Minutes - 1998 - Planning & Zoning - 03/02/1998 - Regular ORIGINAL THE CITY OF EAGLE PLANNING & ZONING COMMISSION MINUTES March 2, 1998 7:00 P.M. 1. CALL TO ORDER 2. ROLL CALL: BRINTON, FARNWORTH, MOSER, TRENT, WILSON The following members were present: Brinton, Farnworth, Wilson, Trent. Absent Moser. A quorum is present. 3. REQUEST FOR APPROVAL: Minutes of February 17, 1998. Moved by Farnworth and Seconded by Trent to approve minutes from February 17, 1998 meeting as corrected. ALL AYE... MOTION CARRIES. 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: Chairman Brinton announced it is time and the place for the Public Hearing, A. RZ-I-98 - Rezone Application - Wayne Forrey: Forest and Dale Prohaska and Cedar Falls Partnership, represented by Wayne Forrey with Hubble Engineering, are requesting a rezone from A (Agriculture) to R-3 (Residential three units per acre maximum) and R-4 (Residential four units per acre maximum), The 39.67-acre site is located on the on the north side of Floating Feather Road approximately %-mile east of Eagle Road at 1020 Floating Feather Road. (Staff requests this item be continued to the March 16, 1998.) B. PP-I-98 Preliminary Plat Approval for Feather Nest Estates Subdivision - Wayne Forrey: Forest and Dale Prohaska and Cedar Falls Partnership, represented by Wayne Forrey with Hubble Engineering, are requesting preliminary plat approval for Feather Nest Estates Subdivision, a 39,67-acre, 113-lot (96-buildable) residential subdivision located on the north side of Floating Feather Road approximately %-mile east of Eagle Road at 1020 Floating Feather Road. (Staff requests this item be continued to the March 16, 1998 meeting.) Brinton introduces the item. Staff addresses the request from the applicant that the item be continued until a hearing with the Sewer District can be attended. Staff suggests these items be continued, Wilson moves to continue items RZ-I-98 rezone and PP-I-98 preliminary plat until the March 16, 1998 Planning and Zoning Meeting. Seconded by Moser. All AYE...MOTION CARRIES... 6, NEW BUSINESS: A. 98-3-ZC - Rezone Application - Darren Leavitt: Mike and Brenda Gallup, represented by Darren Leavitt with Arrow Land Surveying, are requesting a rezone from RT (Rural Transition) to Rl (Estate Residential). The 4.69-acre site is located on the west side of Meridian Road Approximately 400- Page 1 of 3 H: IP&z\BASEDOCSINEWDOCSIPZAGENDA. WPD Feet south of Beacon Light Road at 2659 N. Meridian Road. This subdivision is located in the Eagle Area of Impact. Brinton introduces the item. Darren Leavitt 128 S. Eagle Rd, representing Mike and Brenda Gallup, gives an overview ofthe application. Brief discussion to clarify Ada County zoning. Vaughan gives brief review of the staff report, and the reason Staff has recommended denial of this application. McFadden addresses Brinton's concern regarding getting Ada County's zoning and Eagle's Comprehensive Plan to be more compatible. Discussion between Staff, Legal Council and Commission to clarify the city's position in this matter. Darren Leavitt states that preliminary plats similar to this have been approved farther out Park Lane between Floating Feather and Beacon Light. Feels the application is consistent with other actions taken place in this general area. Leavitt feels a further lot split for this particular property would probably not be possible because set backs which would need to be maintained. Farnworth moves to approve 98-3-ZC rezone application. ,.motion dies due to lack of second. Discussion regarding how to approve thisapplication with conditions and Ada County's options if they choose to abide by Planning and Zonings recommendation. General discussion among Commission and Attorney. Farnworth expresses his concern that the applicant should not be punished because of the lack of action from the City to work with Ada County in order to obtain compatible zoning. Moser suggests that perhaps this item should be tabled until Staff can address the issue of, if and how the City has addressed Ada County regarding the zone change. Discussion amongst Board regarding how to address this item in regards to the motions. Farnworth moves to approve 98-3-ZC rezone application. Seconded by Moser. ALL AYE.. .MOTION CARRIES. Wilson moves that the Commission recommends to the City Council to move ahead with negotiations with Ada County to change their (ADA County's) zoning ordinance to take into consider,ation one unit per two acres so that it is compatible with the Eagle Comprehensive Plan. Seconded by Farnworth. Discussion. ALL AYE...MOTION ACRRIES. B. 98-1-PDR Preliminary Plat Approval for Gallup Estates Subdivision - Darren Leavitt: Mike and Brentda Gallup, represented by Darren Leavitt with Arrow Land Surveying, are requesting combined preliminary and final plat approval for Gaallup Estates Subdivision, a 4,69-acre, 2-lot residentail subdivision located on the west side of Meridian Road approximately 400-feet south of Beacon Light Road at 2659 N. Meridian Road. This subdivision is located in the Eagle Area oflmpact. Brinton introduces the item. Darren Leavitt 128 S. WPD Leavitt continues with his explanation of the application using an overhead to illustrate the items which he discusses, Comments that they will comply with all ACHD requirements regarding paving, discusses drainage, wells, and irrigation on each lot. Staff briefly reviews staffs site specific and standard conditions of approval. Moser moves to approve 98-1-PDR Preliminary Plat approval for Gallup Estates Subdivision with site specific and standard conditions of approval. Seconded by Trent. ALL AYE...MOTION CARRIES. C. Discuss proposal to assi~n a liaison from Plannin2 & Zonin~ to attend re~ular City Council meetin~s. A joint City CouncillPlanning & Zoning Commission meeting will be held on March 30, 1998. Brinton introduces the item. Discussion amongst Board and McFadden regarding the procedure for presenting information to the Council. Brinton requests a report item be added to the Planning and Zoning Commission agendas to review the items discussed at Council. Farnworth volunteers to act as liaison. He will begin attending the Pre-Council meetings and reporting to them as necessary. Agenda items for the Joint Meeting on March 30, 1998: Wilson: Discuss where Council is going with the Ada County Zoning, Brinton: Would like an explanation ofthe high cost of recommendations for Ada County Transmittal applications. Would like a justification of costs from the Council regarding the application fee schedule. Farnworth: Discussion of Comprehensive Plan and the public response to the current proposed changes. Brinton: Would like to discuss designs and restrictions for the bypass and construction along it. Farnworth: Update on the process to merge the City of Eagle and the Sewer District into one entity, Brinton: Would like to know why it takes a formal written complaint before the City takes action regarding a problem. Brinton: Would like a report regarding the proposed sign enforcement letter Council is in the process of drafting. Brinton: Would like to discuss the City Municipal Water System (EM2), 7. ZONING ADMINISTRATOR'S REPORT: Vaughan comments on Council actions regarding applications that have come before the Planning & Zoning Commission, 8. ATTORNEY'S REPORT: Discussion on code enforcement. Brinton would like to begin the training of the Commission. McFadden would like to briefly touch on the power the Commission legally possesses.
