OR\G\NAL CALL TO ORDER ROLL CALL: BRINTON, F ARNWOR TH, MOSER, TRENT, WILSON The following members were present: Brinton, Farnworth, Moser, Trent, Wilson.. A quorum is present. REQUEST FOR APPROVAL: Minutes of March 2, 1998, Moved by Trent And Seconded by Farnworth to approve minutes from March 2, 1998 as presented. ALL AYE... MOTION CARRIES. OLD BUSINESS: None Brinton reviews the time limits for testimony. PUBLIC HEARINGS: RZ-I-98 - Rezone Application - Wayne Forrey: Forest and Dale Prohaska and Cedar Falls Partnership, represented by Wayne Forrey with Hubble Engineering, are requesting a rezone from A (Agriculture) to R-3 (Residential three units per acre maximum) and R-4 (Residential four units per acre maximum). The 39.67 -acre site is located on the on the north side of Floating Feather Road approximately %-mile east of Eagle Road at 1020 Floating Feather Road. (This item is continued from the March 2, 1998 meeting.) Brinton introduces the issue. Wayne Forrey, 3045 Bannock Place, Boise, ID 83709, and other members of Cedar Falls Partnership, including legal council, represent Forest and Dale Prohaska in the rezone of the property. Butler reviews the rezone application with an overhead to show the areas and surrounding density displayed on a map. Brinton opens the issue to public comment. Although two individuals had signed up no one would like to speak at this time, Brinton closes the public hearing. Moser, representing Eagle Sewer on the P&Z Commission, states Eagle Sewer does have the capacity to serve both R3 and R4, therefore; Eagle Sewer is comfortable with the Rezone. PP-I-98 Preliminary Plat Approval for Feather Nest Estates Subdivision - Wayne Forrey: Forest and Dale Prohaska and Cedar Falls Partnership, represented by Wayne Forrey with Hubble Engineering, are requesting preliminary plat approval for Feather Nest Estates Subdivision, a 39.67-acre, 113-lot (96- buildable) residential subdivision located on the north side of Floating Feather Road approximately %- mile east of Eagle Road at 1020 Floating Feather Road, (This item is continued from the March 2, 1998 meeting.) Brinton introduces the issue. Wayne Forrey, and other members of Cedar Falls Partnership, including legal council, represent Forest and Dale Prohaska in the preliminary plat approval application of the property. School system capacity is addressed, Butler discusses the fencing around the ditch, density of the area, open space, and the comparison to Lexington Hills Subdivision. The sewer system is discussed, Roadway accessibility and traffic flow is presented. Discussion of concerns on the construction process and the effect oftrucks traveling through Lexington Hills for the new subdivision. Brinton opens the public hearing, Concerns are voiced on insufficient open areas, school availability, and trails on the canal being used for dog runs, Lots 22 through 25 are not conducive to the other lots abutting the existing Lexington Hills lots. It is suggested that either the common area be enlarged or those lots be made larger, A representative of Lexington Hills Homeowners Board reviews the letter sent to the city of Eagle, dated March 16, 1998. Farnworth addresses item B. on the list. "The Covenants should specifically state that the common areas in Lexington Hills are private property and are not for public use," As a community we do not want to have pathways established as private property. Letters received, but not in time for the Commission to review prior to the meeting, are read by: Farnworth reads the letter from Mr. and Mrs. Douglas Thomas Butler reads the letter from John and Linda Holt Brinton closes the public hearing, Wayne Forrey addresses the issues brought before the Commission by the public. Fred Shoemaker comments on school issues, common area in LH is private area and this should be stated in the Feather Nest Estates CC&R's, (LH might want to put up signs stating private property and proceed at your own risk) and the fence issue needs to be addressed with all parties concerned. Farnworth would like to have a letter from the ditch company to verify they are comfortable they can ensure their continued water flow, McFadden states the assumption for the Commission is that if there is no comment from an entity and Page 2 of 3 H:IP&ZIBASEDOCSINEWDOCSIPZAGENDA. WPD they have been informed of the issue, they have no concerns. Trent Moves to continue this issue until the next Planning & Zoning Meeting, April 6, 1998, to receive additional information from the Farm Union Canal and the Meridian School District. PP-I-98 - Preliminary Plat Approval for Feather Nest Estates Subdivision - Wayne Forrey. Seconded by Farnworth. ALL AYE. MOTION CARRIES... REPORTS A. B. C. Zoning Administrator City Attorney: Training for the Land Use Planning Act City Council Liaison Butler gives his report. Discussion on the written complaint issue, Commission is shown the new city grid. McFadden talks about the responsibility of the Commission to approve subdivision development with insufficient school systems. Brinton requests McFadden to give his report after the next meeting. Farnworth gives his report on the last City Council Meeting. Brinton would like to see Design Review join the joint meeting on the 30th. Topics for the joint meeting: 1) Subdivisions new developers meet with existing residents in adjoining property. 2) ADJOURNMENT at 10 p.m. Moved by Farnworth and Seconded by Trent to Adjourn.
