EAGLE PLANNING AND ZONING MEETING
MINUTES APRIL 5, 1999
6:30 PM
The Planning and Zoning Commission on AprilS, 1999, Chairman Brinton presiding.

CALL TO ORDER:
2. ROLL CALL: The following members were present: DONALD BRINTON, LYNN
MOSER, FRED WILSON, GENEVA TRENT, F ARRIN FARNWORTH. A quorum is present.

REQUEST FOR APPROVAL: None
Geneva Trent made a motion to approve the March 29, 1999 minutes as written. Wilson
seconded. ALL AYE. MOTION CARRIES...
The last five minutes will be continued to the April 12, Planning and Zoning meeting.

5.
PUBLIC HEARINGS:
A ZOA-1-99 - Cross Connections - Zonin!! Ordinance Amendment - Hubble En!!ineerin!!:
Hubble Engineering, Inc., represented by AJ. Carlson, is proposing to amend Eagle City Code
Title 6 "Public Ways and Property", Chapter 5 "Water System", Section 13 (C)(2)
"Discontinuance of Service" to change the description of and allow "Cross Connections" with a
state-approved reduced pressure backflow assembly; and to amend Eagle City Code Title 9
"Land Subdivisions", Chapter 4 "Required Improvements", Section 1-9 (C)(l)(a) "Water Supply
and Sewer Systems" to allow a pressurized irrigation system to be connected to a potable water
system with a state-approved reduced pressure backflow assembly and with the approval of the
water purveyor.
Ben Forrey, Hubble Engineering. Gives report on Zoning Ordinance Amendment. Spoke on the
Water System for Feather Nest Sub. They would like to be allowed to add Cross Connections
with a backflow assembly to allow pressurized irrigation. Metering would be paid by the
Homeowners Association at the time of use.
Commissioner Moser had questions for Ben Forrey. Voices concerns on policing of the changes
to be taking place.
Bill Vaughn comments on the issues. He asks that Dan Brown from United Water be present at a
meeting to answer any questions,
Angela Deckers, 2249 Dickey Circle, Eagle. Against the Cross over Connections. Concerned for
safety of the water.
Chairman Brinton closed the Public Hearing on 4-5-99.
Ben Forrey, Hubble engineering asks for a possible continuation for further proof of the
effectiveness.

Wilson asks for technical information from the Engineers. How would the matter by policed.
Farnworth suggests tabling the matter.
Farnworth made a motion to table the item for further clarification as to who will police the
project and more information on the success factors for water safety. Asks that the public
hearing be opened again. Continued to the April 19, 1999. Moser seconded. ALL AYE.

Chairman Brinton asks for a report from the City Engineer on the above item.
B. CU-I-99 -138kv sub-transmission line - Idaho Power:
Idaho Power, represented by Jerry Ellsworth, is requesting conditional use approval to construct a
new 138kv sub-transmission line to connect the existing HP Substation located on the east side of
Cloverdale Road approximately V4-mile south of Chinden Blvd. to the existing 138kv sub-
transmission line located near the northeast comer of State Highway 44 and State Highway 55.
The portion that is proposed to be constructed within the Eagle City Limits is located at 2500 E.
State Street (temp. address) near the intersection of State Highway 44 and State Highway 55
extending southward approximately Y2-mile.
Jerry Ellsworth, Idaho Power, requesting conditional use approval for a new transmission line
that would feed to the existing HP Substation.
Triss Yerrington, City Engineer Idaho Power, describes the project.
Bill Vaughn presents staff report on the conditions for approval of this item. Staff recommends
that four conditions be met, for approval from staff.
Bill Selvage, developer, representing Monroe properties. Testifies that everything is in great
shape for the project.
Triss Yerrington, Idaho Power, Lakeland Estates has worked with Idaho Power on easements and
placement of berms. Twelve poles five steel, seven remaining will be wood.
Chairman Brinton Closed the public hearing on 4-5-99 for Cu-1-99.
Farnworth moved to approve CU-I-99 with Site Specific and Standard Conditions of
approval from staff. Trent seconded. ALL AYE. MOTION CARRIES...
C. A-I-99 & RZ-2-99 - Annexation and Rezone From Rl & RT to R-l. R-4. M-IA. & PS-
City of Ea!!le: The City of Eagle, represented by Mark L. Butler, is requesting approval of an
annexation and rezone from Rl & RT (Residential) to R-l & R-4 (Residential), M-IA (Industrial
Park), and PS (publici Semi Public). The 30+1- acre site is generally located near the intersection
of Hill Road and State Highway 55 (see attached map for exact location).
Bill Vaughn, presents report and asks for advice from City Attorney.
City Attorney states the P & Z does not have the ability to comment on the Annexation.

Angela Deckers, 2249 Dickey Circle, Parks Committee representative. Support for rezone.
Comments on the parcels
Rich Butterfield, 2400 Hill Rd., is opposed to changes.
Daryl Tague, 2422 E. Hill Rd. Eagle. Opposed to the changes. Wants to remain out of City
limits. Not offered City water and sewer so he doesn't see any benefits in annexation or rezone.
Barbara Beehner-Kane, Ada County Highway District. ACHD owns land has a stockpile pit for
gravel. Wants to make sure ACHD will be able to continue to stockpile gravel for rural road
work needs.
Susie Lowe, 2511 East Eagle Rd. Her family has two parcels in this area. Concerned if moved
into City Limits if their way of living would change. Concerned agriculture or animals would not
be allowed.
Jerry Pitz, 2835 E Hill Rd. Owns three parcels. He states that he doesn't understand why the
City wants this area to become commercial. He states he heard earlier in the meeting that it fits
the direction that Eagle wants to go. He also heard in a lot of the meetings "The Flavor of Eagle
is Rural."
Beth Thomas, Property owner, against annexation & rezone from agriculture to commercial.
These comments came in a letter, which was read by Commissioner Farnworth. Reads as
follows: No, No, No, we do not want the annexation. The only thing they have to offer is higher
taxes. She asks to please leave us alone. Let us remain rural. Do not force us to do something
we don't want to do at this time.
Idaho Forest Industries, John Evans. Commissioner Wilson reads a letter from John which states
he is in support of the annexation and rezone.
Rich Butterfield, 2400 E.Hill Rd. Had a question about the letter from P&Z on whether the
meeting was to be rezone or annexation.
Bill Vaughn, Staff. States that the letter was only a courtesy letter not a mandatory letter by law.
States that the Public Notice has to be run in the newspaper three consecutive times, which was
done. Bills states they didn't even need to send a letter legally.
Chainnan Brinton asks Bill Vaughn for a copy of the notice.

Motion made by Moser to table RZ-2-99 until the 1999 Comp Plan is completed. Seconded

D. ' Eal!le is DrODOsinl! to amend its Comprehensive Plan and Land Use MaD. The Plan and
Map are official policy documents for the City and its Area of Impact and are intended to provide
the vision, goals, policies and implementation actions that will guide the community's
development. The Plan addresses the following components: Property Rights, Population and
Growth, Economic Development, Public Services, School Facilities, Land Uses, Natural
Resources and Hazardous Areas, Transportation, Parks, Recreation and Open Space, Housing,
Community Design and Cultural Resources. The Plan also includes a Land Use Map that, in part,
illustrates types of land uses and residential densities for Eagle and its Area of Impact. NOTE:
After the public hearings for the Comprehensive Plan Amendment listed herein are closed,
deliberation should take place on this item (CPA-6-97) first. (Continuedfrom 3-20-99 P&Z
Meeting.)

Moser made a motion to table the Comp Plan items with e, f, and G until April 12, 1999,

E. CPA-I-98 & RZ-2-98 - Eal!le River Development (Grossman Properties) - Eal!le River.
LLC: Eagle River, LLC, represented by Bill Clark, is requesting approval of a comprehensive
plan amendment from Public/Semi-Public to Commercial and from Medium Density Residential
to Commercial, Mixed Use, Public/Semi-Public; and a rezone from A (Agriculture) and M-IA
(Industrial Park District) to PS-DA (Public/Semi-Public), R-4-DA (Residential), C-3-DA
(Highway Business District), and MU-DA (Mixed Use) with a development agreement. A
portion of the proposed change from the residential land use designation to the Public/Semi
Public land use designation and M-IA zoning designation to PS-DA zoning designation is City
initiated for a City park. The 93-acre site is located on the southeast comer of State Highway 44
and S. Eagle Road.
NOTE: CPA-I-98 & RZ-2-98 should be heard together since they are significantly
interrelated by means of the development agreement. However, CPA-I-98 must be acted
on prior RZ-2-98.
The public hearing on this item was closed on October 26, 1998, except to obtain input on City's
Floodplain ordinance. (Continued from 3-20-99 P &Z Meeting.)
F. CPA-2-98 - ComDrehensive Plan Amendment for BramHall Subdivision - Rol!er C.
Crandlemire: Roger C. Crandlemire, represented by Roylance & Associates, is requesting
approval of a comprehensive plan amendment from Very Low Density Residential (one dwelling
unit per two acres maximum) to Medium Density Residential (four dwelling units per one acre
maximum). The 95.2-acre site is located on the north side of Floating Feather Road
approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road. The public hearing
for this item was closed on November 9, 1998. (Continued from 3-20-99 P & Z Meeting.)
G. CPA-3-98 - Comprehensive Plan Amendment for Patterson ProDerty - Sharon
Patterson: Sharon Patterson, represented by The Land Group, is requesting approval of a
comprehensive plan amendment from Medium Density Residential (four dwelling units per acre
maximum) and Industrial to Mixed Use and Commercial. The 9.6-acre and I-acre sites are
located on the southwest and southeast comers of State Highway 55 and Hill Road at 2805 and
2809 Hill Road. The public hearing on this item was closed on October 19, 1998. (Continued
from 3-20-99 P& Z Meeting.)
H. RZ- 7-98 - Rezone for BramHall Subdivision - Rol!er Co Crandlemire: Roger C.
Crandlemire, represented by Roylance & Associates, is requesting approval of a rezone from A-R
(Agricultural-Residential - one dwelling unit per five acres maximum) to R-3 (Residential - three
dwelling units per one acre maximum). The 95.2-acre site is located on the north side of Floating
