The Planning and Zoning Commission on February 16, 1999 Chairman Brinton presiding.

A. Findin2s and Conclusions for CU-8-98 -Conditional Use for Ea~le Fire Department
Additional Tower Hei2ht - Dan Friend: Project Description: Dan Friend, represented by Rocky
Towle with Design Resources, is requesting conditional use approval for a 50-foot high training
tower to be attached to the fire station. The .54-acre site is located on the south side ofW. State
Street approximately 400-feet west of Eagle Road at 149 W. State Street.
Moser and Trent declined on vote due to conflict of interest.
Wilson moved to accept Findings and Conclusions for CU-8-98-Conditional Use for Eagle
Fire Department Additional Tower Height. Seconded Farnworth. 3 AYE. MOTION

(Residential) - Providence Develooment Group: Project Description: Providence
Development Group, LLC, represented by Wayne S. Forrey with Hubble Engineering, is
requesting a rezone from A (Agricultural) to R-4 (Residential four units per acre maximum). The
16.62-acre site is located on the south side of Floating Feather Road approximately Y2-mile east
of Eagle Road at 1200 Floating Feather Road.
Farnworth Moved to accept the Findings and Conclusions for RZ-1l-98 - Rezone from A
(Agriculture) to R-4 (Residential) - Providence Development Group.Seconded by

Providence Development Group: Project Description: Providence Development Group, LLC,
represented by Wayne S. Forrey with Hubble Engineering, is requesting preliminary plat
approval for Eagle Knoll Estates Subdivision, a 16.62-acre, 57-lot (52-buildable) residential
subdivision located on the south side of Floating Feather Road approximately Y2-mile east of
Eagle Road at 1200 Floating Feather Road.

A. FPUD-1-99 & FP-1-99- Final Development Plan and Final Plat for Banburv Meadows
Subdivision No.2 - Harvey Hoff: Harvey Hoff, represented by Roy Johnson, is requesting final
development plan and final plat approval for Banbury Meadows Subdivision Phase 2 , a 59-lot
(50-buildable) residential subdivision. This 19.22-acre (approx.) phase of Banbury Meadows
PUD is located on the west side of Eagle Road approximately Yz-mile north of Chinden Blvd.
The site is within the Eagle City Limits.
Cornell Larson ,210 Murray, Boise, Showed map of Banbury Meadows second phase.
Bill Vaughn Staff, staff report was given. Bill would like to Strike #2 of site specifics, strike #3
&4.
Brinton expresses concerns about the portion of walkway that is not paved. The safety factor for
the children is of concern.
Moser Moved to accept FPUD-1-99 & FP-1-99- Final Development Plan and Final Plat for
Banbury Meadows Subdivision No.2 with all standard recommendations and staff site
specific recommendations by staff deleting #2, #3 and #4 of those five recommendations
Farnworth seconded. ALL AYE. MOTION CARRIES...
Brinton excused himself from the public hearing due to his wife being a bookkeeper for Quarter
Circle Ranch. He will leave for the rest of the night.

PUBLIC HEARINGS:
A. RZ-IO-98/CU-9-98/PPUD-2-98/PP-8-98-0uarter Circle Ranch Planned Unit
Develooment-B.W. Inc.: B.W. Inc., represented by Dennis M. Baker, is requesting a rezone
from A (Agricultural) to R-2-P (Residential two units per acre maximum - PUD), and conditional
use, planned unit development preliminary development plan, and preliminary plat approvals for
Quarter Circle Ranch Planned Community. The development consists of a 237-acre, 419-10t
(371-buildab1e) residential subdivision. The site is located on the west side of Eagle Road
approximately 1600-feet south of State Highway 44 at 1505 S. Eagle Road (temp. address).
Dan Torfin, 250 S. Beachwood, Boise Presented several handouts and gave a description of
Quarter Circle Ranch. Presented several photos of existing sites.
Bill Vaughn, City staff, Presents staff report. Similar to Brookwood as far as floodplain
language. Staff recommends approval of the project.
Barry Peters, 1457 Mace Rd., Said he was impressed with developers. Supports the project.
Ann Johnson, 844 S.Channel Rd., against the development. Concerns are increased traffic due to
the development. Voiced concerns about sub surface moisture with the ponds and artesian water
concerns.
Kay Johnson, 844 S Channel Rd, Take a look at the pathway it goes no where.
Don Knickrehum, 1423 Mace Rd., Commend the developers for the development.
Bill Clark, 479 Main St., Boise, Supports the development.
Kelsey Royvall, 7181 S. Channel Rd., Commends the developers.
Diane Roesch, 1811 W. Mace, Comments on the study for Eagle Island State Park from Ada
Planning Association. Does not support the development.
Tim Blood, Mace Rd., Representing the Eagle Island State Park, There is a haying operation

going on at Mace Rd. Wants to know the effects it will have on their large equipment going up
and down this road. At this time they have to get in and out with trucks they have no other way
to go at this time. Wants to have access.
Kelsey Royvall, 7181 S. Channel Rd., Concern about the nuisance law.
Dan Torfin, 250 S. Beachwood, Boise, Pipelines, Addressed the pond issue and the pathway
issues. He agreed that Water Resource could do a study.
Dennis Baker, 250 S. Beachwood, Boise, supports the rural aspects off Eagle will put this in any
of the documentation for the development (Closed public hearing on 2-16-99 )
Discussion among the Commission began.
Five minute recess.
Steve Bradbury, 877 Main St., Boise, speaking on the water rights. Come up with language for
the city on water right interference.
Trent made a Motion to approve the rezone R-I0-98 from agriculture to residentiaI.Wilson
Seconded.AlI Aye. Motion Carries...
Wilson moves to approve CU-9-98 conditional use permit and PPUD-2-98 & PP-8-98 as
written with one addition to the site specific conditions paragraph 26 would read as "The
Cities action on application does not grant the applicant any appropriation of water or
interference with existing water rights and the applicant identifies and holds the City
harmless for any and all water rights claims associated with the project. Amend this
motion to add item 27 that a note be placed on the face of the existing plat with the to the
precise language to be submitted to City Attorney to be reviewed.7 & 8 Seconded by Moser.
Applicants attorney changes to be made to page 14,3 with 100 Year flood plain. 14,of 19

Wilson made a motion to continue all comp plan items to February 22, 1999 at 6:30

Wilson recommends that P & Z meet every week on Comp Plan until done.6:30 p.m.
B. CP A-6-97 - City Initiated Comprehensive Plan Amendments - City of Eae:le: The City of
Eagle is proposing to amend its Comprehensive Plan and Land Use Map. The Plan and Map are
official policy documents for the City and its Area of Impact and are intended to provide the
vision, goals, policies and implementation actions that will guide the community's development.
The Plan addresses the following components: Property Rights, Population and Growth,
Economic Development, Public Services, School Facilities, Land Uses, Natural Resources and
Hazardous Areas, Transportation, Parks, Recreation and Open Space, Housing, Community
Design and Cultural Resources. The Plan also includes a Land Use Map that, in part, illustrates
types of land uses and residential densities for Eagle and its Area of Impact. NOTE: After the
public hearings for the Comprehensive Plan Amendment listed herein are closed,
deliberation should take place on this item (CPA-6-97) first. (Continued from 2-1-99 P&Z
Meeting.)
C. CPA-I-98 & RZ-2-98 - Eae:le River Development (Grossman Properties) - Eae:le River.
LLC: Eagle River, LLC, represented by Bill Clark, is requesting approval of a comprehensive
plan amendment from Public/Semi-Public to Commercial and from Medium Density Residential
to Commercial, Mixed Use, Public/Semi-Public; and a rezone from A (Agriculture) and M-lA
(Industrial Park District) to PS-DA (Public/Semi-Public), R-4-DA (Residential), C-3-DA
(Highway Business District), and MU-DA (Mixed Use) with a development agreement. A

portion of the proposed change from the residential land use designation to the Public/Semi
Public land use designation and M-IA zoning designation to PS-DA zoning designation is City
initiated for a City park. The 93-acre site is located on the southeast comer of State Highway 44
and S. Eagle Road.
NOTE: CPA-1-98 & RZ-2-98 should be heard together since they are significantly
interrelated by means of the development agreement. However, CPA-1-98 must be acted
on prior RZ-2-98.
The public hearing on this item was closed on October 26, 1998, except to obtain input on City's
Floodplain ordinance. (Continuedfrom 2-1-99P &2 Meeting.)
D. CPA-2-98 - Comorehensive Plan Amendment for BramHall Subdivision - Rol!er C.
Crandlemire: Roger C. Crandlemire, represented by Roylance & Associates, is requesting
approval ofa comprehensive plan amendment from Very Low Density Residential (one dwelling
unit per two acres maximum) to Medium Density Residential (four dwelling units per one acre
maximum). The 95.2-acre site is located on the north side of Floating Feather Road
approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road. The public hearing
for this item was closed on November 9, 1998. (Continuedfrom 2-1-99P & 2 Meeting.)
E. CP A-3-98 - Comprehensive Plan Amendment for Patterson Prooertv - Sharon
Patterson: Sharon Patterson, represented by The Land Group, is requesting approval of a
comprehensive plan amendment from Medium Density Residential (four dwelling units per acre
maximum) and Industrial to Mixed Use and Commercial. The 9.6-acre and I-acre sites are
located on the southwest and southeast comers of State Highway 55 and Hill Road at 2805 and
2809 Hill Road. The public hearing on this item was closed on October 19, 1998. (Continued
from 2-1-99 P& 2 Meeting.)
F. RZ-7-98 - Rezone for BramHall Subdivision - Ro~er Co Crandlemire: Roger C.
Crandlemire, represented by Roylance & Associates, is requesting approval of a rezone from A-R
(Agricultural-Residential - one dwelling unit per five acres maximum) to R-3 (Residential - three
dwelling units per one acre maximum). The 95.2-acre site is located on the north side of Floating
Feather Road approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road.
NOTE: This item should not be acted on until the Planning and Zoning Commission has
made their recommendation on the Comprehensive Plan. The public hearing for this item was

Moser gave City Council Report.
