MINUTES
May 10, 2001
The Design Review Board met in regular session on May 10,2001. Chairman Murray presiding.
1.
CALL TO ORDER:
2. ROLL CALL: The following members were present: MURRAY, MC CULLOUGH,
KENISON, CHRISTENSEN, BARNES, COUNCIL LIAISON MERRILL. A quorum is present.
3. APPROVAL OF MINUTES:
A. Minutes of April 12, 2001.
McCullough moves to approve the minutes of April 12, 2001 as amended. Seconded by
Kenison. ALL A YE...MOTION CARRIES.
4. UNFINISHED BUSINESS:
A. DR-68-00 - Common Area Landscapine for Baoburv Meadows Subdivision No.5 -
Banburv Meadows LLC: Banbury Meadows LLC, represented by Dick Phillips, is requesting
design review approval of the landscaping within the common area of Banbury Meadows
Subdivision No.5. The site is located on the east and west sides of Locust Grove Road extended
approximately Y2 mile north of Chinden Boulevard. This item was continued from the April 12,
2001 meeting.
Murray introduces the item and notes that the applicant has asked to be continued to the June
meeting.
B. DR-15-m - Flex Space Buildioe within Rockv Mountain Business Park - Eaele Land
LLC: Eagle Land LLC, represented by Mike Fairchild, is requesting design review approval to
construct a 13,511-square foot flex space building. The site is located approximately 200-feet
east of Plaza Drive and approximately 200-feet north of Iron Eagle Drive within the Rocky
Mountain Business Park at 1117 East Plaza Drive. This item was continued from the April 12,
2001 meeting.
Murray introduces the item. The applicant is not present and the item is thus moved to later in
the agenda.
C. DR-17-m- Daoce Studio aDd Office Buildine within Roekv Mountaio Busioess Park-
Carol Tooe: Carol Tong, represented by Mark Butler with Land Consultants Inc., is requesting
design review approval to construct a 5,700-square foot dance studio and office building. The
site is located approximately 200-feet south of Iron Eagle Drive within the Rocky Mountain
Business Park at 500 South Fitness Place. This item was continued from the April 12, 2001
meeting.
Murray introduces the item.
Mark Butler, 222 E. State Street, with Land Consultants Inc. representing Carol Tong. Mr.
Butler reviews the changes that have been made to this application. Discusses the architectural
changes, proposed lighting and the screening ofHV/AC units. Mr. Butler acknowledges that the
revised landscape plan was not submitted.
Phil Hull with The Land Group reviews the revised landscape plan. Ground mounted HV/AC

units are addressed by Mr. Butler.
Cerda would like the applicant to specify the CMU colors which have been chosen by the
applicant as numerous colors have been submitted, also the location and screening method of
ground mounted HV / AC units is needed, as well as the submittal of the revised landscaping plan.
Discussion amongst the Board.
Butler confirms that 4 colors of masonry will be used and these are the samples that have been
submitted to the City.
Kenison would like the screening method of the ground mounted units to be reviewed by staff
and one member of the Board. Murray would still like the bollards to be used. McCullough has
no problem with the landscape plan. Barnes would also like the bollards to be used.
McCullough moves to approve DR-17-01 - Dance Studio and Office Building within Rocky
Mountain Business Park with the standard and site-specific conditions of approval with the
following additions to site-specific conditions: The Design Review Board stands behind the
original suggestion of the bollard lighting as opposed to the historical lights. Any ground
mounted mechanical units shall be fully screened by landscaping and the landscape plan shall be
reviewed accordingly. The revised landscape plan shall be reviewed and approved by staff and
one member of the Design Review Board. Seconded by Kenision. Discussion. McCullough
withdraws his motion. Second agrees.
Murray moves to approve DR-17-0l - Danee Studio aDd Office Building within Roeky
Mountain Busioess Park with the site specifie and standard eooditions of approval with the
following modifications and additions to the site-specific conditions:

Site-specific conditioo #4 shall read: The applicant shall be required to provide
construction fencing around the three existing trees abutting Fitoess Drive and
Highway 44 prior to and during construction of the site. The construction fenciog shall
be installed prior to issuanee of a building permit.
Site-specific eondition #6 shall read: The applieaot shall be required to provide a
recorded agreemeot with the property owner to the east to allow the trash eoclosure to
be plaeed on the property to the east. The recorded agreement shall be reviewed and
approved by staff prior to issuaoce of a building permit.

Site-specific eoodition #7 shall read: The applieaot shall be required to provide a
recorded cross access agreement between the street aDd the property to the east aDd the
Road House Bar-B-Q. The recorded eross access agreement shall be reviewed and
approved by staff and the City Engineer prior to issuanee of a building permit.
Site specific condition #8 shall read: The Design Review Board recommends that the
applicaot iostall 2 low height bollards light fixtures at each end of the onsite parkiog
east of the building to provide sufficient pedestrian lighting at both ends of the parkiog
lot. This lightiog plan should be reviewed by staff prior to issuanee of a building
permit.
The applieant is required to provide a revised landscape plan to iodicate sereeniog of
the proposed condeoser equipment that is ground mounted on the west side of the
building. The applicant shall also provide staff a copy revised landscape plan that was
presented at tonight's meeting.

The applicatioo is approved based on the revised elevations provided to the Desigo
Review Board dated 5/8/01, with the knowledge that 4 different colored masoory units
are provided with this applieation.

Murray notes that a representative for item 4B is now in attendance and that item will now be

Phil Hull, 222 N. Eagle Rd., The Land Group, represents Eagle Land LLc. Mr. Hull reviews the
landscape revisions io the parking, comments on access, site lighting and mechanical unit
screening.
Cerda comments on the proposed lighting and suggests options for mechanical unit screening.
Hull addresses the Board in regards to lighting.
Discussion amongst the Board. Barnes would like to seem more detail on the mechanical unit
screening, and more with the coordination of the site lighting needs to be done. Kenison would
like to continue the item. Murray feels that the item could be approved with conditions that need
to be met prior to building permit issuance.
Murray moves to approve DR-15-0l Flex Space Building within Rocky Mouotain Busioess
Park with site specific and standard eooditions of approval as set forth io the original staff
report with the following modifications:
. Site-specific conditioo #3: The landscape plan as preseoted along the east property lioe
meets the intent of landscape bufferiog with this applieation and is eonsidered
acceptable to the Design Review Board.

Site-specific conditioo #6: The applieant's revised landscape plan indicating a shared
landscape area, total width 7', between the fire departmeot access drive and the
parkiog spaces of this developmeot is aceeptable to the Desigo Review Board as
presented with the additional landscaping tonight. The applicant will be required to
provide acknowledgement prior to issuance of a building permit that maiotenance of
this landscaped area will be given the responsibility of one party, either this
development or the fire department. It is not inteoded to have a 5' strip maintaioed by
the fire department and a 2' strip maiotained by this applicant.
Site-specific eondition #11 shall read: The applieant shall be required to provide a
complete lightiog plan which further delineates the 6 lighting fixtures preseoted
tonight. The lighting plan shall take into account the proposed lighting within the fire
departmeot development immediately to the west. The Design Review Board is Dot in
favor of shared usage of either lighting design, however the flex office spaee shall

consider placement of their lighting poles with regards to those of the fire departmeot.
Site-specific condition #12 shall have the following sentenee added: The access showo
ooto Plaza Drive shall be reeognized aDd approved by Ada County Highway District
prior to issuance of a building permit.
Site-specifie eondition #15: The applieaot shall be required to provide full details of
elevations in sections to indieate screening of the meehanical equipmeot adjaeent to the
building on the east elevation. 10 addition, the landscape plan shall be revised to
facilitate full screening methods of the meehanieal equipment on the north and south
sides of this buildiog. This design shall be reviewed aDd approved by staff and one
member of the Design Review Board prior to issuanee of a building permit.

5. PUBLIC HEARING:
A. DR-21-Ol- Dentist Office Buildioe - Brendeo Clemeots: Brenden Clemeots, represented
by James Gipson, is requesting design review approval to construct a 5,OOO-square foot dental
office building. The site is located on the southwest comer of Eagle Road and Floating Feather
Road at 1177 North Eagle Road. This item was continued from the April 12, 2001 meeting.
Murray introduces this item and notes that it will be heard at the June meeting.
B. DR-23-01- Monument Sien for Eae:le Professional Plaza - Eseo. Ine.: Esco, Inc.,
represented by Diane Mazy with Aim Sign Co., is requestiog design review approval to construct
a monument sign for the Eagle Professional Plaza. The site is located on the south side of State
Street at 589 East State Street.
Murray introduces the item.
Diane Mazy representing Esco Inc. Ms. Mazy comments on a few site specific conditions
specifically, landscaping and lighting. Would like specific location of the sign left flexible as it
receotly came to their attention that the ACHD is requiring rent for license agreements.
Discussion.
Cerda has nothing further to add to the presented staff report other than if the sign is to be
illuminated then appropriate screening is required.

Kenison does not feel the design meets the City Code would like a re-design for more
architectural detail. Murray concurs with Kenison's comments on the sign. Barnes would like to
review the changes to the structure of the sign and landscaping additions. McCullough and

Christensen concur that they would like to see this item again with the changes discussed tonight.
Kenison moves to continue DR-23-01 Mooument Sign for Eagle Professional Plaza.to the
oext regularly scheduled meeting of the Design Review Board.
. The applieation is to be returned to the Board with a landscape plan surrounding the
proposed sign.
The Board also recommends the applicant redesigo the sign box iocorporating greater
architectural detail that ties it in better to the building it complimeots.

Tilbury, represented by Roger Llewellyn with Golden West Advertising, is requesting design
review approval of a master sign plao for the Road House Bar-B-Q building. The site is located
on the southeast comer of Fitness Place and Iron Eagle Drive within Rocky Mountain Business
Park at 1059 Iron Eagle Drive.

Barnes moves to approve DR-24-01 Master Sign Plan for Road House Bar-B-Q Building as
preseoted with the following modifications to the site-specific eonditioos:

Site-specific eondition #1: The applicaot will comply as stated tonight, to reduce the
size of the size of the sign from 30 square feet to 27.5 square feet.
Site-specific eondition #2: The applicaot shall be required to provide an elevation of the
building showing that the free hanging sign boards are a minimum of 7' 6" above the
walkway. The elevations shall be reviewed and approved by staff prior to issuaoce of a
sign permit.
Site-specific condition #5: The applicant has indieated that no interior illumioation is
proposed for the monument sign.
Site-specific condition #6: To go back to the originally approved landseape plan, the
aonuals will be iocorporated ioto the landscaping around the monument sigo.

D. DR-25-01 - Two Professional Offiee Buildines within Casa Escuela Subdivisioo - Larrv
and Viekv Coelho: Larry and Vicky Coelho, represented by Mark Butler with Land Consultants
Inc., is requesting design review approval to construct two professional office buildings totaling
9,976-square feet (one 5, 151-square foot building and one 4,825-square foot building). The site
is located on the east side of Academy Avenue approximately 300-feet north of State Street

within the Cas a Escuela Subdivision at 172 and 208 Academy A venue (Lot 4 and 5, Block I,

reviews the application and comments on the staff report.
Talena Dovel with The Land Group comments on the ground cover on the stepping stones.
Butler states that no lighting is proposed other thao recessed lighting above the door. The
applicant is not opposed to bollards if that is what the Board desires. Murray questions the
placement and screening of mechanical equipment. Butler points out proposed locations at the
rear of each of the buildings. Also comments on roof drainage.

need more landseaping to soften the walls and the foundation.

Butler with Land Consultaots Inc., is requesting design review approval of the common area
landscaping within Williamsburg Subdivision (to be developed as Eagle Crest Subdivision, a re-

agrees but does have concerns with the lots being significantly reduced in size. Discussion.
Murray moves to approve DR-26-0l Common Area Landscaping with the site specific aDd
standard eonditions of approval with the following modificatioos:
. Site-specific condition #2 seotence #2 shall be rewritten as follows: The landscaping
shall be similar in tree and shrub installation as existing within the landscape areas of
the western side of State Highway 55. The Design Review Board recognizes the
complexity of the existing grade and eocourages the applicant to have limited area for
drought toleraot grasses, as well as allowiog the steep slope grass seeding per ITD
standards. Plans shall be submitted to staff and one member of the Desigo Review
Board prior to issuance of a building permit or prior to City Clerk signing the final
plat.

identifieation and design does not need further approval by the Design Review Board.

Hawkes: Sarah Hawkes, represented by Mark Butler with Land Consultants Inc., is requesting
design review approval to construct a 6,684-square foot professional office building. The site is
located on the south side of Fitness Place approximately 600-feet south of Iron Eagle Drive
within Rocky Mountain Busioess Park at 500 Fitness Place.
Murray introduces the item.
Murray notes that the applicant is Custom Mortgage, and he is currently in the process of
obtaining a loan from them. He stands to gain no financial gain, thus he will participate in
discussion and voting on this item.
The applicant asks for a minor delay in hearing this item.
Murray notes that a new business item will be added and heard prior to 5F.

DR-19-00MOD - Modifieation to Commercial Buildine - Chuck Storv:
Mr. Storey addresses the Board with his requests for modifications.

Murray moves to approve DR-19-00 MOD Modification to Commercial Building with the
following eonditions of approval:

Site-specifie eoodition #1: The applicant is required to remove the ehain link feoce aDd
slates aDd replace that feoee with either a wood fenee (per the original application) or a
vinyl paoel fence, at the applicaot's choice, at the same height. The fenee design shall
be reviewed by staff prior eommencemeot of construction of said fence.
Site-specifie eondition #2: The applicant shall be required to install 5 of the 6 original
Aristoerat Ornamental Pear trees in the following manoer: three shall be plaeed along
the east property line at the center of the building aDd spaeed in accordaoce to the
original plan; aDd two additional trees shall be place one on each side of the State
Street eotrance within the public right-of-way. The applicant shall be required to show
proof of approval of a license agreement with ACHD prior to installation of said trees.

The developers of the commercial building located at 2106 East State Street are requesting a
modification to the approved plans for the above mentioned site. The approved plans show six
(6) Aristocrat Ornamental Pear trees planted along the back (east) side of the building and a six
foot (6') high wood fence on the east and west property lines. In lieu of these improvements, a
7.5 -foot wide by 132 -foot long concrete pad has been constructed abutting the east side of the
building and a six foot high (6') chain link fence with white slates on the east and west property
lines.
Staff requests that the Design Review Board add this item to the agenda under New Business.
Staff defers comment regarding the requested modification to the Design Review Board.

We are asking you to consider the following changes to said
conditions of approval on said property:
1. Remove the six trees on the East side of the building
and replace with concrete for the following reason:
• We only have 7' from building to a 6' high fence
Limiting the area available to grow in.
• Restrict access to Gas and Power Companies
• Restrict tenant access and use of said area.
• Maintenance Headache
Rubbing against fence and building
Leaves in the fall filling the rain gutters and fenced
in areas with wet old leaves. Plus adding leaves
onto the neighboring property as well for them to
take care off.
2. Change 6' wooden fence to a 6' chain Zink with white
slats.
• More durable and safer for tenants
• Long term care and look for area much better.

the area not only today but also into the future.
