Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: DONALD BRINTON, FRED WILSON. F ARRIN FARNWORTH, GENEVA TRENT, LYNN MOSER. A quorum is present. 3. REQUEST FOR APPROVAL: Wilson moved to accept the January 4,1999 minutes and to continue the January 19, 1999 minutes to the February 16, 1999 meeting. Farnworth Seconded.ALL AYE.MOTION CARRIES... 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: A. CU-8-98 -Conditional Use for Ea!!le Fire Department Additional Tower Hei~ht - Dan Friend: Dan Friend, represented by Rocky Towle with Design Resources, is requesting conditional use approval for a 50-foot high training tower to be attached to the Eagle fire station. The .54-acre site is located on the south side ofW. State Street approximately 400-feet west oĊ’agle Road at 149 W. State Street. Commissioners' Trent and Moser declined comment and vote on the above stated item. Both Commissioners have relationship to Fire Department personnel. Chairman Britton opened the meeting for public comment on the Conditional Use for Eagle Fire Department Tower. Rocky Towle, 2210 Broadway, explains the purpose of the need for the Tower. A brief question and answer period took place on the item. Dan Friend, 92 S. Eagle Rd., explains the tower is for training purposes. The fire department responds to fires that may occur outside the Eagle area, high rise buildings in Boise. Dan friend states that training would take place weekly in the tower if built. Bill Vaughn, City of Eagle Staff member, presents staff Report. Discussion among the commission took place. Farnworth expresses concern on the height of the Tower. The item was closed to public discussion. Wilson made a motion to approve CU-8-98 - Conditional Use Permit for Eagle Fire Department Additional Height Tower. RZ-1l-98 - Rezone from A (A!!riculture) to R-4 (Residential) - Providence Development Group: Providence Development Group, LLC, represented by Wayne S. Forrey Page 1 of 4 K:\P&Z\MINUTES\1999\PZ-2-1-99min2.doc with Hubble Engineering, is requesting a rezone from A (Agricultural) to R-4 (Residential four units per acre maximum). The 16.62-acre site is located on the south side of Floating Feather Road approximately Yz-mile east of Eagle Road at 1200 Floating Feather Road. Counsel recommends discussion on items B. and C. Eagle Knolls Estates may be heard together and voted on separately. Wayne Forey, 9550 Bethel Ct., presents 2 handouts as part of the record. Discusses the rezone shows maps on Eagle Knolls Estates of the pathway and open space. Shows the landscape on roadways and the traffic circulation. Expresses that the Subdivision will be finished in one Phase. Forey shows the drainage plan also. Tom Cornell, 470 E. Floating Feather, testifies that he is opposed to Eagle Knolls Preliminary Plat because of his concern for additional traffic to Floating Feather. Bill Vaughn, Eagle City Staff, explains staff recommendations. Eleanor Chase, 70 W. Floating Feather, expresses that she would like this issue to be settled because of her involvement in the property. Public hearing for Rezone RZ-1l-98 rezone from A (agriculture) to R-4 (residential) is closed. Motion made by Wilson to approve RZ-11-98 rezone from A to R-4 Providence Development Group.Farnworth Seconded. All Aye. MOTION CARRIES... C. PP-9-98 - Preliminarv Plat for Ea~le Knoll Estates - Providence Development Group: Providence Development Group, LLC, represented by Wayne S. Forrey with Hubble Engineering, is requesting preliminary plat approval for Eagle Knoll Estates Subdivision, a 16.62-acre, 57-lot (52-buildable) residential subdivision located on the south side of Floating Feather Road approximately Yz-mile east of Eagle Road at 1200 Floating Feather Road. Moser moves to approve PP-9-98 Preliminary Plat for Eagle Knoll Estates with site specific and standard conditions of approval with the following changes to the site specific conditions. Site specific condition #1 shall be changed to read: Provide the Design Review Board with a copy of the subdivision's CC&R's showing requirements to be installed within the 5-foot wide planter strip between the sidewalk and curb. The installation requirements within the 5-foot wide planter strip approved as part of the Design Review application for Feather Nest Estates Subdivision (DR-13-98) shall be the same requirements to be placed within the CC&R's for Eagle Knoll Estates. Site specific condition #2 shall read: Provide a 7-foot wide (minimum) asphalt pedestrian pathway along the eastern edge of Lot 9, Lot 10, and Lot 11 extending from Floating Feather Road southward to the school located near the southeast corner of the site. The pathway shall be located within a 17-wide (minimum) common lot. Seconded by Wilson. ALL A YE.MOTION CARRIES... Ten minute recess. D. CPA-6-97 - City Initiated Comprehensive Plan Amendments - City of Ea!!le: The City of Eagle is proposing to amend its Comprehensive Plan and Land Use Map. The Plan and Map Page 2 of 4 K:\P&Z\MINUTES\ 1999\PZ-2-1-99min2.doc are official policy documents for the City and its Area of Impact and are intended to provide the vision, goals, policies and implementation actions that will guide the community's development. The Plan addresses the following components: Property Rights, Population and Growth, Economic Development, Public Services, School Facilities, Land Uses, Natural Resources and Hazardous Areas, Transportation, Parks, Recreation and Open Space, Housing, Community Design and Cultural Resources. The Plan also includes a Land Use Map that, in part, illustrates types of land uses and residential densities for Eagle and its Area of Impact. NOTE: After the public hearings for the Comprehensive Plan Amendment listed herein are closed, deliberation should take place on this item (CP A-6-97) first. The public hearing on this item was closed on January 19, 1999. (Continued from 1-19-99 P&Z Meeting.) Nancy Taylor will provide the comp plan changes, which will be attached to the minutes at that time. Wilson moved to continue the rest of the Comp Plan and the following items to February 16,1999 meeting 6:00 p.m. Seconded by Farnworth. ALL AYE. MOTION CARRIES... E. CPA-I-98 & RZ-2-98 - Ea21e River Development (Grossman Properties) - Ea~le River. LLC: Eagle River, LLC, represented by Bill Clark, is requesting approval of a comprehensive plan amendment from Public/Semi-Public to Commercial and from Medium Density Residential to Commercial, Mixed Use, Public/Semi-Public; and a rezone from A (Agriculture) and M-IA (Industrial Park District) to PS-DA (Public/Semi-Public), R-4-DA (Residential), C-3-DA (Highway Business District), and MU-DA (Mixed Use) with a development agreement. A portion of the proposed change from the residential land use designation to the Public/Semi Public land use designation and M-IA zoning designation to PS-DA zoning designation is City initiated for a City park. The 93-acre site is located on the southeast comer of State Highway 44 and S. Eagle Road. NOTE: CPA-I-98 & RZ-2-98 should be heard together since they are significantly interrelated by means ofthe development agreement. However, CPA-I-98 must be acted on prior RZ-2-98. The public hearing on this item was closed on October 26, 1998, except to obtain input on City's Floodplain ordinance. (Continued from 1-19-99 P &Z Meeting.) F. CPA-2-98 - Comprehensive Plan Amendment for BramHall Subdivision - Rol!er c..Crandlemire: Roger C. Crandlemire, represented by Roylance & Associates, is requesting approval of a comprehensive plan amendment from Very Low Density Residential (one dwelling unit per two acres maximum) to Medium Density Residential (four dwelling units per one acre maximum). The 95.2-acre site is located on the north side of Floating Feather Road approximately %-mile west of Eagle Road at 1400 W. Floating Feather Road. CP A-3-98 - Comprehensive Plan Amendment for Patterson Propertv - Sharon Patterson: Sharon Patterson, represented by The Land Group, is requesting approval of a comprehensive plan amendment from Medium Density Residential (four dwelling units per acre maximum) and Industrial to Mixed Use and Commercial. The 9.6-acre and I-acre sites are located on the southwest and southeast comers of State Highway 55 and Hill Road at 2805 and 2809 Hill Road.
