The Planning and Zoning Commission on July 12, 1999, Chairman Brinton presiding.

CALL TO ORDER:

ROLL CALL: The following members were present: DONALD BRINTON, LYNN
MOSER, FRED WIT-SON, GENEVA TRENT, FARRIN FARNWORTH. A quorum
is present. Fred Wilson was absent.

CONSENT AGENDA:
A. FPUD-4-99 & FP-12-99 - Findines of Facts and Conclusions of Law for
Brookwood No.1: Project Summary: Aries Development, LLC, represented by
Mike Hormaechea, is requesting final development plan and final plat approval
for Brookwood Subdivision Phase 1 , a 97-10t (75-buildable) residential
subdivision. This 67.26-acre (approx.) phase of Brookwood PUD is located on
the northeast comer of Eagle Road and Floating Feather Road. The site is
within the Eagle City Limits.
Farnworth moves to approve THE Facts and Conclusions of Law for Brookwood
No.1 FPUD-4-99 with the correction on page 3 of 4.Trent seconded. ALL AYE...

FPUD-3-99 & FP-1l-99 - Findines of Fact and Conclusions of Law for
Banbury Meadows No.3: Project Summary: Banbury Meadows, LLC,
represented by Roy Johnson, is requesting final development plan and final plat
approval for Banbury Meadows Subdivision Phase 3, a 70-10t (66-buildable)
residential subdivision. This 24.23-acre (approx.) phase of Banbury Meadows
PUD is located on the west side of Eagle Road approximately Y2-mile north of
Chinden Blvd. The site is within the Eagle City Limits.
Moser moves to approve consent agenda Facts and Findings for items B & C
together Farnworth seconded. ALL A YE...MOTION CARRIES...
B.
CU-6-99 - Findines of Fact and Conclusions of Law for Eaele Church of
the Nazarene: Project Summary: Eagle Church of the Nazarene, represented
by Randy Haverfield with Architecture Northwest, is requesting a conditional
use permit for an 11,080-square foot expansion of the existing church. The
site is located on the south side of State Street approximately %-mile west of
Eagle Road at 1001 West State Street.
PUBLIC HEARINGS:
A. CU-5-99 - Conditional Use Permit for Washineton Mutual Bank with
drive UP Service - Callison Architecture.Inc.: Washington Mutual,
represented by Martin Hill with Callison Architecture, Inc., is requesting a
conditional use permit for a 5,000-square foot bank with drive-up service within
Channel Center Subdivision located at 468 S. Rivershore Lane. The site is
located on the southwest comer of new State Highway 44 and Eagle Road.

Bill Vaughan gave staff report on above item. Discussion took place on the item between
commission and staff. Concerns were expressed over the head lights.
Dennis Baker, 250 S. Beechwood, Boise. Testifies about the lots in the area of the bank.
Dan Tornn, 250 S. Beechwood, Boise. Sewer in the building is not a problem.
Public hearing was closed on 9-7-99.
Discussion took place among the commission.
Trent moves to approve the Conditional Use CU-S-99 Washington Mutual Bank
eliminating the staff site specifics of approval and maintaining standard approval. Moser
seconded.. ALL AYE... MOTION CARRIES...
CU-7-99 - Conditional Use Permit for Eaele United Methodist Church -
Cole/Associates: Eagle United Methodist Church, represented by Bruce Poe
with Cole Associates, is requesting a conditional use permit for a 4,600-square
foot expansion of the existing church. The 5.5-acre site is located on the west
side of Eagle Road approximately Y2-mile north of State Street at 651 N. Eagle
Road.
Bruce Poe, 2034 Ridgemont Lane, Boise. Gave a brief description of the Eagle United
Methodist expansion of the church.
Draft read from ACHD by Bruce Poe. Ranch Rd and Eagle Rd. signals are being planned.
B.
Larry Sale Planning and Development Supervisor with ACHD. Has an oral agreement with the
church to acquire the Right of Way, ACHD would like to tie up and buy it from the church.
Bill Vaughan brief staff report on the issue.
Closed the public hearing 9-7-99.
Farnworth moves to approve CU-7-99 Conditional Use for the Eagle United Methodist
Church expansion with site specific conditions 2 & 3 with site # 1 changed to state who
will construct Ranch Dr. with documentation from ACHD. Trent seconded. ALL
AYE...MOTION CARRIES...

A. V AC-2-99 - Vacation To The Final Plat Of Lexineton Hills Subdivision
No. 10 - Lexineton Hills Inc.: Lexington Hills Inc., represented by Roylance
& Associates, is requesting City approval of a vacation to the final plat of
Lexington Hills Subdivision No. 10 to remove the storm drain easements along
the rear lot lines of Lots 97, 102, and 110, Block 7. The vacated drainage
easements are proposed to be replaced with new 5-foot wide easements along
adjoining properties so as not to decrease the overall 15-foot wide easement
area along the rear portions of the lots within this phase. The site is located on
the northwest comer of Floating Feather Road and Seven Oaks Way.
Roylance and Associates gives report on Lexington Hills Subdivision No. 10 vacation.
Farnworth moves to approve V AC-2-99 Vacation to the final plat OF Lexingtion Hills

6. REPORTS: Council Chairwomen reports on the Joint Meeting with Council and
ACIID of September 7, 1999. Ballantyne and State St. elimination. Eagle will be getting a
report on the ACHD five year report.
