The Planning and Zoning Commission met in regular session on October 5, 1998.
Chairman Brinton presiding.
1. CALL TO ORDER: DONALD BRINTON, F ARRIN FARNWORTH, LYNN
MOSER, GENEVA TRENT, FRED WILSON
2. ROLL CALL: The following members were present: DONALD BRINTON,
GENEVA TRENT, FRED WILSON. ABSENT: F ARRIN FARNWORTH. A quorum
is present.
3.
REQUEST FOR APPROVAL:
A. Minutes of the September 28, 1998.
Wilson moves to continue approval of the minutes of September 28, 1998 as
presented. Trent seconds. ALL AYE. MOTION CARRIES...
Trent moves to modify the agenda to move the original Item B to Item C and add a
new Item B of Findings and Conclusions for V-2-98 - Variance to Decrease Front
Yard Setback - Darren Leavitt. Moser seconds. ALL AYE. MOTION

4. OLD BUSINESS:
A. Findines and Conclusions for CU- 7-98 - Eaele Country Plaza Shoppine Center -
William Hod~es: Project Description: William Hodges is requesting conditional use
approval for Eagle Country Plaza Shopping Center consisting of a multi-tenant
commercial building (with attached restaurant and with drive-thru service for an
unspecified use), and two separate building pads (one pad to include drive-thru service
for a drug store). The total building area proposed is approximately 74,000-square feet.
The entire site is 7.5-acres and is located at the northeast comer of Chinden Boulevard
and Eagle Road.
Wilson abstains from participating in item CU- 7-98.
Brinton introduces the issue. Butler corrects the area (directions) on Item #2 of site
specific conditions of approval. Trent corrects Item #6 eliminate the last few words
"approximately 150 feet north of Chin den,"
Trent moves to approve the findings and conclusions for CU- 7-98 - Eagle Country
Plaza Shopping Center as corrected above. Moser seconds. ALL AYE. MOTION

B. Findines and Conclusions for V -2-98 - Variance to Decrease Front Yard Setback
- Darren Leavitt: Project Description - Variance to Decrease Front Yard Setback - Mary
Ann Dalton, represented by Darren Leavitt with Arrow Land Surveying, is requesting
City approval of a variance to decrease the required front yard setback of an existing
house from 20-feet to IS-feet. The 0.69-acre site located on the southeast comer of
Syringa Street and Elliot Street at 2196 Elliot Street.
Wilson moves to approve findings and conclusions for V -2-98 variance to decrease
front yard setback. Moser seconds. ALL AYE. MOTION CARRIES...
C. Discussion of Impact Fees:
Brinton introduces David Bieter, city attorney, to present issues associated with impact
fees. General discussion.
Wilson moves to have the Planning and Zoning Commission embrace the idea of an
impact fee committee being formed and would like to recommend the committee be
a diversified group of citizens with an odd number of members, and this group not
be under Planning and Zoning Commission. Trent seconds. ALL AYE. MOTION

5. PUBLIC HEARINGS:
A. V-3-98 -Variance to Decrease Rear Yard Setback - Eaele Fire Department: The
Eagle Fire Department, represented by Rocky Towle is requesting City approval of a to
decrease the rear yard setback of the existing building and the proposed addition from 20-
feet to approximately 8-feet. The 0.54-acre site is located on the south side of W. State
Street approximately 400-feet west of Eagle Road at 149 W. State Street.
NOTE: The Public Hearing Sign was not placed on this site as required per Eagle
City Code. Therefore, the Commission plans to continue this item to the November
2,1998, Planning and Zoning Commission meeting.
Moser moves to continue V -3-98 - Variance to Decrease Rear Yard Setback - Eagle
Fire Department to the November 2,1998 meeting. Wilson Seconds. ALL AYE.

NEW BUSINESS: NONE
7. REPORTS:
A. Zoning Administrator, Butler would like input from the Commission on the agenda's
for upcoming meetings. Suggested schedule for public hearings is as follows:
(1) Comprehensive Plan amendment of Eagle River
(2) Comprehensive Plan Sharon Patterson
(3) Comprehensive Plan Dave Roylance
(4) Focus Group presentations
(5) Rezone and development agreement of Grossman property
(6) Rezone for Crandlemire property
Bieter explains the process needed to complete the public hearing on the comprehensive
plan amendments. Commission suggests after the initial meeting on October 19, 1998,
they schedule meetings for once a week at six o'clock. Meeting more frequently would
allow issues to be heard more quickly.
Wilson needs to have his packet hand delivered. Butler agrees to deliver Wilson's
packet.
Butler adds to his report concerning other issues.
B. City Attorney. (1) Buckwheat case, and its relevancy to the city of Eagle, is
explained. (2) The process necessary for the comprehensive plan public hearings will be
presented in writing by city legal counsel. (3) Clarification ofthe responsibility of
participation in attendance from legal counsel.
C. City Council Liaison. Farnworth is absent.
8. ADJOURNMENT: Moved by Moser and Seconded by Wilson to adjourn at
