MINUTES OCTOBER 18, 1999

The Planning and Zoning Commission on October 18, 1999, Chairman Brinton presiding.

CALL TO ORDER:

ROLL CALL: The following members were present: DONALD BRINTON, LYNN
MOSER, FRED Wll..SON, GENEVA TRENT, FARRIN FARNWORTH. A quorum
is present.

REQUEST FOR APPROVAL: September 20, 1999.
Trent moved to accept the minutes of September 20,1999. Fred seconded. ALL AYE...

PUBLIC HEARINGS:
A. ZOA-3-99 -Zonin2 Ordinance Amendment - Ea2le River LLC: Eagle
River LLC, represented by Clark Development is proposing to amend Eagle
City Code Title 8 "Zoning", Chapter 2 "Zoning Districts and Maps", Section
3 "Schedule of District Use Regulations to amend the list of permitted,
conditional, and prohibited uses within the "MU" zoning designation. The
proposed amendment will create more permitted and conditional uses, thus
decreasing total prohibited uses making the "MU" zoning designation less
restrictive than it is in its current form.
B. A-3-99 & RZ-S-99 - Annexation and Rezone from RT to R2 -Crai2 and
Kristen Van En2elen: Craig and Kristen Van Engelen are requesting
annexation and a rezone from RT (one unit per five acres) to R-2 (two units
per acre). The site located on the south side of Floating Feather Road
approximately Y2-mile west of Ballantyne Road.
Staff report given by Bill Vaughan. Staff recommend R -1 Zone.
Discussion took place among commission.
Jeff Gilbertson, Floating Feather Rd. Opposed to the density Concerns for traffic.
Bob Moffat, 2925 Floating Feather. Concerns for traffic problems.
Ron Marshall, 740 Palmetto, Read letter from his mother, which supported the
development.
Dorin Ellis, 2567 Ballantyne. For the development.
Bob Moffat, not against the development of property just has concerns about the
density.

Mike Pierce, 2820 Floating Feather Road, Opposed to the density.
Mark Zentist, opposed to change of density.
Craig Van Engelen shares concern for traffic problems.
Closed the public hearing annexation and rezone October 18,1999.
Commission had general discussion.
Farrin moved Fred Seconded to come back after the Plat. ALL AYE.
MOTION CARRIED...
C. PP-2-99 - Colony II Subdivision - Crail! and Kristen Van Enl!elen: Craig
and Kristen Van Engelen are requesting preliminary plat approval for
Colony II Subdivision, a 50.27-acre, 79 lot residential subdivision located on
the south side of Floating Feather Road approximately Y2-mile west of
Ballantyne Road.
Craig Van Engelen, requesting a preliminary Plat for Colony ll.
Bill Vaughan gives staff report.
Ron Marshall 740 Palmetto, comments on the open space and pipeline.
Bob Moffatt 2924 W. Floating Feather, doesn't understand acreage changes.
Craig Van Engelen states he is willing to put in the pathways for the High School
kids. Comments on Pear trees.
Christine Van Engelen concerned on Redwood Creek.
(Closed the Public Hearing on October 18, 1999.)
General discussion took place on this item between the commission.
Moser moved to approve the Sub Division with Standard conditions of approval
with and site specific conditions of approval with removal of 2,4,5,6,7.
Wilson moved to approve A-3-99 and RZ-5-99 Annexation and Rezone from
RA to R-2 as presented and eliminate staff recommendations. Moser seconded.
ALL A YE...MOTION CARRIES...
Moser moved to approve PP-2-99 with Standard Conditions of Approve and
the changes in Site Specific Condtions as discussed. Trent seconded...ALL
AYE...MOTION CARRIES...
