Minutes - 1998 - Planning & Zoning - 11/23/1998 - Regular EAGLE PLANNING AND ZONING MEETING MINUTES November 23,1998 The Planning and Zoning Commission met on November 23, 1998. Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: DONALD BRINTON, LYNN MOSER, FRED WILSON. ABSENT: F ARRIN F ARNWOR TH, GENEVA TRENT. A quorum is present. 3. REQUEST FOR APPROVAL: None 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: None 6. NEW BUSINESS: A. FPUD-2-98 & FP-3-98 - Final Development Plan and Final Plat for Banbury Meadows Subdivision No.1 - Harvey Hoff: Harvey Hoff, represented by Roy Johnson, is requesting final development plan and final plat approval for Banbury Meadows Subdivision Phase 1, a 39-10t (30-buildable) residential subdivision. This 9.82-acre (approx.) phase of Banbury Meadows PUD is located on the west side of Eagle Road approximately Y2-mile north of Chinden Blvd. The site is within the Eagle City Limits. Chairman Brinton introduces the issue. Butler presents the reasoning for P&Z Commission reviewing the application, prior to City Council. Trent arrives at 6:05 p.m. Dick Phillips, 210 Murray Street, Boise, reviews the application. Overheads are shown and explained. The club-house is being reviewed by Design Review at this time. Cornell Larson, 210 Murray Street, Boise, architect for the project, assists in the explanation and description of the golf course and club-house. Phillips reviews the staff conditions of approval. A nature park is introduced in place of conventional open space, which could include youngsters. With the theme of the subdivision, Banbury, most of the homeowners will be empty-nesters. Clint Travis, introduces the nature park, its program and amenities (stream and pathway going through nature park). Explanation is given concerning the inter-relationship between the golf course, nature park, and the homeowners association. This amenity will be included in Phase 1. ------_.__._---.~---- - There are individuals that have leased the maintenance agreement from the golf course, therefore assuring continued, professional maintenance will be a part of the project. Jerry Grow, 700 Palmetto, introduces the special features ofthe golf course. An example of the features would be golf classes for a variety of age groups. Youth will also find employment at the golf course. Brinton suggests that a program of golf classes, etc. be prepared to present before City Council. The concept of zero lot-line is explained. The structure can be on the property line, no windows are allowed on the zero property line side of the home. The structure virtually becomes the barrier, instead of a fence. General discussion concerning a pathway from Banbury to Banbury Meadows. The feasible areas to place a pathway are discussed. Harvey Hoff, 2725 Dwayne, Meridian, explains his reasoning for the development configuration. Pictures are shown of the area and the unfeasibility of a meandering sidewalk proposed in the staff recommendations. Brinton would like to see some sort of sidewalk for safety reasons. Staff and ITD are to work with the property owners to try to develop a sidewalk. A handout is distributed to demonstrate the townhouse set-backs. Another handout is distributed on the issue of private carts verses club-house carts. A request from the applicant is put forth to eliminate items 6, 7, and 8 from the staff conditions of approval. These items are defined more clearly on the distributed handouts. Butler suggests items be revised on the site specific conditions of approval. Wilson moves to approve FPUD-2-98 & FP-3-98 - Final Development Plan and Final Plat for Banbury Meadows Subdivision No.1 - Harvey Hoff as presented with the amendments as mentioned covering the changes to staff recommendation regarding page one and the changes to the plans for overall development and special concern to open space. Seconded by Moser. ALL AYE. MOTION CARRIES... (For details see Findings of Fact) A. Findines and Conclusions for V-3-98 - Variance To Decrease Rear Yard Setback - Ea~le Fire Department. Rocky Towle: The Eagle Fire Department, represented by Rocky Towle with Design Resources Architects, is requesting City approval of a variance to decrease the rear yard setback of the existing building from 20-feet to 2-feet and the proposed addition from 20-feet to approximately 8-feet. The 0.54-acre site is located on the south side ofW. State Street approximately 400-feet west of Eagle Road at 149 W. State Street. Brinton introduces the item. Moser recused himself from the issue. Trent moves to approve Findings and Conclusions for V-3-98 - Variance To ------- ---- --- --------- --- - ----- - - Decrease Rear Yard Setback - Eagle Fire Department, Rocky Towle, with the corrections as mentioned: Wilson Seconds.
