Minutes - 1998 - Planning & Zoning - 11/02/1998 - Regular ORIGINAL EAGLE PLANNING AND ZONING MEETING MINUTES November 2, 1998 The Planning and Zoning Commission met in regular session on November 2, 1998. Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: DONALD BRINTON, FARRIN FARNWORTH, LYNN MOSER, GENEVA TRENT, FRED WILSON. ABSENT: A quorum is present. 3. REQUEST FOR APPROVAL: A. Minutes of October 19, 1998. Wilson moves to continue the minutes of October 19, 1998, for correction and additional information to the November 9, 1998 meeting. Farnworth seconds. ALL AYE. MOTION CARRIES... B. Minutes of October 26, 1998. Farnworth moves to approve minutes of October 26,1998, as corrected. Trent seconds. ALL AYE. MOTION CARRIES... 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: Chairman Brinton announced it is the time and the place for the Public Hearing. A. PP-5-98 - Clear Creek Crossin!: Subdivision (formerly Wintry River) - Jayo Construction. Roylance & Associates: Jayo Construction, represented by David Roylance with Roylance & Associates, is requesting preliminary plat approval for Clear Creek Crossing Subdivision, a 54.8-acre, 89-lot residential subdivision. The site is generally located on the southwest comer ofN. Eagle Road and Floating Feather Road. Brinton introduces the issue. Butler and the Commission discuss the conflict in the code with the flood plain. Butler mentions applicant had requested a continuance in the preliminary plat application due to this conflict. Russ Buschert, 235 W. Floating Feather Road, asks questions from the audience concerning the process for approving subdivisions. Brinton states this is not a public hearing, and allows Buschert to ask questions in order to clarify the continuance of this application. General Discusssion. Moser moves to continue PP-5-98 until the December 7,1998, meeting. General Discussion. Wilson seconds. ALL AYE. MOTION CARRIES... B. V -3-98 - Variance To Decrease Rear Yard Setback - Eal!le Fire Deoartment. Rocky Towle: The Eagle Fire Department, represented by Rocky Towle with Design Resources Architects, is requesting City approval of a variance to decrease the rear yard setback of the existing building and the proposed addition from 20-feet to approximately 8-feet. The O.54-acre site is located on the south side ofW. State Street approximately 400-feet west of Eagle Road at 149 W. State Street. Bieter is counseled in the degree of involvement needed to recluse oneself from the issue in discussion. Moser recluses himself from this issue. Trent recluses herself from this issue. Rocky Towle, with Design Resources Architects, reviews the application. A letter from Walter Drewery is read by Butler owner of the property directly behind the property requesting the variance. The letter states Drewery has no objection to the application for a variance to decrease in the rear yard setback of the existing building. Dan Friend, 92 S. Eagle Road, Eagle Fire Department, clarifies parking issues. Butler reviews the staff report. General Discussion. Farnworth moves to approve V-3-98 - Variance To Decrease Rear Yard Setback - Eagle Fire Department, Rocky Towle with staff site specific conditions. Wilson seconds. ALL AYE. MOTION CARRIES... 6. NEW BUSINESS: None REPORTS: A. Zoning Administrator, Butler gives his report. Butler discusses the meeting dates with the Commission. Suggested dates for the month of December are the 7th and 14th. General discussion of traffic issues and the possibility of a representative from AP A addressing the Commission to clarify the design of future streets. Dates for meetings in November are the 9th and 16th. Butler reviews the events of the joint meeting after the Commission had vacated. B. City Attorney. Bieter has no information to discuss at this time. The discrepancy on the flood plain code is briefly discussed. The relationship between the Comprehensive Plan and the City Code/Ordinances is dermed. C. City Council Liaison. 7. 8.
