ORIGINAL CALL TO ORDER ROLL CALL: BRINTON, F ARNWOR TH, MOSER, TRENT, WILSON The following members were present: Brinton, Farnworth, Moser, Wilson. Trent is absent. A quorum is present. Geneva Trent arrives at 7:30. REQUEST FOR APPROVAL: Minutes of June 1, 1998. Moved by Farnworth and Seconded by Moser to approve minutes from June 1, 1998 as presented. ALL AYE... MOTION CARRIES. CONSENT AGENDA: None OLD BUSINESS: None PUBLIC HEARINGS: A. RZ-3-98 - Rezone from R-4 to CBD (with development aereement) - James Beard: James Beard, represented by James Gipson, is requesting a rezone from R-4 (Residential) to CBD (Central Business District). The Zoning Administrator is recommending that a development agreement accompany the rezone. The 0.3-acre site is located on the south side of Aikens Road approximately 250- feet east of Eagle Road at 79 East Aikens Road. This application was continued from the June 1, 1998 Commission Meeting because the applicant did not post the property as required. Staff recommends that this item be continued to the July 6, 1998 meeting because on June 7, 1998 the site was still not posted. If the applicant doesn't properly post the property staff recommends that the application be remanded back to staff with a stipulation that the applicant pay all fees to renotice the hearing in the paper and to property owners. Brinton introduces the issue. RZ-4-98 - Rezone from R4 to CBD - Zamzow's, Represented by BRS Architects: Zamzow's, represented by BRS Architects, is requesting a rezone from R-4 (residential) to CBD (Central Business District). The 0.92-acre site (includes only the portion ofland proposed for rezone) is located on the west side of Eagle Road approximately ISO-feet north of State Highway 44. Issue is introduced by Brinton. Eagle Road Justine Alderson, 302 Neskowin General discussion. Eugene Bushel, 286 S. Neskowin comments on the drainage ditch and general area. Butler explains the meaning of the CBD zone and the Comprehensive Plan. General Discussion. Lighting, noise, setbacks, trees, and berms are discussed. Billy Ray Strite, 1087 W. River St., Ste. 160, comments on the issues of concern by the public. Brinton closes the public hearing. Farnworth moves to approve the rezone of RZ-4-98 from R-4 (Residential) to CBD (Central Business District). Seconded by Trent. ALL AYE. MOTION CARRIES... C. V-I-98 Variance for Zamzow's, Represented by BRS Architects: Zamzow's, represented by BRS Architects, is requesting a variance to decrease the minimum 20% lot coverage required for the 2.43-acre site located on the northwest corner of State Highway 44 and S. Eagle Road at 435 S. Eagle Road. Brinton introduces the item. Billy Ray Strite, 1087 W. River St., Ste. 160, discusses the item, handout of printed material. Strite reviews an overhead of the proposed land. Butler gives staff report. Review of overhead and presentation of issues associated with the variance application in reference to the comprehensive plan and city business district. Brinton explains the purpose of conditions of lot size. General Discussion. Melissa Anderson, 339 S. Kestrel, Kestrel Cove resident comments about lighting. Ed Camp, S. Neskowin, voices concerns with ITD and the integrity of the landscaping of the green space and compromising the existing city codes. Ed Candor, 294 S. Neskowin, comments with lack of control of the state ground, wants to comply with existing codes. Rick Zamzow, 4941 Glenwood, Boise, ID, gives statement on the difficulty with the configuration of the land, specifically with the existing trees, green space and the proposed commercial building site. Brinton closes the public hearing. Brinton asks clarification from legal council concerning landscaping and land configuration in respect to a variance application. General Discussion. Moser moves to approve the variance ofV-I-98 Zamzow's, represented by BRS Architects, with site specific conditions of approval with the exclusion of condition #4, and #5 changed to require a 20- foot wide landscape area, and the inclusion of an additional condition requiring the applicant to obtain a license agreement from Idaho Transportation Department of Transportation to landscape the right-of-way area between this piece of property and the edge of pavement of the alternate route and Eagle Road. Also need to strike out the 'other than the landscape area required' in condition #5. Decrease the minimum lot coverage required to 13%. Seconded by Wilson. ALL AYE. MOTION CARRIES... D. CU-I-98 - Conditional Use Permit - Zamzow's. Represented bv BRS Architects: Zamzow's, represented by BRS Architects, is requesting a conditional use permit for a 3,000 sq. ft. bank with drive- thru. The 2.43-acre site located on the northwest corner of State Highway 44 and S. Eagle Road at 435 S. Eagle Road. Brinton introduces issue. Billy Ray Strite, BRS Architects, 1087 W. River Street, Ste. 160, presents specifics of the application. Butler gives overview of staff report. Melissa, speaks with concerns with the elimination of the trees and the relocation of the entrance to align the entrance with Albertson's. Pam speaks with concerns about noise, lights, activity, and etc. Justin speaks with concerns about his future bedroom window facing the intersection. Strite speaks on the concerns of the commission and public. Brinton closes the public hearing. General Discussion. Farnworth Moves to approve CU-I-98 - Conditional Use Permit - Zamzow's, Represented by BRS Architects: Zamzow's with site specific conditions and standard conditions as well as the coordination with Ballantyne Ditch Company to landscape along the canal and require Zamzow's to comply with the previous variance application approved earlier this evening. Seconded by Trent. ALL AYE. MOTION CARRIES... E. CU-2-98 - Conditional Use Permit - B.B. One. Represented by Dennis M. Baker: B.B. One, represented by Dennis M. Baker, is requesting a conditional use permit for a 9,500 sq. ft. montessori childcare center to be located in a 13,500 sq. ft. multi-tenant building proposed within Channel Center commercial subdivision. Staff recommends that this item be continued to the July 6, 1998 meeting because on June 7, 1998 the site was still not posted. Brinton introduces the issue. NEW BUSINESS: A. 98-04-S/98-09-PR Moore or Les. Inc.. Represented by David A. Bailey with Pinnacle Eneineers. Inc.: Moore or Les, Inc., represented by David A. Bailey with Pinnacle Engineers, Inc., is requesting preliminary plat approval for Sweeping View Subdivision, a 4-10t, 20.06-acre residential subdivision with a private road. The proposed subdivision is located on the north side of Valli-Hi Rd, approximately 1,300 feet west of Eagle Road. (This subdivision is located in the Eagle Area of Impact.) Brinton introduces the issue. Butler reviews the item and staff report. Wilson Moves to approve 98-04-S/98-09-PR Moore or Les, Inc., Represented by David A.
