Minutes - 2001 - Design Review - 06/28/2001 - Regular ORIGINAL DESIGN REVIEW BOARD MINUTES June 28, 2001 The Design Review Board met in regular session on June 28, 2001 Chairman Murray presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: MURRA Y, KENISON, CHRISTENSEN. Absent: BARNES, MCCULLOUGH, COUNCIL LIAISON MERRILL. A quorum is present. CONSENT AGENDA. 3. . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. DR-30-01- Voice Stream Co-location Antenna - Cricket Communications: Cricket Communications, represented by Kirk Johnson, is requesting design review approval to construct a telecommunications antenna on the existing Voice Stream antenna. The site is located on the west side of Horseshoe Bend Road within Republic Storage at 8785 North Horseshoe Bend Road. Murray introduces the item. Murray inquires if the applicant is present. The site is located on the east and west sides of Locust Grove Road extended approximately Y2 mile north of Chinden Boulevard. This item was continued/rom the May 10,2001 meeting. Murray notes that the applicant has requested the item be moved to the July meeting. Kenison moves to continue DR-68-00 to the next regularly scheduled meeting. Seconded by Christensen. Discussion. Inc.: Esco, Inc., represented by Diane Mazy with Aim Sign Co., is requesting design review approval to construct a monument sign for the Eagle Professional Plaza. The site is located on the south side of State Street at 589 East State Street. This item was continued/rom the May 10,2001 meeting. Murray introduces the item. Diane Mazy with Aim Signs reviews the changes with the Design Review Board. Cerda reviews the written comments that have been submitted by Board member McCullough regarding the proposed landscaping for this application. Cerda notes that with the revisions the applicant has submitted certain site-specific conditions will no longer be need. She reviews these changes. Murray moves to approve DR-23-01 Monument Sign for Eagle Professional Plaza with the revised signage plan, lighting and landscape plan presented at this meeting. With the following modifications to the site-specific conditions of approval: . Site-specific condition #1 shall be replaced as follows: The applicant shall be required to provide additional quantity of landscape material within the planting areas presented tonight. The species that have been shown on the landscape plan are acceptable. . Site-specific #2 shall have the following sentence added. The site is located north of State Street and approximately 200-feet west of Academy Way within Trolley Square Shopping Center. Murray introduces the item. Tom Bauwens 380 E. Parkcenter Blvd. Boise, Idaho. Mr. Bauwens briefly reviews the application, and makes himself available for questions. Mr. Moulder the lighting engineer answers questions posed by the Board. Murray moves to approve DR-16-01 Interior Parking Lot Lighting within Trolley Square Shopping Center based on the submittal package presented at tonight's meeting with the following recommendations: . The level of illumination shall be reduced to a height of 27' for poles P3 and P4 and 12' for poles P2 to coincide with the point to point photometrics that were presented with this application. . The applicant has indicated and the Design Review Board concurs that the PI fixtures indicated on the south side of State Street are not part of this application. . The applicant shall be required to submit to staff the extension of the point to point photometrics along the residential property of LaRue Acres to assure no light level extension beyond their property line. . The applicant is encouraged to continue to provide a downward directing historic light fixture as defined in this application as PI. . The site is located on the east side of Academy A venue approximately 300-feet north of State Street at 172 and 208 Academy A venue. This application meets the intent of site-specific conditions 2, 3, 8, 9, 10, and 11. . The applicant shall be required to provide pressurized irrigation to the planters located around the entrances of each building. . Murray moves to approve DR-27-01 Professional Office Building within Rocky Mountain Business Park with the revised submittal presented at tonight's Design Review Meeting with the following notations. . The Design Review Board has reviewed and approved the amended elevation design for the front entry door as dated June 26, 2001 and presented by the applicant. . The Design Review Board has reviewed and accepted the alternate wainscot material from what was a cultured stone product to a clay brick. . Site-specific condition #13 requiring the wainscoting to continue to grade remains the same. . It is requested that the stucco color be the darker brown color as shown on the submitted sample and the accent bands and window trim around the elevations be a darker shade from the base wall color. All of those colors shall be reviewed, in sample size, and approved by staff and one member of the Design Review Board prior to issuance of a building permit. . All other conditions of the original Design Review approval other than those noted here shall remain in affect. Seconded by Kenison. ALL A YE...MOTION CARRIES. 5. PUBLIC HEARING: A. DR-21-01- Dental Office - Brenden Clements: Brenden Clements, represented by James Gipson, is requesting design review approval to construct a 5,OOO-square foot dental office. The site is located on the southwest comer of Eagle Road and Floating Feather Road at 1177 North Eagle Road. Murray introduces the item. James Gipson, representing Brenden Clements, reviews the application. Mr. Gipson has no objection to the proposed conditions. States that a revised landscape plan was submitted to City Staff today. Discussion regarding site lighting, building materials, drainage, the garden shed and garden spot, mechanical unit screening and roof drainage. Cerda draws the Boards attention to the revised landscape plan that has been submitted. She also reviews the written comments submitted by Board member McCullough. Discussion between Cerda and Board. Murray opens the public hearing. Murray closes the public hearing. Discussion amongst the Board regarding the lighthouse as a sign, fencing, and maintenance of the garden. Murray moves to approve DR-21-01 Dental Office with the site specific and standard conditions of approval written in the staff report including the revised landscape plan dated June 28, 2001 as submitted to the city, with the following amendments to the site-specific conditions of approval: . Site-specific condition #2 shall have the following language added. The revised landscape plan shall be designed and presented by a representative knowledgeable in the profession of landscape design. . Site-specific condition #3 shall have the following language added. The revised landscape plan shall be designed and presented by a representative knowledgeable in the profession of landscape design. Site-specific condition #6 shall have the following language added. The applicant has indicated 2, 10' high historical light fixtures to be placed in the parking lot. The Design Review Board requests the applicant provide parking lot lighting in conformance with Eagle City Code standards. Site lighting shall be reviewed by staff prior to issuance of a building permit. . Site-specific condition #7 shall read: The overall landscape plan shall be reviewed and re-designed by an individual knowledgeable in the profession of landscape design. The Design Review Board will allow staff and one member of the Design Review Board to review and approve the revised plan prior to issuance of a building permit. . The applicant has indicated that mechanical equipment screening shall be done with a masonry wall and landscaping on the northwest corner of the building, the height and size of that screening shall completely conceal from view the mechanical equipment as designed. . Site-specific condition #9: Any lighting proposed for the monument signs shall be screened with material capable of screening the lights 12 months of the year. Those lights shall also be in conformance with Eagle City Code in regards to visibility and sight lines from public right-of-way. . Site-specific condition #10: The Design Review Board recognizes the lighthouse structure shown west of the street intersection, to be a third monument sign of excessive height in Eagle City's Code. Although the Design Review Board appreciates the structure it requests the applicant remove the structure from the project. . The applicant has identified that the vegetable/flower garden indicated on the revised landscape plan will be maintained by the property owners during the complete growing season. The Design Review Board welcomes this in the application, but requires the applicants maintain the garden area as testimony provided tonight. The garden area shall be serviced with pressurized irrigation at a design suitable for planting material. . The applicant shall be required to provide revised elevations and details of the trash enclosure and equipment shed identified on this site plan. That design shall be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a building permit. . The applicant has indicated no rooftop-mounted equipment will be designed into this structure. All roof drainage shall be handled in a gutter downspout configuration incorporated into the building elevations. . No building lighting other than that proposed at the entrances at the west side of the building has been presented to staff. The applicant is encouraged to work with the design of the Red Leaf Heights subdivision for some site amenities associated with pedestrian and bicycle access. This is strictly an option to the applicant and is only a recommendation from the Design Review Board. . The applicant has identified a perimeter fence along the south and west side of the property to be a split rail design, which would meet the intent of the Design Review guidelines. DR-31-01 - Professional Dental/Medical Office Buildine: - Joel Courtial DDS: Joel Courtial DDS, represented by mark Butler with Land Consultants Inc., is requesting design review approval to construct a 4,450-square foot professional dental/medical office building. The site is located on the west side of Stierman Way approximately 150- feet north of State Street at 151 Stierman Way. Murray comments on item 5D and is concerned that it is an incomplete application, and thus is asking the Board to continue the item as there is only one lot, and the existing structure is not in compliance with Eagle City Code. Murray moves to continue this item to the July meeting until such time that either the application can be supported with existing building recommendations to bring it up to code or a planning action to make a lot split occur. Seconded by Kenison. Discussion. Butler states that it is 2 parcels, but he does not have legal representation of that fact tonight. He states that documentation has been submitted that there are two lots, but he cannot prove that they are two legal lots. Murray states that as the applicant cannot prove that there are two legal lots the application will be continued. He also amends his motion that as the July packets have already gone out the application will be continued to the August meeting. Second concurs with the amendment. Discussion. DR-28-01- Two Buildine: Wall Sims and One Monument Sim for Sherwin Williams Paint Store - Sherwin Williams: Sherwin Williams, represented by Jeff Carico with Image National Signs, is requesting design review approval to construct two building wall signs and one monument sign for the Sherwin Williams paint store. The site is located on the south side of State Street just west of Palmetto A venue at 753 East State Street. Murray introduces the item. Murray moves to approve DR-28-01 Two Building Wall Signs and One Monument Sign for Sherwin Williams Paint Store with the site specific and standard conditions of approval set forth in the staff report with the following modifications: . Site-specific condition#l: Shall be re-written as follows: The applicant based on the original design decision to maintain an open parking lot configuration on Periwinkle Drive has limited the signage to one face only even though it appears to front two public streets. The applicant is given the option of applying that single S % internally illuminated sign on either the north or west elevations of the building. . Site-specific condition #2: The applicant has presented a revised monument sign with a total square footage of 30 square foot per side with limiting dimensions of 6' high by 10' wide. The Design Review Board requests the applicant revise the sign design to be completely base mounted instead of pole mounted as presented. The sign design for the monument structure shall be created and integrated with the architecture of the principal building to comply with the conditions of Eagle City Code. The size of the sign shall be no larger than 10' x 6' and is not intended to be internally illuminated per Eagle City Code. . The applicant has indicated the desire for external illumination of this monument sign and the Board concurs. If external illumination is proposed the source of illumination must be screened with permanent planting of landscape material for 12 months of the year. . The landscape plan as proposed must be designed by someone knowledgeable in the profession of architecture, and shall be revised and submitted to staff and one member of the Design Review Board for review and approval prior to the issuance of a building permit. . The Design Review Board recognizes the desire of the national retailer to implement corporate standards within their signage and the Design Review Board supports that with the limitations set forth above. The site is located on the south side of Floating Feather Road approximately 800-feet east of State Highway 55 at 2471 East Floating Feather Road. Murray introduces the item. Douglas Landwer, 2601 E. Floating Feather Rd., representing Robert DeShazo! Berkshire West presents revisions to the application to the Board for review. Mr. Landwer reviews a letter dated as composed on June 12,2001 that he submits to the Board and staff for review. These comments are attached to the minutes. Discussion. Discussion. Landwer states that an alternate method of compliance has already been submitted and approved. Comments on the time line for the shelter construction. Cerda notes that the alternate method of compliance was submitted with the preliminary plat application, but this alternate method still needs to be approved by the Board. Discussion amongst the Board. Murray moves to continue DR-29-0l to either the July or August meeting depending on the applicant's commitment to get the required information into staff by July 6th. With the request the applicant provide additional information on the alternate method of compliance for the landscape buffer along East Floating Feather Road. If shrub plantings are proposed within the berms that they be further identified in a planting plan of legible quality. The applicant is encouraged to provide new arborvitae or conifers where the existing species are shown. The site is located on the south side of Iron Eagle Drive approximately 1,012-feet west of Edgewood Lane at 1323 East Iron Eagle Drive. Murray introduces the item. Murray moves to approve DR-33-01 Primary Colors Daycare Facility with the site- specific and standard conditions of approval set forth in the staff report with the following amendments to the site-specific conditions: . Site-specific condition #2 shall read: Provide a revised landscape plan showing a S' wide by 6' high landscape buffer for the trash enclosure as represented on the site plan. The landscape plan shall be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a building permit. . The installation of the trees shall be done by either the applicant or the developer, but must be done prior to certificate of occupancy. Site-specific condition #9 shall be re-written as follows: The Design Review Board recognizes the limit of dictating use adjacent to transportation corridors. The Design Review Board requests the applicant provide evergreen or coniferous screening along the entire south fence line of the play ground with a minimum conifer of 6' tall in addition to the fence as presented. This would replace the original condition in the previously approved plan for frontage landscaping along State Highway 44. The intent of this landscaping is to provide a visual buffer between Highway 44 and the children within the play area. The revised landscape plan shall be reviewed by staff and one member of the Design Review Board prior to issuance of a building permit. . Site-specific condition #11 shall have the following language added: The Design Review Board recommends to the applicant that primary colors such as high intensity red or yellow be discouraged in these canopies, and that a more subtle color like blue or green or other color be presented. . . Site-specific condition #13: The applicant shall be required to provide site lighting in the parking lot per Eagle City Code. . Site-specific condition #14: The applicant shall be required to revise the exterior elevations on the south side of the building to add additional dimension through entrance canopies similar to that of the main entrance in design and style. . The mechanical equipment screens shall be as located on the architectural elevations and not the landscape plan as presented with this application. . The applicant is encouraged to provide additional color to the building elements other than the beige, white, and browns as presented. The Design Review Board encourages the use of additional colors to reflect visual interest in the building. . All building lighting shall be concealed within the overhead canopies unless presented to staff and one member of the Design Review Board for review and approval prior to issuance of a building permit. . The river rock wainscot as shown on the application shall connect with either finish grade or finish paving for the perimeter of the building. . The applicant is required to provide shade trees and planting areas within the playgrounds a minimum of 2 % in area. The design shall be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a building permit. . The landscaping plan shall be revised to reflect the following comments: additional plantings are required in the front planters where the blue chip junipers are designed. The entry plantings for the main entrance shall have better diversification. As noted earlier the plants along the dumpster area shall be installed to facilitate screening per Eagle City Code. The site is located on the southwest comer of Beacon Light Road and State Highway 55 at 12725 State Highway 55. Murray introduces the item. Murray moves to approve DR-3S-01 Subway Wall Sign for Fast Eddy Chevron with the following site-specific conditions of approval. . The applicant has been approved to install the subway sign on the east elevation as presented within this application. . The applicant has suggested the corporate logo Chevron "Bug" sign on both the north and south sides of the canopy be removed. . ARTICLE VI ARCHITECTURAL COMMITTEE 6.1 Members of the Committee. The Architectural Committee for the Property, sometimes referred to as the "Committee", shall consist of three (3) members. Each said member shall hold office until such time as he/she has resigned or has been removed or his successor has been appointed, as provided herein. Declarant has final approval until all Lots are sold and closed. 6.2 Right of Appointment and Removal At any time, Grantor is the Owner of at least one (1) of the Lots, Grantor shall have the right to appoint and remove all members of the Committee. Thereafter, the Board of Directors of the Association shall have the power to appoint and remove all members of the Committee. 6.3 Review of Proposed Construction. The Committee shall consider and act upon any and all proposals of plans and specifications submitted for its approval pursuant to this Declaration, and perform such other duties as from time to time shall be assigned to it by the Board of the Association, including the inspection of construction in progress to assure its conformance with plans approved by the Committee. The Board shall have the power to determine, by rule or other written designation consistent with this Declaration, which types of improvements shall be submitted to the Committee review and approval. The Committee shall approve proposals or plans and specifications submitted for its approval only if it deems that the construction, alterations or additions contemplated thereby in the locations indicated will not be detrimental to the appearance of the surrounding area of the Property as a whole, that the appearance of any structure affected thereby will be in harmony with the surrounding structures, and that the upkeep and maintenance thereof will not become a burden on the Association. 6.3.1 Conditions of Approval. The Committee may condition its approval of proposals or plans and specifications upon such changes therein as it deems appropriate, or upon the agreement of the Owner submitting the same ("Applicant") to grant appropriate easements to an Association for the maintenance thereof, upon the agreement of the Applicant to reimburse the Association for the cost of maintenance, or upon all three, and may require submission of additional plans and specifications or other information before approving or disapproving material submitted. Page 1 of 4 6.3.2 Committee Rules and Fees. The Committee also may establish, from time to time, rules and/or guidelines setting forth procedures for the required content of the applications and plans submitted for approval. Such rules may require a fee to accompany each application for approval, or additional factors which it will take into consideration in reviewing submissions. The Committee shall determine the amount of such fee in a reasonable manner, provided that in no event shall such fee exceed One Hundred and no/100 Dollars ($100.00). Such fees shall be used to defray the costs and expenses of the Committee or for such other purposes as established by the Board. Such rules and guidelines may establish, without limitation, procedures, specific rules and regulations regarding design and style elements, landscaping and fences and other structures such as animal enclosures as well as special architectural guidelines applicable to Budding Lots located adjacent to public and/or private open space. 6.3.3 Detailed Plans. The Committee shall require such detail in plans and specifications submitted for its review as it deems proper, including, without limitation, floor plans, site plans, landscape plans, drainage plans, elevation drawings and descriptions or samples of exterior material colors. Until receipt by the Committee of the required plans and specifications, the Committee may postpone review of any plan submitted for approval. 6.3.4 Committee Decisions. Decisions of the Committee and the reasons therefore shall be transmitted by the Committee to the Applicant at the address set forth in the application for approval within seven (7) days after filing all materials and plans required by the Committee. The Committee will respond in writing, pursuant to this Article, when the plans have been reviewed and approved, approved with changes or disapproved. The said seven (7) day period shall only commence to run when an authorized representative of the Committee has executed an application form acknowledging acceptance of such application and acknowledging that such application is complete. 6.4 Meetings of the Committee. The Committee shall meet from time to time as necessary to perform its duties hereunder. The Committee may from time to time by resolution unanimously adopted in writing, designate a Committee Representative to take any action or perform any duties for and on behalf of the Committee, except the granting of variances pursuant to section 6.9. In the absence of such designation, the vote of any two (2) members of the Committee, or the written consent of any two (2) members of the Committee taken without a meeting, shall constitute an act of the Committee. 6.5 No Waiver of Future Approvals. The approval of the Committee of any proposals or plans and specifications or drawings for any work done or proposed, or in connection with any other matter requiring the approval and consent of the Committee, shall not be deemed to constitute a waiver of any right to withhold approval or consent as to any similar proposals, plans and specifications, drawings or matter whatever subsequently or additionally submitted for approval or consent. 6.6 Compensation of Member. The members of the Committee shall receive no compensation for services rendered, other than reimbursement for expenses incurred by them in the performance of their duties hereunder and except as otherwise agreed by the Board. Page 2 of 4 6.7 Inspection of Work. Inspection of work and correction of defects therein shall proceed as follows: 6.7.1 Upon the completion of any work for which approved plans are required under this Article, the Owner shall give written notice of completion to the Committee. 6.7.2 Within forty-five (45) days thereafter, the Committee or its duly authorized representative may inspect such improvement. If the Committee finds that such work was not done in substantial compliance with the approved plans, it shall notify the Owner in writing of such noncompliance within such forty-five (45) day period, specifying the particular noncompliance, and shall require the Owner to remedy the same. 6.7.3 If upon the expiration of ten (10) days from the date of such notification or any longer time the Committee determines to be reasonable, the Owner shall have failed to remedy such noncompliance, the Committee shall notify the Association Board in writing of such failure. Upon notice and hearing, as provided in the Bylaws, the Board shall determine whether there is noncompliance and, if so, the nature thereof and the estimated cost of correcting or removing the same. If a noncompliance exists, the Owner shall remedy or remove the same within a period of not more than forty-five (45) days from the date of the announcement of the Board ruling unless the Board specifies a longer time as reasonable. If the Owner does not comply with the Board ruling within such period, the Board, at its option, may either remove the non -complying improvement or remedy the noncompliance, and the Owner shall reimburse the Association, upon demand, for all expenses incurred in connection therewith. If such expenses are not promptly repaid by the Owner to the Association, the Board shall levy a Limited Assessment against such Owner for reimbursement pursuant to this Declaration. 6.8 Non Liability of Committee Members. Neither the Committee nor any member thereof, nor its duly authorized Committee representative, shall be liable to the Association, or to any Owner or Grantee for any Toss, damage or injury arising out of or in any way connected with the performance of the Committee's duties hereunder, provided such person has, upon the basis of such information as may be possessed by him, acted in good faith without willful or intentional misconduct. The Committee shall review and approve or disapprove all plans submitted to it for any proposed improvement, alteration or addition, solely on the basis of aesthetic considerations and the overall benefit or detriment which would result to the immediate vicinity and to the Property generally. The Committee shall take into consideration the aesthetic aspects of the architectural designs, placement of buildings, landscaping, color schemes, exterior finishes and materials and similar features, but shall not be responsible for reviewing, nor shall its approval of any plan or design be deemed approval of any plan or design from the standpoint of structural safety or conformance with building or other codes. Page 3 of 4 6.9 Variances. The Committee may authorize variances from compliance with any of the architectural provisions of this Declaration or any Supplemental Declaration, including restriction upon height, size, floor area or placement of structures, or similar restrictions, when circumstances such as topography, natural obstructions, hardship, aesthetic or environmental considerations may require. Such variances must be evidenced in writing, must be signed by at least two (2) members of the Committee, and shall become effective upon recordation in the Office of the County Recorder of Ada County. If such variances are granted, no violation of the Restrictions contained in the Declaration or any Supplemental Declaration shall be deemed to have occurred with respect to the matter for which the variance was granted. The granting of such a variance shall not operate to waive any of the terms and provisions of this Declaration or of any Supplemental Declaration for any purpose except as to the particular Property and particular provision hereof covered by the variance, nor shall it affect in any way the Owner's obligation to comply with all govemmental laws and regulations affecting his use of the premises, including but not limited to zoning ordinances and Lot setback lines or requirements imposed by any govemmental or municipal authority.
