Minutes - 1998 - Planning & Zoning - 08/31/1998 - Regular ORIGINAL EAGLE PLANNING AND ZONING MEETING MINUTES August 31,1998 The Planning and Zoning Commission met in regular session on August 31, 1998. Chairman Brinton presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present: DONALD BRINTON, F ARRIN FARNWORTH, FRED WILSON. ABSENT: LYNN MOSER, GENEVA TRENT A quorum is present. 3. REQUEST FOR APPROVAL: A. Minutes of August 17, 1998 Moved by Wilson and seconded by Farnworth to approve the minutes of the August 17, 1998, meeting as corrected. ALL AYE...MOTION CARRIES... 4. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Commission President, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, or Design Review Board shall be adopted as part of the Commissions Consent Agenda approval motion unless specifically stated otherwise. A. Findin~s and Conclusions for RZ-8-97/CU-6-97/PPUD-1-97/PP-2-97 Brookwood Subdivision - Mike Hormaechea: Project Description- Hormaechea L TD, represented by Mike Hormaechea, is requesting a rezone from A (Agricultural) to R-2-P (Residential two units per acre maximum - PUD) and R-4-P (Residential four units per acre maximum - PUD) with a development agreement, and conditional use, planned unit development preliminary development plan, and preliminary plat approvals for Brookwood Planned Community. The development consists of a 219.2-acre, 457-10t (41 I-buildable) residential subdivision. The site is located at the northeast comer of Floating Feather Road and Eagle Road, approximately one mile north of State Street Brinton introduces the item. Brinton makes note of a spelling error on page 15 of 24. Farnworth moves to approve Findings and Conclusions for RZ-8-97/CU-6-97/PPUD-1- 97/PP-2-97 Brookwood Subdivision. Seconded by Wilson. Page 14 of24, item #8 the recommendation to install a pedestrian bridge over Dry Creek. Farnworth questions on who will participate in extending the pathway up to the foothills, also questions why ACHD would have interest in footbridges, when he thought their area of interest would be highways and roads. Condition #17: Construction of a 10 foot wide gravel path, Farnworth questions if the pathway shouldn't be asphalt instead of gravel if it is indeed for pedestrian use only. Wilson is uncomfortable with an asphalt pathway located that close to Dry Creek. Discussion of pathway. Mike Hormachea provides some input regarding whether or not the Old Barn Road pathway ties into the bridge. Farnworth questions whether ACHD has the right to request a pedestrian pathway across Dry Creek and assess this applicant $30,000 to be placed in a fund for the next twenty or thirty years as far as we know, he wonders why, we, as a City, would allow that. Farnworth moves to make a special recommendation to Council that they closely review site specific conditions #8 and #17. Condition #8: Questioning the feasibility of requiring the applicant to place $30,000 in a trust fund for a pathway bridge because of a "special recommendation" from ACHD. And Condition #17: Specifically the choice of a gravel pathway vs an asphalt pathway. Seconded by Wilson. ALL AYE...MOTION CARRIES. 8.
