Minutes - 2001 - Design Review - 07/19/2001 - Regular ORIGINAL DESIGN REVIEW BOARD MINUTES July 19, 2001 The Design Review Board met in regular session on July 19,2001 Chairman Murray presiding. 1. CALL TO ORDER 2. ROLL CALL: The following members were present: MURRA Y, MC CULLOUGH, KENISON, BARNES, CHRISTENSEN, Absent: COUNCIL LIAISON MERRILL. A quorum is present. Merrill arrives at 6:08. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. The site is located on the east and west sides of Locust Grove Road extended approximately Y2 mile north of Chinden Boulevard. This item was continued from the June 28,2001 meeting. Barnes moves to approve DR-47-01-Building Wall Sign with Reader Board for Seven Oaks Elementary with the following site specific conditions of approval: Site specific condition #3. It is recommended by the Design Review Board that the size of the sign be increased to include an area below the letters "Elementary School" and above the actual reader board area, the area would match the soldier course now on the building of brown iron spot to create an aesthetically pleasing look to the building. Seconded by Kenison. Barnes amends the motion to approve the signage of the reader board with conditions stated above and also to include the standard conditions of approval. The site is located on the south side of Floating Feather Road approximately 800-feet east of State Highway 55 at 2471 East Floating Feather Road. The Design Review Board recognizes these trees in their designed position as meeting the intent of the site specific guideline set forth in the preliminary plat. The trees shall be located in the landscape strip between the sidewalk and the curb as presented on the plan. Prior to the City Clerk signing the final plat for each phase, the applicant shall either install the designed trees, landscaping and irrigation or provide the City with a letter of credit for ISO % of the cost of the installation of all landscape and irrigation improvements within the five foot landscape strip. Trees shall be installed prior to obtaining any occupancy permits for the homes. A temporary occupancy permit may be issued if weather does not permit landscaping installation. . Site specific condition #3 shall be revised as follows: The landscape plan as prepared by Tealy Land Surveying dated April, 2001, represents installation of two street lights located with the western edge of Lot 6, Block 2 and the northern edge of Lot 2, Block 1. These streetlights appear to be in acceptable locations with regard to the impact on this property and the Board takes no exception to their placement. . Site specific condition #6 shall be revised as follows: Due to the nature of the property frontage along East Floating Feather Road the Design Review Board accepts the design of the berms represented on the landscape buffer exhibit for Yorkshire Acres Subdivision dated February, 2001 as represented with this application. The Design Review Board requests that the City Council accept this design in lieu of an alternate method of compliance. The original alternate method of compliance submitted with the preliminary plat provided insufficient information with regards to a ruling by the Design Review Board, however the applicants testimony and design reached agreement with the Design Review Board. . Site specific condition #7 shall be deleted. . Site specific condition #8 shall have the following sentence added. Additional information provided by the applicant at the June Design Review Board meeting indicated a cross section between the height of 3 to S feet not meeting the intent of the original design. The Design Review Board requests the City Council to review this cross section as part of their application and rule on this condition. . Site specific condition #9 shall have the following sentence added. The Design Review Board accepts the sketches submitted at the June Design Review Board meeting as complying with this condition. . Site specific condition #10 shall be deleted. . Site specific condition #11 shall be edited as follows: The applicant has provided sketches of the proposed design for the shelter located on the western edge of the common area landscaping. The Design Review Board accepts this design as presented in meeting compliance with this request. . Site specific condition #12 shall have the following sentence added. Site specific condition #14 shall be replaced as follows: The landscape plan shall be further redesigned by an individual knowledgeable in the field of landscape design with respect to shrub and plant placement within the common area of landscaping. The request for redesign is in regards to more distance between tree plantings, additional evergreen tree placement, shrub grouping and identification of ground covers within the berm. This revised landscape plan shall be reviewed by staff and one member of the Design Review Board prior to issuance of any building permits. Seconded by Kenison. Discussion. Murray amends his motion for the submittal requirement for site-specific condition #14. The revised landscape plan shall be reviewed and approved by staff and one member of the Design Review Board prior to the City Clerk signing the final plat. Second concurs. DR-31-01- Professional Dental/Medical Office Buildine: - Joel Courtial DDS: Joel Courtial DDS, represented by mark Butler with Land Consultants Inc., is requesting design review approval to construct a 4,450-square foot professional dental/medical office building. The site is located on the west side of Stierman Way approximately 150-feet north of State Street at 151 Stierman Way. This item was continued from the June 28, 2001 meeting. Murray introduces the item. Mark Butler with Land Consultants Inc., reviews the application. Mr. Butler requests additional time to review new conditions. Board chooses to hear item 5D. D. DR-42-01 - Two Monument Sie:ns for the Flex Space Buildine: within Rockv Mountain Business Park - Eae:le Land LLC: Eagle Land LLC, represented by John McBride, is requesting design review approval to construct two monument signs for the Eagle Land flex space office building. The site is located approximately 200- feet east of Plaza Drive and approximately 200-feet north of Iron Eagle Drive within the Rocky Mountain Business Park at 1117 East Plaza Drive. Mr. Butler states that he has discussed this application with the Mayor, as a neighbor of the applicant. Mr. Butler is pleased with new conditions of staff report, with the exception of three items. Barnes states for the record that she knows the applicant but she has not discussed this application with them. Cerda reviews the revised site conditions of approval. Murray opens public testimony. Murray moves to approve DR-31-01- Professional Dental/Medical Office Building with the site specific and standard conditions of approval represented in the amended memo by staff dated July 19, 2001 with the following revisions to the site- specific conditions of approval: . Site specific condition #1. The last sentence shall be revised as follows: The revised landscape plan and elevation shall be reviewed and approved by staff prior to issuing building permit. . Site specific condition #3 shall be revised as follows: The Design Review Board recognizes city code section 8-2A-6.C.3.b with respect to side building setbacks and recommends that the application be permitted as presented with the north side yard setback being 4S feet. No additional re-submittal plan will be required of the applicant. . Site specific condition #S shall be revised as follows: Provide the revised plan showing the 10' wide sidewalk abutting at the south parcel along Stierman Way, which shall terminate at the south side of the entry drive to this development. The plan shall include street trees, pedestrian lighting, and furnishings as outlined in Eagle City Code 8-2A-6.C.S. Site specific condition #7 shall be deleted. . Site specific condition #9 shall be revised as follows: The applicant has requested that this application be conditioned to limit the tenant space on the East side of this building to be of such a use requiring a parking requirement of one space per 2S0 square feet, per Eagle City Code. This condition remains with the building and would not be changed should the building ownership change. . Site specific condition #IS shall be added. The Design Review Board recognizes the Eagle Comprehensive Plan to connect Idaho Street from its current terminus point behind City Hall to Stierman Way. The decision to continue this road remains within the approval of the Eagle City Council. The Design Review Board approves this application with the knowledge that there are alternative locations to the continuation of this road north of this property or south of this property. Approval of this application should not be construed as removing the importance of the secondary connection parallel to State Street. . Site specific condition #16 shall be as follows: The applicant shall be required to provide the staff and one member of the Design Review Board additional details with regards to the front wall along Stierman Way. It is suggested that minor relief with the use of pilasters and a masonry or concrete cap be used on the wall to break up the long continuous planes. . Site specific condition #17 shall read as follows: The applicant is required to return to staff and one member of the Design Review Board with the color palette and building materials that represent colors complimenting the adjacent structures using warm earth tones rather than cold gray tones. . Site specific condition #18 shall read as follows: The applicant shall provide pedestrian lighting within the parking lots as required by Eagle City Code and that lighting shall be reviewed by staff and one member of the Design Review Board prior to issuance of the building permit. . Site specific condition #19 shall read as follows: The applicant has indicated that all storm water collection will be done through perimeter gutters and chain drop down spouts. The storm water collection within the parking lot is intended to be done through underground seepage pits below the parking surface. The design shall be reviewed by staff and the city engineer prior to issuance of the building permit. Seconded by McCullough. Discussion Murray amends motion to replace site specific condition #7 as follows: The applicant has provided to the Design Review Board a revised landscape plan which complies with the original condition of site specific condition #7. Site specific condition #4 shall read as follows: The existing sign placard located on the monument sign for 600 South Rivershore Lane has been reviewed by the Design Review Board and considered an off-premise sign which is prohibited by Eagle City Code. The applicant shall be required to remove that sign prior to issuance of a sign permit. . The applicant shall comply with all requirements of the Ada County Highway District and/or the Idaho Transportation Department, including but not limited to approval of the drainage system, curbs, gutters, streets and sidewalks. A letter of approval from the highway district having jurisdiction shall be submitted to the City prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. 2. Idaho Department of Health & Welfare approval of the sewer and water facilities is required prior issuance of any building permits or Certificate of Occupancy, whichever occurs first. 3. All permits from Central District Health, Eagle Sewer District & Eagle Fire District shall be secured prior to issuance of building permit or Certificate of Occupancy, whichever occurs first. 4. Written approval of all well water for any shared or commercial well shall be obtained from the Idaho Department of Water Resources shall be submitted to the City prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. 5. The applicant shall submit a letter from the appropriate drainage entity approving the drainage system and/or accepting said drainage; or submit a letter from a registered professional engineer certifying that all drainage shall be retained on-site prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. A copy of the construction drawing(s) shall be submitted with the letter. 7. The applicant shall submit plans and calculations prepared by a registered professional engineer to handle the satisfactory disposal of all storm drainage on the applicant's site. Drainage system plans shall be submitted to the City Engineer for review and approval prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The plans shall show how swales, or drain piping, will be developed in the drainage easements. The approved drainage system shall be constructed, or a performance bond shall be submitted to the City Clerk, prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The lot shall be so graded that all runoff runs either over the curb, or to the drainage easement and no runoff shall cross any lot line onto another lot except within a drainage easement. All design and calculations shall meet the requirements of Ada County Highway District. Construction of the storm drain disposal system shall be complete before an occupancy permit is issued. 8. No ditch, pipe or other structure or canal, for irrigation water or irrigation waste water owned by an organized irrigation district, canal company, ditch association, or other irrigation entity, shall be obstructed, routed, covered or changed in any way unless such obstruction, rerouting, covering or changing has first been approved in writing by the entity. A Registered Engineer shall certify that any ditch rerouting, piping, covering or otherwise changing the existing irrigation or waste ditch (1) has been made in such a manner that the flow of water will not be impeded or increased beyond carrying capacity of the downstream ditch; (2) will not otherwise injure any person or persons using or interested in such ditch or their property; and (3) satisfied the Idaho Standards for Public Works Construction. A copy of such written approval and certification shall be filed with the construction drawing and submitted to the City prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. 9. Street light plans shall be submitted and approved as to the location, height and wattage to the City Engineer (if applicable) prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. All construction shall comply with the City's specifications and standards. The applicant shall provide a recorded easement, acceptable to the City Engineer, for the purpose of installing and maintaining street light fixtures, conduit and wiring lying Page 4 of 7 K\Planning DepttEaglc Applications1DA20011DR-31-01 mel.doc outside any dedicated public right-of-way, prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The applicant shall pay applicable street light inspection fees prior to Certificate of Occupancy. 10. Parking lot light plan shall be submitted and approved as to the location, height and wattage by the City Engineer. All construction shall comply with the City's specifications and standards. Lighting is required in the parking area and shall be properly illuminated to avoid accidents. Any lights used to illuminate the parking lot shall be so arranged as to reflect the light away from the adjoining property. 11. The parking area shall be paved and shall be maintained in good condition without holes and free of all dust, trash, weeds and other debris. 12. One set of building plans, for any non single-family residential use, shall be submitted to the Eagle Fire Department for approval. An approval letter from the Eagle Fire Department shall be submitted to the City prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The letter shall include the following comments and minimum requirements, and any other items of concern as may be determined by the Eagle Fire Department officials: a. "The applicant has made arrangements to comply with all requirements of the Fire Department." b. The fire hydrant locations shall be reviewed and be approved in writing by the Eagle Fire Department prior to the City Engineer signing the final plat. c. Minimum flow per hydrant shall be 1,000 gallons per minute for one and two family dwellings, 1,500 gallons per minute for dwellings having a fire area in excess of 3,600 square feet, and 1,500 gallons per minute for non-residential uses (i.e.; Commercial, Industrial, Schools, etc.). Flow rates shall inspected in accordance with all agencies having jurisdiction, and shall be verified in writing by the Eagle Fire Department prior to issuance of any building permits or certificate of Occupancy, whichever occurs first. d.
