EAGLE PLANNING AND ZONING MEETING
MINUTES July 19, 1999
6:30 PM
The Planning and Zoning Commission on July 19, 1999, Chairman Brinton presiding.

CALL TO ORDER:
2. ROLL CALL: The following members were present: DONALD BRINTON, LYNN
MOSER, FRED WILSON, GENEVA TRENT, FARRIN FARNWORTH. A quorum
is present.
Farrin Farnworth was absent.

CONSENT AGENDA: None
A. CU-4-99 -Findines and Facts and Conclusions of Law for a Private
Hieh School for Lexineton Schools. Inc.: Lexington Schools, Inc.,
represented by Kenneth P. Gee, is requesting a conditional use permit to convert an
existing residence into a 9,OOO-square foot private high school. The 95.2-acre site
(4.5-acre school site) is located on the north side of Floating Feather Road
approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road.

Moser made a motion to approve the Facts and Findings of Conclusions of Law for CU-4-
99 Lexington Hills Schools, Inc. Seconded by Wilson. ALL A YE...MOTION CARRIES...

PUBLIC HEARINGS:
A. gA-6-97 - C!!Y1nitiated Comprehensive Plan Amendments - City of
Eaele: The City of Eagle is proposing to amend its Comprehensive Plan and Land
Use Map. The Plan and Map are official policy documents for the City and its
Area of Impact and are intended to provide the vision, goals, policies and
implementation actions that will guide the community's development. The Plan
addresses the following components: Property Rights, Population and Growth,
Economic Development, Public Services, School Facilities, Land Uses, Natural
Resources and Hazardous Areas, Transportation, Parks, Recreation and Open
Space, Housing, Community Design and Cultural Resources. The Plan also
includes a Land Use Map that, in part, illustrates types of land uses and residential
densities for Eagle and its Area of Impact. NOTE: After the public hearings for
the Comprehensive Plan Amendments listed herein are closed, deliberation
should take place on this item (CPA-6-97) first.
Lynn Moser reads a letter dated July 10, 1999 from Calleen Birch-Maile. She had negative
remarks toward the Draft Comp Plan.
Wilson read a letter from Albertson's dated July 19, 1999, Laura Dins supports the Draft Plan.
Geneva Trent arrived at 6:50 p.m.
Chairman Brinton read a letter from Thomas Datter, Julyl9, 1999. The Grossman property on
SE Eagle Rd. comments on the zoning change. Mixed Use parcels to shield from residential
areas.

Geneva Trent read a letter dated July 19, 1999. Roylance and Associates, in favor of the Comp
Plan Draft.
Lynn Moser read a letter from Clark Development. He made a suggestion for the Draft. Add
elements and scratch office in mixed use description.
Donald Brinton agrees that all things should fall under the City Initiated only Comp Plan
public hearing, Geneva Trent agrees, Fred Wilson agrees, Lynn Moser agrees.
Fred Wilson presented an overview on the Comp plan Draft. Thanks community for their
dedication to the time they devoted, and the different view points on the item. . Clarity 1997 is
the current plan.
Donald Brinton presented the differences between the maps.
Time will be limited to 3 minutes per testimony.
Dave Brady asks for clarification on whether public testimony will be taken under advisement.
Angela Deckers, 2249 Dickey Circle. Chairman of parks, pathway, and open space. Has been
involved in comp plan changes for 3 years. Number one concerns paths, parks, and
development.
Steve Deckers, 2249 Dickey Circle. Said that he is disappointed in the land increases.
Pat Miller, 959 Preakness. Concerned that there will be difficulty in acquiring land for
schools. Presents map for public record.
Marty Taylor, Downing Downs.
Bill Selvage 1992 wants to make three comments in order to understand the changes
third item is the Floodway info is incorrect.
Dave Brady 909 Arlington. Throwaway the green copy and keep the blue.
Mike Sealer, 1125 Steepleview. Testifies on the density issues.
Bill Clark, 479 Main St., Boise. Gives testimony on mixed use areas.
Betty Miller 959 Preakness.
Doug Russell 128 S Eagle Rd., first testimony is reintegrated.
The
Elenore Chase 70 W. Floating Feather Rd. Expresses her feelings on her property.
Glida Bothwell 4845 N. Curling. Seconded that the green version is very short. Was on the
Parks committee that they spent a year on the document.
Greg Nicholas, 971 Preakness. Our experience is Eagle has good ethics, Growing rapidly.
Angela Deckers, 2249 Dickey Circle, Concerned about the mixed use and maintaining of it.
Close the public hearing.
Five minute break. Meeting begins at 8:45 PM.
Discussion took place between the Commission.
Wilson moved that the recommendation to accept CPA-6-97 City Comprehensive Plan as
the P&Z Comp Plan and CPA-1-98, CPA-2-98, CPA-3-98, be moved to Council as the
updated 6-22-99 Draft Plan Comp. Then the decision will reflect our opinions on the

B. gA.l.98 - Compreþensive Plan Amendment for Ea1de River
~opment (Grossman Properties) . Eaele River. LLC: Eagle River,
LLC, represented by Bill Clark, is requesting approval of a comprehensive plan
amendment from Public/Semi-Public to Commercial and from Medium Density
Residential to Commercial, Mixed Use, Public/Semi-Public. A portion of the
proposed change from the residential land use designation to the Public/Semi
Public land use designation is City initiated for a City park. The 93-acre site is
located on the southeast comer of State Highway 44 and S. Eagle Road.
C. CPA.2.98. Comprehensive Plan Amendment for BramHall Subdivision
. R02er C. Crandlemire: Roger C. Crandlemire, represented by Roylance &
Associates, is requesting approval of a comprehensive plan amendment from Very
Low Density Residential to Medium Density Residential, however, the
Commission has proposed a change as part of the City initiated Comprehensive
Plan Amendment in this area from Very Low Density Residential to Residential
Three and Residential Two (proposed new designations). The applicant's
representative agrees with the Commission's proposal and is now requesting the
same. The 95.2-acre site is located on the north side of Floating Feather Road
approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road.

D. CPA.3.98. Compre~ve Plan Amendment for Patterson Propertv-
Sharon Patterson: Sharon Patterson, represented by The Land Group, is
requesting approval of a comprehensive plan amendment from Medium Density
Residential (four dwelling units per acre maximum) and Industrial to Mixed Use
and Commercial. The 9.6-acre and I-acre sites are located on the southwest and
southeast comers of State Highway 55 and Hill Road at 2805 and 2809 Hill Road.
OLD BUSINESS:
A. ~Z-2.98 - !{ezone ~evelopment (Grossman Properties)
. Ea2le River. LLC: Eagle River, LLC, represented by Bill Clark, is requesting
approval of a rezone from A (Agriculture) and M-IA (Industrial Park District) to
PS-DA (Public/Semi-Public), R-4-DA (Residential), C-3-DA (Highway Business
District), and MU-DA (Mixed Use) with a development agreement. A portion of
the proposed change from the M-IA zoning designation to PS-DA zoning
designation is City initiated for a City park. The 93-acre site is located on the
southeast comer of State Highway 44 and S. Eagle Road (The Commission closed
the public hearing for this item).
Moser moved to deny RZ.2.98 due to non compliance of Comp Plan.Trent
seconded. ALL A YE...MOTION CARRIES...
B. ~Z.7.98 - Rezone for BramHall Subdivision. R02er C. Crandlemire:
Roger C. Crandlemire, represented by Roylance & Associates, is requesting
approval of a rezone from A-R (Agricultural-Residential - one dwelling unit per
five acres maximum) to R-2 and R-3 (Residential - two dwelling units per one acre
maximum) and (Residential - three dwelling units per one acre maximum). The
95.2-acre site is located on the north side of Floating Feather Road approximately
%-mile west of Eagle Road at 1400 W. Floating Feather Road (The Commission

Moser made a motion to deny RZ.7.98 Bramhall predicated that it doesn't reflect the
application as it exists to fit the Comp Plan.Trent seconded. ALL AYE MOTION
