'.' f' \r~ t7JJd~t' u'1' r " -0, EAGLE PLANNING AND ZONING MEETING MINUTES JUNE 28, 1999 7:00 PM The Planning and Zoning Commission on June 28, 1999, Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: DONALD BRINTON, LYNN MOSER, FRED WILSON, GENEVA TRENT, FARRIN FARNWORTH. A quorum is present. 3. 4. 5. REQUEST FOR APPROVAL: None CONSENT AGENDA: None PUBLIC HEARINGS: A. ZOA-2-99 - Si2:n Re2:ulation Amendments- Board of Directors Ea2:le Chamber of Commerce: An Ordinance Amending Eagle City Code Title 8 "Zoning", Chapter 2 "Zoning Districts And Maps", Article A "DR Design Review Overlay District", Section 8 "Sign Regulations"; And Section 9 "Procedures", And Providing An Effective Date. The proposed amendments in part: would eliminate the City's prohibition of internally illuminated signs; would allow additional and larger monument signs; would allow additional and larger wall signs; would allow special portable signs; would provide criteria for temporary signs; would change the Design Review procedures so only master sign plans and internally illuminated signs would require Design Review Board approval with all other signs requiring review to be approved by the City staff. Michael Shepherd and Dave Dickey, Chamber of Commerce. Presents the proposal for change on the Sign Ordinance. Dave Dickey states that the Chamber of Commerce came up with some ideas that they believe will help the business district to grow and prosper. Michael Shepherd, States that the Board of Chamber of Commerce believes that the existing sign ordinance is to restrictive and does not provide sufficient flexibility for business identification. The goal is to give suggestions for developing a revised Sign Ordinance that would allow for soft subtle and effective signage for our businesses with in our community. It is not their intent to create a Fairview Ave. atmosphere. Many quality businesses are hesitant to come to Eagle because of the restrictions on the signage. Many Commercial Land owners have stated that well established businesses that the Chamber is trying to attract for the betterment of our community are reluctant or have declined to come to the Eagle area because of our overly restrictive Sign Ordinances and the lengthy cumbersome review process. The Chamber believes that only Master sign plans and internally illuminated signs should go before the Design Review process. With the City Zoning Administrator approving all other signs or requirements for review. Feel that a more logical sign ordinance would help Eagle grow their tax revenue base by allowing the business to attract and encourage our citizens to shop in our community. Dave Dickey stated that the Chamber had talked to some of the experts in this field and came up with the following recommendations. Will ask that internal illumination is approved at 5%, 10% would be too large according to Council. Would also like to change C8 to as follows: Each business to a single building shall be allowed one wall sign for every street it fronts, and the entire building shall be permitted one monument sign per every it fronts. C9 would be a recommendation we might have would be any corner business within a multi tenant building shall be allowed two wall signs. Michael Shepherd as far as ClO goes special portable signs which are not classified as portable temporary signs as regulated within this title which are used on an on going basis throughout the year may be permitted by the City if the following criteria is complied with. Illumination would not be permitted, will also set special height provisions. Dave would also like to consider changing 01 to as follows: A shopping center as defined in City code shall be allowed one monument sign per street it abuts. Michael also wanted to bring up that no monument sign shall be closer then 20 feet from a monument or other pre standing sign on an adjacent property. We recommended the change to 02 as follows and that is an individual free standing single tenant building not in a shopping center shall be permitted to construct erect and retain one monument sign per street that it abuts. Wanted to delete 04 and change El as follows: and that is to allow internally illuminated signs. However the brightness levels shall be controlled to assure a soft subtle effective light in accordance with the code. Dave would like to recommend changing I 10 basically if sales are over take down the signs. I 12 to as follows search lights except that maybe permitted under section L, as they will talk about later, are prohibited. Change the title L as follows temporary signs shall be in compliance with the conditions specified within this section and any other applicable provisions within this chapter. The section under L has already been adopted by the City Council, as a policy there is just a few minor changes we would like to see adjusted. One is we would like to change the status on #4 that reads basically ten days per month we would to increase that to increase to thirty days per three month period. To again handle for special circumstances that lasts for more then ten days and that is basically the only change. M 14 non-illuminated window signs may cover a maximum of 25% of the window. M 15 as follow: Neon signs no larger then 4 square feet or 10% of the window, which ever is larger shall be permitted. M 16 window arts shall be permitted. M 17 door signs identifying the business and or indicating business hours, emergency numbers, shall be permitted up to a maximum of 2 square feet, which is currently 1 square feet. Michael states we also wanted to change the review process as follows: Only master sign plans and internally illuminated signs shall require Design Review Board approval and all other signs that require review shall be approved by the City Staff. Trent has questions on why they have eliminated all references to detached street sign wonders why. Dave Dickey says that Chamber felt like a detached street sign was kind of ambiguous. Farnworth asks who the City Staff is and expresses that it should be clarified. To Zoning Administrator. Wilson would líke to change section I 3 and the last paragraph to be reviewed by Zoning Administrator. And leave design review member out. Dave Brady 650 EState St., Copy Express. Frustrated business owner in the area of signs. Thankful to the Commission for listening to them. He asked all 4 why they came in and 2 said because of the ugly truck sign out in front of the building. When he first put in the application for the sign he was told by one of the committee that signs are not for advertising and that is a direct quote. He says that the signs are very important if they don't have the signs they are not going to have the business that we need to exist and prosper as businesses and if we don't prosper as businesses then we loose a lot of business to Boise and means a lot of tax base to Boise. He would like to address the surface area of the building if you can recall Copies Expresses building our sign is 5% of what is defined as the surface area of their part of the building. He says the sign is to small to see from any distance it needs to be considerably larger. Bob Halford, Coast to Coast, 316 W. State St., presents pictures. Gary Blaylock, Evans, 931 State. Comments on process of internal lit signs. Can be done tastefully. Pauline Hinman, Chamber of Commerce, 404 Ranch Dr., 3 R 'S Thanks the Commission for their thoughtfulness and for listening. Sandy Smith, Chevron owner, Testifies about her business. She states her signs are not seen from the road. Pat Miller, 959 Preakness. Opinion on lit Signs help over bigger signs. Limit the wattage of the signs but would work. Give the business the option. Sandy Smith Chevron needs clarification for window art. Closed the public hearing 6-28-99 Five minute break. Meeting continued at 9:35. Commission would like to continue to a special meeting on July 5, 1999. Fred Wilson thinks that an ordinance should take the place of the committee to decide on a sign. Dave Dickey will not be available March 2, 1999. Wilson moved to re-open the Sign Ordinance Public Hearing. Farnworth seconded. ALL AYE...MOTION CARRIES... CU-4-99-Conditional Use Permit for a Private Hieh School-Lexineton Hills. Inc.: Lexington Schools, Inc., represented by Kenneth P. Gee, is requesting a conditional use permit to convert an existing residence into a 9,OOO-square foot private high school. The 95.2-acre site (4.5-acre school site) is located on the north side of Floating Feather Road approximately 3h-mile west of Eagle Road at 1400 W. Floating Feather Road. Ken Gee, 112 S. Blackwood Ave, Eagle, Proposing college prepitorial High School the school is based on a smaller ratio of student to teacher. The house would be used for the classrooms. the gate is too close to the road and not big enough. Staff report was given by Bill Vaughn.
