DESIGN REVIEW BOARD
MINUTES
February 8, 2001
The Design Review Board met in regular session on February 8, 2001. Chairman Murray
presiding.
1.
CALL TO ORDER: Meeting is called to order at 6:00 p.m.
2. ROLL CALL: The following members were present: MURRAY, MC
CULLOUGH, ANDERSON, BARNES, COUNCIL LIAISON MERRILL. Absent:
KENISON A quorum is present.
3.
CONSENT AGENDA.
. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless a Design
Review Board member, City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent
Agenda will be placed on the Regular Agenda in a sequence determined by
the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from
the City of Eagle shall be adopted as part of the Design Review's Consent
Agenda approval motion unless specifically stated otherwise.
A. Minutes of January 11,2001.
B. DR-3-01 - Buildin~ Wall Sien for Healthsouth-
Healthsouth:Healthsouth, represented by Debbie Anderson with Idaho
Electric Signs, is requesting design review approval of their existing
building wall sign for Healthsouth. The site is located on the west side of
Rivershore Lane within Channel Center Subdivision at 655 South
Rivershore Lane.
C. DR-9-01 - Buildine Wall Sien for Red Hot Shack Deli - Randy West:
Randy West, represented by Bryant Ideas, is requesting design review
approval to construct a building wall sign for Red Hot Shack Deli. The site
is located on the south side of State Street within Eagle Professional Plaza
at 611 East State Street.
Item A is removed from the Consent agenda and placed on the agenda under item 4A.
Staffhas requested that item 3B be remanded back to staff as a master sign application
needs to be submitted for this development.
McCullough moves to approve item 3C, DR-9-01 Buildiog Wall Sign for Red Hot

Murray notes changes on pages 5 and 7.
McCullough moves to approve the minutes of January 11,2001 as amended.

Murray notes that there have been modifications to the agenda before them tonight. The
following changes have been made.
Item 4A. DR-68-00 - Common Area Landscapine for Banbury Meadows
Subdivision No.5-Banbury Meadows LLC: Banbury Meadows LLC, represented by
Dick Phillips, is requesting design review approval ofthe landscaping within the common
area of Banbury Meadows Subdivision No.5. The site is located on the east and west
sides of Locust Grove Road extended approximately Y2 mile north of Chinden Boulevard.
This item was continued from the January 11, 2001 meeting.
Murray notes that the applicant has requested this item be continued to the March 8, 2001
Design Review meeting.
Barnes moves to continued DR-68-00 Common Area Landscaping for Banbury
Meadows Subdivision No.5 Banbury Meadows LLC to the March 8,2001 Design
Review Board meeting. Seconded by Anderson. ALL A YE...MOTION CARRIES.
Murray notes that due to an error in the public hearing publication for item 5B DR- 73-00
- Classrooms for Eagle Academy School - Meridian School District No.2 this item will
be heard at a special meeting to be held on February 22, 2001.
Anderson moves to continue DR- 73-00 Classrooms for Eagle Academy School
Meridian School District No.2 to the special meeting on February 22, 200l.

Murray notes that the applicant for item 5G DR-6-01 Common Area Landscaping for
Eagle Towne and Country including the WinCo Building Eagle Development Associates
LLC has requested this item be continued to the March 8, 2001 Design Review Board
meeting.
Barnes moves to continue DR-6-01 Common Area Landscaping for Eagle Towne
and Country including the WinCo Building Eagle Development Associates LLC to
the March 8, 2001 Design Review Board meeting. Seconded by Anderson. ALL

B. DR- 70-00 - Phase I Common Area Landscapine within Ea~le River Subdivision
- Ea~le River LLC: Eagle River LLC, represented by Phil Hull with the Land Group, is
requesting design review approval for subdivision signage and for a portion of common
area landscaping within Eagle River Subdivision. This Phase I landscaping plan is
limited to the landscaping along the interior streets and within the common areas along
and adjacent to Eagle Road and State Highway 44. The site is located on the southeast
corner of Eagle Road and Highway 44. This item was continued from the January 11,
2001 meeting.

Phil Hull 128 S. Eagle Road Eagle, Idaho. Hull reviews sign materials and color
samples. Hull notes that the tree spacing originally proposed has been modified in order
to comply with the spacing designated in the development agreement for this project.
Comments on the planters in the center median on the entries onto Eagle Road. Bill
Clark, gives an overview ofthe development.
The Board agrees to take public comment.
Mike Plunkett 843 Ballantyne Rd. Eagle, Idaho. Questions the placement of signals at
the entrances. Hull clarifies that a signal will be installed at the south entrance only.
Questions what will be done in the ITD right of way. Hull states it will be landscaped in
grass and underground irrigation will be installed.
Discussion amongst the Board.
McCullough moves to approve DR- 70-00 Phase I Common Area Landscaping
within Eagle River Subdivision with the site specific and standard conditions as
previously presented, as well as the changes presented this evening. Seconded by
Barnes. Discussion. McCullough moves to amend his motion and add a site-specific
condition #8 stating: The 5 entry signs and corner signs are accepted with the
materials and concept as presented tonight. Second agrees to the amendment. ALL
A YE...MOTION CARRIES.
5. PUBLIC HEARING:
A. DR-72-00 - Multi-Tenant Office Buildin~ (Addition) - Old Town I. LLC: Old
Town I, LLC, represented by Mark Butler, is requesting design review approval to
construct a 646-square foot addition to an existing 816-square foot office building,
creating a multi-tenant office building. The site is located on the east side of North 2nd
Street approximately 75-feet north of State Street at 50 North 2nd Street.
Murray introduces the item.
Mark Butler, 222 E. State Street. Mr. Butler reviews the application. He requests certain
modifications to site specific conditions concerning parking, dumpster, and the 50% glass
requirement for this application. Discussion.
Cerda reviews the staff report.
Murray opens the public hearing.
Murray closes the public hearing.
Butler comments on the parking and trash enclosure options.
Discussion amongst the Board.
Murray moves to approve DR- 72-00 Multi-Tenant Office Building (Addition) with
the site specific and standard condition of approval. Modifying the site specific
conditions as follows:
. The applicant shall provide an agreement with the City in accordance with Eagle
City Code 8-4-4-1-A to allow a link between these three properties and the off
site parking lot located on the southwest corner of Second Street and Idaho
Street. This agreement shall be reviewed and approved by the City Attorney

and shall be recorded by the applicant prior to issuance of a certificate of
occupancy.
Site specific condition#3 shall read: No sign should be approved with this
application, a separate Design Review master sign plan application is required
for the approval of any signs. The Design Review Board has recognized and
agrees with the design intent provided at this Design Review hearing.
Site specific condition#4 is revised as follows: The applicant shall be required to
redesign the front, west elevation of this building to maximize the allowable glass
frontage on this building face. The additional glazing 00 the existing building
shall be acquired by lowering the sill heights of the south windows, but neither
height nor width shall be modified. Also the single pane picture window on the
north side of the existing building shall be replaced with a grid system to tie all
frontage windows together. The Design Review Board recognizes structural
inability's to meet the required 50% of glass, and suggests that this alternative
be approved by City Council during the design review application and further
approved by staff prior to issuance of a building permit.
Site specific condition #5 shall be replaced as follows: The applicant shall be
permitted to use the rolling tote container currently utilized on the north side of
the corner building. The container shall be screened by either the installation of
an opaque gate system tying the two buildings together as was indicated on this
application, or the applicant may also, at his discretion, provide an enclosure
attached to the existing building that is matching in construction materials both
in wall and roof construction to that existing building. The later alternative
shall be reviewed and approved by staff and one member of the Design Review
Board prior to issuance of a building permit.

added: It has been presented by this applicant that no surface mounted lighting
will be provided on this building only soffit lights at the entry are proposed.

B. DR-73-00 - Classrooms for Eaele Academy School- Meridian School District No.
1: Meridian School District No.2, represented by Stillman Anderson with Leatham-
Krohn-Van Ocker, is requesting design review approval to construct a 12,000-square foot
classroom building to replace the existing four relocatable classroom buildings. The site
is located on the north side of Academy Way approximately 600-feet north of State Street
at 100 South Academy Way.

C. DR-I-Ol - Camille Beckman Office and Production Facility Phase I - Camille
Beckman: Camille BeckmanlFoad and Susan Roghani, represented by Billy Ray Strite
with BRS Architects, are requesting design review approval to construct a 104,340-

square foot office and production facility and perimeter landscaping. This is the first of
three phases which include manufacturing, production, packaging, and office facilities,
English cottage style shops, showrooms, bed and breakfast accommodations, gardens,
amphitheater and other similar uses. The site is located on the southeast corner of
Highway 44 and Park Lane.
Murray introduces the item.
Billy Ray Strite, 1010 Allante Boise, Idaho. Mr. Strite reviews the application. States
that the applicant does not want to install the meandering sidewalk along Highway 44 and
the pathway system in place for the City will provide access along a river pathway
system. Comments on site lighting and roof mechanical units. Notes that the river rock
as called out on the rendering, will be changed to sandstone. Site drainage is addressed
and Mr. Strite states that the engineer is working on that currently.
Rodney Evans with The Land Group presents the landscape plan for the site.
Cerda reviews the staff report. Discussion between staff and Board.
Murray opens the public hearing.
Mary Shaner 353 N. Cove Colony Way. Questions how the parking lot lighting will
effect her property, and also questions the amount of movement of traffic in and out of
the proj ect.
Murray closes the public hearing.
Mr. Strite rebuts comments made by staff and answers questions directed from the Board.
Discusses parking, the height of the fireplace, walkways, traffic and landscaping. Susan
Roghani 2273 Riveara Drive. Ms. Roghani comments on the planting of arborvita. Mr.
Evans provides clarification on existing tree locations.
Discussion amongst the Board.
Barnes moves to continue DR-I-Ol Camille Beckman Office and Production Facility
Phase I to the March meeting. The applicant is requested to submit drainage plans,
building material samples and colors, and provide site lighting details. Seconded by
Anderson. Discussion. Barnes amends her motion. Applicant is requested to
submit a method of drainage and also an amended landscape plan for the west side
to show more density or different types of materials to create more density, as well
as the changing of some of the plant material on the north side of the building. With
regards to the materials, the Board would like to see a larger drawing so that the
detail is easier to see. Second agrees to the amendment. ALL A YE...MOTION
CARRIES.
D. DR-2-01 - Common Area Landscapine for Countryside Estates Subdivision -
Capital Development and Tom Ricks: Capital Development and Tom Ricks,
represented by Dave Koga with The Land Group, is requesting design review approval of
the common area landscaping of Countryside Estates Subdivision. The site is located on
the northwest corner of Highway 44 and Ballantyne Lane.

McCullough moves to approve DR-2-01 Common Area Landscaping for
Countryside Estates Subdivision with the site specific and standard conditions of
approval with the following modifications to site specific conditions:
Site specific conditions #6 and #7 shall be deleted.
Site specific conditions #8 shall read: The basketball court, tot lots and pathway
improvement shall be constructed per phase within 6 months of completion of
the roadway construction, as long as weather conditions permit.
. Site specific conditions #9 shall be deleted.
. Site specific conditions #10 shall have the following language added: Shall be
landscaped to the gravel shoulder and documentation from the highway
department shall be provided to staff when the gravel shoulder is established.
Seconded by Barnes. Discussion. McCullough amends his motion and removes the
above modification to site specific condition #10. Site specific eondition #10 shall
read: The applicant shall be required to provide a license agreement, approved by
ITD and/or ACHD, allowing the right-of-way between this site and the gravel
shoulder along Ballantyne Lane and State Highway 44 to be landscaped. ALL

E. DR-4-01 - Common Area Landscapin~ for Red Leaf Manor Subdivision - Hill
View Development: Hill View Development Corporation, represented by Mark Butler
with Land Consultants Inc., is requesting design review approval of the common area
landscaping of Red Leaf Manor Subdivision. The site is located on the south side of
Floating Feather Road approximately Yz mile east of Eagle Road.
Murray introduces the item.
Mark Butler 222 E. State St. reviews the application. Phil Hull provides comment on the
landscaping plan. Butler submits in writing changes they are requesting to the site
specific conditions (attached to minutes). Discussion between Board and Mr. Butler, and
Mr. Hull.

Murray moves to approve DR-4-01 Common Area Landscaping for Red Leaf
Manor Subdivision with the site specific and standard conditions of approval as
written in the staff report with the following modifications.
. Site specific condition #2: The applicant shall be required to seek approval by
City Council to reduce or confirm that the current 40 ' wide buffer area along
Floating Feather Road is in compliance with Eagle City Code. If so, the
landscape plan as presented is acceptable to the Design Review Board with no
further action required. Should City Council require an amendment to the
width of this landscaped area, the applicant shall be required to return with a
revised landscape plan to be reviewed with staff and one member of the Design
Review Board prior to issuance of a building permit.
. Site specific condition #3: The applicant shall be required to provide a revised
landscape plan showing the required 3" caliper shade trees along the western
edge of east Knoll Drive connection on lots 2 and 13, as well as a shift in the
common line between lots 7 and 8. The revised plan shall be reviewed by staff
prior to issuance of a building permit.
Site specific condition #6: The applicant has indicated the removal of all trees
fronting Floating Feather Road from west to east in property frontage. The
applicant has also indicated the removal of the existing house shown on lot 7.
Prior to any removals the applicant shall be required to identify the size, caliper
and species on this lot scheduled to be removed, and presented to staff prior to
issuance of a building permit. Any trees that are remaining on the site shall be
protected with construction fencing extending beyond the drip line of the tree
during of subdivision.

#7: The Design Review Board recognizes the removal of the Floating Feather
frontage trees would require the applicant to provide an additional 135" of tree
caliper. The 135" does not recognize any additional trees being removed on lot 7
or lot 2. The Design Review Board recognizes the inability to replace that
quantity of tree caliper in this small application, and suggests that the design as
presented be accepted. The Design Review Board encourages the City Council
to expedite the approval of a tree fund ordinaoce to allow the City an
opportunity to gain funds for tree plaeements across the City.
Site specific condition #8: The applicant shall be required to match the
conditions of the edge of landscaping (i.e. grass and irrigation) with that of Eagle
Knoll subdivision to the west or to the edge their new property line (after right of
way take) which ever distance is less from the street center line.

Site specific condition #9: The privacy fence detail along Floating Feather Road
shall match that of the adjacent development Eagle Knoll's. The Design Review
Board recommends to City Council the inclusion of similar fencing along
common walkway running north south along the western edge of the property
and that it matches the western side completely in height, design, and pattern.
This fencing is the responsibility of the developer to be installed at time of
appropriate construction.

Site specific condition #11: The Design Review Board does not recognize/require
nor has reviewed any perimeter fencing of this application adjacent to current
residential properties. The need for fencing between two residential properties
is to be between the property owners.
Site specific condition #12: The applicant shall be required to provide a 20'
easement between lot 7 and 8 as identified by ACHD staff report site specific
condition #3.

F. DR-5-01- Common Area Landscapin~ for Red LeafHei~hts Subdivision - Hill
View Development: Hill View Development Corporation, represented by Mark Butler
with Land Consultants Inc., is requesting design review approval of the common area
landscaping of Red Leaf Heights Subdivision. The site is located on the southeast corner
of Floating Feather Road and Eagle Road.
Murray introduces the item.
Phil Hull reviews the application. Mark Butler incorporates all of the previous comments
on Red Leaf Manor into this application.
Cerda presents the staff report.

Murray moves to approve DR-5-01 Common Area Landscaping for Red Leaf
Heights Subdivision with site specific and standard conditions of approval with the
following modifications to the site specific conditions:

Site specific condition #2:The applicant shall be required to seek City Council
approval to reduce the buffer width of 50' wide along Floating Feather and
Eagle Road excluding the right of way. If successful at City Council, then the
landscaping plan submitted tonight meets the Design Review guidelines for
buffer width and would be accepted without further action. Should City Council
require an amendment to widen the buffer to the 50' dimension, the applicant
shall be required to submit a revised landscape plan that is reviewed by staff and
one member of the Design Review Board prior to issuance of a building permit.
Site specific condition #7 add the following language: The Design Review Board
recognizes and accepts the enlarged landscape plan submitted tonight indicating
the retention of several black locust trees at the intersection of Eagle Road and
Floating Feather Road. Should upon further investigation of these trees the
landscape plan require revisions greater than the removal of three trees that
have been shown to remain the applicant may proceed with the implementation
of the design as proposed. Should more trees be required to be removed after
further investigation a revised landscape plan shall be reviewed by staff and one
member of the Design Review Board prior to implementation.

Site specific condition #8 add the following language: The applicant is required
to provided landscaping (Le. grass and irrigation) to the location matching Eagle
Knoll subdivision to the east of this project, or to the extent shown on the
landscape plan which ever is closer to the existing street centerline.
Site specific condition #9: The applicant has provided the Design Review Board
with an enlarged plan of the proposed park areas and has provided the Board
with accessories and amenities which meet the Boards approval. Those park
areas shall be completed within 6 months of from the completion of roadway
paving for each phase, an extension will be granted based on inclement weather.

Site specific condition #10 is deleted and replaced with the following: The
applicant will be required to maintain three street trees within the cul-de-sac of
Bennington Place, and four street trees within the cul-de-sac opposite
Manchester Drive due to the unique configuration of the lots. The applicant will
be required to add five additional trees along Red Leaf Way, at the entrance of
Floating Feather Road spaced appropriately. That design shall be reviewed by
staff prior to issuance of a building permit.
Site specific condition #11: The applicant has provided a privacy fence detail
which matches the conditions of Eagle Knoll's Subdivision for both design and
material composition. The Design Review Board accepts this design as
presented.
Site specific condition #13: The applicant is required to enter into a discussion
with the Meridian School District to provide a 6' wide micro-path of asphalt
construction connecting the termination of Orlens Way with the school district
property thus allowing children residing in this subdivision to have a direct link
with the adjacent elementary school. This concept, if denied by the school
district, would be removed. Should the school district not wish to construct this
the applicant is not obligated to install.

the WinCo Buildin~ - Ea2le Development Associates LLC: Eagle Development
Associates, represented by Jeff Huber, is requesting design review approval of the
common area landscaping of Eagle Towne and Country Centre and approval of a 99,000-
square foot WinCo Foods building. The site is located on the north side of State Street
between Highway 55 and Horseshoe Bend Road at 3182 East State Street.

I would like to address Staff site specific conditions of approval # 4 and #8 regarding Mark Butlers
planned addition on North 2°d Street.
Comment #4 is a requirement for 50% glass on the front/west elevation of the building. As this is a small
addition to an existing building we ask that the 50% glass not be required To achieve 50% glass we would
have to.cut large sections of wall from the existing building. The addition of glass would remove shear
bracing from the existing building needed to provide lateral stability. The interior of the existing building is
plaster with historical details induding niches for phones, cove ceilings etc. These details would be lost if
more windows were to be added.
We have maximized the amount of glass in the addition while trying to maintain a design that is consistent
with the existing building. Adding more glass to the addition would ruin the building elevation and make it
look like a 'sore thumb'.
Comman #8 requires that the addition be extended to the edge of the access easement, which was formerly
an alley. The `alley' is still being used to access the adjacent properties. The requirement in Eagle City
Code that the side setback be brought to the property line is intended to have buildings abut each other and
produce a pleasant street facade. The `alley' easement prevents this from happening, as the buildings
would still be 16' apart.
We designed the addition to be 10' away from the property line, (center of the alley), so that the addition
could have unprotected window openings. ffthe building were place closer than 10' to the t,-,„, ;.;ty line the
windows would have to be ugly fire rated windows in hollow metal frames. These windows would not be
attractive, would not stay with the `period architecture', and would not match the existing building.
Also, if the building were set right on the `alley' it would present a dangerous traffic situation.
We have attempted to meet your requirement for 50% glass without damaging the aesthetics of the existing
building and the new addition. Care has been given to provide for i -Y proportions and consistent
detailing, staying within the `period architecture' Eagle is preserving and promoting. 1 hope you will agree
and approve the design as submitted.
