DESIGN REVIEW BOARD
MINUTES
November 9, 2000
The Design Review Board met in regular session on November 9,2000 at 6:08 p.m.
Chairman Murray presiding.
1.
CALL TO ORDER:
2. ROLL CALL: The following members were present: MURRAY, KENISON,
ANDERSON, Council Liaison Merrill. Absent: MC CULLOUGH . A quorum is present.
3.
CONSENT AGENDA.
. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless a Design
Review Board member, City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent
Agenda will be placed on the Regular Agenda in a sequence determined by the
Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from
the City of Eagle shall be adopted as part of the Design Review's Consent
Agenda approval motion unless specifically stated otherwise.
A. Minutes of October 12, 2000.
B. DR-56-00 - Buildin2 Wall Si2n for the Ifealth Nut - Rick amJ Terrv Jackson: Rick
and Terry Jackson, represented by Debbie Anderson with Idaho Electric Signs, are
requesting design review approval to construct an internally illuminated building wall
sign for Health Nut. The site is located within Eagle Pavilion Shopping Center at 360
South Eagle Road.
The applicant is present and agrees with the conditions in the staff report. No one
from the public chooses to speak to this item. Anderson requests this item be pulled
from the consent agenda.
C. DR-57-00 - Buildin2 Wall Si2n for AA L020S - Louise Powell: Louise Powell,
represented by Debbie Anderson with Idaho Electric Signs, is requesting design
review approval to construct an internally illuminated building wall sign for AA
Logos. The site is located within Eagle Plaza at 228 East Plaza Drive.
The applicant is present and agrees with the conditions in the staff report. No one
from the public chooses to speak to this item. Anderson requests this item be
removed from the consent agenda.
D. DR-58-00 - Modification to The Artisian Buildin2 Wall Si2n - Leslie Ditz: Leslie
Ditz is requesting design review approval to modify the existing building wall sign

located on State Street elevation at The Artisan to add Eagle Custom Frame. The site
is located at the northeast comer of State Street and 1 st Street at 118 East State Street.

Anderson moves to add DR-45-00 Building Wall Sign for Friends 'N Stitches
Cherne Newberry to the Consent Agenda. The applicant is not present. No one from
the audience chooses to speak. Seconded by Kenison.
4A. DR-45-00 - Buildinl! Wall Sil!n for Friends 'N Stitches - Cherrie Newberry:
Cherne Newberry is requesting design review approval to construct a building wall
sign for Friends 'N Stitches. The site is located on the north side of State Street
within the Kings Shopping Center at 324 West State Street.
Kenison requests that DR-54-00 Common Area Landscaping for Picadilly
Subdivision be added to the Consent Agenda. The applicant is not present. No one
from the public chooses to speak. Kenison withdraws his motion as the applicant is
not present.
Anderson moves to approve the Consent Agenda as amended. Seconded by
Kenison. ALL A YE...MOTION CARRIES.

with the standard conditions of approval. Adding a site specific condition of
approval stating:
. Internal illumination shall not exceed 430 milli-amps.

A. DR-45-00 - Bui.!!lin2 Wa~l Si2n for Friends 'N Stitches - Cherrie Newberry:
Cherne Newberry is requesting design review approval to construct a building wall
sign for Friends 'N Stitches. The site is located on the north side of State Street
within the Kings Shopping Center at 324 West State Street.
Moved to Consent Agenda.

PUBLIC HEARING:
Chairman Murray announces it is the time and the place for the Public Hearing.
A. DR-44-00 - Common Area Landscapin2 for Trolley SQuare Shoppin2 Center -
Coulter Properties LLC: Coulter Properties LLC, represented by Dakota Company Inc.,
is requesting design review approval of the landscaping within the common areas of
Trolley Square Shopping Center. The site is located on the north side of State Street
approximately 1O0-feet east of Palmetto A venue.
Murray introduces the item.
Larry Dirkhum with the Dakota Company Inc. representing the applicant reviews the
application. Disagrees with the second site specific condition of approval with is
regarding trying to preserve existing trees. Requests that certain site specific conditions
be reviewed by staff instead of coming back before the Design Review Board.
The Board expresses their desire to have more information i.e. caliper, placement of
existing tree, etc. regarding existing trees on the site. Anderson notes that it is very
important for site lighting to be approved by the Board. Discussion between Board and
Mr. Dirkhum.
Cerda presents the staff report. She reiterates that this application is for perimeter
landscaping. Discusses the staff report.
Murray opens the public hearing.
Mathew Glavach 248 N. Palmetto Dr. Eagle, Idaho. President of the LaRue Acres
Homeowners Association. Has questions regarding the north west corner of the project.
Concerned with the proposed 8' block wall, as it will impact eight homes. Also
concerned with parking lot lighting as it affects abutting homes, also the proposed
building which will affect the views of those live near it.
Murray closes the public hearing.
Mr. Dirkhum rebuts testimony given. The block wall was added as a result of the public
testimony given at the conditional use hearing by neighboring homeowners. Comments
on the height of the proposed building. He will provide historic street lighting all along
State Street, and will provide plans that reflect this - providing of course that ACHD will

sign off on it. Comments on the continuation of Academy Place. Doug Russell, The
Land Group, states that they will be able to provide information regarding existing tree
location and caliper size. Discussion on the sidewalk along State Street.
Discussion amongst the Board. Kenison expresses his desire to see the existing tree plan.
Anderson expresses her desire to explore options for those being affected by the LaRue
Acres homeowners. Murray would like to see cross sections of the proposed landscaping.
Murray moves to continue item DR-44-00 Common Area Landscaping for Trolley
Square Shopping Center to the regularly scheduled December meeting of the Design
Review Board. With the following recommendations.
. During that 30 day period the applicant provide the Design Review Board with
the location, size and species of all existing trees that will be affected by this
application.
. The applicant is required to show compliance with Eagle City Code 8-2A-7.K.2
for buffering of perimeter parking lots along street frontages.
. The applicant is required to provide a minimum of one cross section per
perimeter side of the development to indicate compliance with Eagle City Code.
It is recommend that a minimum of three be made along State Street.
. Currently all site specific and standard conditions of approval will remain.
Seconded by Kenison. Discussion. Kenison moves to amend the motion
. To have the north cross section will be the part that abuts LaRue Acres.
. Also adding the recommendation that an arborist report be brought in showing
the location and caliper size of all of the existing trees in this subdivision.
Seconded by Anderson. Discussion. Anderson moves to amend Kenison
amendment adding the following recommendations:
. The northwest corner, the Board highly recommends that we look at eliminating
the 8' fence and going a lot softer, and going denser with evergreens trees and
landscaping on that side.
. It be noted that along State Street the street lighting shall be the historical
lighting.
. On the pathways that die into a driveway and connect on the opposite side, that
there be some sort of a connection there, possibly brick or stone, something
aesthetically pleasing.
Seconded by Kenison. Discussion. ALL A YE...MOTION CARRIES.
B. DR-53-00 - professfonal O{!Jce Retail Build~ne: - Robert DeSþazo. Jr.: Robert
DeShazo Jr., represented by Douglas Landwer, is requesting design review approval to
remove an existing structure of 1,532-square feet and to construct a 5,944-square foot

professional retail building. The site is located on the north side of State Street
approximately 600-feet west of Eagle Road at 172 West State Street.
Murray introduces the item.
Douglas Landwer, representing Robert DeShazo, Jr. Mr. Landwer reviews the
application. Comments on the staff report and reviews a handout commenting on items
of concern. Discussion between Mr. Landwer and Board.
Cerda reviews the staff report.
Murray opens the public hearing.
Burt Canfield 153 Park Road Eagle, Idaho. Lives on the property to the north, has
concerns with the irrigation ditch that runs behind the proposed application. Also would
like some buffering between his property and this site. Concerned with site lighting
spilling onto his property.
Mark Butler 1640 W. Washam Rd. In favor of an expanded grid system, but does feel
that in this case it should not be followed. States there was a recent supreme court case
which was filed this year in which the jump between zoning code and comprehensive
plan was not upheld. The applicant does have property rights and due process of law and
therefore the Comprehensive Plan should be set aside in this case.
Bill Ditz, 673 W. Fordham Drive Eagle, Idaho. States that he is the Chairman of the City
Facilities Assessment Committee. Has worked with Doug Landwer feels he is quite
conscientious. The road alignment should be rethought.
Murray closes the public hearing.
Landwer rebuts testimony. The parking lot design has been revised to comply with fire
access. Comments on parking space design. Is willing to meet with the neighbors to the
north.
Discussion amongst the Board.
Murray moves to continue DR-53-00 Professional Office Retail Building to the
regularly scheduled meeting in December with the following recommendations to
the applicant:
. The applicant is encouraged to provide to the Design Review Board additional
information associated with:
1) The location and screening method of all mechanical equipment.
2) The design intent for the roof drainage, and subsequent water disposal.
3) The applicant should indicate methods of building lighting if planned.
4) The applicant is encouraged to discuss with the utility easement on the north
side of the building, the restrictions, if any, for plant materials. And if no
restrictions occur, then a method of screening in compliance with adjacencies
to residential property would be provided.
5) The applicant is encouraged to provide a revised building/site plan for the

south portion of the building to show 70 % attachment with the street
sidewalk.
6) The applicant is encouraged to provide additional detail for shadow relief
along the east elevation to avoid a mono-plane appearance.
Seconded by Kenison. Discussion. Murray amends his motion adding one
additional condition:
7) The applicant is encouraged to provide and additional level of detail with
respect to the texture of the north elevation for reason to avoid a monolithic
plane appearance.

C. DR-54-00 - Common Area Landscauim! for Picadillv Subdivision - Stacia
Patterson: Stacia Patterson, represented by Mark Butler with Land Consultants Inc., is
requesting design review approval of the landscaping within the common areas of
Picadilly Subdivision. The site is located on the southwest comer of Highway 55 and
Hill Road.
Murray introduces the item.
Mark Butler 222 E. State Street. Mr. Butler reviews the application.
Cerda reviews the staff report.
No one chooses to speak.
Murray closes the public hearing.
Discussion amongst the Board.
Anderson moves to approve DR-54-00 Common Area Landscaping for Picadilly
Subdivision with the standard conditions of approval. Modifying the site specific
conditions as follows:
1) Shall remain.
2) Shall be modified to read: The applicant instead of installing an 8' foot high
emu wall, the applicant shall install a berm buffer as proposed in the
landscape plan which was received in the Design Review packets.
3) Shall remain.
4) The applicant shall install a denser evergreen plant material in the berm
areas to provide more screening.
Seconded by Kenison. Discussion. Anderson amends her motion. Site specific
condition #4 shall read:
4) Underneath the shade trees shall be filled in with evergreen shrubs varying
in size and height to allow for greater density in sections Band C.

D. DR-55-00 - Convert Residence into Office - Robert Runyan: Robert Runyan,
represented by Mark Butler with Land Consultants Inc., is requesting design review
approval to convert an existing 1,026-square foot residence into an office building. The
site is located on the east side of Park Road approximately 215-feet north of State Street
at 74 Park Road.
Murray introduces the item.
Mark Butler 222 E State Street, reviews the application. Robert Runyan 3638 Holl Drive
Eagle. Mr. Runyan is the owner of the building answers questions regarding the proposed
architecture. Phil Hull reviews the landscaping plan. Discussion between Mr. Butler,
Mr. Runyan, Mr. Hull and the Board.
Cerda reviews the staff report.
Murray opens the public hearing.
John Adams, 208 Park Road. Concerned with a commercial property being developed in
this residential area at this time. States the road is very narrow. Shows the Board pictures
he has taken of Park Road. There is not good traffic flow on the street as it is now and
would like to discourage allowing commercial usage on Park Road at this time.
Mary Coil 265 Park Road. Has lived at this address for 23 years. She is wondering how
the zoning of this area has become a transitional residential area. Comments on the
traffic flow problems on Park Road.
Debra Reignhart. Would like to see a Children at Play sign required. Comments on the
speeding that occurs on Park Rd. States that speed bumps would be beneficial and larger
Dead End and Speed Limits signs. Also states that if anything is parked on State Street it
becomes a huge problem getting out of Park. Would like school-crossing signs added.
Also states that additional street lighting is needed on Park Road. Questions where the
signage will be placed.
Ken Ward 303 Park Road. Draws the Boards attention to the petition that was submitted
that is opposed to the commercial use of this site. Would like Park Road to stay
residential only.
Bill Ditz 674 W. Fordham Dr. Comments on the lot size and the driveway size.
Murray closes the public hearing.
Butler rebuts testimony given. States that parking in the rear would make it less
hazardous to turn around.
Discussion amongst the Board.
Murray moves to approve DR-55-00 Convert Residence into Office with the site
specific and standard conditions of approval as noted in the staff report with the
following exceptions.
. Site specific condition #2 shall read: The pergola shall be extended to a distance
of 2 additional feet to meet the maximum 25-foot front building setback limit as
required by the staff report. The applicant is encouraged to provide a cut out

around the existing conifer tree as directed by the applicants landscape architect
so as to avoid damaging the tree.
. Site specific condition #3 shall remain.
. Site specific condition #4 shall read: The applicant's driveway as proposed shall
be altered within the confines of the drip line of the tree to either a paver with
peñorated piping for oxygenation as recommended by the landscape architect or
the use of grass crete as al alternate method for the pavers. The choice is within
the opinion of the landscape architect.
. Site specific condition #5 shall read: The existing landscaping and fencing
proposed on the site plan shall be accepted in conformance with the alternate
method of compliance. The fencing may be altered to a vinyl fence of the same
height and pattern as selected by the applicant. The vinyl fence and landscaping
shall be reviewed by staff and one member of the Design Review Board prior to
issuance of a building permit.
. Site specific condition #8 shall read: The river rock stone piers as shown on the
presented elevations shall be extended down to finish grade and no concrete stem
wall shall be visible.
. Site specific condition#9 shall read: Any proposed lighting shall be in
compliance with Eagle City Code.
. Site specific condition#10 shall read: The decking material or floor material of
the pergola shall be reviewed by staff and one member of the Design Review
Board prior to issuance of a building permit. This will take into account a
decking material which may require lattice below the floor finish level.
. Site specific condition #11 shall read: The Design Review Board recognizes the
concerns of the adjacent property owners with respect to both car and truck
traffic, and the Design Review Board suggests that the Mayor and Council
review their concerns at some time directed by Mayor and Council.
. Site specific condition #12 shall read: At the north end of this property the
applicant is required to provide a "Children at play" sign in compliance ACHD
standards, provided ACHD approves installation of such sign.
. Site specific condition #13 shall read: The rafter tails as presented in the
elevations are not to be installed on this building as provided by testimony.
. Site specific condition #15 shall read: The windows on the front elevation as well
as the railings be further detailed to minimize overall size and scale, and be
reviewed by staff and one member of the Design Review Board prior to issuance
of a building permit.

7. REPORTS:
A. Design Review Board Members: Kenison comments on ex-parte contact. Requests

staff not direct people to contact Board members. And if ex-parte contact is made it
should be disclosed during a meeting. Legal Council agrees that ex-parte contact be
avoided at all cost.
B. Council Liaison: Notes that a new Design Review Board member may be confirmed
at the next Council meeting. Will discuss with Council certain items regarding the
application from Robert DeShazo that was heard tonight, specifically the roadway
placement and the interpretation of the 70% street frontage. Comments on Joint Meeting
agenda items.
C. Staff:

CROSS ACCESS AND/OR THROUGH-ACCESS AGREEMENT
This Agreement is made and entered into this day of , 2000 by
Robert Runyan(Grantor) whose address is 74 Park Road, Eagle, Idaho 83616, hereinafter referred to as
Grantor for the purposes hereinafter set forth.
WITNESSETH:
WHEREAS,the Grantor is the fee simple owner of property more fully described as Lot 11,
Block 1, of Jackson Park Subdivision;and
WHEREAS,the Grantor pursuant to Eagle City Planning and Zoning Application File#
RZ-11-00 has been granted access to Park Road a public street, in accordance with the conditions of
compliance for development application file number RZ-11-00 and whereas, a joint access easement is
required as a condition of such access by the Ada County Highway District, a Body Politic and Corporate
of the State of Idaho (hereinafter"District") as well as the City of Eagle; and
WHEREAS, it is anticipated that,upon change in use of the parcel abutting this site to the south
(Lot 10,Block 1,of Jackson Park Subdivision) a Cross Access and/or Through-Access Agreement will
hiely be required from that property owner also for the purpose of ingress/egress to Park Road for the
ultimate shared use of the cross access easement area by both Lot 10 and Lot 11 of Jackson Park
Subdivision. An example of the possible dimensions and location of the cross access easement area for
Lot 10,Block 1, of Jackson Park Subdivision is generally depicted on the application file number RZ-11-
00 site plan Exhibit`B", attached hereto and incorporated herein. Any such Cross Access and/or
Through-Access Agreement for Lot 10, Block 1, of Jackson Park Subdivision would be subject to any
requirements of a development application for that site.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, and other good
and valuable consideration,the receipt and sufficiency of which is hereby acknowledged, the Grantor
agree as follows:
1. The Grantor hereby agree to grant, for the purpose of ingress/egress to Park Road, a CROSS-
ACCESS and/or THROUGH-ACCESS EASEMENT, an eleven foot (11') wide strip of land as
generally depicted on the application file number RZ-11-00 site plan Exhibit`B", and as
specifically described in legal description Exhibit"A"attached hereto and incorporated herein, to
the abutting property as shown on the stated Exhibit `B", pursuant to the requirements of
development application file number RZ-11-00, upon, over, and across the land described in
Exhibit"A".

2. This Agreement shall be binding upon the successors, heirs, executors, administrators,personal
representatives, or assigns of the Grantor and upon all persons acquiring an interest thereunder,
and shall be a covenant running with the title to the Grantor's land herein described until
terminated as provided herein.
3. The District shall have standing to enforce this Agreement regarding ingress/egress to and from
Park Road. In the event it shall be necessary for the District to bring suit to enforce this
Agreement, or for damages on account of any breach of the Agreement, or of any easement,
warranty, covenant, conditions,requirement or obligation contained herein, the prevailing party
shall be entitled to recover from the other,in addition to its damages,all legal costs and
reasonable attomey's fees as fixed by the Court,both at the trial and the appellate level.
4. The District shall not be liable or responsible for any maintenance or repairs to the Grantor's real
property.
5. This Agreement and the provisions contained herein shall be construed, controlled, and
interpreted according to the laws of the State of Idaho, and all duly adopted ordinances,
regulations, and policies of the District now.in effect and those hereinafter adopted.
6. The location for settlement of any and all claims, controversies, or disputes, arising out of or
relating to any part of this Agreement, or any breach hereof, shall be Ada County, Idaho.
7. The Grantor and the District agree to comply with the laws, rules, regulations and requirements of
all governing authorities having jurisdiction over the real property described herein.
8. The Grantor shall cause to have this Agreement recorded and made of public record in the office
of the Ada County Recorder, Boise, Idaho.
9. The Grantor hereby covenants and agrees that this Agreement and the terms mentioned herein are
specifically enforceable because monetary damages would be insufficient to redress the denial of
such easement.
10. This Agreement shall run with the land, unless terminated jointly by all of the parties hereto which
shall included written approvals for any such termination by the District and the City of Eagle..

11. The Grantor hereby acknowledge that they have freely and voluntarily entered into this

1. The City's comprehensive plan shows a local North— South roadway through
this parcel to connect to an extension of Idaho Street along the North property
line. District Policy requires streets to align on offset a minimum of 125 feet from
centerline to centerline. The street location as designated on the
comprehensive plan does not conform to District Policy, and would not be
approved in that location. When designating the location of new Local
streets, the City should consult with ACHD staff, and adhere to the policy
and standards of ACHD.
