DESIGN REVIEW BOARD MINUTES May 11, 2000 The Design Review Board met in regular session on May 11, 2000. Chairman Murray presiding. 1. CALL TO ORDER: 6:30 PM 2. ROLL CALL: The following members were present: KAUFFMAN, MURRAY, KENISON. Absent: ANDERSON, MC CULLOUGH and Council liaison MERRILL. A quorum is present. 3. CONSENT AGENDA. . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. DR-23-00 - Buildin~ Wall Si2n for Desperado's - Kim and Debi Pieper: Kim and Debi Pieper are requesting design review approval for an internally illuminated building wall sign for Desperado's. The site is located on Plaza Drive within Eagle Plaza Shopping Center at 228 East Plaza Drive, Suite I. D. DR-24-00 - Buildine Wall Sien for Gold Medallion Insurance - Donald Brinton: Donald Brinton is requesting design review approval for a building wall sign for Gold Medallion Insurance. The site is located on the east side of Second Street, approximately 100-feet north of State Street at 50 North Second Street. 6B. DR-18-00 - Sales Office within Banbury Meadows Subdivision- Banburv Meadows LLC: Banbury Meadows LLC, represented by Cornel Larson with Willowbrook Development, is requesting design review approval to construct an 848-square foot sales office. The site is located on the north side of Oakhampton Drive within Banbury Meadows Subdivision Phase 2 at 484 West Oakhampton Drive. Murray inquires if the applicants have any comments regarding their applications or the staff reports. The applicants have no comments. UNFINISHED BUSINESS: None NEW BUSINESS: None PUBLIC HEARINGS: Chairman Murray announced it is the time and the place for the Public Hearing. A. DR-17-00 - Buildine Wall Siens For McDonalds - Darmody Enterprises: Darmody Enterprises, represented by Dan Conlin with Idaho Electric Signs, is requesting design review approval for two internally illuminated building wall signs for McDonalds. The site is located on the northeast corner of Eagle Road and Plaza Drive within Eagle Plaza Shopping Center at 178 South Eagle Road. Dan Conlin with Idaho Electric Signs, 6528 Supply Way, Boise, Idaho 83716. Discusses the signage for McDonalds. Discussion between applicant and the Board about mounting of the signs on the building. Cerda discusses the landscape plan that was faxed over today that was required with the original Play Place addition. Discusses how square footage of buildings is calculated for the 5% of the signage. Discussion between Board and staff about faxed landscape plan with regards to the east and south landscaping that was required previously. Murray opens the public hearing. Murray closes the public hearing. Discussion amongst the Board. Murray moves to approve DR-17-00 Building Wall Signs for McDonalds with the site specific and standard conditions of approval with the following amendments to site specific conditions. Amending site specific condition #1 adding the following language: The Design Review Board suggests that the play place sign age be the only sign age on the south elevation and be lowered onto the mansard roof between the windows and the main gutter line and the size of the play place sign fall within the 5% are as required with Eagle City Code. Adding site specific condition: The landscape plan prepared in conformance with Eagle City shall be submitted to Staff prior to a Grand Opening. The landscape plan shall be reviewed and approved by Staff, it does not need to come back before the Board. DR-18-00 - Sales Office within Banbury Meadows Subdivision - Banburv Meadows LLC: Banbury Meadows LLC, represented by Cornel Larson with Willowbrook Development, is requesting design review approval to construct an 848- square foot sales office. The site is located on the north side of Oakhampton Drive within Banbury Meadows Subdivision Phase 2 at 484 West Oakhampton Drive. See Consent Agenda. C. DR-1l-98 MOD - Proposed Poles and Nettine within Banbury Meadows Golf Course - Banbury Meadows LLC: Banbury Meadows LLC, represented by Cornel Larson with Willowbrook Development, is requesting to install poles and netting along the east end of the driving range and along the north side of the driving range that are 40- feet in height. Cornel Larson with Willowbrook Development, 210 Murray Street, discusses the proposed poles and netting on Banbury Meadows Golf Course Driving Range. Notes that trees have been installed on the south side of the range. Discussion between Mr. Larsen and Board members. Cerda briefly explains the staff report. Murray opens the public hearing. George Dillard 135 W Jakona Ln. Eagle. Mr. Dillard notes that an agreement exists between Harvey Hoff and Mr. Dillard and his wife and this agreement was incorporated into the PUD approval. States that golf balls have entered his yard, and feels that limited flight balls should be used. He does not object of a net, but does want approval of the net and pole. He objects to the type of poles that have been installed. His view has been ruined by the installation of the poles. Mr. Dillard feels the application should be denied. Dave Edmark 3058 S. Whitepost, Eagle. The poles are quite obvious, as is the netting. States that none of the plans he had ever seen showed netting. Expresses concern of wildlife and the effect an 800 foot wall will have on them. States the netting does not meet code and asks that the Board reject the application, and keep Eagle a pleasant place to live. Lori Edmark 3058 S. Whitepost, Eagle. Ms. Edmark shows the Board pictures of the netting from different angles. Keith Watson 260 W. Oakhampton, Eagle. Mr. Watson states that when he purchased his lot he was never informed that his view would be destroyed by the installation of netting and poles. Discusses the use of berming that Spurwing Golf Course has utilized. He paid handsomely for the view and that view has now been marred. Mr. Watson would like the application denied. The poles are soaked with creosote and are a carcinogen and could be a hazard to water table and an environmental impact statement should be required by the city. Morgan Masner 3168 S. Whitepost, Eagle. Mr. Masner states that he was a member of Page 3 of9 \\EAGLENTl\COMMON\DESI_REV\MINUTES\Temporary Minutes Work Area\DR-O5-11-00min.doc the City Council when the original PUD was approved. A development agreement between Mr. Dillard and Banbury Meadows LLC was required by the City in an attempt to protect Mr. Dillards property. Unfortunately it was not taken into consideration that the tee locations would be moved so that golfers could practice off of the grass. Also states that the original plan shows the number of poles and pole location. The Developer has the right to install netting and poles, but he has not gone about the process in an appropriate matter and has not abided by the original development. Mr. Masner and his neighbors in the Banbury Subdivision find the poles obnoxious and unsightly. They should be screened on both sides with trees. He does state that the golf course is a blessing to the community, but the developer needs to follow the criteria established in the agreement even if it means using limited flight golf balls. Debra Svedberg 1640 Joplin, Eagle. Ms. Svendberg lives a mile away and can still see the poles sticking up out of the ground, rather obnoxiously. From a mile away they can be seen. David Giles 3066 S. Whitepost, Eagle. Does not feel that any landscaping will sufficiently mask the poles. Perhaps thinner poles could be used. Asks that the application be denied. He has lived here for twelve years and finds the poles very unsightly, and feels an alternative should be pursued to the current poles. Carline Canfield 1100 Clearvue Ct. Eagle. Owns 50 acres along the western boundary of the golf course. Asks for confirmation that the only netting and poles being addressed tonight are for the driving range, and all other poles and netting originally requested by the applicant and have been withdrawn. Chairman Murray confirms this. Ms. Canfield is opposed to the use of netting and poles, and agrees with all of the reasons that others have addressed tonight, including marring the view, endangering wildlife, and devaluing neighboring properties. David Preis 1600 Joplin Lane Eagle. His concern is with the hazards of creosote soaked poles and feels the issue should be addressed. Janelle Walters, 1600 Joplin Lane Meridian, Idaho. Is concerned with the aesthetic looks of the netting. Wants to know ifby allowing netting around the driving range if precedence will be set that would allow netting elsewhere, or will another public hearing have to be held. Very concerned with the waterfowl and how they will interact with the netting. How will the netting be repaired? Jerry Breaux 2626 Mary Post Eagle, Idaho represents golf course. It had never been the intention to use the Astroturf as the only teeing option. Acknowledges that they have been trying to alleviate the impact the driving range has had with Mr. Dillard's property. Feels the golf course is the premier course in Eagle and will hopefully host a national tournament. Clint Travis represents golf course. Mr. Travis does not feel low flight golf balls is the solution. Notes that Mr. Breaux has attempted to work out a solution with Mr. Dillard, and had thought that the problem had been solved. The best netting will be used, it has a 10 year warranty it is a fine mesh. The poles are Douglas Fir class 2, 50' tall pole with 8 feet in the ground. The net will be attached by aircraft cable along the top and sides similar to Shadow Valley Golf Course. Discussion of tree plantings. He drove by the noticed that not many golf balls seem to be flying off of the driving range. Doesn't see the need for the netting on the north side. George Dillard states that there are 2 artesian wells within 100 feet of the poles and wants to know the environmental impact the creosote soaked poles will have on the wells. Expresses his concern for wildlife safety. Wants a low flight golf balls to be used. Morgan Masner reminds the Board of the requirement of underground utilities, and that the existing poles are reminiscent of over head utilities. Peter Simon 3034 S Whitepost Way Eagle, Idaho. Is opposed to the poles, they are an eyesore. Believes there is probably an alternative pole type that is available that may be acceptable. June Walters owns land on the 15th Fairway. Expresses concern for the wildlife, and aesthetic beauty of the area. Murray closes public hearing. Dick Phillips, 210 Murray Street Boise. Comments on testimony tonight. Notes that the trees on the river are higher than the poles, and hopefully the herons will be able to clear the netting. States that limited flight golf balls will correct the concerns regarding distance, but not the direction the balls are flying. The poles used are the same type that Idaho Power uses. Discussion between Board, Staff, and Applicant. Murray moved to continue to DR-1l-98 MOD Proposed Poles and Netting within Banbury Meadows Golf Course with the following requests: Staff shall provide the Design Review Board members with the language specifically dealing with the fence on the north side of the property. Should any supplemental site plans be determined in the file, the Board shall receive a copy of them. The applicant is requested to, if available, to determine PGA guidelines for driving range fence heights, that would be appropriate as published back up material for this design. Seconded by Kauffman. Discussion. Murray amends his motion to change PGA guidelines to USGA or published golf association guidelines. TWO AYE...ONE NAY. MOTION CARRIES. Murray notes that the public hearing has been closed and no additional testimony will be taken. Break D. DR-19-00 - Commercial Buildine with Office and Flex Space - Chuck Story: Chuck Story, represented by James Gipson Associates, is requesting design review approval to construct a 4,000-square foot commercial building with office and flex space. The site is located on the north side of State Street and south of Dunyon Street at 2106 East State Street. James Gipson P. O. Box 219, Eagle, Idaho reviews the application. Cerda discusses that there is approximately 9.5% of the site has landscaping. Discusses Flex Space as defined in ECC. Clarifies the need for the 6' high fence as per Eagle City Code. Murray opens the public hearing. Doris Pottenger 2128 Dunyon Street, Eagle. Discusses the site and is concerned about the public using this site in regards to the speed in which they leave the site and travel down Dunyon since the site is design to enter off of State Street and exit out on to Dunyon Street. Murray encourages Ms. Pottenger to contact ACHD regarding speed limits on Dunyon. Pat Palmer 1588 Deadwood, Eagle, Idaho he is a partner with Chuck Story. States the intent for this project and states that he received encouragement from the previous Zoning Administrator and thought they had complied with his wishes. Comments on the architectural aspects of the building and landscaping. Murray closes the public hearing. General discussion. Murray moves to approve DR-19-00 Commercial Building with Office and Flex Space with the site specific and standard conditions of approval with the following additions: Site specific condition #5 shall read: No storage on the east side of the building shall be permitted beyond a vertical height of 6' so that the existing fence conceals any rear storage. #6: The existing tree located near the existing property line shall be protected during construction of this project. #7: The overhead doors shall be moved from the north and south elevations to the west elevation to comply with the definition of Flex Space under Eagle City Code 8-1-2. #8: The roofing shall be constructed with concealed fasteners and it is recommended that a non grey color be used and approved by staff. #9: All mechanical equipment shall be screened from view and not placed on the roof surface. #10: The north and south elevations shall be revised to reflect two window openings and the shed roof shall be continued around the elevations. #11: The applicant is encouraged to provide a post mounted sign in conformance with Eagle City Code that notifies exiting drivers of 20 MPH speed limit. DR-20-00 - Two - Two Story Office Buildines - BB One: BB One, represented by Phil Hull with The Land Group, is requesting design review approval to construct two 29,800-square foot two story office buildings. The site is located on the west side of Rivershore Lane within Channel Center Subdivision at 599 South Rivershore Lane (a portion of Lot 3, Block 1 and Lot 1, Block 1 and all of Lot 2, Block 1). Phil Hull, The Land Group 128 South Eagle Road. Discusses the project layout and landscaping. Jeff Cramer 2413 South Falls Hill Lane, Boise. Architect of the building. Discusses the building design. Cerda has nothing further to add to the report. Discussion between the Board and staff. Murray opens the public hearing. Don Brandt 203 II1h Avenue South, Nampa, Idaho. Co-owner of project with Dennis Baker. He states that he likes the architecture of the building. Dan Torfin, 250 Beechwood, Boise. Discusses the pathways to the river trail and where the northern one is to be relocated. Murray closes the public hearing. Discussion amongst the Board. Murray moves to continue DR-20-00 Two - Two Story Office Buildings to the May 25, 2000, Special Design Review Meeting, with the recommendation that the exterior building reflect comments made from the Board tonight with respect to the repetitive nature of the windows, the long expansive singular planes of the two short sides and the rear side of the building, the mechanical equipment screen being only partially roof covered, and that additional shadowed relief be looked at on those roof planes. The Developer is encouraged to provide amenities design that allows the Design Review Board to see the features on this pathway as they are being planned. Seconded by Kenison. DR-21-00 - Retail/Office Buildine - Waldron/Graham/Ea2le Gravel Corporation: Waldron/Graham/Eagle Gravel Corporation, represented by Phil Hull with The Land Group, is requesting design review approval to construct a 33,240-square foot two story retail/office building. The site is located on the south side of Cedar Ridge Drive within Eagle Pavilion Shopping Center at 408 South Eagle Road (a portion of Lot 7, Block 1, Eagle Pavilion Subdivision). Phil Hull, The Land Group, 128 South Eagle Road Eagle, Idaho. Discusses the projects layout and landscaping. Rod Graham, 1410 Southwest Marsing, Suite 800 Portland, Oregon. Owner/architect of project discusses the site and architecture of the building. David Waldron, 650 Valley Drive, Hailey ID. Developer of proj ect. Discusses the project. Board discusses the brick, lighting, gutters and columns with the developers. Phil Hull discusses the 25-foot landscape requirement that was required by staff. Asks that the requirement be deleted when the lot line adjustment is completed. Cerda discusses a pathway from this site to the pathway to the south. Discusses the 25' oflandscaping required per ECc. John McFadden addresses Eagle City Code's 25' required landscaping interpreting the code to be from the adjusted lot line. Discussion of site lighting. Murray opens the public hearing. Murray moves to approve DR-21-00 Retail/Office Building with standard and site specific conditions of approval with the following amendments to the site specific conditions. Adding #6: A pedestrian connection shall be made between the Eagle Pavilion Shopping Center and the sidewalk adjacent to this new structure. #7: Staff Page 7 of9 \\EAGLENT1\COMMON\DESI_REV\MINUTES\Temporary Minutes Work Area\DR-O5-11-00min,doc and one member of the Design Review Board shall review and approve the location and placement of gutters and down spouts on this building, as well the selection of masonry units during the time of permit review. #8: A pedestrian connection between the by pass pathway and the parking lot shall be made and an amended plan showing such shall be reviewed and approved by staff and if necessary one member of the Design Review Board. Amend site specific condition adding the following language #3: A lot line adjustment shall be approved prior to issuance of a certificate of occupancy which allows the presented landscape plan to satisfy the 25' required landscape extension. #9: The light band shown on the column section is intended only for the wall mounted sign age, which shall be done under a separate application, and is not intended to be an illuminated band. DR-22-00 - Retail Paint Store - Reed Development/Ea2le LLC: Reed Development/Eagle LLC, represented by Jerrie Wolfe Associates, is requesting design review approval to construct a 5,O88-square foot retail paint store. The site is located on the south side of State Street, just west of Palmetto Avenue at 753 East State Street. Jerrie Wolfe 410 South Orchard Street, Suite 100, architect. Discusses the setback requirements that are required by ECC. Discussion between the Board and the representative. Cerda discusses the site in regards to the setbacks. Discusses the north/south access easement with regards to the two large driveways proposed by the applicant. Discussion amongst the Board. Murray opens the public hearing. Murray closes the public hearing. Discussion amongst the Board. Murray moves to continue to DR-22-00 Retail Paint Store Reed Development/Eagle LLC to the next available Design Review meeting. With the recommendation that the architect review the site specific conditions of approval and return with a site plan addressing those areas. The architect shall provide a truck route through the site to indicate the travel path of the delivery vehicles. The continuance is based on the warehouse look of the east south and partial west elevations. The applicant is encouraged to add trellises and fast growing specimens to provide a softer appearance to the monoplane walls. The applicant is encouraged to have a representative from the end user here at the next Design Review meeting to discuss operations activities. Seconded by Kenison. ALL AYE...MOTION CARRIES. Design Review Board Members- Kenison asked about request of photos to be submitted. Staff clarifies that the applicants have submitted photos, just need to ask to look at them they are in the files. B. Council Liaison-not present. C. Staff- Asked Board about modifications to the Road House Bar-B-Q that was recently approved. Board would like to see it at the next meeting showing the modifications and have the applicant there to discuss the proposed changes. Retail building within Eagle Pavilion Shopping Center, need to have Design Review Board approval per site specific conditions. I represent 29 home sites which are immediately adjacent to BanBury on the north side of their driving range. As the numbers of people using this range have increased,the number of balls landing on the entrance street and our lots have increased. Dear City Council Members, I am oppossed to this exception requested by Banbury Meadows Golf Course. First of all, when we purchased and built our home here in Banbury Subdivision, we were told by Mr. Hoff that the "meadow" below our property would likely be developed into five acre ranch lots . Much to our chagrin we instead have a golf course and a whole lot of houses. That' s water under the bridge. Issues such as too bright street lamps and now these very tall poles to suspend netting for the driving range are becoming more than just a distraction. These poles were not in the original planning and zoning applications. No one was consulted or asked to comment on the sudden appearance of these unsightly poles . I do not support the poles and netting for the driving range, and further- more, do not support the placement of poles and netting anywhere else on Banbury Meadows. I offer the following recommendations; - Reduce the number of tee spots on the driving range by four to five on both ends. This will reduce errant balls going onto the adjacent road and number nine fairway. - Put in artificial turf and tee spots along the sidewalk that marks the Westernmost edge of the driving range. This will reduce the liklihood of any long balls reaching the private property on the Easternmost edge of the range. - Erect tall earthen berms with large trees on the Northern edge of the range to protect vehicular traffic. - Do the same as noted above, to protect golfers coming down number nine fairway. Putting a driving range in a subdivision and near roadways is a risky venture. I submit that it is the responsibility of Banbury Meadows to prove by deed that they can be a good neighbor and resolve this dispute, keeping in mind the sizeable investment that Banbury residents have in their homes.
