EAGLE PLANNING AND ZONING MEETING
MINUTES
November 9, 1998
6:00 p.m.
The Planning and Zoning Commission met on November 9, 1998, at the Eagle Senior
Center. Chairman Brinton presiding.

The following members were present: DONALD BRINTON, FARRIN FARNWORTH,
LYNN MOSER, GENEVA TRENT. ABSENT; FRED WILSON. A quorum is present.

REQUEST FOR APPROVAL:

Agenda is modified to show the approval of minutes from October 26, 1998, to
October 19, 1998.

Trent moves to approve the minutes of October 19, 1998. Farnworth seconds. ALL

OLD BUSINESS:

5. PUBLIC HEARINGS:
Chairman Brinton announced it is the time and the place for the Public Hearing. Brinton
clarifies the procedure for signing the public hearing sheet. The individuals from the last
public hearing meeting that were not able to speak will be heard prior to any individuals
that have signed up on tonight's sheets for the City initiated Comprehensive Plan.
A. CP A-2-98 - Comprehensive Plan Amendment for BramHall Subdivision -
Roger C. Crandlemire: Roger C. Crandlemire, represented by Roylance & Associates,
is requesting approval of a comprehensive plan amendment from Very Low Density
Residential (one dwelling unit per two acres maximum) to Medium Density Residential
(four dwelling units per one acre maximum). The 95.2-acre site is located on the north
side of Floating Feather Road approximately o/4-mile west of Eagle Road at 1400 W.

19, 1998, P & Z Meeting)
Brinton introduces the issue and reviews the time limits set for speaking.
Dave Roylance, 391 W. State Street, handouts of overhead slides are distributed to the
Commission. Roylance introduces the project and explains the overhead slides. Brinton
asks Roylance to explain the design planned for this development. Roylance has turned
in a land plan for the development, but it is not a final design of the area. The
approximate number of units would be around 160. However, the project planned is a
quality project with many common lots.
Vaughan reviews the staff report. Staff recommends denial of the Comprehensive Plan
amendment for BramHall Subdivision.
Wilson arrives at 6:55 p.m.
Diane Desortis, 105 W. Rush Court, objects to the out of control growth, due to lack of
land and resources and infrastructure.
Delmar Vail, 725 W. Floating Feather, 4th or 5th time he has spoken on this area's
development. Opposed to the issue.
Arlee Kawakawi, 1101 W. Floating Feather, opposes the change in the comprehensive
plan amendment.
Sharon Barnard, 212 E. Ranch, gives the Commission a handout. Discusses traffic, air
quality, density. Objects to the lack of plan on developer.
Marie Alder, 641 W. Rush Court. Objects to the change in the density in the
comprehensive plan. This will increase the potential for gang activity. This will have a
negative impact on the rural atmosphere and conditions in the resources.
Tom Schmalz, Central District Health Department. Sewer is reasonable, but if there is
septic applications they will be denied. This development will be required to be on
central sewer system. Recommends denial of this project unless served by the sewer.
Invited by the engineer.
Jere Cochran, 1087 W. Floating Feather. Lives just south ofthe project. This project
will totally disrupt his lifestyle. Opposed to the zoning change and the project.
Pat Miller, 959 Preakness, concern about the sewer system. Does not want a change in
the comprehensive plan. The infrastructure is not prepared for this type ofproject.
Opposed.
Betty Miller, 959 Preakness, comprehensive plan is like a mission statement. It says
where do we, as a group, want to go. Changes should reflect the good ofthe whole
community, not the interests of one individual. Gives numbers that would have an effect
on the infrastructure. Are there already housing developments that have smaller lots
planned for a diversified income group.
Dave Brady, 909 Arlington, reviews Idaho State Code.
Roger Warren, 350 Stillwell Drive, how will this development effect the air quality in
Eagle? Opposed.
Eleanore Chase, 70 W. Floating Feather Road, has lived in Eagle for forty years. Would
like to subdivide her property at some time in the future. Her property is adjacent to the
property at issue. Has been a farmer for many years and it is a lot of work to maintain the
land. Due to the subdivisions already created her land has been chopped up and taken
away to accommodate the individuals residing in Eagle now. Feels she should be able to
develop her land.
Don Gentile, 1067 Arlington Drive, why have a comprehensive plan if you are not going
to stick by it. The developer has no plan, how could you possibly approve it. Opposed.
Mike Sieler, 1125 Steeple View Drive, a show of hands of individuals in the group (CPR
of Eagle) he represents is shown. Opposed.
Pati Strittmatter, 1520 Rush Road, why do we need 5 and 6 thousand sq. ft. homes?
Opposed.
Susie Kerr, 252 W. Meadow Ridge, address has just changed. Lives just next to Eleanore
Chase. Not opposed to growth, but opposed to high density. Question about mixed
density in the new comprehensive plan. Concerned about polluting the irrigation water.
Opposed to comprehensive plan changes.
Scott Nordstrom, 2590 W. Timber Drive, Redwood Creek spokesman. Wants clarity on
the procedure for Commission's voting on this issue. Concerns about infrastructure
needed for future growth. Unclear about the new comprehensive plan and the continued
growth plan. How many changes will there be in the future? Somewhere you have to
draw the line. Crandlemire development will set a precedent.
Mardie Taylor, 832 Hialeah, most of the points she would like to make have already been
mentioned. Would like to see Eagle follow the current comprehensive plan. To deviate
from the comprehensive plan is false advertisement.
Ken Gee, 112 S. Blackwood Avenue, feels the community is selfish to decide how much
the farmers should get for their land. Thank goodness others don't have the ability to
decide how much he makes. Has taught in many of the surrounding schools. Reads a
constitutional amendment, and due process oflaw. Many people here want to enjoy the
land of others that they have said they could not afford. Plunder verses work. Feels the
developer has a right to develop his land. If people want to enjoy land they need to
purchase it.
Edward Kothegard, 2373 N. Ram Avenue, wants to stick with the current comprehensive
plan.
Brinton announces a ten minute break.
Larren Walker, 301 Meadow Ridge, wanted to live in Eagle the entire time he was
growing up. Just completed a new home in Eagle. Comprehensive plan, who deserves
what?, plan needs to be followed. Does not feel income factor holds much weight.
Suggest that we develop land already zoned high density and after that is developed, look
at changing the zone in other areas. Opposed to changes in the comprehensive plan.
Russ Buschart, against the project. Many individuals who are against this project are not
here tonight because they have been at other meetings and have not been heard.
Diane Schlekaway, 1173 E. Rush Road, is against the development and the changes in
the comprehensive plan. Does not want current comp plan changed.
Phil Carney, 1353 Travino, does not want current comp plan changed.
Ron Stone, 1495 Washam, is concerned about infrastructure. Opposed to changing the
comp plan.
Don MacDonnagh, 145 Fisher Street, opposed to the change in comp plan.
Leslie DeDori, 8828 (unintelligible), gives numbers on growth. Concerned about
infrastructure and schools. Opposed to higher density.
Lloyd Gerber, former P&Z Commissioner, has seen a lot of time and effort put into the
current comprehensive plan. It is currently an elite community and wants it to stay that
way. Lets put limitations on the growth. Follow the current comp plan.
Glida Bothwell, 632 Steeple View Drive, opposed to changes in the comp plan. This is
an economic issue. High density is not an economically feasible for the community.
Phil Whitener, 198 Rooster Drive, comp plan is to focus on what is best for the
community. Issue of affordability is nonsense.
Toni Glaser, 2380 W. Beacon Light Road. Opposed to changes in the comp plan.
Mike Chase, 70 W. Floating Feather Road, Elenore Chase's son. Is not opposed to
development, but recommends any development be well planned. This is not an area we
can continue to farm. Many times people have almost run over him on his tractor. This
area is not conducive to farming.
Dennis Whitmore, 3319 Dewey, one ofthe developers of Lexington Hills and
Canterbury. NIMBY is the theme of the evening. Mr. Crandlemire does not have water
rights. Have seen a lot of selfishness tonight.
Steve Deckers, 2249 Dicky Circle, reads from the current comp plan and the process
necessary to make a change in the plan. There is a reasonable alternative to this change
in the comp plan.
Debbie Barns, 1365 W. Yellowstone, resident of Eagle for 22 years. Opposed to changes
in the comp plan.
Dave Roylance gives a rebuttal. Crandlemire has purchased surface water rights to the
land, the paper work has not been transferred. Supply and demand are price setters.
Change in situation - owner building new home - sewer is available - in city limits.
Brinton closes the public hearing.
Farnworth Moves to continue CP A-2-98 - Comprehensive Plan Amendment for
BramHall Subdivision - Roger C. Crandlemire and the RZ- 7-98 - Rezone for
BramHall Subdivision until the November 16, 1998 meeting. Moser Seconds. ALL
AYE. MOTION CARRIES...
B. RZ- 7-98 - Rezone for BramHall Subdivision - Roger Crandlemire: Roger C.
Crandlemire, represented by Roylance & Associates, is requesting approval of a rezone
from A-R (Agricultural-Residential - one dwelling unit per five acres maximum) to R-3
(Residential- three dwelling units per one acres maximum). The 95.2-acres site is
located on the north side of Floating Feather Road approximately o/4-mile west of Eagle
Roiad at 1400 W. Floating Feather Road.
NOTE: This item should not be acted on until the Planning and Zoning
Commission has made their recommendation on the Comprehensive Plan
amendments. The public hearing for this item was continuedfrom the October 19,
1998, meeting.

C. CP A-6-97 - City Initiated Comprehensive Plan amendments - City of Eagle:
The City of Eagle is proposing to amend its Comprehensive Plan and Land Use Map.
The Plan and Map are official policy documents for the City and its Area of Impact and
are intended to provide the vision, goals, policies and implementation actions that will
guide the community's development. The Plan addresses the following components:
Property Rights, Population and Growth, Economic Development, Public Services,
School Facilities, Land Uses, Natural Resources and Hazardous Areas, Transportation,
Parks, Recreation and Open Space, Housing, Community Design and Cultural Resources.
The Plan also includes a Land Use Map that, in part, illustrates types of land uses and
residential densities for Eagle and its Area of Impact. (This item was continuedfrom the
October 26, 1998, Commission Meeting)
NOTE: After all of the Comprehensive Plan amendment public hearings are closed,
deliberation should take place on this item (CP A-6-97) first.
Sue Carney, 1353 E. Travino, (reads the attached statement). Concerned about
floodplain, likes lower density and would like to see existing business buildings filled.
Chris Korte, 499 Main Street, former Ada County P&Z Commissioner, distributes maps
of Eagle Island Flood Plain and a spreadsheet. Would like to see current comp plan
remain as is, with maybe a few small changes. Density of one unit per two acres is
already too low, will have a cornucopia of open space.

Dave Erickson, 1406 W. Deadwood Court, objects to new roads.
Debbie Barnes, 1365 W. Yellowstone, agrees with Dave Erickson.
Susan Debois, 1453 W. Powder Court, objects to the proposed road and the Crandlemire
development.
Steve Ardaiz, 1428 W. Powder Court, objects to the proposed road.
Lynn Melton, 3939 Brookside Lane, was on the Land Use and Impact Focus Group.
Would like the Commission to approve the new proposed Comprehensive Plan.
Dennis Baker, 250 S. Beachwood, Boise, look at open spaces, downtown, and
infrastructure. River ordinance is a high priority. Leave the comp plan as is.
Marty Bridges, P.O. Box 633, Boise, ill, 83701, United Waters ofIdaho, would like to
see the comp plan go further to disallow building in the 100 year flood plain. Gives
handout to Commissioners. By Boise building in the flood plain they have put Eagle in
jeopardy, if Eagle builds in the flood plain they will continue to put people down river in
jeopardy. Prohibit building in the 100 year flood plain.
Janet Buschard, 235 W. Floating Feather Road. Support limiting building in the flood
plain. Supports pathways in new comp plan. Urge patience and taking time in the
process.
Russ Buschard, 235 W. Floating Feather Road, against the proposed road running parallel
to Balantyne. Global Warming, weather extremes. Need a water shed study. Protect the
flood plain.
D. CPA-I-98 & RZ-2-98 - Eagle River Development (Grossman Properties)-
Eagle River, LLC: Eagle River, LLC, represented by Bill Clark, is requesting approval
of a comprehensive plan amendment from Public/Semi-Public to Commercial and from
Medium Density Residential to Commercial, Mixed Use, Public/Semi-Public; and a
rezone from A (Agriculture) and M-IA (Industrial Park District) to PS-DA (Public/Semi
Public), R-4-DA (Residential), C-3-DA (Highway Business District), and MU-DA
(Mixed Use) with a development agreement. A portion of the proposed change from the
residential land use designation to the Public/Semi Public land use designation and M-IA
zoning designation to PS-DA zoning designation is City initiated for a City park. The 93-
acre site is located on the southeast comer of State Highway 44 and S. Eagle Road.
NOTE: CPA-I-98 must be acted on prior to RZ-2-98. The public hearing on this
item was closed on October 26, 1998, except to obtain input on City's Floodplain
Ordinance.
E. CP A-3-98 - Comprehensive Plan Amendment for Patterson Property -
Sharon Patterson: Sharon Patterson, represented by The Land Group, is requesting
approval of a comprehensive plan amendment form Medium Density Residential ( four
dwelling units per acre maximum) and Industrial to Mixed Use and Commercial. The
9.6-acre and I-acre sites are located on the southwest and southeast corners of State
Highway 55 and Hill Road at 2805 and 2809 Hill road. The public hearing on this item
was closed on October 19, 1998.
Farnworth moves to continue the remaining items on the agenda to the next
scheduled meeting, November 16, 1998. Wilson seconds. ALL AYE. MOTION
