Drive and approximately 200-feet north of Iron Eagle Drive within
the Rocky Mountain Business Park at 1117 East Plaza Drive.

apologizes to the board for not being available to add this item to the consent agenda.

Kenison moves to approve DR-42-01 Two Monument Signs for the Flex Space
Building within Rocky Mountain Business Park with all the standard and site
specific conditions of approval as included in the application.
Seconded by Barnes. ALL A YE...MOTION CARRIES.

Mr. Butler states that he has discussed this application with the Mayor, as a neighbor of
the applicant. Mr. Butler is pleased with new conditions of staff report, with the
exception of three items.
Barnes states for the record that she knows the applicant but she has not discussed this
application with them.

Discussion amongst the Board regarding color of building and parking issues.
Murray moves to approve DR-31-01- Professional Dental/Medical Office Building
with the site specific and standard conditions of approval represented in the
amended memo by staff dated July 19, 2001 with the following revisions to the site-
specific conditions of approval:
. Site specific condition #1. The last sentence shall be revised as follows: The
revised landscape plan and elevation shall be reviewed and approved by staff
prior to issuing building permit.
. Site specific condition #3 shall be revised as follows: The Design Review Board
recognizes city code section 8-2A-6.C.3.b with respect to side building setbacks
and recommends that the application be permitted as presented with the north
side yard setback being 4S feet. No additional re-submittal plan will be required
of the applicant.
. Site specific condition #S shall be revised as follows: Provide the revised plan
showing the 10' wide sidewalk abutting at the south parcel along Stierman Way,
which shall terminate at the south side of the entry drive to this development.
The plan shall include street trees, pedestrian lighting, and furnishings as
outlined in Eagle City Code 8-2A-6.C.S. The revised plan shall be reviewed and

approved by staff and one member of the Design Review Board prior to issuance
of the building permit.
. Site specific condition #7 shall be deleted.
. Site specific condition #9 shall be revised as follows: The applicant has
requested that this application be conditioned to limit the tenant space on the
East side of this building to be of such a use requiring a parking requirement of
one space per 2S0 square feet, per Eagle City Code. This condition remains with
the building and would not be changed should the building ownership change.
. Site specific condition #IS shall be added. The Design Review Board recognizes
the Eagle Comprehensive Plan to connect Idaho Street from its current terminus
point behind City Hall to Stierman Way. The decision to continue this road
remains within the approval of the Eagle City Council. The Design Review
Board approves this application with the knowledge that there are alternative
locations to the continuation of this road north of this property or south of this
property. Approval of this application should not be construed as removing the
importance of the secondary connection parallel to State Street.
. Site specific condition #16 shall be as follows: The applicant shall be required to
provide the staff and one member of the Design Review Board additional details
with regards to the front wall along Stierman Way. It is suggested that minor
relief with the use of pilasters and a masonry or concrete cap be used on the wall
to break up the long continuous planes.
. Site specific condition #17 shall read as follows: The applicant is required to
return to staff and one member of the Design Review Board with the color
palette and building materials that represent colors complimenting the adjacent
structures using warm earth tones rather than cold gray tones.
. Site specific condition #18 shall read as follows: The applicant shall provide
pedestrian lighting within the parking lots as required by Eagle City Code and
that lighting shall be reviewed by staff and one member of the Design Review
Board prior to issuance of the building permit.
. Site specific condition #19 shall read as follows: The applicant has indicated
that all storm water collection will be done through perimeter gutters and chain
drop down spouts. The storm water collection within the parking lot is intended
to be done through underground seepage pits below the parking surface. The
design shall be reviewed by staff and the city engineer prior to issuance of the
building permit.

Murray amends motion to replace site specific condition #7 as follows: The
applicant has provided to the Design Review Board a revised landscape plan which
complies with the original condition of site specific condition #7. The Design Review
Board recognizes this and approves it as designed.

Murray amends the motion, site specific condition #20 shall be added. Should City
Council determine that the extension of Idaho Street fall within the confines of this
particular property the applicant shall be required to provide a revised site plan for
complete review by the Design Review Board prior to issuance of a building permit.

B. DR-34-01 - Common Area Landscauine: within Arbor Ride:e Subdivision Phase I
- Stacia Patterson: Stacia Patterson, represented by Mark Butler with Land
Consultants Inc., is requesting design review approval of the common area
landscaping within Arbor Ridge Subdivision Phase I. The site is located north of Hill
Road and west of State Highway 55. This item was continued from the June 28,2001
meeting.
The applicant has requested that this item be continued to the August 9 meeting.
Barnes moves to continue DR-34-01 to August meeting. Seconded by Christensen.

review approval of a master sign plan for the Montessori multi -tenant building. The
site is located on the west side of Rivershore Lane within Channel Center Subdivision
at 655 South Rivershore Lane.

Murray moves to approve DR-3-01-Master Sign Plan for the Montessori Multi-
Tenant Building within Channel Center Subdivision with the site specific and
standard conditions of approval set forth in the staff report with the following
additions to the site specific conditions of approval:
. Site specific condition #4 shall read as follows: The existing sign placard
located on the monument sign for 600 South Rivershore Lane has been reviewed
by the Design Review Board and considered an off-premise sign which is
prohibited by Eagle City Code. The applicant shall be required to remove that
sign prior to issuance of a sign permit.

Site specific condition #S shall read as follows: The applicant has indicated

that the building developer will provide an E.I.F .S. band along the vestibule
exterior wall, the color complimenting the existing building construction. The
signage proposed in this application will then be individual letters pin-mounted

The signage shall remain externally illuminated as current conditions apply.

McCullough moves to approve DR-44-01-Common Area Landscaping within Clear
Creek Crossing Subdivision with the site-specifics conditions and standard
conditions of approval with the following amendments to the site specific conditions:
. Site specific condition #4 shall be rewritten beginning with prior to the City
Clerk signing the final plat for each phase, the applicant shall either install the
required trees or provide the City with a letter of credit for $SOO per tree and the

cost of the installation of the trees and the landscaping and irrigation of the
common area will be provided by each individual homeowner (before certificate

fencing" shall be replaced with "open picket style fencing".
. Site specific condition #10 shall read as follows: The gravel path in the easement
area on the west side of the project will be constructed of a compacted small
angular chip material.
. Site specific condition #11 shall read as follows: A sign prohibiting motorized
vehicles shall be placed at the northern most property line where the path enters
the floodway easement.
. Site specific condition #12 shall read as follows: A street lighting plan shall be
provided and approved before signing of the final plat.
. Site specific condition #13 shall read as follows: Benches shall be provided every
SOO feet along the pathway through the common area.
. Site specific condition #14 shall read as follows: Two picnic tables shall be
provided in the open space in the common area near the two ponds at the
southern end of the property.

dark sky complying acorn fixture.
Site specific condition #13 shall be amended to read: Benches shall be provided
through the common area within the interior of the project.

After discussing the issue with the Board Chairman, Jim Murray, the Chairman said the
agenda could be amended at the meeting to add the review of the color pallet since it was
old business and not a public hearing.

Roof:
• Architectural Relief shingles 25 years or better. "Elk Premium" brand only, black color
only, Black D -Metal. Paint all roof Jacks black. Minimum 6/12 roof pitch. Minimum 7/12
roof pitch on front facing gables.
Doors:
• Front doors to be half -lite with grids or solid six (6) -panel 6" brass kick plate and brass
handle set.
Colors:
• Choose from Architectural Control Committee pre -selected color schemes plus all white.
• Front doors white, black, red, green or stained from pre -selected color boards.
Elevation requirements:
• Architectural Control Committee reserves the right to reject plans which lack integrity and
balance according to their judgment.
▪ Windows — all with grids, square pattern, single hung on front elevations preferred.
• Minimum of 8" facia, with stacked 1' x 4' on gable, wood or fiberglass gable vents, round
or square. No metal.
• Front elevations must have suitable architectural elements. Brick, stone, stucco on front
elevation. i.e. wrap raised front porches or full height at a gabled wail or wrap an entry
door. No minimum wraps at garage faces. Fronts elevation should also contain some mix
of siding. ie, fish scale, shingle, or scalloped siding plus normal cottage lap. Use 1 x 6
comer boards and 6" window trims with a header detail i.e, crown, cottage or boxed.
• All designs to have some front porch, minimum 6' deep, front columns to be tapered 8"
or larger or 10" square fluted (milled), not prime trim, no 4x4 posts etc.
Fences:
• All fences to be the picture frame style — front facing only.
• All fences to be cedar or approved by ACC, and not to exceed six feet in height.
• Fences to be new material and constructed in a workmanlike manner.

Landscaping
• Front and side lots adjacent to the street must be sodded including sprinkler system,
within thirty days of substantial completion or occupancy, whichever occurs first.
• Back yards must be sodded or seeded within six months.
• The front yard will include two 2" caliper trees at least 6' tall, five 5 gallon plants, and
five 2 gallon shrubs minimum. (Berms and planting areas are encouraged.)
Site cleaning:
• All builders must operate a clean site with all debris deaned daily. Builders are not to
allow garbage to blow to other sites.
• All builders must provide a 4' x 8' garbage box to construction site prior to framing.
• Weeds must be kept to a minimum, trim if necessary, and properly disposed of.
• Builders who do not adhere to lot cleaning rules may be subject to a fine equal to the
cost of lot cleanup.
Marketing:
• This will be an exclusive Holland Realty Subdivision. Holland Realty will handle all
marketing. All listings will be through Larry Asin at Holland Realty.
Manage;
• Only designated marketing company (Holland Realty) signage is approved. All other
signage must be approved prior to placement.
Mailboxes:
• The developer will provide all mailboxes and mailbox stands.
Portable outhouses and street cleaning:
• There is a $150.00 fee collected at closing per lot to provide portables and street
cleaning.
Home Owners Associationt
• Annual homeowner association dues are $120.00 per year, prorated at time of home sale
closing. The one-time homeowner association set-up fee is $150.00. This set-up fee will
be collected at dosing of lot.
Architectural Control Committee
• Builder must submit 2 sets of plans to Eaglecrest Architectural Control Committee, 500 W
Idaho, Ste. 240, Boise, Idaho, 83704 (343-6699) prior to start of construction. Plans to
include plot plan, all elevations, exterior colors, floor plan, and a deposit of $1000.00.
Deposit to be held until and released upon visual inspection on completed home and
landscape requirements.
• Variations only if pre -approved by the Architectural Control Committee.
• A landscape plan must be submitted and approved prior to start of landscaping.
• Plans will be held until 30 days after completion.
• The builder must have WRITTEN approvals from the ACC prior to the start of
construction and/or landscaping.

On May 10, 2001, a design review application to construct a 4,450 -square foot professional
dental/medical office building was submitted to the City. The staff report for this site was
written addressing the existing building and vacant land as one parcel. Documentation showing
this site as two separate lots was not submitted with the application.
On June 28, 2001, the Design Review Board continued the above mentioned application until
verification of an approved legal lot split could be submitted to the City showing the parcel with
the existing building and the lot proposed for development was two separate lots.
On June 28, 2001, the applicant's representative, Mark Butler, submitted to the City at the
Design Review meeting (after the above mentioned application had been continued)
documentation showing previous City approval of a lot split and a copy of the Quitclaim Deed
showing the parcel as two legal lots.
Due to this additional information the only applicable provisions within the staff report should be
these which relate to the southern parcel (Parcel B). The following site specific conditions of
approval as noted in the original staff report should be revised as follows. The text shown with
strike-thru is to be deleted by staff and the text shown with underline is to be added by staff.
STAFF RECOMMENDATION:
If City Council determines that an east/west public street connection is not a necessity
along the southern property line (as shown on the Transportation Network Map #2 of 2
within the 2000 Comprehensive Plan) then staff recommends the applicant provide

revised plans to comply with the Site Specific and Standard Conditions of Approval as
recommended herein.
NOTE: Additional conditions will more than likely be placed on this application by the
Design Review Board. The Board may also request a continuance of this item if they
determine that they need revised plans or other additional information to complete the
review.

3. The side building setbacks are required to be zero feet (0') so as to tie into adjoining
structures or ten feet (10') maximum. The side setback for the proposed building is 45 288 -
feet (north) and 10 -feet (south). The applicant shall be required to submit revised plans
showing the proposed building in compliance with setback requirements.

5. Provide revised plans showing a 10 -foot wide sidewalk abutting the entire parcel along
Stierman Way with street trees, pedestrian lighting and furnishings as outlined in Eagle City
Code Section 8 -2A -6(C)(5). The revised plans shall be reviewed and approved by the Design
Review Board prior to issuance of a building permit.
6. Provide construction fencing around the trees to provide protection during construction of
this site. The construction fencing shall be installed prior to issuance of a building permit.
7. Provide a revised landscape plan showing the required plantings between the right of way
and the parking lot per thirty five (35) linear feet of frontage. The revised landscape plan
shall be reviewed and approved by staff and one member of the Design Review Board prior
to issuance of a building permit.
8. Provide a revised landscape plan showing the required 8% interior landscaping within the
parking lot. The revised landscape plan shall be reviewed and approved by the Design
Review Board prior to issuance of a building permit.
9. Provide a revised plan showing the required 31 -parking spaces for the existing and nronosed
office buildings on-site (Parcels A and B). The revised plan shall be reviewed and approved
by staff prior to issuance of a building permit.

10. No signs are proposed with this application. A separate design review application is required
for the approval of any signs.
11. Provide a recorded cross access agreement between this nronerty and the property to the
north. The recorded cross access agreement shall be reviewed and approved bv staff prior to
issuance of a building permit.
12. The applicant shall be required to enter into a ioint narking agreement (as reauired by Eagle
City Code Section 8-4-4-3) with the City and the owner of the parking lot to the north. The
joint parking agreement shall be reviewed and approved by the City. Attorney and shall be
recorded prior to issuance of a building permit.
13. The applicant shall be required to provide detailed elevations of the trash enclosure showing
the materials and colors to be used. The elevations, materials and colors shall be reviewed
and approved bv staff and one member of the Design Review Board prior to issuance of a
building permit.
14. The applicant shall be required to enter into a recorded agreement with the property owner to
the north to allow the trash enclosure to be shared with the property to the south. The .
recorded agreement shall be reviewed and approved by staff prior to issuance of a building
permit.
OR
The applicant shall be required to provide a revised landscape plan showing the trash
enclosure on site (Parcel B. The revised landscape plan shall be reviewed and approved by
staff prior to issuance of a building permit.
STANDARD CONDITIONS OF APPROVAL:
1. The applicant shall comply with all requirements of the Ada County Highway District
and/or the Idaho Transportation Department, including but not limited to approval of the
drainage system, curbs, gutters, streets and sidewalks. A letter of approval from the
highway district having jurisdiction shall be submitted to the City prior to issuance of any
building permits or Certificate of Occupancy, whichever occurs first.
2. Idaho Department of Health & Welfare approval of the sewer and water facilities is
required prior issuance of any building permits or Certificate of Occupancy, whichever
occurs first.
3. All permits from Central District Health, Eagle Sewer District & Eagle Fire District shall
be secured prior to issuance of building permit or Certificate of Occupancy, whichever
occurs first.
4. Written approval of all well water for any shared or commercial well shall be obtained
from the Idaho Department of Water Resources shall be submitted to the City prior to
issuance of any building permits or Certificate of Occupancy, whichever occurs first.
5. Unless septic tanks are permitted, wet line sewers will be required and the applicant will
be required to furnish the City Engineer with a letter from the sewer entity serving the
property, accepting the project for service, prior to issuance of any building permits or

Certificate of Occupancy, whichever occurs first.
6. The applicant shall submit a letter from the appropriate drainage entity approving the
drainage system and/or accepting said drainage; or submit a letter from a registered
professional engineer certifying that all drainage shall be retained on-site prior to issuance
of any building permits or Certificate of Occupancy, whichever occurs first. A copy of
the construction drawing(s) shall be submitted with the letter.
7. The applicant shall submit plans and calculations prepared by a registered professional
engineer to handle the satisfactory disposal of all storm drainage on the applicant's site.
Drainage system plans shall be submitted to the City Engineer for review and approval
prior to issuance of any building permits or Certificate of Occupancy, whichever occurs
first.
The plans shall show how swales, or drain piping, will be developed in the drainage
easements. The approved drainage system shall be constructed, or a performance bond
shall be submitted to the City Clerk, prior to issuance of any building permits or
Certificate of Occupancy, whichever occurs first. The lot shall be so graded that all
runoff runs either over the curb, or to the drainage easement and no runoff shall cross any
lot line onto another lot except within a drainage easement.
All design and calculations shall meet the requirements of Ada County Highway District.
Construction of the storm drain disposal system shall be complete before an occupancy
permit is issued.
8. No ditch, pipe or other structure or canal, for irrigation water or irrigation waste water
owned by an organized irrigation district, canal company, ditch association, or other
irrigation entity, shall be obstructed, routed, covered or changed in any way unless such
obstruction, rerouting, covering or changing has first been approved in writing by the
entity. A Registered Engineer shall certify that any ditch rerouting, piping, covering or
otherwise changing the existing irrigation or waste ditch (1) has been made in such a
manner that the flow of water will not be impeded or increased beyond carrying capacity
of the downstream ditch; (2) will not otherwise injure any person or persons using or
interested in such ditch or their property; and (3) satisfied the Idaho Standards for Public
Works Construction. A copy of such written approval and certification shall be filed with
the construction drawing and submitted to the City prior to issuance of any building
permits or Certificate of Occupancy, whichever occurs first.
9. Street light plans shall be submitted and approved as to the location, height and wattage
to the City Engineer (if applicable) prior to issuance of any building permits or Certificate
of Occupancy, whichever occurs first. All construction shall comply with the City's
specifications and standards.
The applicant shall provide a recorded easement, acceptable to the City Engineer, for the
purpose of installing and maintaining street light fixtures, conduit and wiring lying

outside any dedicated public right-of-way, prior to issuance of any building permits or
Certificate of Occupancy, whichever occurs first.
The applicant shall pay applicable street light inspection fees prior to Certificate of
Occupancy.
10. Parking lot light plan shall be submitted and approved as to the location, height and
wattage by the City Engineer. All construction shall comply with the City's
specifications and standards.
Lighting is required in the parking area and shall be properly illuminated to avoid
accidents. Any lights used to illuminate the parking lot shall be so arranged as to reflect
the light away from the adjoining property.
11. The parking area shall be paved and shall be maintained in good condition without holes
and free of all dust, trash, weeds and other debris.
12. One set of building plans, for any non single-family residential use, shall be submitted to
the Eagle Fire Department for approval. An approval letter from the Eagle Fire
Department shall be submitted to the City prior to issuance of any building permits or
Certificate of Occupancy, whichever occurs first. The letter shall include the following
comments and minimum requirements, and any other items of concern as may be
determined by the Eagle Fire Department officials:
a. "The applicant has made arrangements to comply with all requirements of the Fire
Department."
b. The fire hydrant locations shall be reviewed and be approved in writing by the
Eagle Fire Department prior to the City Engineer signing the final plat.
c. Minimum flow per hydrant shall be 1,000 gallons per minute for one and two
family dwellings, 1,500 gallons per minute for dwellings having a fire area in
excess of 3,600 square feet, and 1,500 gallons per minute for non-residential uses
(i.e.; Commercial, Industrial, Schools, etc.). Flow rates shall inspected in
accordance with all agencies having jurisdiction, and shall be verified in writing
by the Eagle Fire Department prior to issuance of any building permits or
certificate of Occupancy, whichever occurs first.
d. The proposed fire protection system shall be reviewed and approved by the Eagle
Fire Department prior to issuance of a building permit or Certificate of
Occupancy, whichever occurs first.
13. Any recreation area, greenbelt area or pathway area along the Boise River, Dry Creek or
any other area designated by the City Council or Eagle City Pathway/Greenbelt
Committee for a path or walkway shall be approved in writing by the Eagle City
Pathway/Greenbelt Committee prior to issuance of a building permit or Certificate of
Occupancy, whichever occurs first.

14. Conservation, recreation and river access easements (if applicable) shall be approved by
the Eagle City Pathway/Greenbelt Committee and shall be shown on the final plat prior to
issuance of a building permit or Certificate of Occupancy, whichever occurs first.
15. The applicant shall comply with the provisions of the Eagle City Code, pertaining to
floodplain and river protection regulations (if applicable) prior to issuance of a building
permit or Certificate of Occupancy, whichever occurs first.
16. The applicant shall obtain written approval of the development relative to the effects of
the Boise River Flood Plain (if applicable) from the Corps. of Engineers prior to issuance
of a building permit or Certificate of Occupancy, whichever occurs first.
17. The applicant shall obtain approval of the development relative to its effects on wetlands
or other natural waterways (if applicable) from the Corps. of Engineers and the Idaho
Department of Water Resources and/or any other agency having jurisdiction prior to
issuance of a building permit or Certificate of Occupancy, whichever occurs first.
18. Basements in the flood plain are prohibited.
19. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all
applicable County, State and Federal Codes and Regulations shall be complied with. All
design and construction shall be in accordance with all applicable City of Eagle Codes
unless specifically approved by the Commission and/or Council.
20. New plans, which incorporate any required changes, shall be submitted for staff approval.
Staff may elect to take those plans to the Design Review Board and/or the Planning and
Zoning Commission for review and approval.
21. Any changes to the plans and specifications upon which this approval is based, other than
those required by the above conditions, will require submittal of an application for
modification -and approval of that application prior to commencing any change.
22. Any change by the applicant in the planned use of the property which is the subject of
this application, shall require the applicant to comply with all rules, regulations,
ordinances, plans, or other regulatory and legal restrictions in force at the time the
applicant or its successors in interest advises the City of Eagle of its intent to change the
planned use of the subject property unless a waiver/variance of said requirements or other
legal relief is granted pursuant to the law in effect at the time the change in use is sought.
23. Approval of any Design Review shall expire without notice to the applicant on the date of
expiration of the Design Review if construction has not started prior to that date, as
stipulated in Eagle City Code (one year from the Design Review Board approval date).
24. All ground -mounted accent lighting fixtures and monument sign lighting fixtures shall be
screened from view with the use of landscaping (top of the fixture shall be no higher than

the surrounding landscaping). The light source itself shall otherwise be screened as
provided for within Eagle City Code.
25. The City's actions on the application does not grant the applicant any appropriation of
water or interference with existing water rights. The applicant indemnifies and holds the
City harmless for any and all water rights, claims in any way associated with this
application.

following general comments regarding this project:
1. Air Quality
* Except during construction activities, we do not anticipate that this project will
violate air quality regulations. Appropriate management practices shall be
employed by site contractors during construction to minimize air quality
impairment.
2. Modifications to Existing Public Drinking Water Systems
* This project proposes modifications to an existing public drinking water system.
All projects involving public drinking water systems must be designed by a
professional engineer registered in the State of Idaho. Plans and specifications
must be approved by this office prior to construction.
3. Wastewater Collection and Treatment
* This project proposes the expansion of an existing wastewater collection system.
All projects involving wastewater collection system extensions must be designed
by a professional engineer registered in Idaho. Plans and specifications must be
approved by this office prior to construction. We do not review plans for
individual service lines. Sewer services to individual lots should be reviewed by
the State Plumbing Bureau and/or the local building department.

4. Storm Water
* This project proposes the use of a permanent storm water disposal system. The
Idaho Ground Water Quality Rule, IDAPA 58.01.11.301: states that "....any
activity with the potential to degrade the quality of an aquifer must be managed at
least to maintain the existing ground water quality through the use of best
management practices (BMPs), or best practical methods (BPMs) to the
maximum extent practical." The storm water disposal system proposed for this
project could degrade ground water quality and therefore shall conform, at a
minimum, to the Catalog of Storm Water Best Management Practices for Idaho
Cities and Counties, or equivalent.
